The North Carolina Department of Transportation proposes to replace bridge 88 over Bee Tree Canal on SR 1122 in Tyrrell County. The proposed action will involve replacing the existing timber bridge structure with three 35 ' cured slab bridge sections . This bridge replacement will take place on existing alignment, and no on-site detour is proposed. The deck elevation of the proposed replacement bridge was established to match the vertical alignment of the existing bridge and roadway approaches . The existing timber bridge consists of five 17 ' spans, with 5 . 1 ' of underclearance to the normal water surface. The proposed concrete bridge has three 35 ' spans with 4 . 7 ' of underclearance, representing a loss of 4 . 8 inches of underclearance. The horizontal clearance width between bridge piers will be increased two fold, from 17 feet to 35 feet. In order to match the underclearance of the proposed bridge to that of the existing bridge, the crown grade of the bridge and roadway approaches would have to be elevated. The natural topography and the existing paved roadway in the proximity of Bee Tree Canal are relatively flat. Considerable expense would be incurred if NCDOT were to elevate the bridge and adjust the elevation of the roadway •«• approaches . It should be noted that SR 1122 intersects SR 1121 immediately west of the bridge site. Therefore, any adjustments to the bridge elevation would also require grading and paving of a segment of SR 1121, leading to further increases in the replacement cost. With respect to the navigational usage of Bee Tree Canal, the Department believes that a 4 .8 inch reduction in underclearance, with a remaining clearance of 4 . 7 feet, should not hinder traditional usage of the canal . The new structure will span from bank to bank. No fill in wetlands or waters of the U.S. is proposed. Approximately 40 cubic yards of high ground excavation is proposed. This excavation will take place behind the present end bents and will allow for a wider opening beneath the bridge, and may also provide an opportunity for improved wildlife movement. Best management practices will be implemented to minimize any adverse effects which may be caused by project related sedimentation. The enclosed permit drawings do not show any property lines or right of way lines . NCDOT believes that obtaining specific property boundaries for permit purposes when replacing existing drainage structures beneath public highways would be of considerable expense and would be considered unwarranted for routine maintenance operations . In this specific case, the proposed activity will not lead to impacts outside of existing roadway footprint (toe of fill, state maintained ditches, underneath bridges, etc) . The Department therefore does not believe that, in this particular case, showing property lines and right of way lines is necessary. NCDOT is requesting that the proposed work be authorized under the appropriate Coastal Area Management Act (CAMA) permit. Because this project will not involve any filling of wetlands or waters of the U.S. , it is not anticipated that a Section 404 permit from the Army Corps of Engineers or a 401 Water Quality Certification from the N.C. Division of Environmental Management will be required. We are including a copy of this application to the Corps of Engineers for information purposes only. Comments on this project will be solicited from the N.C. Division of Environmental Management during the CAMA public notice process . If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS 113A- 121.1 or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office of Administrative Hearings, P.O. Drawer 11666, Raleigh, NC 27611, (919)733-2698 within twenty (20) days of this decision on your permit. You should also be aware that if another qualified party submits a valid objection to the issuance of this permit within twenty(20)days,the matter must be resolved prior to work initiation.The Coastal Resources Commission makes the final decision on any appeal. The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be carried out in accordance with your application. Modifications, time extensions, and future maintenance require additional approval. Please read your permit carefully prior to starting work and review all project plans, as approved. If you are having the work done by a contractor, it would be to your benefit to be sure that he fully understands all permit requirements. From time to time, Department personnel will visit the project site. To facilitate this review, we request that you complete and mail the enclosed Notice Card just prior to work initiation. PROJECT SUMMARY: The applicant proposes to replace an existing ±20' wide by ±80' long bridge with a ±24' wide by ±105' long bridge. Project setting The N. C. Department of Transportation's (NC DOT) proposed bridge replacement site is located on SR 1122 at Bridge No. 88 crossing Bee Tree Canal which connects into the Scuppernong River southwest of Columbia in Tyrrell County, North Carolina. The existing bridge is ±20' wide and ±80' long. The bridge is bordered on both sides by dirt roads running parallel to the canal. A ±20' vegetative buffer separates the canal and roads on both sides and is vegetated with several pines, mixed hardwoods, upland grasses and various herbaceous shrubs. The canal is ±60' wide at the bridge crossing and the vertical clearance under the existing bridge is ±5'. The water depth at the center of the canal is ±5.5'. Bee Tree Canal is classified as C-SW by the Environmental Management Commission. Project description NC DOT proposes to replace an existing ±20' wide by ±80' long bridge with an approximately 24' wide by ±105' long bridge. The existing bridge which has 4 bents will be removed and replaced with the new bridge which has 2 bents. Approximately ±540 ft2 of high ground will be removed which will slightly increase the horizontal opening under the bridge. The existing vertical clearance of ±5.1' will be reduced to ±4.7'. Public Trust Areas is the only AEC involved. The County Plan offers the following guidance on proposals of this type; • Public Trust AEC's are acknowledged on Page 33 of the Plan and note that the CAMA permitting process is guided by local policy and will respond to more restrictive uses designated by the local government if they are developed. • The transportation portion of the Plan (Page 37) notes the replacement of Bridge 88 is scheduled by DOT during the 1990-96 time period. • Pages 67-68 include County policy on AEC's and in particular Public Trust Areas of Environmental Concern and notes the need for protection due to their biological function and defer appropriate uses to those in the State Administrative Code. • County policy on Commitment to State and Federal Progress (Page 84) note that DOT's road and bridge improvement programs are very important to the County and the County is receptive to this and other programs that benefit the County. • The landward portion of this proposal appears to be in the Rural Land Classification as shown on the County's land class map. That class (Page 102) calls for low intensity uses where agriculture, forestry and similar uses are prevalent. Traditional urban services such as water and sewer are not provided. • By definition all AEC's are included in the Conservation Land Class (Page 102), thus this classification applies to the public trust portion of the proposal. County discussion of permitted uses within the Conservation class (Page 103-104) totes; "5. Roadways, when construction of roadways can be conducted without significantly altering the ecological system, and in compliance with existing Federal, State and local regulations."
