State Project no. 5.2151. The North Carolina Department of Transportation proposes to replace Bridge No. 7 over Keys Canal on SR 1203 near Bayboro in Pamlico County. The proposed action will involve replacing the existing 49 foot long, timber bridge with a 52 foot long, single barrel , aluminum box culvert (25 ft. 3 in. wide by 7 ft. 9 in. high) . This bridge replacement will take place on existing alignment and local traffic will be detoured along existing roadways. The new structure is longer than the existing bridge (see Section B—B sheet 2 of 3) . To facilitate the longer structure the North Carolina Department of Transportation proposes to excavate a small amount of material (202 C.Y.) below NWL. No wetlands will be affected by the proposed excavation. There will be no fill below NWL and no fill in wetlands. The shoreline will be stabilized by the placement of prefabricated aluminum endwalls. The elevation of the new structure will be lower (0.5 ft. ) than the existing bridge. The proposed culvert will not affect existing water flow and will not affect existing navigation potential . The North Carolina Department of Transportation is requesting that the proposed work be authorized under the appropriate Coastal Area Management Act (CAMA) permit. Enclosed is a permit application for a CAMA Major Development Permit including permit drawings and a copy of the fee application check for $250.00. t• By copy of this letter, we are also requesting issuance of a 401 Water Quality Certification from the North Carolina Department of Environmental Management. We do not anticipate requesting an individual permit from the Corps of Engineers for discharge of dredge or fill material in waters of the United States, but propose to proceed under General Permit 31 in compliance with Section 10 of the Rivers and Harbors Act of 1899 (33 U.S.C. 403) and Section 404 of the Clean Water Act (33 U.S.C. 1344) . NARRATIVE DESCRIPTION: Project Setting Bridge #7 is located on unimproved SR 1203 over Keys Canal near Bayboro in Pamlico County. Keys Canal essentially forms the headwaters of the Estuarine Waters of Bay River. Water depth at the project site is approximately -3.5' below NWL. Just upstream of the project site, the canal becomes a typical farm field drainage ditch/canal. A 49'-long, timber bridge currently exists on the site. Farm fields dominate the adjacent properties and there are no wetlands on the site. Project Description The applicant proposes to replace an existing 49'-long, timber bridge with a 52'- long, single barrel, aluminum box culvert (25' 3" wide X 7' 9" high). The work will take place on the existing alignment and local traffic will be detoured along existing roadways. Since the proposed structure is longer than the existing bridge, some excavation below NWL will occur (231 yds3). The culvert is slightly larger than the existing canal so a limited amount of high ground excavation is also proposed (324 yds3). Both shoreline banks will be stabilized by the placement of prefabricated aluminum endwalls. Anticipated Impacts The project as proposed would have minimal impact on the Estuarine and Public Trust Waters of Keys Canal. As a result of the installation of the box culvert and placement of the backfill material, approximately 1,196 ft2 of canal bottom would be filled. In addition, approximately 1,300 ft2 of high ground would be excavated during site "prep" and would also be filled. Best Management Practices should keep any offsite turbidity problems to a minimum. Section III Land Classification System (Page III-3) and Section V Relationship of Policies and Land Classification (Page V-2) of the LUP state that Pamlico County allows all uses which are consistent with the 15A NCAC 7H use standards in the Conservation IV classification. Applicable policies in the LUP for this project include Resource Production and Management Policies for Marine Resource Areas (Page IV-14) . These policies reiterate the County' s support for the state' s minimum use standards for development in Estuarine Waters and Public Trust Areas . Economic and Community Development Policies for Transportation are included on Pages IV-18 and IV-19 and support improvements that are necessary to ensure that traffic congestion and dangerous traffic conditions do not exist . Pamlico County' s Commitment to State and Federal Programs is discussed on Page IV-17 . Staff biologists with the Wildlife Resources Commission have reviewed the project and associated impacts on wildlife and fishery resources in the area. A site visit was made on March 13, 1996. Our comments are provided in accordance with provisions of the Fish and Wildlife Coordination Act(48 Stat. 401, as amended; 16 U.S.C. 661 et. seq.)and the Coastal Area Management Act(G.S. 113A-100 through 113A-128). The NCDOT is proposing to replace an existing timber bridge with a 52'-long, 25' wide X 7'9"high aluminum box culvert over Keys Canal. Proposed activities will impact about 1,196 ft of Public Trust waters. Keys Canal forms the headwaters of the Estuarine Waters of Bay River and is classified as 'SC Sw NSW'. This section of the creek is not designated as a Primary Nursery Area. We are concerned over the potential adverse impacts to aquatic fauna resulting from turbidity associated with the proposed activities. Elevated turbidity could reduce water quality in these areas and stress aquatic organisms. Excessive turbidity is particularly damaging to egg and larval life stages of aquatic organisms. Best Management Practices to minimize adverse impacts resulting from project related sedimentation should be strictly enforced. It also serves as a follow-up to my telephone conversation with Ms. Alice N. Gordon of your office. The purpose of my site inspections was to determine the CAMA jurisdiction at the sites and to determine the permit requirements of the DCM for the replacement of the two aforementioned bridges. Based upon my September 25, 1995 inspection, I conclude that the waters of both tributaries in question are Public Trust and Estuarine Waters. Public Trust Areas and Estuarine Waters are Areas of Environmental Concern (AECs) and fall under the jurisdiction of the Division of Coastal Management. Therefore, the replacement of these bridges would constitute development and would require a permit from this Division. Also, please make note that there are extensive Coastal Wetlands (also an AEC under the jurisdiction of the DCM) on the Gale Creek site. Any bridge replacement proposal should be designed to minimize the impacts to those wetlands. Thank you for taking the time and interest to comply with the permit requirements of this Division.
