Excavation and Fill

1) A box culvert design that maintains the existing stream cross section must be utilized.

2) In order to protect juvenile shrimp and finfish populations, no excavation or filling will be ,
permitted between April 1 and September 30 of any year without the prior approval of the
Division of Coastal Management, in consultation with the Division of Marine Fisheries. /

ADDITIONAL CONDITIONS
• 5) The aluminum box culvert must be structurally tight so as to prevent seepage of backfill
materials through the structure.
• 6) All fill material must be clean and free of any pollutants, except in trace quantities. Metal '
products, organic materials, or unsightly debris will not be used.
• 7) All backfill material will be obtained from a highground source and confined behind the
permitted bulkhead.
• 8) The temporary placement or double-handling of excavated or fill materials within waters or '
vegetated wetland is not authorized.
• 9) No excavated or fill material will be placed at any time, in any marsh or surrounding waters,
outside of the alignment of the fill area indicated on the workplan dated revised 1/96.
• 10) All excavated materials will be confined above normal high water and landward of all regularly '
or irregularly flooded marsh behind adequate dikes or other retaining structures to prevent
spillover of solids into any marsh or surrounding waters.
Sedimentation and Erosion Control
• 11) In order to protect water quality, runoff from the construction must not visibly increase the '
amount of suspended sediments in adjacent waters.
• 12) Silt fences shall be placed immediately upstream and downstream of the project site prior to
initiation of construction, and shall remain in place until project completion.
• 13) All disturbed areas will be properly graded and provided a ground cover sufficient to restrain
erosion within thirty (30) working days of project completion.
• NOTE: The permittee is reminded that high quality water, soil, and erosion control measures
should be used due to the Primary Nursery Area designation of Gale Creek.

SUBJECT: Pamlico County, Replacement of Bridge No. 62 on SR 1224 over
Tributary of Gale Creek. State Project No. 5.2151.
The North Carolina Department of Transportation proposes to replace
Bridge No. 62 over the Tributary of Gale Creek on SR 1224 near Mesic in
Pamlico County. The proposed action will involve replacing the existing
single-lane, 18-foot, timber bridge with a two lane, single barrel , aluminum
box culvert (12 ft. 7 in. wide by 5 ft. 2 in. high) . This bridge replacement
will take place on existing alignment and local traffic will be detoured
along existing roadways.
The new structure is longer than the existing bridge (see Section B-B
sheet 2 of 3) . To facilitate the longer structure the North Carolina
Department of Transportation proposes to excavate a small amount of material
(160 C.Y. ) below NWL from the coastal wetland adjacent to the present
structure. This activity will restore the roadside drainage ditches to their
preconstruction dimensions. In addition, a minor amount (less than 10 C.Y.)
of material will be excavated from the wetlands located between the existing
structure and the ditches (i .e. ditchside wetlands) . There will be no fill
in the coastal wetlands. There will be minor fill in the ditchside wetlands.
The placement of the culvert will be stabilized with 28 C.Y. of fill
below NWL. The shoreline will be stabilized by the placement of
prefabricated aluminum endwalls.
The elevation of the new structure will be lower (0.5 ft.) than the
existing bridge. The proposed culvert will not affect existing water flow
and will not affect existing navigation potential .
The North Carolina Department of Transportation is requesting that the
proposed work be authorized under the appropriate Coastal Area Management Act
(CAMA) permit. Enclosed is a permit application for a CAMA Major Development
Permit including permit drawings and a copy of the fee application check for
$250.00. "ti

By copy of this letter, we are also requesting issuance of a 401 Water
Quality Certification from the North Carolina Department of Environmental
Management.
We do not anticipate requesting an individual permit from the Corps of
Engineers for discharge of dredge or fill material in waters of the United
States, but propose to proceed under General Permit 31 in compliance with
Section 10 of the Rivers and Harbors Act of 1899 (33 U.S.C. 403) and Section
404 of the Clean Water Act (33 U.S.C. 1344) .

