This permit, issued on August 3,2020 , is subject to compliance with the application (where consistent with the permit), all applicable regulations,special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action;or may cause the permit to be null and void. TIP No. B-2500,Phase I 1) Unless specifically altered herein,this Minor Modification authorizes the following: an additional breasting line (S-3) approximately 400 linear feet on the east side of the Marc Basnight bridge; extension of the temporary South Dock sheet pile wall by approximately 50 linear feet, and the use of four additional existing artificial reefs (AR-320,AR-340, AR-250 and AR-255) for deployment of bridge demolition material when conditions prevent deployment through Oregon Inlet, all as depicted on the attached workplan drawings. NOTE: The specific development being permitted does not preclude the remainder of the B-2500 project being built in the Pamlico Sound provided that future development will be constructed in a way that avoids and minimizes impacts to AECs. Department of Transportation Permit No. 106-12 Page 2 of 3 ADDITIONAL CONDITIONS 2) All work authorized by this permit shall be carried out in accordance with the following attached workplan drawings (14), except as modified herein: 6 dated 6/2/20; 3 dated as received 6/18/20;2 dated 6/5/20; 2 dated 5/29/20; and 1 dated as received 7/14/20. 3) The permittee shall continue to utilize the previously authorized existing artificial reef disposal locations (AR-130, AR-140,AR-145, and AR-160) for bridge demolition material to the maximum extent practicable in accordance with the original plan. NOTE: The South Dock steel sheet pile wall extension will result in approximately 300 square feet of temporary surface water impacts due to fill, and the additional breasting line (S-3) will result in approximately 78 square feet of additional temporary surface water impacts. 4) No excavation or filling shall take place at any time in any vegetated wetlands or surrounding waters outside of the alignment of the areas indicated on the attached workplan drawings, without permit modification. 5) The authorized South Dock steel sheet pile wall extension shall be structurally tight so as to prevent seepage of fill materials through the structure. 6) The installation and removal of piles for the temporary breasting line S-3 shall be accomplished by jetting,pile driving and/or the use of a vibratory hammer. Should the permittee and/or its contractor propose to utilize another type of pile installation, additional authorization from DCM shall be required. 7) The installation and removal of piles for the South Dock steel sheet pile wall extension shall be accomplished by pile driving and/or the use of a vibratory hammer. Should the permittee and/or its contractor propose to utilize another type of pile installation, additional authorization from DCM shall be required. 8) The breasting line S-3 and South Dock steel sheet pile wall extension shall be removed in their entirety immediately after they are no longer needed, or within 30 days of written notification from DCM, whichever comes first, and disposed of at an approved high ground location. 9) No sewage, whether treated or untreated, shall be discharged at any time from any vessels using the authorized facilities. 10) The permittee shall exercise all available precautions in the day-to-day operation of the facility to prevent waste from entering the adjacent waters and wetlands. 11) The permittee and/or its contractor shall provide for proper storage and handling of all oils, chemicals, etc.,necessary to carry out the project. 12) Construction staging areas shall be located only in upland areas, and not in wetlands or waters of the State. 13) The permittee and/or its contractor is encouraged to contact the DCM Transportation Project Coordinator in Elizabeth City to request a preconstruction conference prior to project initiation. Department of Transportation Permit No. 106-12 Page 3 of 3 ADDITIONAL CONDITIONS 14) This permit authorizes only the structures that are expressly and specifically set forth in the permit application or depicted on the attached workplan drawings. No other structures, whether floating or stationary,may become a part of the facilities authorized by this Minor Modification without additional authorization from DCM. No non-water dependent uses of structures may be conducted on, in, or over public trust waters without permit modification. 15) The permittee shall install and maintain, at its expense, any signal lights, signals, signage, or notifications prescribed by the U.S. Coast Guard, through regulations or otherwise, on the authorized breasting line S-3. At a minimum,permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 16) In accordance with commitments made by the permittee, barges moored at the authorized breasting line S-3 shall not be located within the current USACE authorized 400' wide dredge channel. 17) No attempt shall be made by the permittee to prevent the use by the public of all navigable waters at or adjacent to the authorized work following completion of construction and demolition activities. 