Manns Harbor to Manteo , as requested in the permittee's application dated 10/28/02. including attached workplan drawings (14): 4 dated as received 10/29/02; 7 dated 9/02; and 3 dated 10/02 This permit, issued on 12/3/02 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Wooden Boardwalk, Canoe Dock and Canoe Access Pier 1) This minor modification authorizes the following, as depicted on the attached workplan drawings except as altered herein: (a) An elevated wooden boardwalk that will extend for approximately 2160 feet from the Roanoke Island Visitor Information Center and Rest Area to the Croatan Sound. The boardwalk will include a pedestrian bridge over Collins Creek and a 75-foot x 6-foot pier at the end of the boardwalk with a 18- foot x 18-foot platform over Croatan Sound. There will also be a 19.7-foot x 4.9-foot canoe dock on Collins Creek adjacent to the elevated wooden boardwalk at approximately Station 121+00. (b) A 26.2-foot x 4.9 foot canoe access pier on Collins Creek with a stairway adjacent to Visitors Center Drive at approximately Station 14+20. (See attached sheets for Additional Conditions) This permit action may be appealed by the pern ittee or Signed by the authority of the Secretary of DENR and the other qualified persons within twenty (20) days of the issuing Chairman of the Coastal Resources Commission. date. An appeal requires resolution prior to work initiation or continuance as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Department of Transportation Permit#7-98 Page 2 of 3 ADDITIONAL CONDITIONS 2) No portion of the canoe dock or canoe access pier shall exceed 14 of the width of the water body. If necessary to accommodate this requirement, the docking facilities may be repositioned landward of the proposed location. 3) This permit authorizes only the boardwalk, pier, platform, canoe dock and canoe access pier located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, may become a permanent part of this boardwalk/canoe access facility without permit modification. No non-water dependent uses of structures may be conducted on, in or over public trust waters without permit modification. 4) Any portion of the permitted elevated wooden boardwalk, pier, canoe dock and canoe access pier built over coastal wetlands must not exceed six feet in width and must be elevated a minimum of three feet over the wetland substrate as measured from the bottom of the decking. 5) In removing any spoil within vegetated wetlands that is generated by pile installation, the permittee shall use extreme care to ensure that damage to vegetation is minimized and that the temporarily impacted areas are returned to pre-project contours and elevations. 6) No excavation or fill will occur within waters or wetlands of the United States. 7) The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 8) No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 9) The authorized structure and associated activity must not cause an unacceptable interference with navigation. 10) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee will not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. General NOTE: This permit does not eliminate the need to obtain any additional permits, approvals or authorizations that may be required. This includes a 401 Water Quality Certification from the N.C. Division of Water Quality, if required. NOTE: Should the adjacent property be sold prior to the initiation of construction, the permittee shall be required to obtain a signed riparian corridor waiver from the new property owner prior to the placement of any structures within the 15 foot riparian corridor. 144 4 ..... ...... .. .. . .......... .. .. This minor modification is for the placement of an elevated wooden boardwalk that will extend from the Visitors Center to the Croatan Sound. This boardwalk will parallel the existing Croatan Sound Bridge and stay within the existing NCDOT right-of-way. The boardwalk will not be wider than 6 feet and will be a minimum of 3 feet above the substrate of the marsh. This project will include a wooden bridge that will span Collins Creek. This bridge will have one bent and two 8 inch salt treated piles placed in Collins Creek. This will allow approximately 12 feet of horizontal clearance on either side of the wooden bent to the creek bank. The vertical clearance will range from 7 to 8 feet from the water surface to the bottom of the bridge. This will not impede navigability of the creek due to the existence of 3 concrete piles that are located directly down stream of the proposed wooden boardwalk bridge. These concrete piles support the Croatan Sound Bridge. They have approximately 9-10 feet of horizontal clearance on one side of the pile and 3-4 feet of horizontal clearance on the other side to the bank. The boardwalk will come to the edge of the Croatan Sound and then extend out into the water by the placement of a pier and platform at the end of the pier. The pier will be 75 feet long and six feet wide. It will have a minimum 3 feet clearance above the substrate to the bottom of the deck. The platform at the end of the pier will be 18 X 18 feet and will be a minimum of 3 feet above the substrate. This boardwalk will be built from the beginning of the walkway at the Visitors Center out to the sound. There will be no heavy equipment used in the jurisdictional areas. Building materials will be brought out on the newly construction boardwalk as it progresses towards the end. The 8 inch treated piles used to elevate the boardwalk will be washed down with a small wash down pump. These piles will be sunk approximately 12 feet below the substrate. There will be no earthen fill associated with this project. A table included with this request quantifies the fill from the placement of the pilings. There is one adjacent landowner that has been notified of the proposed project. A letter has been requested from this landowner for permission to place a pier within 15 feet of the property boundary. A copy of this letter will be sent to you as soon as NCDOT receives that letter. A location map and work plat is included with this request.
