Box 2188 Washington, N.C. 27889-2188 Dear Mr. Moye Re: Proposed Replacement of Bridge No. 23 on NC-45 in Hertford County On/about September 20, 1995 the North Carolina Department of Transportation (NCDOT) submitted a CAMA Major Development Permit application for the proposed replacement of bridge # 23 in Hertford County. A permit Is required; because the Wiccacon River, at the site of bridge # 23, was determined to be a Public Trust Water Area of Environmental Concern per Administrative Code Subchapter 7H.0207. As a Categorical Exclusion, the project's anticipated impacts to Section 404 wetlands (0.95 acre) are authorized under Nationwide Permit 23. These impacts include 0.23 acre of PFO1 C and 0.72 acre of PFO6F bottomlands. On October 4, 1995 the Division of Coastal Management (DCM) returned the application due to discrepancies in the information provided and due to concerns about proposed changes in vertical navigation clearance, right of way, etc. Responses to these concerns have been made and are addressed in this letter and attached information, including revised MP-1 and MP-5 applications. Riparian landowner notification verifications are also provided. Concerns raised by the DCM • Adjacent Riparian Property Owner Notifications: See attached material • Justification for requesting a reduction in vertical clearance: During its planning study, the NCDOT determined that commercial river traffic, including log barges, no longer utilize the river above the existing bridge. Furthermore, the NCDOT's investigation confirmed that the only vessels observed using the river channel are pleasure craft, including bass boats, etc., not over 22 ft in length. During • i a fir ti• -. `.1�,.r;,r. - --ems- Page 2 January 29, 1996 Mr. Move the planning study efforts were made to contact local residents and others who were/are familiar with patterns of usage in the river. Although records of the individual interviews were not kept, the conclusion of the study was that the existing vertical clearance was entirely unjustified, based upon a pattern of usage that had been established during the last couple of decades. • Will existing causeway be removed to wetland elevations ? The Revised Categorical Exclusion document for this project, published in 1994 (attached) stated that the NCDOT would remove the causeway to natural ground elevations. • NEPA documentation: The NCDOT has completed a NEPA study of the proposed project, in accordance with Federal Highway Administration guidelines; a federal categorical exclusion document is routinely required for federally funded bridge replacement projects, which have been determined to pose minor risks to the environment. This document is attached. • Right of Way concerns: The NCDOT proposes to replace the existing bridge on new location, which will necessitate the acquisition of additional right of way. Proposed right of way is indicated in plan views. Right of way acquisition will be accomplished either through "fee simple' purchase, or the statutory condemnation process well in advance of the anticipated August 1996 construction letting. It is requested that this revised application be processed as soon as possible to enable the NCDOT to upgrade the existing, functionally obsolete structure in the near future. PROJECT SUMMARY: The applicant proposes to replace an existing ±25' 10" wide by ±379' long bridge with a ±33' 1" wide by ±360' long bridge. NC DOT Bridge #23 Hertford County Project setting The N. C. Department of Transportation (NC DOT) proposes to replace bridge #23 located on NC 45 over the Wiccacon River near Harrellsville in Hertford County, North Carolina. The existing bridge is ±25' 10" wide and ±379' long and has a vertical clearance of ±25'. The navigable water depth at the existing fender system is ±23'. The bridge is bordered on the downstream (east) side by 404 delineated wooded wetland vegetated with various species of hardwoods including cypress. The wetland area gives way to upland grasses on the road shoulder. The upstream(east) side is bordered by an approximately 50' wide cut over area of 404 delineated wooded wetland for aerial transmission line right-of-way. This cut over area is vegetated with various wetland plant species which give way to upland grasses on the road shoulder. Adjacent the cut over area continuing upstream of the bridge are 404 delineated wooded wetland vegetated with various species of hardwoods including cypress. The upstream (west) side of the site is bordered by uplands with a dwelling and various out buildings. This area is vegetated with lawn grasses, shrubs and several pines and hardwoods. The downstream (west) side of the bridge is bordered by an upland hardwood area. As you move away (west) from the river this upland wooded area gives way to an area of 404 delineated wetland. This wetland area appears to be the upper limit of a bottom land hardwood finger which connects to the Wiccacon River and is vegetated with various species of hardwoods, pines and various wetland plants. The river is ±225' wide at the bridge crossing and an existing fender system is in place with a navigable width of ±60'. The Wiccacon River is classified as C-NSW by the Environmental Management Commission. Project description NC DOT proposes to replace an existing ±25' 10" wide by ±379' long bridge with an approximately 33' 1" wide by ±360' long bridge ±50' downstream of the present location. The existing bridge which has 16 bents will be removed and replaced with a new bridge which has 4 bents. The existing vertical clearance is ±25 and the proposed bridge will be lowered to ±13' 7". The existing fender system has a navigable width