Re: Proposed Replacement of Bridge No. 29 on SR 1160 in Hertford County
On/about September 29, 1995 the North Carolina Department of Transportation
(NCDOT) submitted a CAMA Major Development Permit application for the proposed
replacement of bridge# 29 in Hertford County. A permit was required, because
Potecasi Creek; at the site of bridge # 29, was determined to be a Public Trust Water
Area of Environmental Concern per Administrative Code Subchapter 7H.0207.
On October 13, 1995 the Division of Coastal Management (DCM) returned the
application due to discrepancies in the information provided. Corrections have been
made to the application as recommended in DCM's October 13th letter. The revised
MP-1 and MP-5 applications and accompanying drawings are attached. Riparian
landowner notification verifications are also provided.
It is requested that this revised application be processed as soon as possible to
enable the Bridge Maintenance program to upgrade the existing, functionally obsolete
structure in the near future.

applicable, the State Dredge and Fill Law, for you to proceed with your project proposal. The original (buff-
colored form) is retained by you and it must be available on site when the project is inspected for compliance.
Please sign both the original and the copy and return the copy to this office in the enclosed envelope. Signing
the permit and proceeding means you have waived your right of appeal described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS 113A-
121.1 or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the
Office of Administrative Hearings, P.O. Drawer 11666, Raleigh, NC 27611, (919) 733-2698 within twenty (20)
days of this decision on your permit. You should also be aware that if another qualified party submits a valid
objection to the issuance of this permit within twenty (20) days, the matter must be resolved prior to work
initiation. The Coastal Resources Commission makes the final decision on any appeal.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must
be carried out in accordance with your application. Modifications, time extensions, and future maintenance require
additional approval. Please read your permit carefully prior to starting work and review all project plans, as
approved. If you are having the work done by a contractor, it would be to your benefit to be sure that he fully
understands all permit requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we request
that you complete and mail the enclosed Notice Card just prior to work initiation. However, if questions arise
concerning permit conditions, environmental safeguards, or problem areas, you may contact Department personnel
at any time for assistance. By working in accordance with the permit, you will be helping to protect our vitally
important coastal resources.

Hertford County
Project setting
The N. C. Department of Transportation (NC DOT) proposes to replace bridge #29
located on SR 1160 crossing Potecasi Creek south of Murfreesboro in Hertford County, North
Carolina. The existing bridge is ±17' wide and ±156' long and is a one lane bridge. The bridge
is bordered on the downstream (south) side by an approximately 50' wide cut over woodland area
for aerial transmission line right-of-way. This cut over area is vegetated with various wetland
plant species which give way to upland grasses on the road shoulder. Adjacent the cut over area
on the downstream side are wooded wetlands on both sides of the creek. The upstream (north)
side of the site is bordered by wooded wetland on both sides of the creek. The creek is ±126'
wide at the bridge crossing and the vertical clearance under the existing bridge is ±5'. Potecasi
Creek which is classified as C-NSW by the Environmental Management Commission.
Project description
NC DOT proposes to replace an existing ±17' wide by ±156' long bridge with an
approximately 27' wide by ±175' long bridge. The existing bridge which has 7 bents will be
removed and replaced with a new bridge which has 3 bents. Approximately 800 ft2 of high
ground (existing approach fill) will be removed which will increase the horizontal opening under
the bridge from ±156' to ±175'. The existing vertical clearance of ±5' will remain the same.
Anticipated impacts
The project as proposed would result in the excavation of ±800 ft2 of high ground. The
existing bridge has a navigable opening between existing bents of ±20' wide with a vertical
clearance of ±5'. The proposed bridge will have a opening of ±50' wide with a vertical
clearance of ±5' which will enhance navigability while maintaining the existing vertical clearance.
The existing bridge width of ±17' will be increased with the new bridge to ±28'. Localized
turbidity would occur as a result of the construction activities.

