ATTENTION: Mr. Terry Moore, District Manager
The Department of Transportation is planning to replace Bridge No. 13 over an
unnamed drainage canal on SR 1320 in Tyrrell County. David Moye of your staff
previously determined that the proposed work will occur within one or more Areas of
Environmental Concern. Through coordination with Mr. Moye and the department's
Hydraulic Unit, it has also been determined that the subject project will not qualify
under General Permit .2300. Consequently, the department is submitting a CAMA
Major Development Permit application for the project.
Enclosed you will find MP-1 and MP-5 application forms (previously reviewed for
accuracy in draft form by Mr. Moye), site drawings, and copies of the Adjacent Riparian
Landowner Notifications, which have been mailed. A check for $250 to cover the
application fee and copies of the green cards from the post office will be forwarded to
you when they arrive.

located on SR 1320 crossing an unnamed manmade canal off Alligator River south of Columbia
in Tyrrell County, North Carolina. The existing bridge is ±24.5' wide and ±45.6' long and has
a navigable vertical clearance of ±6' measured to the normal water level (NWL). The canal is
±15' wide at the bridge crossing and the existing navigable width is ±15'. The bridge is
bordered on the south by mixed hardwoods, shrubs, vines, herbaceous plants, and mixed grasses.
The site is bordered on the north side by agriculture fields and a private drive. The road
shoulders are vegetated with upland grasses. The manmade canal at the project site is outside the
575' permit zone that accompanies the ORW classification of Alligator River at this location. The
manmade canal is classified as C-SW by the Environmental Management Commission and is not
open to shell fishing.
Project description
NC DOT proposes to replace an existing ±24.5' wide by ±45.6' long bridge with an
approximately 19.5' wide by ±43' long aluminum box culvert. Approximately 1,961 ft2 of canal
bottom will be removed to allow for the installation of the box culvert. The existing vertical
clearance of ±6' will be reduced by 1.0' to 5' measured to the NWL. The existing navigable
width will be increased from ±15' to ±19.5'.
Anticipated impacts
The project as proposed would result in the excavation of ±1,961 ft2 of canal bottom and
±800 ft2 of high ground. The existing bridge has a navigable width of ±15' with a vertical
clearance of ±6'. The proposed box culvert will have a opening of ±19.5' wide with a vertical
clearance of ±5' which will enhance navigability while slightly lowering the existing vertical
clearance. Localized turbidity would occur as a result of the construction activities.

The proposed project appears consistent with the rules found in Subchapter 7H concerning
development in Estuarine Water, Estuarine Shoreline, and Public Trust Areas. The existing
horizontal clearance for navigation will increase from ±15' to ±19.5'. The existing vertical
clearance will be reduced from 6' to 5'. The manmade canal is for agricultural drainage and is
not a natural stream setting. If the permit is issued I would suggest the following conditions be
placed on the permit;
CONDITIONS
1. The temporary placement or double handling of excavated or fill materials within waters
or vegetated wetlands is not authorized.
1 2. No excavated or fill material will be placed at anytime in any vegetated wetlands or
surrounding waters outside of the alignment of the fill area indicated on the work plat(s).
3. Prior to any construction activity a silt curtain will be installed below the project site and
will remain until 24 hours after the project has been completed.
4. Appropriate erosion and sedimentation control devices, measures, or structures shall be
used to prevent sediment from entering the adjacent wetlands/watercourses/property (e.g.,
silt fence, diversion swales/berms, sand fence, etc.).

The project comes under the auspices of the July 1991 CRC certified Tyrrell County/Town
of Columbia Land Use Plan update. Based upon my review of the LUP, the project appears to
be consistent with the plan regarding public transportation projects within the aforementioned
AECs. In addition, based upon my familiarity with the project site, this project appears similar
to other bridge replacement projects in the same county.