of ±60' and will be removed. The new bridge will have a navigable width of ±85'. Approximately 27,500 ft2 of wooded wetland will be filled to create the approach for the new bridge. The shift of the existing approach will also result in the filling or disturbance of ±120,000 ft2 of highground. NC DOT proposes to remove the existing approach outside the toe of the new approach and return it to the grade and elevation of the adjacent substrate. NC DOT Bridge #23 Hertford County Page Two Anticipated impacts The project as proposed would result in the filling of ±27,500 ft2 of wooded wetland and the filling or disturbance of ±120,000 ft2 of high ground. The existing bridge has a navigable opening between existing fenders of ±60' wide with a vertical clearance of ±25'. The proposed bridge will have a opening of ±85' wide with a vertical clearance of ±13' 7". While this proposal enhances navigation width, the loss of 11' 5" of vertical clearance will eliminate timber barge access upstream of the new bridge. The proposed bridge will reduce the number of pile bents in the overall span from the existing 16 down to 4. The existing horizontal clearance for navigation will increase from ±60' to ±85'. The existing vertical clearance of ±25' will be lowered to ±13' 7". A vertical clearance of ±13' 7" allows for continued use by outboard motorboats but will eliminate any future use by timber barges as well as other deep draft recreational craft. Based upon 7H.0207(b), (c), and (d), as well as 7H.0208(a)(2)(H), I recommend that the existing clearance of ±25' be conditioned to remain unchanged. If the permit is issued I would suggest the following conditions be placed on the permit; CONDITIONS ? 1. The existing vertical clearance of ±25' must be maintained by the proposed bridge. 2. The temporary placement or double handling of excavated or fill materials within waters or vegetated wetlands is not authorized. 3. No excavated or fill material will be placed at anytime in any vegetated wetlands or surrounding waters outside of the alignment of the fill area indicated on the work plat(s). 4. Public Trust AECs are involved and the proposal comes under the auspices of the July 1991 CRC certified Hertford County Land Use Plan update. The county plan offers the following guidance on proposals of this type: • County policy on AECs (page 40) is ". . . to support protective measures in AECs but to encourage resource development activities which can meet state and federal and local standards." • County policy on hazardous and fragile areas (page 40-41) includes ". . . to strictly enforce the CAMA regulations and support and uphold the permitting process of state or federal agencies for fragile areas, including 404 wetlands." • The plan includes a discussion on commitment to state and federal programs (page 48) and notes "highway improvements are of particular concern in areas where peak traffic loads create a burden on the system." County policy is to support all state and federal regulations. • By definition (page 64-65) AECs are in the Conservation land classification and dialogue notes county support for their protection. • The county land classification map (page 65.1) notes the landward portion of the proposal in the Rural land class. This class (page 64) notes the low population densities and agrarian nature associated. Wiccacon River functions as a spawning and nursery area for blueback herring and alewife. White perch, yellow perch, catfishes and other commercially and recreationally important species also utilize the area. This agency is concerned with the loss of 27,500 sq. ft. of wooded wetlands. Wetlands are of great importance to fisheries resources, serving as sources of basic biological productivity, providing food directly and indirectly, and serving as spawning and nursery areas for many species. Finally, wetlands perform important roles in modifying acute impacts of hydrologic events, moderating stormwater flows, trapping sediments, and providing nutrients for incorporation into resident plants. Adequate mitigation must occur for the loss of these wetlands. The mitigation should be inkind and at a greater than 1:1 ratio. The Division requests a moratorium associated with the construction of the new bridge. The moratorium time frame is 15 February through 30 September. This will ensure the environmental integrity of the area is protected during critical times of usage by the above mentioned species. Adequate clearance will be provided with the new bridge for recreational and commercial fishing vessel use. However as noted in the bio-report commercial vessel use will be restricted. Staff biologists with the Wildlife Resources Commission have completed a review of the project with regards to associated impacts on wildlife and fisheries resources in the area. A site visit was conducted on March 14, 1996. Our comments are provided in accordance with provisions of the Coastal Area Management Act(G.S. 113A-100 through 113A-128), and the Fish and Wildlife Coordination Act(48 Stat. 401, as amended; 16 U.S.C. 661 et seq.). The applicant proposes to replace bridge#23 located on NC Highway 45, Hertford County,with another spanning structure. The existing bridge is±25 ft. 10 in. wide and±379 ft. long, and will be replaced by an approximately 33 ft. 1 in. wide by±360 ft. long bridge located ±50 ft. downstream of the present location. Vertical clearance will be lowered from±25 ft. to ±13 ft. 7 in. Bridge#23 is located over the Wiccacon River. The proposed project would result in the fill of 27,500 ft of 404 designated vegetated wetlands, and 120,000 ft2 of highground. The Wiccacon River is classified as class C,and nutrient sensitive waters (NSW)by the Environmental Management Commission. Wetlands found on this site provide functions which benefit the public as well as fish and wildlife. Wetlands act as a stormwater runoff purification zones between upland areas and surface waters. Wetlands store and convey flood waters and provide shoreline erosion protection through attenuation of wave energy. Wetlands also serve as a physical habitat for numerous • .