18) If it is determined that additional permanent and/or temporary impacts are necessary that are not shown on the attached workplan drawings or described in the authorized permit application, a permit modification and/or additional authorization from DCM may be required. In addition, any changes in the approved plan may also require a permit modification and/or additional authorization from DCM. The permittee shall contact a representative of DCM prior to commencement of any such activity for this determination and any permit modification. 19) The N.C. Division of Water Resources (DWR) authorized the additional breasting line (S-3)on 7/16/20 (DWR Project No. 20160186 v.3)under General Water Quality Certification No. 4141. Any violation of the Certification approved by DWR shall be considered a violation of this CAMA permit. NOTE: The U.S. Army Corps of Engineers authorized the additional breasting line under Nationwide Permit Number 33 (COE Action ID No. SAW-1993-03077), which was issued on 7/27/20. NOTE: This Minor Modification does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. 20) Nothing in this Minor Modification authorizes any activity that has not received approval from the National Park Service(NPS) and/or the United States Fish and Wildlife Service (USFWS), if required, for work within the Cape Hatteras National Seashore and/or the Pea National Wildlife Refuge. 21) This Minor Modification shall be attached to the original of Permit No. 106-12, which was issued on 9/19/12, as well as all subsequent modifications, and copies of all documents shall be readily available on site when a Division representative inspects the project for compliance. 22) All conditions and stipulations of the active permit remain in force under this Minor Modification unless specifically altered herein. NOTE: A minor modification application processing fee of$100 was received by DCM for this project. As a result of recent discussions with Dare County and NCDMF,NCDOT requests the addition of existing artificial reefs AR-250 and AR-255 to the list of authorized deployment sites for the 55%of bridge demolition materials originally permitted for AR-160. AR-250 and AR-255 are in Federal Waters south of Ocracoke,and deployment to these sites would be a shorter transit route than the long routes taken to the artificial reef sites off Oregon Inlet. This would result in AR-160,AR-320,AR-340,AR- 250,and AR-255 authorized to accept 55%of the Bonner Bridge demolition material. Currently,NCDOT is permitted under this CAMA Permit to dispose of bridge demolition material to AR-130,AR-140,AR-145,and AR-160 outside of Oregon Inlet and offshore of Dare County. Through a partnership between NCDOT and NCDMF's Artificial Reef Program,these 4 artificial reef sites were also authorized for bridge demolition with permits issued to NCDMF. Unfortunately,deployment of bridge demolition to these artificial reef sites has been logistically challenging and costly in the last several months due to shoaling at the Oregon Inlet Ocean Bar. In late 2019,shoaling at the Oregon Inlet Ocean Bar started to impede the deployment of bridge demolition material to AR-130,AR-140,AR-145,and AR-160 through Oregon Inlet. Due to the high demand for the limited US Army Corps of Engineers(Corps)dredging assets and inclement ocean conditions at the Oregon Inlet Ocean Bar,the dredging efforts at Oregon Inlet have been sporadic and unpredictable in the last 12 months. In the spring of 2020,the shallow conditions of the Oregon Inlet Ocean Bar prevented tugboats from deploying bridge demolition barges though Oregon Inlet. During this time,NCDOT and Dare County provided supplemental funding to the Corps to prioritize dredging efforts in Oregon Inlet. Those efforts have been inadequate in maintaining a sufficiently deep channel for the tugboats and barges,and alternate routes to the artificial reefs were initiated. Since December 2019,the demolition barges without overhanging debris material are traveling through the intercoastal waterway to Norfolk and back down the coast(200 miles one way)to the permitted reef sites,and barges with overhanging debris material are traveling through the Pamlico Sound to Morehead City and back up the coast(220 miles one way)to the permitted reef sites. From December 21,2019 to June 28,2020, 16 barges loads have been forced to utilize one of the long routes to deploy bridge demolition to the four permitted artificial reefs sites,incurring additional direct costs of$528,000 to the project. Furthermore, the very long barge routes to the artificial reefs and inclement ocean conditions have impacted the time to complete the reef deployments and keep empty barges available on the project. The empty barges are needed on the project such that demolition work is not stopped for lack of space to stage the demolition debris. The NCDOT anticipates additional requests from the contractor for direct and indirect delay costs and stand-by costs they have incurred due to the impacts to the demolition work and the tugboats' transits. The NCDOT estimates 32 barge loads remain to be deployed to the artificial reef sites. If all the remaining barge loads are taken to the four previously permitted reef sites