9. NARRATIVE DESCRIPTION:
Project Setting
Bridge #62 is located on the unpaved SR 1224 near Mesic, on a tributary of Gale
Creek in Pamlico County. Gale Creek is a major tributary to the Bay River. An
extensive high marsh system predominantly vegetated with black needlerush Juncus
roemerianus and salt meadow grass Spartina patens border both sides of the creek.
Marsh vegetation as well as other wetland vegetation have become established along
the fringes of the roadside ditches that are so typical of these low lying area. Water
depth along this section of the tributary averages 3.5' to 4' below NWL. Gale Creek
has been classified SA NSW but is closed to shellfishing. It is a designated Primary
Nursery Area.
Project Description
The applicant proposes to replace an existing single, 18'-timber bridge with a
two lane, single barrel, aluminum box culvert measuring 42' long X 12' 7" wide X 5'
2" high. The bridge replacement will take place on the existing alignment and local
traffic will be detoured along existing roadways. Since the new structure is longer than
the existing bridge approximately 342 ft2 of Coastal Wetlands are proposed to be
excavated. Also, while "prepping" the site for culvert installation, approximately 832
ft2 of creek bottom would be excavated and ultimately filled with the culvert and
backfill material. Both shoreline banks would be stabilized by the placement of
prefabricated aluminum endwalls.
Anticipated Impacts
The project as proposed would affect the following AECs: Coastal Wetlands,
Estuarine waters, Public Trust Areas, and the Estuarine Shoreline. Site "prep" would
remove 342 ft2 of Coastal wetlands from the system. The excavation for and
placement of the culvert would remove approximately 832 ft2 of creek bottom.
Approximately 173 yds3 of material would be excavated below the NWL while
approximately 28 yds3 of material would be placed below the NWL. Approximately
1,050 ft2'of high ground would be disturbed for culvert installation and ditch bank
stabilization. Excavation and filling activities would probably result in an increase in
the short-term and localized turbidity levels.

I have reviewed the subject application in regards to 07H.0205, .0206, .0207, .0208 and
.0209 and it appears that the proposed project is not inconsistent with the General and Specific
Use Standards for those rules. And although there would be some coastal wetlands impacted,
it appears that the NCDOT has kept that impact to a minimum. In addition, the wetlands to be
impacted are the fringe wetlands that have become established along the roadside ditch leading
into Gale Creek. Consequently, I would have no objection to the permit being issued with the
following conditions:
1. In order to protect juvenile shrimp and finfish populations, no excavation or
filling will be permitted between DATE SET BY NC MARINE FISHERIES and
DATE SET BY NC MARINE FISHERIES of any year without the prior
approval of the Division of Coastal Management, in consultation with the
Division of Marine Fisheries.
x 2. Excavation will be conducted below the normal water level.
3. Excavation will not exceed 5.5 feet below the normal water level.
4. The aluminum box culvert must be constructed/installed prior to any backfilling
activities.
5. The aluminum box culvert must be structurally tight so as to prevent seepage of
backfill materials through the structure.
6. The aluminum box culvert must be solid and constructed of metal sheet piles or
other suitable materials approved by Department personnel. No excavation is
permitted except as shown on the workplat dated Rev. 1/96. This permit does
not authorize any excavation waterward of the approved alignment.
7. All fill material must be clean and free of any pollutants, except in trace
quantities. Metal products, organic materials, or unsightly debris will not be
used.

8. All backfill material will be obtained from a highground source and confined
behind the permitted bulkhead.
9. The temporary placement or double-handling of excavated or fill materials within
waters or vegetated wetlands is not authorized.
10. No excavated or fill material will be placed at any time, in any marsh or
surrounding waters, outside of the alignment of the fill area indicated on the
workplat dated Rev. 1/96.
11. All excavated materials will be confined above normal high water and landward
of all regularly or irregularly flooded marsh behind adequate dikes or other
retaining structures to prevent spill-over of solids into any marsh or surrounding
waters.
12. In order to protect water quality, runoff from the construction must not visibly
increase the amount of suspended sediments in adjacent waters.
13. All disturbed areas will be properly graded and provided a ground cover
sufficient to restrain erosion within thirty (30) working days of project
completion.

