1) In order to protect spawning and juvenile anadromous fish and other species using this
functioning nursery area, no work may take place below normal water level from February 15 - ,
June 30 of any year without prior approval of the Division of Coastal Management in ,
consultation with the Wildlife Resources Commission and the Division of Marine Fisheries. ,

SITE DESCRIPTION
The NC DOT owns and maintains Bridge # 6 at the crossing of SR 1318 and Pollock Swamp ,
approximately 2 miles north of the Town of Edenton, Chowan County.
Pollock Swamp in the vicinity of the SR 1318 bridge is approximately 1200 ft. wide and is forested
with mostly Taxodium distichum (bald cypress), Nyssa aquatica (black gum), Acer rubrum (red maple)
and Magnolia virginiana (sweetbay magnolia). The shoreline adjacent to the existing bridge is
predominately vegetated with the same overstory canopy.
The waters of Pollock Swamp are classified by the Wildlife Resources Commission and the Division
of Marine Fisheries as Inland Waters. These waters are classified by the Division of Environmental
Management as CSW. The waters of Pollock Swamp are classified as Public Trust Waters by the Division
of Coastal Management and is a part of the Estuarine System Area of Environmental Concern.
Flow data are not readily available on Pollock Swamp although a very slow flow was observed on
October 17, 1995. The existing channel of Pollock Swamp is often choked with Limna spp. (duckweed).
No submerged aquatic vegetation were noted during this investigation although emergents such as Saururus
cernuus (lizards tail) and Polygonum amphibium (water smart weed) were present adjacent to the channel
area and as groundcover in the adjacent swamp.
The submitted plat work on NC DOT Bridge # 6 indicates the existing bridge is 19.2 ft. in width
and 69 ft. in length, a mid-point water depth of - 6.0 ft. and a vertical clearance over Public Trust Waters
of 4.5 ft. at normal water level conditions.
During a field investigation on October 17, 1995 the channel water depth and vertical bridge
clearance at the mid-point location of the bridge was 5 ft. 2 in. and 4 ft. respectively. The bridge is
constructed of asphalt-covered wood planking supported by nine wood/concrete piles. The adjacent
shorelines are stabilized with natural vegetation.
PROPOSED WORK
The DCM received an application on October 6, 1995 from the NC DOT requesting authorization to
replace the existing bridge No. 6. NC DOT proposes to remove and replace the wooden bridge at Pollock
Swamp with a 24 ft. wide reinforced concrete structure. The proposed 105 ft. long bridge structure consist
of three 35 ft. long prestressed concrete spans supported on two 15 inch diameter bent piles. The proposed
structure would provide a clearance over Public Trust Waters of about 4.0 ft. at normal water level
conditions. Both existing approaches to Bridge # 6 would be widened to 36 ft. in width for a distance of
40 ft. from the proposed bridge structure.
SR 1318 will be closed for the duration of the project. No temporary bridge bidge access will be
needed.

ANTICIPATED IMPACTS
NC DOT Bridge #6 has no known historical significance. The proposed project would require the
placement of piles and fill which will directly impact and freshwater wetlands and Public Trust Waters. The
new bridge structure would result in the filling of 600 sf. and the shading of 960 sf. of Public Trust Waters
as well as the filling of 45 sf. of freshwater wetlands. Access to Public Trust Waters would be impacted
by the proposed one-half ft. reduction in vertical clearance.
Construction of the proposed project would temporarily increase turbidity within the stream channel
and downstream. The NC DOT has not offered any compensation for the projected wetland or Public
Trust losses or impacts.
CAMA REVIEW
The proposed development falls within the purview of the Chowan County Land-Use Plan. In its
plan, the County expresses support for various state and federal programs, especially NC DOT road
improvements. The County relies on existing regulations when dealing with impacts to the AEC's that can
be permitted by regulatory agencies. If these permitting agencies issue a permit for the proposed work, it
would be consistent with the Chowan County Land-Use Plan.

The new bridge structure will be the same alignment as the
existing bridge. The proposed structure will reduce the current
clearance by 0. 5 ft, NWL. The proposed project, through filling,
will directly impact 45 sf. of freshwater wetlands and 600 sf. of
Public Trust Waters. The new bridge would shade a total of 960 sf.
of Public Trust Waters.
I recommend approval of this proposed project with the
following conditions.
1) This project will require a site erosion plan ;
2) All fill material will be obtained from an upland source
and will be clean and free of any pollutants, except in
trace quantities ;
3) All fill, construction materials and construction
equipment shall be contained within the approved
construction site ;
4) Appropriate erosion and sedimentation control devices,
measures or structures shall be used to prevent sediment
from entering the adjacent marsh and estuarine waters ;
5) Ground cover sufficient to restrain erosion shall be
provided within 30 working days of completion of any
phase of grading on cut or filled slopes ;
4 6) Activities will be conducted in such a manner as to
prevent significant increase in turbidity outside the
construction area ;

7) In order to protect juvenile finfish populations, no
excavation or filling will be permitted between
t February 15 and September 30 of any year without prior
approval of the Division of Coastal Management in
consultation with the Division of Marine Fisheries ;
8) In the event that significant archaeological resources
are found present within the boundaries of this proposed
permit area, the permittee shall notify the Division of
Coastal Management and develop a cultural resources
management plan in consultation with the Division of
Archives and History for the effective long-term
management of such resources.

