Moore, District Manager SUBJECT: Request for Modification to CAMA Major Development Permit No. 99-96: Proposed Replacement of Bridge No. 23 on NC 45 over the Wiccacon River in Hertford County; TIP No. B-1231; State Project No. 8.1070401; Federal Aid No. BRS-5053(2) REFERENCE: NCDOT's December 3, 1997 Letter to M.Smith, USACOE The Division of Coastal Management issued CAMA Major Permit No. 99-96 on June 26, 1996. This permit would have authorized the construction of a replacement structure (+/-) 360 feet long with a vertical navigation clearance of (+/-) 15 feet. As you are aware, the Department of Transportation reapplied to the U.S. Coast Guard in December 1997 following U.S. Coast Guard objections to the original bridge design. The latest application for a U.S. Coast Guard permit reflects a 20-foot vertical navigation clearance. The enclosed plan sheets (6 sets) reflect this latest design. The referenced letter provides additional details related to wetland impacts, etc. Based upon previous discussions with your office, the Department is proceeding under the assumption that the change in design will necessitate a minor modification to the existing CAMA Permit. Accordingly, a check in the amount of $50.00 is enclosed to cover the required fee for processing this modification. WATERWAY AND LOCATION: Wiccacon Creek, mile 12.0, located in Harrelsville, North Carolina. CHARACTER OF WORK: The North Carolina Department of Transportation is proposing to construct a new two lane, fixed span, low level, highway bridge. This new bridge will be replacing the existing deteriorated fixed two lane highway bridge across Wiccacon Creek at Harrelsville, North Carolina. The existing bridge and fender system will be completely removed once the new bridge has been completed. No fendering system is planned for the new bridge. MINIMUM NAVIGATIONAL CLEARANCES: Existing Proposed Vertical clearance: 25 feet at mean low water Vertical clearance: 20 feet mean low water 7.6 meters mean low water 6.08 meters mean low water 21 feet mean high water 19 feet 6 inches mean high 6.38 meters mean high water water 5.95 meters mean high water Note: The mean high water differences between the existing bridge and the proposed bridge illustrates a difference of 3 feet 6 inches. Horizontal clearance: 58 feet between fenders Horizontal clearance: 85 feet 2 inches between piles 17.63 meters between 25.90 meters between fenders piles 16591 January 28, 1998 ENVIRONMENTAL CONSIDERATIONS: The Federal Highway Administration, (FHWA) the lead federal agency, has tentatively determined the proposed action will not have significant environmental impacts for purposes of the National Environmental Policy Act. The project was classified as a Categorical Exclusion (CE) in 1986. The Federal Highway Administration subsequently revised this CE in 1994, and has determined this project is still classified as a CE. FHWA will complete an update to their 1994 CE which will document the basis for the CE, and forward it to the Coast Guard. The documents are available for review at the address listed below, Monday through Friday, 8:00 a.m. to 4:30 p.m. The bridge is located within a floodplain. A Coastal Area Management Act (CAMA) Major Development permit and a 401 Water Quality Certificate will be required in order for the Coast Guard to issue a bridge permit. WETLANDS: Anticipated impacts to high quality swamp forest will total 1.11 acres for the current proposal (440 foot bridge with a twenty foot vertical clearance). ENDANGERED/THREATENED SPECIES: Agency coordinated and field investigations reveal that no known endangered or threatened species are located within the study area. HISTORIC PROPERTIES: The project area was archaeologically surveyed in 1985. The survey resulted in the discovery of archaeological site 31HF99, a significant prehistoric site that was to be disturbed by the bridge replacement as it was designed at that time. Archaeological data recovery excavations were recommended for 31HF99 as a result of that survey. Since that time, the Federal Highway Administration has completed a data recovery plan which has been accepted by the State Historic Preservation Officer and the Advisory Council on Historic Preservation. No impacts to unique or prime farmland, wild and scenic rivers, or displacement of residences and businesses will result from the proposed project. SOLICITATION OF COMMENTS: Interested parties are requested to express their views, in writing, on the construction of the proposed bridge giving sufficient detail to establish a clear understanding of their reasons for support of or opposition to the proposed work. The PN states that the North Carolina Department of Transportation (NCDOT) has applied for a U.S. Coast Guard (USCG) permit