This permit, issued on 2/10/20 , is subject to compliance with the application(where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action;or may cause the permit to be null and void. 1) Unless specifically altered herein, this Minor Modification authorizes a change in the demolition methodology for the piles of Bridge Bents 88-102 of the Herbert C. Bonner Bridge from jetting/removing the piles in their entirety to cutting off piles at the mudline, as depicted on the attached workplan drawings. 2) No new vegetated wetlands, submerged aquatic vegetation, or waters of the State shall be excavated or filled, without permit modification. NOTE: The specific development being permitted does not preclude the remainder of the B-2500 project being built in the Pamlico Sound provided that future development will be constructed in a way that avoids and minimizes impacts to the AECs. Department of Transportation Permit#106-12 Page 2 of 2 ADDITIONAL CONDITIONS 3) Nothing in this Minor Modification authorizes any activity that has not received approval from the National Park Service (NPS) for work within the Cape Hatteras National Seashore. The proposed work shall not commence until the permittee has been issued a Special Use Permit from the NPS,if required, and a copy of the Special Use Permit is received by DCM. 4) NCDOT shall monitor the cut piles (Bents 88-102) at least once a year in the spring for 10 years to ensure that they all remain at or below the mudline. NCDOT shall provide the results of these annual surveys to DCM in a brief written report. In addition, if NCDOT or DCM become aware of any remnants of cut piles that become exposed at any time in the future,NCDOT shall coordinate with DCM and other appropriate resource agencies to determine if removal is necessary to avoid potential navigational hazards. 5) After project completion, NCDOT shall provide DCM with an as-built survey that includes the GPS coordinates of each cut pile that remains in place, the depth of the water at the location where the pile was cut, the vegetative community type at the location where the pile was cut, and the height at which the pile was cut in relation to the mudline. 6) Materials and/or debris resulting from cutting of the piles shall not enter wetlands or waters of the State, even temporarily. 7) If it is determined that additional permanent and/or temporary impacts are necessary that are not shown on the attached work plan drawings or described in the authorized permit application, a permit modification and/or additional authorization from DCM shall be required. In addition, any changes in the approved plan may also require a permit modification and/or additional authorization from DCM. The permittee shall contact a representative of DCM prior to commencement of any such activity for this determination and any permit modification. NOTE: The permittee and/or its contractor is encouraged to contact the DCM Transportation Project Coordinator in Elizabeth City at(252) 264-3901 to request a preconstruction conference prior to project initiation. 8) This Minor Modification does not eliminate the need to obtain any additional permits, approvals or authorizations that may be required. This includes approval, if required, from the U.S. Coast Guard and the N.C. Division of Water Resources (DWR). 9) This Minor Modification shall be attached to the original of Permit No. 106-12, which was issued on 9/19/12, as well as all subsequent modifications, and copies of all documents shall be readily available on site when a Division representative inspects the project for compliance. 10) All conditions and stipulations of the active permit remain in force under this Minor Modification unless altered herein. Pile Extraction Methodology Change The North Carolina Department of Transportation(NCDOT)requests a modification of the above referenced permits due to pile extraction methodology changes related to the demolition of the existing Herbert C. Bonner Bridge(Bonner Bridge).NCDOT is proposing pile extraction methodology changes between Bonner Bridge Bents 88-102(Permit sheets 11 and 12). Cut-off piles from Bents 88 to 102—Supplemental Information In the request letter dated January 7,2020,NCDOT requested a modification of the above referenced permits for a pile extraction methodology change in the region covering Bents 88 to 102. The request was to change from the authorized jetting method to cutting off piles at the mudline due to shallow water depths preventing the use of a barge-mounted floating assist crane and other barge-mounted marine equipment. The contractor observed that current water depths in the region that includes Bents 88 to 102 are only 1 to 5 feet. In addition,Condition 20 of CAMA Permit No. 106-12 requires"Existing bridge pilings in SAV areas and wetlands shall be cut off at the mudline.” Although SAV's have not been observed in the area of Bents 88 to 102,the current shallow water depths of the site and SAV's in the project vicinity indicate this area would be suitable SAV habitat. The authorized jetting method of removing the existing