PROJECT SUMMARY: The applicant is proposing to pave SR 1712 in Beaufort County which will result in both coastal wetlands and estuarine waters being excavated and filled. North Carolina Department of Transportation SR 1712 Beaufort County Environmental Setting The project site is SR 1712 in northeastern Beaufort County in the Leechville Community. The unpaved road extends from US 264 just west of the Pungo River Bridge in a southeasterly direction for approximately 2.4 miles to the Pungo River. The proposed paving of the road, which will be discussed later, will involve 4 areas in which the Division of Coastal Management has permit jurisdiction. The 4 sites which are described below are listed in the application package. Site No. 1 This site is nearest US 264. At the site a manmade canal (Estuarine Waters and Public Trust Area AEC's) comes to within ±40' of the existing road. A ditch crosses beneath the existing road which contains a 15" plastic pipe and a 18" CMP. Wetland vegetation is present on both sides of the road. On the eastside the vegetation is dominated by Sagittaria Falcata, bulltongue; while on the west side the vegetation is dominated by Typha spp. and bulltongue. Site No. 2 This site is located to the south of Site No. 1. At the site a ±15' wide canal crosses beneath the road. The canal which is both Estuarine Waters, and Public Trust Area AEC's connects the Pungo River. The canal contains a 72" by 48" corrugated metal pipe arch. Wetland vegetation is present on both the east and west sides of the road and is dominated by Typha spp. and bulltongue. Site No. 3 This site is located to the south of Site No. 2. At the site a ±20' wide canal crosses beneath the road. The canal which is both Estuarine Waters and Public Trust Area AEC's is connected to the Pungo River. The canal contains a 24" RCP. Wetland vegetation is present on both the east and west sides of the road. On the east side the vegetation is dominated by Myrtles and scattered Typha spp. ; the west side is scattered by Typha spp. Site No. 4 This site is located at the Pungo River where the road terminates. At the site the erosion scarp has been lined with various types of riprap. No wetland vegetation at the site. Site No. 1-A This site is also listed in the application package, however, at the site no permit jurisdiction by the Division of Coastal Management exists. The site is a 404 wooded area vegetated with Myrtles, various types of Oaks, Sweetgums, etc. North Carolina Department of Transportation SR 1712 Beaufort County Project proposal The project proposed is the widening and paving of SR 1712. The proposal involves the widening of the 15' wide dirt and gravel road to a 20' wide paved road. At Site No. 1, the existing 18" CMP will be replaced by the same size and type of pipe, however, it will be slightly longer. The 15" plastic pipe will be replaced by the same size and type of pipe, however, it also will be slightly longer. At Site No. 2, the existing 72" by 48" corrugated metal pipe will be replaced by two 42" CMP's. At Site No. 3, the existing 24" RCP will be replaced by the same size and type of pipe, only slightly longer. At Site No. 4, the project proposal involves the paving of SR 1712 to within 50' of the Pungo River. Environmental impact The following environmental impacts will occur: Site No. 1 0. 14 acre of wetlands vegetated with Typha spp. and bulltongue will be filled; 0.02 acre of open water area will be filled and 0.06 acre of open water area will be excavated. Site No. 2 0. 14 acre of wetlands vegetated with Typha spp. and bulltongue will be filled; 0.01 acre of open water area will be filled and 0.06 acre of wetlands will be excavated. Site No. 3 0. 15 acre of wetlands vegetated with Myrtles and Typha spp. will be filled and 0.01 acre of open water area will be filled. Site No. 4 Minimal environmental impact should occur. No wetlands will be excavated and/or filled. Site No. 1-A 0. 17 acre of wetlands vegetated with Myrtles, various Oaks and Sweetgums will be filled and 0.06 acres of the same type wetlands will be excavated. David L. David L. Gossett - Washington Regional Office - 10 August 1993 I MEMORANDUMNrr eA r 6 NA TO: David Gossett FROM: John Crew DATE: 11 August 1993 SUBJECT: Road improvements, SR 1712, Beaufort County, North Carolina This proposal by NC DOT involves widening, paving and replacing existing cross pipes on North Carolina SR 1712 in the Leechville area of Beaufort County and comes under the auspices of the March 1993 CRC Certified Land Use Plan Update. The Plan offers the following on proposals of this type: • County policy on State and Federal programs (Pg. VIII-19) is; "The county