The North Carolina Department of Transportation proposes to replace
Bridge #62 over a tributary of Gale Creek, on SR 1224 , near Mesic,
Pamlico County. The existing timber bridge is to be replaced with
an aluminum box culvert .
AECs impacted by this bridge replacement project include Public
Trust Areas, Estuarine Waters, Estuarine Shoreline and Coastal
Wetlands . Waters at the site are classified as SA NSW and are
closed to the harvesting of shellfish. The area is a Primary
Nursery Area.
I have reviewed this proposal for consistency with the 1992 Pamlico
County Land Use Plan (LUP) Update and offer the following comments .
The general area of the project is classified as Rural with
Services . The Estuarine Shoreline AEC is classified as Conservation
I, the Coastal Wetlands are classified as Conservation III, and the
Estuarine Waters and Public Trust Areas are classified as
Conservation IV.
Within the Conservation I classification, Pamlico County has
established a permanent conservation zone within seventy-five feet
of the mean high water level for all shorelines bordering primary
nursery areas and other estuarine and public trust waters .
Development in this zone (which corresponds to the Estuarine
Shoreline AEC) are strictly limited. However, some activities are
allowed, including paving for access as allowed by the 7H Use
Standards .
Allowed uses in the Conservation III classification are those uses
allowed by the State' s minimum use standards . Likewise, allowed
uses in Estuarine and Public Trust Areas are those allowed by the
7H Use Standards .
Applicable policies contained in the Pamlico County LUP include
those for Marine Resource Areas (Page IV-14) . These policies also
state the County' s support for the 7H Use Standards for Estuarine
and Public Trust Areas as specified in 15A NCAC 7H. Pages IV-18 and
IV-19 discuss Transportation policies and support those
improvements that prevent traffic congestion and dangerous
conditions . Page IV-17 discusses the County' s Commitment to State
` r
and Federal Programs . Generally, Pamlico County is receptive to
these programs, particularly those which provide improvements to
the County.
Based on the above policies, this project appears to be consistent
with the 1992 Pamlico County Land Use Plan, provided all
requirements set forth in the 7H Use Standards can be satisfied.

SUBJECT: CAMA Permit NCDOT Bridge 62, Gale Creek, Pamlico County
The North Carolina Division of Marine Fisheries (NCDMF) offers the following comments
on the subject project pursuant to G.S. 1 13-131 . The NCDOT proposes to replace an existing
18' long by 17.1 ' wide bridge with a 12.7' aluminum box culvert. The culvert is 42' long.
Gale Creek is a Primary Nursery Area (PNA). Nursery areas are those portions of
estuarine waters most critical to the early life stages of marine and estuarine organisms. Initial
development of the post larval stages of many fish and shellfish species occurs in PNAs
located in the uppermost areas of estuaries and their tributaries. The importance of estuarine
nursery areas to the commercial and recreational fisheries cannot be over-emphasized. More
than 90% of the commercial harvest and 60% of the sport harvest consists of estuarine
dependant species. PNAs are very sensitive to activities on adjacent lands and changes in
salinity.
The NCDMF prefers that bridges be replaced with bridges. This preference is based
on the potential negative impacts constricted opening have on the free flow of water and
hence, the passage of both adult, larval and post larval marine organisms. Round structures
significantly reduce the potential flow volume of the structure which could also impact normal
distribution of marsh detritus (the basis of estuarine food chains).
The NCDMF approves of the proposed project with the following stipulations:
1 . An enlarged box culvert, that maintains the current single flow passage
be required. The proposed culvert design and associated fill will
constrict the flow volume by about 29% (12.7' versus current 18').
2. A construction moratorium be required April-September. The area is a
designated Primary Nursery Area and a moratorium will lessen potential
impacts the bridge replacement will have on juvenile finfish and
crustaceans.

