Dear Mr. Parker: SUBJECT: Bridge No. 4 over Cullie Creek on SR 1300 in Carteret County The Department of Transportation applied for a CAMA Major Development Permit (CMDP) in August 1989 to replace the subject bridge with four (4) metal pipe arches. The Division of Coastal Management issued a CMDP (No. 249-89) on December 19, 1989. The Department was not able to allocate the necessary funds to complete this bridge replacement project until recently. Consequently, the original CAMA authorization expired on December 31, 1992. More recently (January 1997) the Department reapplied to the Division of Coastal Management for another CMDP to replace the bridge with metal pipe arches. Comments on the proposal, submitted by state and federal natural resource agencies in response to the public notice from the Division of Coastal Management and/or the U.S. Army Corps of Engineers, revealed that some agencies harbored substantial concerns about the project as proposed. On March 22, 1997, the Department . - 71 i requested that the processing of the permit be temporarily discontinued until a review of the proposal could be completed. As a result of the concerns raised during the public notices, the Department has reevaluated its original design and now recommends a bridge-for-bridge replacement at the site. Furthermore, the Department has approved a minimum-footprint concept for the proposed improvements to the approachways. The current design will result in only minimal impacts to adjacent estuarine marshland. The anticipated impacts to coastal wetland under the current proposal will be less than 0.02 acre. One further item which is being included in the revised application is a signed adjacent riparian landowner notification which was sent to Carolina Telephone & Telegraph Co. (Sprint). This notification was initiated recently when it was learned that ownership of one of the four parcels changed hands subsequent to submittal of the original permit application. Based upon an understanding that the original processing clock will be reinitiated as soon as the revised application exhibits have been accepted, the Department is hopeful that your office can make a permit decision as soon as possible. Funding for this project is strictly tied to this fiscal year. The Department is satisfied that the environmental concerns that were raised during the recent public notices have been resolved by the most recent design changes. NARRATIVE DESCRIPTION: Project Setting The project is located on SR 1300, near Merrimon, on Cullie Creek in Carteret County. Cullie Creek is a tributary of Adam's Creek. A 50'-long existing bridge spans the 35' to 40' wide creek. Vertical clearance under the existing bridge is approximately 2.5' to 3'. An extensive marsh system vegetated with black needlerush Juncus roemerianus, sawgrass Cladium iamaicense and cattails Typha spp. border both sides of the creek. Cullie Creek is classified SA NSW and is open to shellfishing. The area is also a designated Primary Nursery Area. A CAMA Major Permit (#249-89) had been issued for the same project in 1989 but the project was never undertaken and the permit expired in 1992. Since the issuance of the original permit, conditions at the site have not changed. Project Description The applicant proposes to replace an existing bridge with four 128" X 83" X 60' corrugated steel pipe arches and to raise the elevation of the adjacent road approximately 1'. The project includes removing the old bridge and "prepping" an area 63' X 70' (the site of the existing bridge) for installation of the four culverts. The area will be excavated to approximately -6 below MHW, the pipe arches installed, and the area backfilled. The applicant also proposes to raise the road elevation which will widen the road bed by approximately 2' on end side. Anticipated Impacts The project as proposed would involve the following AECs: Coastal Wetlands, Estuarine Waters, Public Trust Areas and the Estuarine Shoreline. Excavation and filling activities within the 63' X 70' area where the culverts are to be placed directly removes approximately 786 ft2 of Coastal Wetlands and approximately 3,250 ft2 of open water habitat and creek bottom (Public Trust). According to the applicant, approximately 800 ft2 of additional Coastal Wetlands would also be excavated to facilitate water flow through the culverts. Approximately 1,560 ft2 of high ground would be disturbed for culvert installation and another 27,000 ft2 for the raising of the road. Excavation and filling activities would probably result in an increase short-term and localized turbidity levels. The applicant proposes to implement Best Management Practices (i.e. silt fences and check dams) to minimize any adverse effects which may be caused by project related sedimentation. Prepared by M. I have reviewed this proposal for consistency with the 1991 Carteret County Land Use Plan (LUP) Update, as amended September 24 , 1993 , and offer the following comments . The general area of the project is classified as Rural, while the AECs impacted by the work are classified as Conservation. Carteret County' s intentions regarding development in Conservation classified areas are discussed in the Resource Protection and Resource Production and Management Policy sections of the Land Use Plan. Applicable policies include those for Marine Resource Areas (Page IV-11) . Generally, Carteret County supports the 7H Use Standards for estuarine and public trust areas . While the LUP specifies certain exceptions to the acceptance of the State' s minimum