«. species of amphibians,reptiles, birds,and mammals. In some instances, wetlands serve as spawning and nursery areas for anadromous fish. Through deposition of detritus into adjacent waters,wetlands contribute large quantities of organic carbon, forming the food chain base and the resulting biological productivity for many aquatic ecosystems. The shallow water habitat in the Wiccacon River is used by numerous species of freshwater fish as spawning,rearing, feeding and escape areas. Increased turbidity in these areas results in the destruction of spawning habitat, and greatly diminishes egg and fry survival. To avoid adverse impacts to spawning populations of anadromous and resident fish species at the project site, we will not object to the project as proposed if in-water work is not conducted between February 15 and September 30. We have concluded that the reduction in vertical clearance will not significantly impact navigational uses of the Wiccacon River. Currently,the majority of boat traffic in the area consists of vessels less than 13 ft. in height. We appreciate the opportunity to provide input into this permit application review. Box 2188 Washington, N.C. 27889-2188 Dear Mr. Moye Re: Proposed Replacement of Bridge No. 23 on NC-45 in Hertford County On/about September 20, 1995 the North Carolina Department of Transportation (NCDOT) submitted a CAMA Major Development Permit application for the proposed replacement of bridge# 23 in Hertford County. A permit Is required, because the Wiccacon River, at the site of bridge# 23, was determined to be a Public Trust Water Area of Environmental Concern per Administrative Code Subchapter 7H.0207. As a Categorical Exclusion, the project's anticipated impacts to Section 404 wetlands (0.95 acre) are authorized under Nationwide Permit 23. These impacts include 0.23 acre of PFO1C and 0.72 acre of PFO6F bottomlands. On October 4, 1995 the Division of Coastal Management (DCM) returned the application due to discrepancies in the information provided and due to concerns about proposed changes in vertical navigation clearance, right of way, etc. Responses to these concerns have been made and are addressed in this letter and attached information, including revised MP-1 and MP-5 applications. Riparian landowner notification verifications are also provided. Concerns raised by the DCM • Adjacent Riparian Property Owner Notifications: See attached material • Justification for requesting a reduction in vertical clearance: During its planning study, the NCDOT determined that commercial river traffic, including log barges, no longer utilize the river above the existing bridge. Furthermore, the NCDOT's investigation confirmed that the only vessels observed using the river channel are pleasure craft, including bass boats, etc., not over 22 ft in length. During tot V. Page 2 January 29, 1996 Mr. Moye the planning study efforts were made to contact local residents and others who were/are familiar with patterns of usage in the river. Although records of the individual interviews were not kept, the conclusion of the study was that the existing vertical clearance was entirely unjustified, based upon a pattern of usage that had been established during the last couple of decades. • Will existing causeway be removed to wetland elevations ? The Revised Categorical Exclusion document for this project, published in 1994 (attached) stated that the NCDOT would remove the causeway to natural ground elevations. • NEPA documentation: The NCDOT has completed a NEPA study of the proposed project, in accordance with Federal Highway Administration guidelines; a federal categorical exclusion document is routinely required for federally funded bridge replacement projects, which have been determined to pose minor risks to the environment. This document is attached. • Right of Way concerns: The NCDOT proposes to replace the existing bridge on new location, which will necessitate the acquisition of additional right of way. Proposed right of way is indicated in plan views. Right of way acquisition will be accomplished either through "fee simple" purchase, or the statutory condemnation process well in advance of the anticipated August 1996 construction letting. It is requested that this revised application be processed as soon as possible to enable the NCDOT to upgrade the existing, functionally obsolete structure in the near future. Your cover letter should explain NCDOT's justification for requesting a vertical clearance reduction of over 10 feet. In your proposal to remove the existing bridge, does NCDOT also propose to return the existing approaches on both sides to the original contours and elevations or to adjacent wetland elevations? I have discussed the question of an Environmental Assessment (EA) document with Raleigh Bland and Mike Bell of the US Army Corps of Engineers and the EA will be required for this project. The project as proposed appears to involve work outside the established DOT R/W for the placement of the new bridge. If NCDOT intends on using the condemnation process to obtain the necessary R/W, then you need to explain this in your cover letter and include the appropriate documentation. If the project