In order to accomplish the necessary improvements to provide for two 9-foot travel lanes, 4 foot shoulders and 3:1 fill slopes (2:1 at wetland sites) it is necessary to fill a small area containing cattails at the end of a bulkheaded canal. This area has been designated a Coastal Wetland. No other Areas of Environmental Concern will be affected by the proposed work. The NCDOT is requesting that the proposed project be authorized under a Coastal Area Management Act permit. I have attached CAMA Major Development Permit application forms, as well as site drawings and sketches of the proposed work. Adjacent Riparian Property Owners have been notified. A portion of this proposed work will be within Estuarine Shoreline and also impact a small Coastal Wetland area. NC DOT SR 1341 Bell Island, Currituck County Bio Report Page Two Site Description NC SR 1341 is a short dirt/gravel road located near the end of SR 1245 (Bell Island Rd.) on Bell Island. Bell Island is located south of the Currituck Court House area in Currituck County and is predominately a residential island which partially separates the Currituck Sound and Coinjock Bay. The proposed work is adjacent to a small canal which is connected to Coinjock Bay. This small canal runs perpendicular to SR 1341. No current direct hydraulic connection runs beneath SR 1341 at this location. The proposed work site is vegetated in lawn grasses and ornamental shrubs other than two small areas adjacent to the road and the canal. These areasare less than 700 sf. and are vegetated in Typha latifolia, Polygonum amphibium and Phragmitis australis. Most of the canal shoreline near the proposed work area is bulkheaded. The Coinjock Bay and the canal's connecting waters are classified as Joint Waters by the Division of Marine Fisheries. These waters are also classified by the Division of Coastal Management as both Public Trust and Estuarine Waters, and as such, are part of the Estuarine System Area of Environmental Concern. Proposed Work The applicant proposes to widen and upgrade approximately 0.18 miles of the 12 ft. wide SR 1341. In order to complete this work, it will be necessary to provide two 9 foot wide lanes and two 4 foot shoulders which will require fill and rip rap to be placed in wetlands on the sides of the existing road adjacent to the above referenced canal. All work will be within the existing NC DOT right of way. Anticipated Impacts Fill and rip rap activity associated with the road improvements described above will impact approximately 150 sf. of Estuarine Shoreline and less than 100 sf. of Coastal Wetlands. The Coastal Wetlands impacted are Typha latifolia and are not a pure stand, mixed with US COE jurisdictional wetlands. It is estimated this proposed work via filling will result in the direct impact to 700 sf. of wetlands. The proposed work will not directly impact any Public Trust Waters. The proposed work may result in a temporary increase in turbidity within the adjacent man-made canal. I have no objection to the proposed project so long as the following recommendations are placed on the permit . 1) The proposed project must conform to any recommendations by other reviewing agencies which are stipulated as conditions to their approval of this permit . 2) In order to protect juvenile finfish populations, no excavation or filling will be allowed between February 15 and September 30 of any year without prior approval of the Division of Coastal Management, in consultation with the Division of Marine Fisheries . 1 3) Excavation shall not occur in state waters . 4) This project will require an erosion control plan. 5) Silt fence will be installed between any area which will or has been excavated, filled, graded or disturbed and any stream or wetland. 6) Any rip rap material used must be free from loose dirt or any other pollutant . It must be of size sufficient to prevent its movement from the site by wave or current action. 7) The temporary placement or double-handling of fill or excavated materials within waters or vegetated wetlands is not authorized. The existing unpaved 24 foot wide roadway. Proposed is to replace it with 18 foot of pave-ment, and a four(4) foot shoulder on each side, plus about five (5)foot of rip-rap. The shoulders will require fill paralleled by rip-rap impacting in about 150 sf. of Estuarine Shoreline, and less than 100 sf of Coastal Wetlands. All work is to occur in existing 60 foot right-of-way. Estimated the direct impacts from fill is less than 700 sf of wetlands. There is no expectation of direct impacts to Public Trust Waters. Consistency Comments: The Currituck County 1990 Land Use Plan certified by the CRC on July 25, 1991 was reviewed to make this determination. Though the County does not have explicit policy for roadway upgrades and wetlands. The County's overall perspective with regard to resource impacts can serve as the basis for the consistency determination. In the section titled"Environmental", on page 59, the Plan states, "development need not be detrimental to the environment. Responsible construction can occur with negligible impact on the County's natural resources", and "with proper planning, the impact on the environment can be minimized" (page 60). Pages 52 and 53 contain"Design Principles"that the County has identified for such responsible development addressing various resource impacts.
