Bonner Bridge on NC Highway 12 , as requested in the permittee's application dated 2/2/16, including the attached workplan drawings(7), as referenced in Condition No. 2 of this permit. This permit, issued on 2/29/16 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. TIP No. B-2500, Phase I 1) Unless specifically altered herein, this Major Modification authorizes the construction of three temporary breasting lines (lengths of 245 feet, 500 feet, and 800 feet), and five temporary mooring anchors [radius' of 350 feet (1), and 450 feet(4)] in Pamlico Sound for securing work barges and vessels associated with the replacement of the Herbert C. Bonner Bridge over Oregon Inlet, all as depicted on the attached workplan drawings. NOTE: The specific development being permitted does not preclude the remainder of the B-2500 project being built in the Pamlico Sound provided that future development will be constructed in a way that avoids and minimizes impacts to AECs. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or Signed by the authority of the Secretary of DEQ and the other qualified persons within twenty (20) days of the issuing Chairman of the Coastal Resources Commission. date. Department of Transportation Permit No. 106-12 Page 2 of 3 • ADDITIONAL CONDITIONS • • 2) All work authorized by this permit shall be carried out in accordance with the following attached workplan drawings (7), except as modified herein: 3 dated received 2/3/16, 1 dated received 2/2/16, 2 dated 1/12/16, and 1 dated 1/25/16. 3) In accordance with commitments made by the permittee, barges shall not be moored within 300 feet of Island C. 4) In accordance with commitments made by the permittee, the installation of piles shall be accomplished by pile driving. Should the permittee and/or its contractor propose to utilize another type of pile installation, such as jetting, additional authorization from the N.C. Division of Coastal Management (DCM) shall be required. 5) The breasting lines and mooring anchors shall be removed in their entirety immediately after they are no longer needed. 6) No excavation shall occur within waters of the State, either by conventional methods or by prop wash "kicking" with boat propellors, without permit modification. 7) In accordance with commitments made by the permittee, barge and tug activity accessing the authorized breasting lines and mooring anchors shall remain within marked navigational channels or historically deep waters. 8) No sewage, whether treated or untreated, shall be discharged at any time from any vessels using the authorized facilities. Any sewage discharge at the authorized facilities shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 9) The permittee shall exercise all available precautions in the day-to-day operation of the facility to prevent waste from entering the adjacent waters and wetlands. 10) The permittee and/or his contractor shall provide for proper storage and handling of all oils, chemicals, etc., necessary to carry out the project. 11) This Major Modification shall not result in permanent impacts to wetlands or waters of the State, without permit modification. 12) If it is determined that additional permanent and/or temporary impacts are necessary that are not shown on the attached workplan drawings or described in the authorized permit application, a permit modification and/or additional authorization from DCM may be required. In addition, any changes in the approved plan may also require a permit modification and/or additional authorization from DCM. Department of Transportation Permit No. 106-12 Page 3 of 3 ADDITIONAL CONDITIONS 14) This permit authorizes only the structures that are expressly and specifically set forth in the permit application, or depicted on the attached workplan drawings. No other structures, whether floating or stationary, may become a part of the facilities authorized by this Major Modification without additional authorization from DCM. No non-water dependent uses of structures may be conducted on, in, or over public trust waters without permit modification. 15) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit for the life of the permitted structure. 16) The permittee shall make every attempt to maintain the same navigation that is currently possible in the project area of Pamlico Sound. 17) The permittee shall install and maintain, at his expense, any signal lights, signals, signage, or notifications prescribed by the U.S. Coast Guard, through regulations or otherwise, on the authorized structures. At a minimum, permanent reflectors shall be attached to the structures in order to make them more visible during hours of darkness or inclement weather. 