will take place on property other than that owned by the NCDOT then the application should be changed to reflect that and copies of the appropriate deeds and letters of consent must be attached. Plans call for the replacement structure to be constructed slightly north (downstream) of the existing structure (see attached plans). Specifically, the proposal provides for the replacement of an aging (1940) structure which has a substructure of creosoted timber caps and piles, and reinforced concrete caps on timber piles; end bents are of creosoted timber caps and piles with timber bulkheads. Multiple (14) spans @ 22 feet and a main span of 69 feet comprise the 379 feet length of the existing structure. The main span, which contains a timber fender system, provides for navigational clearances of 58 feet horizontally and 25 feet vertically. The replacement structure consists of five spans, including two @ 90 feet, two @ 70 feet and one @ 40 feet. The main channel span will provide for navigational clearances of 85 feet-7 inches horizontally and 13 feet-7 inches vertically. The existing fender system will not be replaced. The clear roadway width of the existing structure is 25 feet-10 inches; the proposed replacement bridge will have a clear roadway width of 30 feet. w Page 2 Ms. Ann Deaton September 20, 1995 Federal funds will be utilized and have been applied for under the Federal Aid Bridge Replacement Program. The Federal Highway Administration (FHWA) project code for this action is BRS-5053(2). The U.S. Army Corps of Engineers (COE) under authority of Section 404 of the Clean Water Act and Section 10 of the Rivers and Harbors Act of 1899 must also approve the action. It is anticipated that the proposed action will be authorized by the COE under Nationwide Permit 23 and by the state Division of Environmental Management under Section 401 Water Quality Certificate No. 2734. The NCDOT-DOH has submitted a Coastal Area Management Act (CAMA) permit application to the state Department of Environment, Health and Natural Resources. A copy of this permit application and associated drawings are enclosed for your review. Once these state and federal permits have been obtained they will be forwarded to your office. The FHWA has determined that this project will not have a significant impact on the human environment and accordingly authorized the project as a Categorical Exclusion in accordance with 23 CFR 771.115 (b) (9). A copy of the Categorical Exclusion document, which was approved by the FHWA in June 1986, is submitted for your review. The Categorical Exclusion study considered several alternatives, including a do-nothing and five (5) build alternatives. There are no wildlife and/or waterfowl refuges, recreational areas. public parks or historic sites in the project study area. Furthermore, a study by a staff biologist has concluded that no federally protected species or their habitat will be affected by the proposed action. Legal authority for the proposed bridge replacement project is found in the General Bridge Act of 1946. As indicated above, application has been submitted for state and federal permits which will be required prior to construction. The existing bridge and obsolete approachway sections will be demolished and removed immediately upon completion of the replacement structure and its associated approachway sections. Construction is scheduled to commence in mid-late Winter 1996. In the final analysis, the Division decision is to approve the design requested by the DOT. This bridge, according to a June 21 telephone communication with DOT design staff, will have a vertical clearance of 15 feet at normal water level. The matter of land required for the alignment adjustment is between the DOT and yourselves. This Division does not have purview over land needs for highway projects and in no way is involved in acquisition and/or condemnation. I was given your name by Randy Turner. I was told that you were the individual that might provide me with some answers. I would like to start by stating that this is my first experience dealing with DOT. I cannot express to you how disappointed I am in how this manner has been handled. I have been left no choice but to investigate myself as to what is going on as nobody from DOT seems to know. If they do, they certainly have not made much of an effort to inform me. My investigation led to you. I have dealt with your right of way agent from Elizabeth City, a Mr. Robertson I believe. I must say that my disappointment is primarily with him. Specifically, he has failed to do what he has told me. In addition, he does not know what is going on with this bridge replacement. In the spring of 1995, he came to my home in Morehead City to inform me of the state's intentions. I was told that I would get an appraisal of my land in about six weeks. In actuality, I did not hear from Mr. Robertson for about six months when he again came to my home and presented me with an appraisal of my land that DOT wishes to purchase. Having delivered the appraisal to me, Mr. Robertson asked for a quick response. Come to find out, he wanted an answer from me on the offer to purchase before I had time to reply to a letter sent to me by M. Randall Turner, dated September 18, 1995! I cannot comprehend this action by Mr. Robertson and can only trust that it is attributable to his ignorance of the situation due to the complexity of the permitting process. My next contact with Mr. Robertson was by telephone and he wanted to know WI had made a decision on the offer. I informed him that he wanted an answer yet I had a letter from Mr. Turner stating that I had 30 days to answer whether