SUBJECT: CAMA/Dredge and Fill Permit Application for NCDOT,Bridge #62 replacement,
SR 1224 over Gale Creek, Pamlico County,North Carolina.
Staff biologists with the Wildlife Resources Commission have reviewed the project and
associated impacts on wildlife and fishery resources in the area. A site visit was made on March
13, 1996. Our comments are provided in accordance with provisions of the Fish and Wildlife
Coordination Act(48 Stat. 401, as amended; 16 U.S.C. 661 et. seq.)and the Coastal Area
Management Act(G.S. 113A-100 through 113A-128).
The NCDOT is proposing to replace an existing bridge with a 42'-long, single barrel
aluminum bgx culvert measuring 12' 7"wipe X 5' 2"high. Proposed activities will impact
about 392 ft of coastal wetlands and 832 ft of Public Trust waters. Gale Creek is a major
tributary of Bay River and is classified as 'SA NSW'. This section of the creek is designated as a
Primary Nursery Area.
We are concerned over the potential adverse impacts to aquatic fauna resulting from
turbidity associated with the proposed activities. Elevated turbidity could reduce water quality in
these areas and stress aquatic organisms. Excessive turbidity is particularly damaging to egg and
larval life stages of aquatic organisms. Therefore,we recommend that no in-water work be
performed between April 1 and September 30. Best Management Practices to minimize adverse
impacts resulting from project related sedimentation should be strictly enforced. Also, if creek
flows permit,we recommend that silt curtains be placed immediately upstream and downstream
of the project site to localize sediment impacts. If possible,we recommend the placement of a
'dry' culvert to provide a travel corridor for small animals and reduce the chance of road-kills.N.

from entering the adjacent wetlands/watercourses/
property (e.g. , silt fence, diversion swales/berms,
sand fence, etc. ) .
5 . A ground cover sufficient to restrain erosion be
provided within 30 working days of completion of any
phase of grading on cut or filled slopes.
6 . An erosion and sedimentation control plan be submitted
at least 30 days prior to initiation of land-disturbing
activities.
7. Additional information concerning the area of the land-
ward disturbance be submitted to determine if an
erosion control plan is required.

Dear Mr. Vick:
Through coordination with the North Carolina Division of Coastal
Management, we have learned of your plans to replace North Carolina
Department Of Transportation (NCDOT) Bridge No. 62 over a tributary of
Gale Creek, located on State Road 1224, near the Town of Mesic, Pamlico
County, North Carolina.
On January 1, 1992, we renewed General Permit No. 198200031, (copy
enclosed) , that authorizes the placement of fill material associated with
the construction, repair, or replacement of bridges across navigable waters
and waters of the United States in North Carolina, including cofferdams,
abutments, foundation seals, piers, temporary construction and access fills,
approach fills, detour fills, and box culvert installation, as part of work
conducted by or in full compliance with the standards and specifications of
the NCDOT.
Your proposed work is authorized if you can comply with all permit
conditions. Please read the enclosed permit to prevent an unintentional
violation of Federal law. As this Department of the Army general permit does
not relieve you of the responsibility to obtain any other required approvals,
you should contact appropriate State and local agencies before beginning work.

The Division of Coastal Management hereby acknowledges receipt of your application
for State approval for development of your property located at Bridge #62 over a tributary of
Gale Creek, on SR 1224 near Mesic, Pamlico County. It was received on January 26, 1996,
and appears to be adequate for processing at this time. The projected deadline for making a
decision is April 10, 1996. An additional 75-day review period is provided by law when such
time is necessary to complete the review. If you have not been notified of a final action by the
initial deadline stated above, you should consider the review period extended. Under those
circumstances, this letter will serve as your notice of an extended review. However, an
additional letter will be provided on or about the 75th day.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the
proposed development. Enclosed you will find a "Notice of Permit Filing" postcard which must
be posted at the property of your proposed development. You should post this notice at a
conspicuous point along your property where it can be observed from a public road. Some
examples would be: Nailing the notice card to a telephone pole or tree along the road right-of-
way fronting your property; or at a point along the road right-of-way where a private road would
lead one into your property. Failure to post this notice could result in an incomplete application.
An onsite inspection will be made, and if additional information is required, you will be
contacted by the appropriate State or Federal agency. Please contact me if you have any
questions and notify me in writing if you wish to receive a copy of my field report and/or
comments from reviewing agencies.