via one of the long transit routes in addition to the 16 barge loads mentioned above; the NCDOT would incur approximately$2,680,000 of direct additional costs from the Contractor for the 48 loads. The indirect costs are currently estimated at$1,600,000 for the 48 barge loads. Therefore,the use of the long routes could cost the NCDOT approximately$4,280,000 if not more. Utilizing reef sites AR-320 and AR-340 would reduce the anticipated costs to NCDOT by approximately 50%. With NCDOT's current limited funding condition,the additional costs and logistic difficulties have led NCDOT and the contractor to explore alternative disposal options. While reviewing and estimating the costs of the limited disposal options,deploying to alternate reef sites would be much more cost effective and effective for marine habitat enhancement than land disposal. Secondly, utilizing the alternate reef deployment sites is more cost effective than having the project in a delayed or stand-by status until the Oregon Inlet Ocean Bar is navigable or waiting for ocean conditions to be conducive for the very long transit routes to the reef sites offshore of Oregon Inlet. The NCDOT has requested a modification of the CAMA Permit to use artificial reef sites AR-320 and AR-340 as deployment sites in addition to the current four artificial reefs. NCDOT proposes that AR-320,AR-340,and AR-160 combined would receive up to 55%of the bridge materials,not to exceed the maximum permitted tons conditioned by the permits issued to NCDMF for the sites.As of May 23,2020,AR-160 has received 22.4%(17,245 tons)of bridge demolition. With the AR-320 and AR-340 sites outside of Morehead City,these artificial reefs are not the preferred sites for the Bonner Bridge demolition material. However,when conditions at the Oregon Inlet Ocean Bar prevent deployment of tugboats and barges through Oregon Inlet, only then would AR-320 and AR-340 be utilized. The Corps is currently dredging at Oregon Inlet,but only for a limited time. With conditions at the Oregon Inlet Ocean Bar unpredictable,it is essential for NCDOT to have alternative artificial reefs sites available to efficiently conduct demolition of the Bonner Bridge. With this letter,NCDOT formally requests NCDMF's support in utilizing artificial reef sites AR-320 and AR-340 for deployment of bridge demolition material from the Bonner Bridge in Dare County. The NCDOT is aware of opposition from organizations within Dare County of this material being placed within artificial reefs offshore of other counties. However, it is imperative that the demolition phase of the bridge project not be delayed and additional costs to the NCDOT be limited while alternative artificial reef sites are available for bridge demolition debris. The B-2500 Bonner Bridge Replacement Project has been exceedingly complicated and costly, and a cost-effective completion of the project is a high priority for the NCDOT. Additionally,NCDOT is specifically requesting a CAMA permit modification for the use of additional artificial reef disposal locations for bridge demolition material. All requested changes are necessary for the demolition of the existing Herbert C.Bonner Bridge(Bonner Bridge). Additional Breasting Line(S-3) The Design-Build Team has determined a need for an additional breasting line to establish a new safe harbor for their crane/barges,as it has been difficult accessing the current safe harbor locations at breasting lines S-1 and S-2(Figure 1-Aerial Map).The Crofton 4600 crane/barge has been tied up at the remnant bridge/fishing pier,and if shoaling continues in the area access may be cut off to the existing breasting lines.Barge access to the existing breasting lines has been limited by shallow water depths due to the formation of a recent sand bar in this area(Figure 2—USACE Hydrographic Survey of Oregon Inlet Spit).The proposed breasting line(S-3)would be located in an area with water depth levels greater than 12 feet,allowing tugboats and the crane/barge system to easily maneuver to this accessible safe harbor.The proposed breasting line(S-3)will be approximately 400 feet in length,and is composed of eleven 36"diameter piles at 40 foot spacing.The included revised permit drawings show the additional proposed breasting line on permit sheet 6A,and Table 1 describes the location. The safe harbor location for the additional breasting line must be located on the east side of the Marc Basnight bridge to eliminate the extraneous breakdown of the Crofton 4600 crane/barge for it to pass under the navigational height clearance of the Marc Basnight bridge. Table 1. The largest barge that would utilize the breasting line is 75 feet at its widest point. Barges moored at the proposed breasting line would not be located within the current USACE authorized 400' wide dredge channel. The proposed breasting line(S-3)would be in use until demolition is complete,which is anticipated to be approximately one year,and removed along with other breasting lines at the completion of the project. South Dock Sheet Pile Wall Extension The Design-Build Team has determined the need to extend the existing steel sheet pile wall at the South Dock.This proposed change is focused on