SUBJECT: NCDOT Bridge #29, Hertford County Application
The proposed project appears consistent with the rules found in Subchapter 7H.0207
concerning development in Public Trust Areas. The proposed bridge will result in the removal
of 4 bents from the Potecasi Creek by going from the existing 7 down to 3. The existing
horizontal clearance for navigation will increase from ±20' to ±50'. The existing vertical
clearance of 5' will remain unchanged. If the permit is issued I would suggest the following
conditions be placed on the permit;
CONDITIONS
1. The temporary placement or double handling of excavated or fill materials within waters
or vegetated wetlands is not authorized.
- 2. No excavated or fill material will be placed at anytime in any vegetated wetlands or
surrounding waters outside of the alignment of the fill area indicated on the work plat(s).
3. Prior"'any construction activity a silt curtain will be installed below the project site and
will remain until 24 hours after the project has been completed.
4. Appropriate erosion and sedimentation control devices, measures, or structures shall be
used to prevent sediment from entering the adjacent wetlands/watercourses/property (e.g.,
silt fence, diversion swales/berms, sand fence, etc.).

Both of these proposals involve replacing existing bridges with new, wider and longer
bridges at the above-referenced sites. Both involve PTA, AEC's and each proposal comes under
the auspices of the CRC certified July 1991, Hertford County LUP update.
The plan offers the following limited guidance on proposals of this type:
* County policy on hazardous and fragile areas (Page 40-41) note the county
supports"the permitting process of state or federal agencies for fragile areas,
including 404 wetlands." (Much discussion on AEC's and their importance is
noted on pages 6-7 in the data collection and analysis section of the plan).
* County policy on commitment to state and federal programs (page 48) notes the
county believes"highway improvements are of particular concern in areas where
peak traffic loads create a burden on the system. While supporting all state and
federal regulations, the county has no additional polices related to these issues."
The landward portions of both of these sites is shown in the Rural Land Class on the
county's land classification map (page 65). This class (page 64) notes an agarian landscape where
limited urban type services are available. The waterward portion of these proposals is by
definition(as AEC')located in the Conservative Land Class (page 64-65). The county has not
develope any use or performance standards, for the conservation class,which exceed minimum
state criteria for development in AEC's.
My opinion is if these proposals can be accomplished in accordance with applicable AEC
and 404 standards, they will not be inconsistent with the county's 1991 Certified Land Use Plan.

another spanning structure. Bridge #29 is located over2Potecasi Creek, "i he proposed project
would result in the excavation of approximately 800 ft of high ground. Potecasi Creek is
classified as class C, and nutrient sensitive waters (NSW) by the Environmental a lanagernert
Commission.
The shallow water habitat in Potecasi Creek is used by numerous ,,p, ' _>t aeshwater
fish as spawning, rearing, feeding and escape areas. Increased turbidity in tL.. i reds results in
the destniction of spawning habitat, and greatly diminishes egg and fry sur t, To avoid
adverse impacts to spawning populations of inland fish species at the project site, we will not
object to the project as proposed if in-water work is not conducted between March 1 and
September 30.

SUBJECT: CAMA/Dredge and Fill Permit Application for NC DOT bridge project on SR
1160 at bridge#29 over Potecasi Creek,Hertford County.
Staff biologists with the Wildlife Resources Commission have completed a review of the
project with regards to associated impacts on wildlife and fisheries resources in the area. Our
comments are provided in accordance with provisions of the Coastal Area Management Act
(G.S. 113A-100 through 113A-128), and the Fish and Wildlife Coordination Act(48 Stat. 401, as
amended; 16 U.S.C. 661 et seq.).
The applicant proposes to replace bridge#29 located on SR 1160, Hertford County, with
another spanning structure. Bridge#29 is located over2Potecasi Creek. The proposed project
would result in the excavation of approximately 800 ft of high ground. Potecasi Creek is
classified as class C, and nutrient sensitive waters (NSW)by the Environmental Management
Commission.
The shallow water habitat in Potecasi Creek is used by numerous species of freshwater
fish as spawning,rearing, feeding and escape areas. Increased turbidity in these areas results in
the destruction of spawning habitat, and greatly diminishes egg and fry survival. To avoid
adverse impacts to spawning populations of inland fish species at the project site, we will not
object to the project as proposed if in-water work is not conducted between March 1 and
September 30.