Reference the application of the NC Department of Transportation (NCDOT)
for a Department of the Army (DA) permit to replace an existing bridge with an
aluminum box culvert, on State Road 1320, over a manmade canal adjacent to the
Alligator River, near Columbia, Tyrrell County, North Carolina.
The Federal agencies have completed review of the proposal as presented
by the application and your field investigation rtport.
We recommend that the following condition(s) be included in the State
authorization:
1. All work authorized by this permit must be performed in strict
compliance with the permit plans.
2 . No excavated or fill materials will be placed at any time in any
vegetated wetlands or waters outside of the permitted area.
3. No vegetated wetlands will be excavated or filled.
4. The temporary placement or double handling of excavated or fill
materials within waters or vegetated wetlands is not authorized.
5. The fill material will be clean and free of any pollutants except in
trace quantities. Metal products, organic materials, or unsightly debris will
not be used.

On February 11, 1991, we renewed General Permit No. 198000291 (copy
enclosed) , which provides Federal authorization for construction activities
that receive authorization from the State of North Carolina.
A review of your application received August 26, 1996, for Department of
the Army (DA) authorization to replace an existing bridge with an aluminum box
culvert, on State Road 1320, over a manmade canal adjacent to the Alligator
River, near Columbia, Tyrrell County, North Carolina, indicates it to be a
candidate for Federal authorization under this general permit. Accordingly,
the administrative processing of your application will be accomplished by the
North Carolina Division of Coastal Management. Comments from Federal review
agencies will be furnished to the State.
If your application must be withdrawn from this general permit process
for any reason, you will be informed regarding its further management. If
there are no unresolved differences in State-Federal positions or policies,
the final action taken on your application by the State will result in your
receiving written notice from us that your application is consistent with the
general permit and you may commence your activity. Only after receiving such
confirmation should you begin work.

Dear Mr. Dorney:
Enclosed is the application of the NC Department of Transportation
(NCDOT) for Department of the Army (DA) authorization and a State Water
Quality Certification to replace an existing bridge with an aluminum box
culvert, on State Road 1320, over a manmade canal adjacent to the Alligator
River, near Columbia, Tyrrell County, North Carolina. Your receipt of this
letter verifies your acceptance of a valid request for certification in
accordance with Section 325.2 (b) (ii) of our administrative regulations.
We are considering authorizing the proposed activity pursuant to
Section 404 of the Clean Water Act, and we have determined that a water
quality certification is required under the provisions of Section 401 of the
same law. A Department of the Army permit will not be granted until the
certification has been obtained or waived.
According to our administrative regulations, 60 days is reasonable for
State action. Therefore, if you have not acted on the request, or asked for an
extension of time, by October 28, 1996, the District Engineer will deem that
waiver has occurred.

Dear Mr. Vick:
The Division of Coastal Management hereby acknowledges receipt of an
application for State approval for development of property located on SR 1320 at
Bridge No. 13 over a manmade canal off Alligator River near Columbia in Tyrrell
County, North Carolina. It was received on 12 August 1996 and appears to be
adequate for processing at this time. The projected deadline for making a
decision is 26 October 1996. An additional 75-day review period is provided by
law when such time is necessary to complete the review. If you have not been
notified of a final action by the initial deadline stated above, you should
consider the review period extended. Under those circumstances, this letter will
also serve as your notice of an extended review. However, an additional letter
will be provided on or about the 75th day. Should there be any questions on this
procedural change, do not hesitate to contact me.
N.C.G.S. 113A-119(b) requires that notice of an application be posted at
the location of the proposed development. Enclosed you will find a "Notice of
Permit Filing" postcard which must be posted at the property of your proposed
development. You should post this notice at a conspicuous point along your
property where it can be observed from a public road. Some examples would be:
nailing the notice card to a telephone pole or tree along the road right-of-way
fronting your property, or at a point along the road right-of-way where a private
road would lead one into your property. Failure to post this notice could result
in an incomplete application.
An onsite inspection will be made and if additional information is
required, you will be contacted by the appropriate State or Federal agency.
Please contact me if you have any questions and notify me in writing if you wish
to receive a copy of my field report and/or comments from reviewing agencies.