requirements, none of these appear to be applicable to this proposal . Economic and Community Development Policies regarding Commitment to State and Federal Programs (Page IV-16) support state and federal programs, particularly those which provide improvements to the County. Specifically, the North Carolina Department of Transportation road and bridge improvement programs are mentioned as receiving Carteret County' s full support . The Coastal Wetlands Conservation Classification is discussed on Pages V-2 and V-3 of the amended Plan. Except as specifically prohibited in the policies section of the Plan, development allowed by the 7H Use Standards may occur in areas identified as coastal wetlands by the Division of Coastal Management . I can find no policy in the amended Plan which would appear to prohibit this bridge replacement project . Through the amended LUP, Carteret County places some restrictions which exceed the state minimum use standards for development in Primary Nursery Areas . However, these policies involve construction of marinas, docks, and piers and are not applicable to this project . The following comments by the NCDMF are provided pursuant to General Statute 113-131. The Division of Marine Fisheries objects to the SR 1300 Bridge #4 replacement project and recommends denial of the permit as proposed because Cullie Creek, as a tributary to Cedar Creek, is a Primary Nursery Area (PNA) identified by the Division and designated by the NC Marine Fisheries Commission. As a PNA, Cullie Creek is an area which for reasons such as food, cover, bottom type, salinity, temperature and other factors, young finfish and crustaceans spend the major portion of their initial growing season. Primary Nursery Areas are those areas in the estuarine system where initial post-larval development takes place. These areas are usually located in the uppermost sections of a system where populations are uniformly very early juvenile (15A, NCAC 3N .0002 (a) (b)) . Primary Nursery Areas are defined as Critical Habitat Areas (CHA's) by the NCMFC. Critical Habitat Areas are fragile estuarine and marine areas that P.O. The Division prohibits the use of bottom-disturbing gears within PNA's and recommends that excavation and filling activities be severely restricted or prohibited. This project is excessive for a PNA and AEC area. The NC Department of Transportation did not evaluate the alternatives of replacing a bridge with a bridge to minimize, instead of maximizing, the negative impacts of the project in this Critical Habitat Area by replacing the bridge with a culvert. The Division finds that the project as proposed would diminish Cullie Creek' s ability to function as a PNA because the excavation and subsequent filling activities will eliminate 3,250 sq. ft. of Non-Vegetated Wetlands (open water) and reduce the functioning capacity of this PNA. The subsequent restricted water flow by the use of culverts will cause increases in sedimentation upstream of the project, thereby reducing habitat. The overall cumulative affect of this project will effectively reduce the Critical Habitat Area nature for the project site and the entire creek upstream of the site. Staff biologists with the Wildlife Resources Commission have reviewed the project and associated impacts on wildlife and fishery resources in the area. A site visit was made on March 13, 1996. Our comments are provided in accordance with provisions of the Fish and Wildlife Coordination Act(48 Stat. 401,as amended; 16 U.S.C.661 et. seq.)and the Coastal Area Management Act(G.S. 113A-100 through 113A-128). The NCDOT is proposing to replace an existing bridge with four 128"X 83"X 60' corrugated steel pipe arches and also to raise the existing road elevation over Cullie Creek. Construction activities will impact about 1,586 ft2 of coastal wetlands and 3,250 ft2 of Public Trust waters. Best Management Practices(i.e. silt fences and check dams)are proposed to minimize adverse impacts resulting from project related sedimentation. Cullie Creek is a tributary of Adam's Creek and is classified as 'SA NSW'. This section of the creek is designated as a Primary Nursery Area. We are concerned over potential adverse impacts to aquatic fauna resulting from turbidity associated with the proposed activities. Elevated turbidity could reduce water quality in these areas and stress aquatic organisms. Excessive turbidity is particularly damaging to egg and larval life stages of aquatic organisms. Therefore,we recommend that in-water work be prohibited between April 1 and September 30. Also,if creek flows permit,we recommend that silt curtains be placed immediately upstream and downstream of the project site to localize sediment impacts. If possible,we recommend the placement of a'dry' culvert to provide a travel corridor for small animals and reduce the chance of road-kills. Thank you for the opportunity to comment on this project. But after several agencies objected to such a proposal, NCDOT revised their proposal to include replacing the existing bridge with a bridge. The proposal also involves raising the elevation of the roadway out of the floodplain and would s-ill impact some coastal wetlands. However, it appears that the NCDOT has minimized these impacts. By revised application, the NCDOT now proposes to replace the existing 52-foot-long bridge with a 70-foot-long bridge and a minimum of 0. 