Potecasi Creek, located on State Road 1160, near Murfreesboro, Hertford
County, North Carolina.
On January 1, 1992, we renewed general permit No. 198200031, (copy
enclosed) , that authorizes the placement of fill material associated with the
construction, repair, or replacement of bridges across navigable waters and
waters of the United States in North Carolina, including cofferdams,
abutments, foundation seals, piers, temporary construction and access fills,
approach fills, detour fills, and box culvert installation, as part of work
conducted by or in full compliance with the standards and specifications of
the North Carolina Department of Transportation (NCDOT) .
Your proposed work is authorized if you can comply with all permit
conditions. Please read the enclosed permit to prevent an unintentional
violation of Federal law. As this Department of the Army general permit does
not relieve you of the responsibility to obtain any other required approvals,
you should contact appropriate State and local agencies before beginning work.

or about the 75th day. Should there be any questions on this procedural change,

N.C.G.S. 113A-119(b) requires that notice of an application be posted at
the location of the proposed development. Enclosed you will find a "Notice of
Permit Filing" postcard which must be posted at the property of your proposed
development. You should post this notice at a conspicuous point along your
property where it can be observed from a public road. Some examples would be:
nailing the notice card to a telephone pole or tree along the road right-of-way

On/about September 29, 1995 the North Carolina Department of Transportation
(NCDOT) submitted a CAMA Major Development Permit application for the proposed
replacement of bridge# 29 in Hertford County. A permit was required, because
Potecasi Creek, at the site of bridge # 29, was determined to be a Public Trust Water
Area of Environmental Concern per Administrative Code Subchapter 7H.0207.
On October 13, 1995 the Division of Coastal Management (DCM) returned the
application due to discrepancies in the information provided. Corrections have been
made to the application as recommended in DCM's October 13th letter. The revised
MP-1 and MP-5 applications and accompanying drawings are attached. Riparian
landowner notification verifications are also provided.
It is requested that this revised application be processed as soon as possible to
enable the Bridge Maintenance program to upgrade the existing, functionally obsolete
structure in the near future.

I have enclosed a vicinity map and a site drawing for a proposed bridge
replacement in Hertford County. A CAMA Major Development Permit application has
been submitted (effective December 7, 1995) by the NCDOT. As designed, the project
will impact less than 0.1 acre of Section 404 wetlands. The wetland impacts are in the
vicinity of the proposed rip-rapped zones adjacent to the proposed end-bents.
I have visited the site on more than one occasion and have made a wetland
determination. The approximate upland-wetland boundary is depicted on sheets 1 and
2. The predominant community in the bridge study area is a swamp forest and fringe
wetlands associated with Potecasi Creek. Soils are mapped as Bibb and evidence of
saturation within the upper 12 inches for extended periods is apparent.
The Division of Coastal Management wants to insure that the wetland
boundaries in the project area have been properly determined, as evidenced by a COE
tear sheet, concurring with the field determination.
Please provide me with a tear sheet confirming that sheets 1 and 2 properly
depict the wetland boundaries in the bridge vicinity. Call me if you have any questions
or comments.

IS REQUIRED .FROM THE NCDCM UNLESS THE APPLICANT IS A FEDERAL AGENCY. IF
THE APPLICANT IS A FEDERAL AGENCY AND ALL OR PART OF TEE DEVELOPMENT
ACTIVITY IS LOCATED WITHIN AN AEC, A CONSISTENCY DETERMINATION PURSUANT TO

The existing bridge is functionally deficient and is scheduled to be replaced by a
reinforced concrete structure.

have an opportunity to review and comment on the proposal. I have also included a
copy of the CAMA Major Development Permit and engineering drawings which depict
the project in plan view (overhead view). Please review this material at your