Staff biologists with the Wildlife Resources Commission have reviewed this permit
application and are familiar with habitat values in the project area. Our comments are provided
in accordance with provisions of the Coastal Area Management Act(G.S. 113A-100 through
113A-128), and the Fish and Wildlife Coordination Act(48 Stat. 401, as amended; 16 U.S.C.
661 et seq.).
NCDOT proposes to replace wooden bridge# 6 on SR 1318 with a concrete span bridge.
The project as proposed will fill 45 square feet of vegetated wetlands, 600 square feet of public
trust waters (PTW), and shade 960 square feet of PTW. Additionally, the project will reduce the
vertical bridge clearance by 0.5 feet.
The project as proposed has the potential to adversely effect fish and wildlife habitat in
Pollock Swamp. Wetlands such as those found on this site provide functions which benefit the
public as well as fish and wildlife. Wetlands act as a stormwater runoff purification zone
between upland areas and surface waters. Wetlands store and convey flood waters and provide
shoreline erosion protection through attenuation of wave energy. Wetlands also serve as a
physical habitat for numerous species of amphibians, reptiles ,birds, and mammals. In some
instances, wetlands serve as spawning areas for anadromous fish. Through deposition of detritus
into adjacent waters, wetlands contribute large quantities of organic carbon, forming the food
chain base and the resulting biological productivity for many aquatic ecosystems.

The shallow water habitat in Pollock Swamp is used by numerous species of anadromous
• freshwater fish(specifically herring)as spawning, rearing, feeding, and escape areas. Because of
the project's potential to adversely impact fish and wildlife in Pollock Swamp,we request that no
in-water work be performed form March 1 to September 30. Impacts to fishery resources will be
minimized if work is not undertaken during this critical spawning and rearing period.

provided pursuant to General Statute 113-131.
Pollock Swamp functions as_ a spawning and nursery area for blueback herring and
alewife. The utilization by these species have been documented by the Division in various
federal aid reports. Other commercially and recreationally important species also utilize the
area. This agency requests a moratorium associated with the removal and replacement of the
bridge. The requested time period is 15 February through 30 June. This will ensure the
environmental integrity of the area is protected during et—altieal time of usage by the
previously mentioned species.

The enclosed permit constitutes authorization under the Coastal Area Management Act, and where
applicable, the State Dredge and Fill Law, for you to proceed with your project proposal. The original (buff-
colored form) is retained by you and it must be available on site when the project is inspected for compliance.
Please sign both the original and the copy and return the copy to this office in the enclosed envelope. Signing
the permit and proceeding means you have waived your right of appeal described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS 113A-
121.1 or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the
Office of Administrative Hearings, P.O. Drawer 11666, Raleigh, NC 27611, (919) 733-2698 within twenty (20)
days of this decision on your permit. You should also be aware that if another qualified party submits a valid
objection to the issuance of this permit within twenty (20) days, the matter must be resolved prior to work
initiation. The Coastal Resources Commission makes the fmal decision on any appeal.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must
be carried out in accordance with your application. Modifications, time extensions, and future maintenance require
additional approval. Please read your permit carefully prior to starting work and review all project plans, as
approved. If you are having the work done by a contractor, it would be to your benefit to be sure that he fully
understands all permit requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we request
that you complete and mail the enclosed Notice Card just prior to work initiation. However, if questions arise
concerning permit conditions, environmental safeguards, or problem areas,you may contact Department personnel
at any time for assistance. By working in accordance with the permit, you will be helping to protect our vitally
important coastal resources.

The Division of Coastal Management hereby acknowledges receipt of your application
for State approval for development of property located at SR 1318 and Pollock Swamp, north
of Edenton, Chowan County. It was received on October 6, 1995, and appears to be
adequate for processing at this time. The projected deadline for making a decision is
December 20, 1995. An additional 75-day review period is provided by law when such time
is necessary to complete the review. If you have not been notified of a final action by the
initial deadline stated above, you should consider the review period extended. Under those
circumstances, this letter will serve as your notice of an extended review. However, an
additional letter will be provided on or about the 75th day.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of
the proposed development. Enclosed you will find a "Notice of Permit Filing" postcard
which must be posted at the property of your proposed development. You should post this
notice at a conspicuous point along your property where it can be observed from a public
road. Some examples would be: Nailing the notice card to a telephone pole or tree along the
road right-of-way fronting your property; or at a point along the road right-of-way where a
private road would lead one into your property. Failure to post this notice could result in an
incomplete application.
An onsite inspection will be made, and if additional information is required, you will
be contacted by the appropriate State or Federal agency. Please contact me if you have any