bridge piles would impact the pile locations with jetting spoil and depressions. The proposed method of cutting off piles at the mudline would have minimal impact on the potential SAV habitat by not producing jetting spoil nor depressions on the bottom. The piles are extracted by means of jetting the full depth of the pile and then lifting the pile using a crane. However, as work has progressed from north to south,the Design-Build Team observed that current water depths in the region that includes Bents 88 to 102 are only 1 to 5 feet. These shallow water depths affect the ability to fully extract the existing bridge piles by the current jetting method. The current permit requires pile jetting and containment from Bent 88 through Bent 186 of the existing Bonner Bridge. The jetting method requires the use of a barge-mounted floating assist crane and other barge-mounted marine equipment;the barges cannot access areas where the water depths are so shallow,and dredging is not allowed in the current permit. On November 25,2019,the Design Build Team took water depth measurements in the region covering Bents 88 and 122(see enclosure).Based on this information,the Design Build Team determined that the preferred pile extraction methodology in the region covering Bents 88 to 102 should be changed from jetting to cutting off piles at the mudline. There would be no changes to permanent impacts from the modification of the proposed pile extraction methodology. If the foundation has a pile cap then the cap would be in the water- 1.0'based on the mean high water elevation,so the cap dimensions were used instead of the individual pile sizes(giving us a larger footprint). If the foundation has 54"circular piles with no pile cap then the pile surface area was used to calculate the impact, plus a small area immediately around the pile. **The impacts for the removal of the existing bridge were calculated using the pile window(the extent that the piles project into the water)and not individual pile sizes. The demolition/pile removal in wetlands was considered "Temporary Fill"because"Temporary Excavation"is not a category. NC DEPARTMENT OF TRANSPORTATION *** Impacts for the temporary work trestle,work bridge, and work platform were calculated as pile impacts. The piles being proposed are 36"circular piles The work trestle. platforms, and bridge all require two piles per span and spans will be spaced every 40 feet apart. The boardwalk impacts are calculated as the entire footprint of the 10'wide boardwalk. Impacts for the trestle and breasting lines installed to remove the existing bridge were calculated as 36"pipe piles with the number of piles needed called out on the plan sheet. The request is for changes to pile extraction methodology related to demolition of the existing Herbert C. Bonner Bridge (Bonner Bridge), which is part of the replacement of Bridge No. 11 over Oregon Inlet on NC Hwy 12, TIP No. B-2500 Phase I, in Dare County. The current permit requires full extraction of existing bridge piles in the region that includes Bent 88 through Bent 102. Extraction by means of jetting requires the full depth of the pile to be jetted,then lifting the pile using a crane. NCDOT states as work has progressed from north to south, the Design-Build Team observed that current water depths in the region that includes Bents 88 to 102 are only 1' to 5' and the shallow water depths affect the ability to fully extract the existing bridge piles by the currently authorized jetting method. The authorized jetting method requires the use of a barge-mounted floating assist crane and other barge-mounted marine equipment; the barges cannot access areas where the water depths are shallow, and dredging is not allowed in the current permit. NCDOT states jetting the piles out from the top- down operation utilizing the existing portion of Bonner Bridge would require two cranes, one crane to support the cap and pile structure and one crane to support the jetting equipment. The existing bridge currently under demolition only has the room/weight capacity for one crane, making a two-crane system not feasible with the current demolition operation. According to NCDOT,the Design Build Team requests that the pile extraction methodology related to Bents 88 to 102 be changed from jetting to cutting off piles at the mudline. Bonner Bridge (Bonner Bridge), as depicted on the attached work plan drawings. Due to the dynamic coastal processes of Oregon Inlet, it is possible that the cut piles that are left in place could become exposed above the mudline in the future if scour occurs in the area. If this occurs, it could present a hazard to public trust usage. For that reason, NCDOT should monitor all cut piles related to the demolition of the existing bridge iin.. open water at least once a year in the spring for 10 years to ensure that they all remain at orbelow the mudline. NCDOT will provide the results of these annual surveys to DCM in a brief written report. In addition, if NCDOT or DCM become aware of any remnants of cut piles associated with the demolition of the existing