to construct a new, two-lane, fixed span, low level, highway bridge over Wiccacon Creek near the Town of Harrelsville, Hertford County, North Carolina. Prior coordination indicatef that project is designated as B-1231 (Replace Bridge No. 23 over the Wiccacon River on NC 45). The existing bridge and fender system would be completely removed after completion of the new bridge. No fendering system is planned for the new bridge. The PN states that the project would impact 1.11 acres of high quality swamp forest. Our comments are submitted in accordance with the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d), and Section 7 of the Endangered Species Act (ESA) of 1973, as amended (16 U.S.C. 1531-1543). They are to be used in your determination of permit issuance in accordance with the Department of Transportation Act of 1966, and Section 9 of the Rivers and Harbors Act of 1899. The Service is concerned about the use of a Categorical Exclusion (CE) to satisfy the requirement of the National Environmental Policy Act (NEPA). The PN states that the original 1986 classification as a CE was revised in 1994. The Federal Highway Administration (FHWA) will complete a new update of this determination. Categorical Exclusions are intended to apply to a uniform group of actions which, based on past experience, do not have a significant environmental 2 impacts. The FHWA regulations specify that bridge rehabilitation, reconstruction, or replacement may qualify as a CE. However, we view the proposed project as actually the construction of a new bridge adjacent to an existing bridge. We believe that the construction a new bridge, a term used in the PN, is a category of projects which may produce a wide range of environmental impacts. Therefore, the Service believes that NEPA requirements should be addressed in an Environmental Assessment (EA) which would contain a full discussion of alternatives, environmental impacts, and compensatory mitigation measures. The Service is especially concerned that the project would result in the loss of 1.11 acres of high quality swamp forest. Swamp forests have many ecological and societal values. These areas represent extremely high quality habitat for fish and wildlife resources. They also function to improve water quality and control floods. The Service believes that the permanent loss of these wetlands would represent a serious, adverse environmental impact. While the loss of this area is relatively small, such small losses should be viewed in a cumulative sense. From the mid-1970s through the mid-1980s, North Carolina had an estimated loss of 1.2 million acres of palustrine forested and scrub-shrub wetlands (Hefner et al. 1994). We believe that any additional losses must be viewed in the context of significant prior losses. In this regard, the characterization of this project as a CE may lead to the use of Nationwide Permit No. 23 (NWP 23). This NWP, like the NEPA designation on which it is based, facilitates approval of a Section 404 permit by the Corps of Engineers for the dredge and fill of wetlands which ". . . neither individually nor cumulatively have a significant effect on the human environment . . ." The Service believes that the use of NWP 23 would be inappropriate for the proposed project. • The PN states that agency coordination and field investigations have revealed that no federally- protected species are located in the project area. Service data indicate that the red-cockaded woodpecker (RCW) (Picoides borealis) is the only listed species known to occur in Hertford County. Our records indicate that there have been no reported occurrences of this species in the immediate vicinity of the project area. However, the Service file for this project does not contain any communications on the field investigations mentioned in the PN and the Service has not issued any concurrence that the project would not adversely affect this species. While we believe that this species would not use the swamp forests adjacent Wiccacon Creek, we do not know the extent of project impacts on other natural communities at this time. Therefore, the Service is unable to confirm that the requirements of Section 7 of the ESA have been fulfilled. In summary, the Service recommends that the USCG request an EA and a formal Finding of No Significant Impact prior to the issuance of a permit. As noted, the proposed project appears to be the construction of an entirely new bridge which happens to be adjacent to an existing bridge, 3 rather than a true bridge replacement project which is more appropriate for a CE. An EA would allow for a more thorough discussion of possible alternatives, an assessment of environmental impacts, and the development a compensatory wetland mitigation plan.