temporary shoreline protection and stabilization where the western edge of the land-based ramp abuts the existing steel sheet pile wall. This area around the South Dock and former ferry ramp has experienced a gradual erosion since the 1990s,and the past three years of shoreline erosion around the South Dock(June 2017—May 2020)are illustrated on Permit Sheet 5A. The proposed steel sheet pile wall extension will run 50 feet in length in a northeast direction from the end of the existing sheet pile wall on the east side of the former ferry ramp.The current sheet pile wall is approximately 70 feet in length,and the combined total sheet pile wall at the South Dock would be 120 feet. The end coordinates of the sheet pile wall are 35.766200°,-75.525300°and a profile view is included in the enclosed updated permit sheets. Alternate Artificial Reef Deployment Site In late 2019,shoaling at the Oregon Inlet Bar started to impede the deployment of demolition material to AR-130,AR-140,AR-145,and AR-160 through Oregon Inlet(Figure 3-USACE Hydrographic Survey of Oregon Inlet Bar).Due to the high demand for limited Corps dredging assets and inclement ocean conditions at the Oregon Inlet Bar,the dredging efforts at Oregon Inlet have been sporadic and unpredictable in the last 12 months.In the spring of 2020,the shallow conditions of the Oregon Inlet Bar prevented tugboats from deploying bridge demolition barges though Oregon Inlet. All four of the permitted artificial reef sites are located in the Atlantic Ocean on the east side of the bridge(Figure 4— DMF Artificial Reef Locations),and are currently inaccessible to the tugboat/barge demolition equipment through Oregon Inlet.At this time,the barges without overhang are traveling through the intercoastal waterway to Norfolk and back down the coast to the permitted reef sites(200 miles one way)(Figure 5— Towing Routes). The barges with overhang are wider and must travel through the Pamlico Sound to Morehead City and back up the coast to the permitted reef sites(220 miles one way)(Figure 5—Towing Routes). This logistic difficulty has led the Design-Build Team and NCDOT to explore alternative artificial reef deployment sites. Per the project commitments listed in the ROD(#6),Division of Marine Fisheries(DMF)has permitted the reef disposal activities themselves and have overseen the disposal operations.As stated in the original CAMA Major Permit,the closest reef site,AR-160 which is in state waters,was anticipated to receive" more than 55% of the bridge materials,and the other three sites(AR-140,-145,-160)located in federal waters were anticipated to each receive at least 15%of the bridge materials(Table 2), subject to continued coordination with the Division of Marine Fisheries(DMF).In late 2019,the Design-Build Team,NCDOT,and DMF determined the artificial reef site,AR-320 could accept bridge disposal material and is currently permitted to accept up to 4,000 tons.AR-320(Clifton Moss Reef)is located in the Beaufort area in the Cape Lookout Region and is accessible by navigating south through the sound side of the North Carolina barrier islands(Figure 6—DMF Alternative Deployment Sites).DMF has provided a delineated area proposed for the Design-Build Team to deploy demolition materials to at AR- 320(Figure 7—AR-320 Bonner Deployment).A second artificial reef site that could be used to accept bridge demolition is AR-340(J.Paul Tyndall Reef).AR-340 is located in federal waters,and DMF would submit a PCN to the Corps and NCDWR for authorization to accept up to 25,000 tons of bridge demolition material. The Design-Build Team is requesting a modification of the CAMA Permit to use AR-320 and AR-340 as deployment sites in addition to the current four artificial reefs.NCDOT proposes that AR-320,AR-340 and AR-160 combined will receive up to 55%of the bridge materials,not to exceed the maximum permitted tons conditioned by the permits issued to DMF for the sites. The remainder of the sites(AR- 130,AR-140,and AR-145)would still receive 15%of bridge demolition material each. Please see Table 2 for the current distribution of demolition material delivered to each artificial reef. Due to the lack of available land in the vicinity of the project,and with most land being owned by National Park Service(NPS)and United States Fish and Wildlife(USFWS),it is not feasible to stage large bridge material for crush/reduction and delivery to other DMF shallow artificial reefs and/or for land disposal.Additional staging/processing areas would be required,and temporary disturbance to the National Park and/or Wildlife Refuge would require approvals that are likely not feasible when a practicable alternative is available.Furthermore,the estimated cost to deploy bridge materials to AR-320 is approximately 30%of that required for land disposal,which also does not fulfill the ROD commitments for artificial reef disposal. Summary Table of Impacts For comparison,Table 3 is an abbreviated version of the surface water and wetland impacts at Site 3 and Site 6.At Site 3,temporary fill in surface water would be 300 square feet as a result of the 1-foot wide sheet pile wall,and a buffer installation/removal area.The total temporary surface