bridge that become exposed at any time in the future,NCDOT shall coordinate with DCM and other appropriate agencies to determine if removal is necessary to avoid potential navigational hazards. If it is determined that additional permanent and/or temporary impacts are necessary that are not shown on the attached work plan drawing(s)or described in the authorized permit application, a permit modification and/or additional authorization from the N.C. Division of Coastal Management(DCM) shall be required. In addition, any changes in the approved plan may also require a permit modification and/or additional authorization from DCM. The permittee shall contact a representative of DCM prior to commencement of any such activity for this determination and any permit modification. Debris/material resulting from the cutting of the piles shall not enter wetlands or waters of the State, even temporarily. 5. I could see a scenario where 1 foot below is ail they can do without a lot of excavation for the equipment. If they could go two feet I would thing that shcLid be plenty sufficient, but obviously the issue in this area is how dynamic it is. One storm and it could expose the remaining piles or cover them with two feet of sand you just don't know. The applicant is modifying the removal methods of bents 88-102 of the old Bonner Bridge over Oregon Inlet. DMF's role is to comment on impacts to fisheries and habitat as well as commercial and recreational fishing and navigation. DMF has concerns for both of these when talking about cutting off bent piles at the mudline. From a navigation standpoint, this area is a highly dynamic system directly adjacent to the inlet complex. Over time,the depths of the area have varied from short term and long-term environmental impacts and will likely continue to do so. If these bent pilings are cut at the mudline and then exposed at a later date, they could cause a navigation concern. DMF would recommend that the NCDOT have a long- term plan to monitor these pilings over time and address any problems in the future if these cut off bents become exposed in the future. Additionally,depths of 1-5 Feet are ideal for SAV which mapping shows occur near site of the piling removal. Cutting these pilings right at the mudline may have a negative effect on the SAV that could potentially occur now that there aren't shading impacts. DMF would recommend that the pilings be cut slightly below the mudline (-12 inches) so that natural infill may occur and provide substrate habitat for SAV rhizome growth, if possible. I'm aware that these areas are in close proximity to the existing bridge, the likelihood of boating activity in that area is small, and the impact area of a few pilings is negligible in scale of the whole project area, however these are just some of the potential concerns that DMF would like to be addressed. At this time, NCDOT and the contractor(PCL) have not determined the best coarse of action to take on the marine demolition of the bridge in the vicinity of the fender system, but the contractor will complete the top—down demolition to Bent 87 by the end of January. In order to avoid delaying the top—down demolition and idling the work crew,the request to authorize the pile cutting from Bents 88—102 is attached. Any requests to modify the permits for the marine demolition are not expected to be submitted in the near future. For your convenience, I am providing the following additional information from the DCM-Raleigh files in case it is helpful to your review: • Condition No. 20 of the original CAMA Permit 106-12 that was issued on 9/19/12 states as follows: "Pilings in open water from the existing bridge and the temporary work trestles shall be removed in their entirety, except that in the event that a bridge piling breaks during removal and cannot be removed in its entirety, DCM shall be notified to determine an appropriate course of action. Existing bridge pilings in SAV areas and wetlands shall be cut off at the mudline." • Because the NCDOT submittal does not include a profile drawing of the area, I have attached the original profile drawing for this area dated 6/22/12 that was submitted by NCDOT with the original permit application. Although it does not provide labels for the old bridge bent numbers, it depicts the new bridge bent numbers along with the station numbers, mean high water, mean low water, existing ground elevation, long term bed elevation, total scour, etc. • From my rough calculations, it appears as though the linear distance from Bent 88 to Bent 102 is approximately 900 feet. • When CAMA Permit 106-12 was issued on 9/19/12, the estimated permanent impacts to SAV's due to shading effects was 2.66 acres from the new bridge. DOT received SAV mitigation credit of 1.38 acres due to the areas that would be un-shaded by removal of the old bridge. This left 1.28 acres of net impacts to be mitigated off-site. Your agency's comments would be appreciated, if it is relevant to your agency, regarding whether this NCDOT proposal may or may not influence the project's approved SAV mitigation plan.