I objected to the project or not. Mr. Robertson, clear to me, did not know what was going on. I believe his quote was something to the affect that he had not heard of a letter like Mr. Turner's since 1962. He went on to tell me that the offer amount would be placed in escrow. He led me to believe that construction would begin in February. I would like to make it clear that never did I reject the offer. I considered it to be a paltry amount when the "big picture" was taken into account and I told Mr. Robertson the same. However, I was never in a position to reply to the offer as I was still gathering information. I would also note that never did I get any type of notification from Mr. Parker that he had received my letter of objection to the project. However, some time later, I received a call from the United States Coast Guard, I beleive the man's name was Bill. After our discussion, he indicated that his office would do a public notice on the project. I recently received this notice out of Norfolk. After my dicussion with Bill, I was left with the impression that the Coast Guard had not yet issued a permit to DOT to lower the height of the replacement bridge. All along, I felt that Mr. Robertson had indicated that the Coast Guard had approved the plans for the replacement bridge at a reduced vertical clearance. Apparently, that is not the case and no Coast Guard permit has been issued. Needless to say, the image of the DOT has been further tarnished in my eyes. It is not my desire to go to court over this matter. However, I am mad about the way I have been treated and the way this matter has been handled. I would like to hear from you, or someone with DOT, other than Mr. Robertson. This needs to be sooner, opposed to later, as the public notice deadline is upon us. If the DOT is committed to the paltry sum of$3,040 for my 1.29 acres, with no regard for what the lowering of the bridge will do to my upstream property value, then I will make every effort to appeal to the Coast Guard to not issue the permit. In addition to my concern over decreased property value, I also own a 52'boat that I wish to bring to my cabin on the Wiccacon. Your proposed bridge would prohibit me from doing that. Thank you for your time and consideration to this matter. I believe that I have placed the "ball" back into DOT's hands. I would certainly entertain a reasonable offer to avoid going to court but I adamantly refuse to take a$3,040 offer and a lowered bridge without one heck of a fight. I must say that I am confused on being given an appraisal, and subsequently, an offer on 1.29 acres of my land prior to the deadline for objections as set forth in the above mentioned letter. I currently have a house situated on the property to be affected by the state's desire to build the replacement bridge. As conveyed to me, the state's offer to buy my land amounts to little more than the value of the timber. To me, the 1.29 acres is worth much more than the value of the timber. As this 1.29 acres includes deep water access to the Wiccacon River, developmental possibilities include a "fish camp" style facility. While part of the property is certainly low land, this does not preclude the possibilty of some type of dock to the water's edge. Access to the Wiccacon is very limited, and the state's proposal to take my land certainly creates a problem when I wish to develop this tract of land. Asking me to give up this land for the price of the timber is quite ludicrous. Lowering the height of the bridge is very much against my wishes. The Wiccacon River is quite deep and affords passage by large pleasurecraft. In the past, I have owned a large pleasureboat and fully expect to own other large boats. As I presently own a house on this land, your decision to lower the bridge prohibits me from ever bringing a boat of any size to my house. Again, any developmental possibilities that I have for the future of this 70 acre tract of land would be curtailed by the lowering of the bridge. I feel that I have several potential home lots overlooking the Wiccacon, upstream from the bridge. In other words, in a direction towards Harrellsville, and south of Highway 45. The lowering of the bridge would serve to lower the value of my property as it would limit access to the Chowan River. When you consider that the existing bridge is 55 years old, a lot of thought must go into the future. I am 38 years old and am young enough to contemplate all of the above possibilities. However, your proposal affects not only me, and my wife, but also my two children, ages nine and eleven. As my family ha timber�concerns that might be adversely affected by this substantial decrease in water t n ge--istance this portion of your proposal is unacceptable. Also, once you lower the height of the bridge then other people in the community might one day be negatively affected as well, since the type of boats that could navigate back and forth into that part of the river would forever be limited. Please know I inherited this land from my grandfather. The land has great emotional and sentimental value to me. I plan on returning home to Eastern North Carolina to retire. My wife and I have often talked of building our dream house on this beautiful site that overlooks the Wiccacon River. The area NCDOT is proposing to build upon would adversely impact two beautiful wooded lots overlooking the river and destroy the natural setting of the area. Since nature is no longer making such magnificent views and it is not within the powers of the NCDOT to replace what nature has sculptured, I do not want that pristine land to be altered, built upon, or changed in any way.