remains committed to State and Federal programs in planning areas, where applicable, related to community and economic development, including erosion control, public access, highway improvements, port facilities, dredging and military facilities." • The resources protection policy section of the County Plan (Pg. VIII-4, etc. ) basically calls for support of development within AEC's as long as that development is in compliance with AEC development standards. • The land classification map and subsequent description refers this area to the Rural With Services Land Class. That class (Pg. IX-8 & 9) acknowledges; "Areas in this category are found along 200' on each side of all State maintained roads that are not currently grouped into another land classification category. " My opinion is that if this proposal can be constructed in accordance with applicable State and Federal regulatory requirements for environmental protection it is not inconsistent with the County's Land Use Plan Update. cc: y John Parker Preston Pate 1)5 RECEIV WASHINGE 6. On February 6, 1990, the DA and the U.S. Environmental Protection Agency (EPA) signed a memorandum of agreement (MOA) establishing procedures to determine the type and level of mitigation necessary to comply with the Clean Water Act Section 404 (b) (1) Guidelines. This MOA provides for first, avoiding impacts to waters and wetlands through the selection of the least damaging, practical alternative; second, taking appropriate and practical steps to minimize impacts on waters and wetlands; and finally, compensating for any remaining unavoidable impacts to the extent appropriate and practical. To enable us to process your application in full compliance with this MOA, we request that you provide the following additional information: a. Permits for work within wetlands or other special aquatic sites are available only if the proposed work is the least environmentally damaging, practicable alternative. Please furnish information regarding any other alternatives, including upland alternatives, to the work for which you have applied and provide justification that your selected plan is the least damaging to water or wetland areas. b. It is necessary for you to have taken all appropriate and practical steps to minimize wetland losses. Please indicate all that you have done, especially regarding development and modification of plans and proposed construction techniques, to minimize adverse impacts. c. The MOA requires that appropriate and practical mitigation will be required for all unavoidable adverse impacts remaining after all appropriate and practical minimization has been employed. Please indicate your plan to -2- mitigate for the projected, unavoidable loss of waters or wetlands or provide information as to the absence of any such appropriate and practical measures. This information is essential to our expeditious processing of your application and it should be forwarded to us by October 4, 1993 . Cajigal District Engineer, Wilmington District Department of the Army, Corps of Engineers P. O. Box 1890 Wilmington, North Carolina 28402-1890 Attention Norm Sanders Dear Colonel Cajigal: The National Marine Fisheries Service (NMFS) has reviewed Public Notice 199303826 (GP) dated August 26, 1993 , whereby the N. C. Department of Transportation proposes to excavate and place fill in wetlands in order to widen and pave SR 1712 near Leechville, Beaufort County, North Carolina. A NMFS biologist inspected the project site on September 9 , 1993 , and determined that 0 . 8 acre of wetlands that support NMFS trust resources would be eliminated by this work. Project area wetlands are predominately vegetated by cattail (Typha spp. ) , bull tongue (Sagittaria falcata) , and myrtle (Baccharis spp. ) . These species are typical of the upper reach of estuarine systems and provide nutrients and water quality maintenance functions that support fisheries. 1 The proposed road improvements utilize the existing road alignment and appear to minimize wetland impacts. However, no mitigation plan to compensate for unavoidable wetland losses is provided with the permit application. In order to maintain the production of fishery resources in the project area and avoid cumulative adverse impacts, we believe that unavoidable losses of wetlands for highway improvements should be mitigated. Therefore, we recommend that federal authorization for this work not be granted unless a mitigation plan to compensate for all wetland losses is provided. A representative of our Beaufort Branch Office is available to assist in developing an acceptable plan. lOdum, W. E. , T.J. Smith III, J.K. Hoofer, and C. C. Mclvor. 1984 .