water impacts at Site 3 remains unchanged at less than 0.01 acres.No additional wetland impacts are anticipated to occur at Site 3 as the sheet pile wall is located within the permitted excavation/mechanized clearing area.At Site 6, 11 piles at 36-inch per pile result in a 78 square foot additional temporary surface water impacts and total impacts for breasting lines remain below 0.01 acres. The Crofton has been tied up to the remnant bridge/fishing pier, but that access will not be available if shoaling in the area continues as anticipated. Before we submit requests for permit modifications, I wanted to get your comments on this new temp. breasting line alignment. The line is close to the centerline of the current navigation channel. The Crofton is 72'wide, so placing it on the north side of the breasting line would place it 226'from the centerline of the channel at most. If the foundation has a pile cap then the cap would be in the water- 1.0'based on the mean high water elevation, so the cap dimensions were used instead of the individual pile sizes(giving us a larger footprint). If the foundation has 54"circular piles with no pile cap then the pile surface area was used to calculate the impact,plus a small area immediately around the pile. **The impacts for the removal of the existing bridge were calculated using the pile window(the extent that the piles project into the water)and not individual pile sizes. The demolition/pile removal in wetlands was considered "Temporary Fill"because"Temporary Excavation"is not a category. Bonner Bridge(Bonner Bridge),which is part of the replacement of Bridge No. 11 over Oregon Inlet on NC Hwy 12, TIP No. B-2500 Phase I, in Dare County.NCDOT states barge access to the existing b ting lines has been limited by shallow water depths due to the formation of a sand bar. proposed breasting line (S-3)would be located on the east side of the Marc Basnight bridge and would eliminate the need to breakdown the Crofton 4600 crane/barge for it to pass under the navigational height clearance of the Marc Basnight bridge and would also provide an area of water depth levels greater than 12'. Barges without overhang are traveling through the intercoastal waterway to Norfolk and back down the coast to the permitted reef sites (200 miles one way) and barges with overhang must travel through the Pamlico Sound to Morehead City and back up the coast to the permitted reef sites (220 miles one way). Based upon my review I have no objection to the issuance of this permit,but offer the following conditions: 1. This one got a little complicated with the different pieces in the application. The only part of this application that I processed was for the breasting lines (DWR project number 20160186 v.3). We issued Water Quality General Certification No. 4141 on 7/16/20 just for the breasting lines. It was determined by the Corps that the sheet pile would not require additional permitting and DWR has no concerns with that proposal. The NC Department of Transportation is currently in the process of removing the existing Bonner Bridge as part of the TIP B-2500 Bonner Bridge Replacement Project. The B-2500 Project is currently authorized to place bridge demolition on AR-130, AR- 140,AR-145, and AR-160 just outside of Oregon Inlet in Dare County. In late 2019, sh a mg at t e regon n e ar s ed to impede the deployment of demolition material to AR-130,AR-140,AR-145, and AR- 60 through Oregon Inlet. Due to the high demand for limited Corps dredging assets and inclement ocean conditions at the Oregon Inlet Bar,the dredging efforts at Oregon Inlet have been sporadic and unpredictable in the last 12 months. In the spring of 2020,the shallow conditions of the Oregon Inlet Bar prevented tugboats from deploying bridge demolition barges though Oregon Inlet. All four of the permitted artificial reef sites are located in the Atlantic Ocean on the east side of the bridge, and are currently inaccessible to the tugboat/barge demolition equipment through Oregon Inlet. At this time,the barges are traveling through the intercoastal waterway to Norfolk and back down the coast to the permitted reef sites(200 miles one way)or through the Pamlico Sound to Morehead City and back up the coast to the permitted reef sites(220 miles one way). This logistic difficulty has led NCDOT to explore alternative artificial reef deployment sites. After discussions between NCDOT and NCDMF, it was determined the artificial reef site AR-320 would be a good alternative site to accept bridge demolition material and is currently permitted to accept up to 4,000 tons of bridge demolition. NCDMF requests a modification of the CAMA Permit and 401 WQC to authorize bridge demolition material from the Bonner Bridge. Bridge demolition material consists of large sections of concrete substructure, superstructure, and piles. Demolition materials will be visually inspected by NCDMF and/or the contractors,to ensure there is no oil,hydrocarbons, or contaminants. If materials are found to be contaminated,the material would be disposed of properly and not put on our artificial reefs. All deployments at this site will follow the same procedures as at the reefs off Oregon Inlet.
