There is no formal paperwork from us. The CAMA rep will coordinate with us, either through our regulatory department or directly with me. We will review the plans you have for the dock and then we will weigh in on the permit request. I would say be sure to show where the piles for your dock will be to ensure there is no confusion. Basically, the setback is designed as a buffer for the channel to ensure that we can dredge and maintain the channel. In this area however the line was originally created in the 1950's, if memory serves, as a harborline. Since the harborline was created by congress and allows more room than our setback policy, it superseded our setback policy and therefore we use the harborline as our setback line in Beaufort Habor and a good portion of Taylor's Creek. We do not allow construction within the setback.So basically no piles channelward of the setback line. We do allow floating dock over the setback line as long as they are anchored outside the setback(landward of the line). They can then extend into the setback, as long as they are not a hazard to navigation and do not encroach into the channel itself. So yes there is some ways to cross the line but no way to construct anything over it. if you decided to design something like this, there is typically a permit condition that states that you will have to remove the floater should the corps need to do maintenance on the channel and then when the project is complete you will be allowed to put the floater back into place. I will add, we are well aware of encroachments up and down the waterway. This is why we have a section in the webpage above about"what if my dock is currently in the setback?". Basically, when it needs maintenance, or is destroyed by a storm, act of nature, or some other sudden event,the dock will only be able to be re-constructed to the setback policy that is in place when the dock needs rebuilding. Eventually this should get rid of most of the encroachments and get everyone behind the setback. If you have any other questions please let me know. Thanks. Our goal would be to construct the floating dock in a manner for it to be "Disassembled" at the federal set back line to aid in the removal of this structure during any dredge operations that might be required.