015 acre of irregularly flooded marsh is to be filled. The NMFS has reviewed the revised application and does not object to the replacement of the bridge with a new, longer bridge. We recommend that the following conditions be included in the State authorization: a. All work authorized by this permit must be done in strict compliance with the permit plans. The existing 52-foot-long bridge will be replaced with a 70-foot-long bridge. b. The temporary placement or double handling of excavated or fill materials within waters or vegetated wetlands is not authorized. c. The fill material will be clean and free of any pollutants except in \ / trace quantities. Metal products, organic materials, or unsightly debris will - \ not be used. r r • -2- d. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or next to the authorized work. y Use of the permitted activity must not interfere with the public's right to free navigation on all navigable waters of the United States. e. The permittee will maintain the authorized work in good condition and in concordance with the terms and conditions of this permit. The permittee is %, not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. f. The activity will be conducted in a way that prevents a significant ^ increase in turbidity outside the area of construction or construction-related f discharge. The applicant, the North Carolina Department of Transportation (NCDOT) , proposes to excavate and fill wetlands adjacent to Cullie Creek, Carteret County, North Carolina. The purpose of the work is to replace existing Bridge No. 4 with three culverts. The proposed project consists of replacing the existing Merrimon Road Bridge No. 4 over Cullie Creek with three 128 inch by 83 inch by 60 foot corrugated steel pipe arches. Also, the elevation of the road in the project area will be increased to reduce flooding. This work involves excavating and filling wetlands to allow placement of the culverts. Based on a March 15, 1996, on-site inspection by a National Marine Fisheries Service (NMFS) biologist, we are concerned that this work will result in the excavation and filling of a small but important area (0. 04 acre) of irregularly flooded tidal marsh vegetated with needlerush (Juncus roemerianus) , sawgrass (Cladium jamaicense, and cattail (Typha sp. ) . These wetlands provide a source of nutrients, habitat for fish and invertebrates, and water quality maintenance functions that are important for the continued production of NMFS trust resources. ' In addition, approximately 0. 07 acre of unvegetated benthic habitat would be excavated and filled as a result of the placement of culverts, fill material, and riprap. PNA's are defined as those area in which, for reasons such as food, cover, bottom type, salinity, temperature, and other factors, young finfish and crustaceans spend the major portion of their initial growing season.2 Commercially, recreationally, and ecologically important species that utilize Cullie Creek as habitat include Atlantic croaker (Micropogonias undulatus) , spot (Leiostomus xanthurus) , flounders (Paralichthys spp. ) , red drum (Sciaenops ocellatus) , Atlantic menhaden (Brevoortia tyrannus) , striped mullet (Mugil cephalus) , killifish (Fundulus heteroclitus) , shrimp (Penaeus spp. ) , and blue crab (Callinectes sapidus) . We are also concerned that this work would adversely impact the ingress and egress of aquatic species that utilize Cullie Creek as habitat. Hydrological restrictions in tidal flow can adversely impact the distribution and species diversity of vegetation and the distribution of fish and invertebrates in the creek. The adverse effect of culverts is proportional to the restriction of tidal flow.3 There is no information provided with the public notice documenting that the proposed culverts will not alter the hydrology of Cullie Creek. The NMFS is opposed to any work that adversely impacts living marine resources, especially when alternatives that would minimize adverse impacts are available. In this case, impacts to wetlands and fishery habitat have not been minimized since the alternative of replacing the existing bridge with a new bridge exists. On February 6, 1990, the DA and the U.S. Environmental Protection Agency (EPA) signed a memorandum of agreement (MOA) establishing procedures to determine the type and level of mitigation necessary to comply with the Clean Water Act Section 404 (b) (1) Guidelines. This MOA provides for first, avoiding impacts to waters and wetlands through the selection of the least damaging, practical alternative; second, taking appropriate and practical steps to minimize impacts on waters and wetlands; and finally, compensating for any remaining unavoidable impacts to the extent appropriate and practical. This form allows the adjacent riparian landowner to express either: (1) that he objects to the project; or, (2) that he does not object and desires to waive his/her right to the 30-day period so that the processing of the application can progress more rapidly. Of course, the adjacent riparian landowner need not sign this form at all if he/she so chooses. No response within 30 days following receipt of this letter and form will be construed to mean the adjacent riparian landowner has no objections. , am an adjacent riparian property owner and am aware of the North Carolina Department of Transportation's plans for replacing Bridge No. 4 over Cullie Creek on SR 1300, and elevating, regrading and paving the immediate approachways in Carteret County. I am further aware that this work will occur in one or more AEC's and therefore will require authorization from the Division of Coastal Management in accordance with the Coastal Area Management Act (CAMA).