18) The N.C. Division of Water Resources (DWR) authorized the proposed project on 2/26/16 (DWR Project No. 20160186) under General Water Quality Certification No. 3893. Any violation of the Certification approved by DWR shall be considered a violation of this CAMA permit. NOTE: The U.S. Army Corps of Engineers authorized the proposed project under Nationwide Permit Number 33 (COE Action ID No. SAW-1993-03077),which was issued on 2/24/16. NOTE: This Major Modification does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. 19) This Major Modification shall be attached to the original of Permit No. 106-12, which was issued on 9/19/12, as well as all subsequent modifications, and copies of all documents shall be readily available on site when a Division representative inspects the project for compliance. 20) All conditions and stipulations of the active permit remain in force under this Major Modification unless specifically altered herein. NOTE: An application processing fee of$475 was received by DCM for this project. This fee also satisfied the Section 401 application processing fee requirements of DWR. The Design-Build Team refined their means and methods for construction while the Department worked through the legal challenges to the project. Since the permits were originally issued in 2012,the construction market and available equipment have changed.As a result of these refinements and market changes,the Design-Build Team has modified plans for several temporary impact areas. There are no proposed changes to the permanent impact areas approved in the original permits. Based on recent coordination with the US Coast Guard,an attached drawing shows mooring points and breasting lines that will be needed on the south end of the project in Oregon Inlet/Pamlico Sound for securing barges and vessels. A mooring anchor would be set in the sound bed, with a mooring chain and buoy attached to it that would allow the attached vessel to swivel within the radius shown. A 245-foot long breasting line (utilizing a series of eight 36-inch hollow steel pipe piles)is proposed,extending to the southwest from the trestle/dock. A mooring anchor location is proposed to the south-southwest of the trestle/dock(see coordinates below in table,with a 350- foot radius). A 500-foot long breasting line(utilizing a series of eleven 36-inch hollow steel pipe piles)is proposed northeast of this mooring anchor location.An 800-foot long breasting line (utilizing a series of seventeen 36-inch hollow steel pipe piles)for safe harbor and material barge storage will also be required near Island"C",which is a more secure site for storage during adverse weather(see attached aerial/drawing,with requisite 300-foot island buffers per the FEIS/ROD). Additionally,four adjacent mooring anchor locations are proposed in Pamlico Sound, approximately 6 miles west of the project site. These mooring anchors would each have a 450- foot radius and nearly abut one another. It is important to have on-site mooring and breasting facilites for barge activity in the work area.This will aid in the keeping an efficienct work schdule and reduce risk during adverse weather conditions. Following project completion and removal of the old bridge,the breasting piles and mooring sites will be completely removed. c. Describe the proposed construction methodology,types of construction equipment to be used during construction,the number of each type of equipment and where it is to be stored. NCDOT proposes to install 3 temporary barge breasting locations and 2 mooring locations.The breasting lines consist of 36" hollow steel piles being evenly spaced and aligned in a row, creating a secure tie off/breasting location for barges.The 3 locations are as described: 1)245 ft. in length,consisting of 8 piles,located adjacent to loading/unloading dock by the Old emergency ferry ramp,2)500 ft. in length,consisting of 11 piles,just south of the loading dock and paralleling the shore alignment, 3)800 ft. in length,consisting of 17 piles,just south of Island"C". Each of the 3 sites locations and alignment are shown on the provided location plats. Breasting piles will be driven by conventional pile driving techniques, utilizing crane/ hammer/barge system.There are two proposed barge mooring locations.One is behind Green Island area along Davis Channel and the second is in the Pamlico Sound.A location plat has been provided showing exact locations and coordinates.The mooring arrangement detail is also included,which involves placement of an anchor, line and bouy, allowing the secured barges to swing in a clear radius. d. A 245' breasting line, 500' breasting line, and 350' radius mooring anchor would be located adjacent to the southern work trestle/dock in the vicinity of Davis Channel,south of Oregon Inlet. An 800' breasting line would be located south of "Island C" and north of Old House Channel. Four 450' radius mooring anchors would be located six miles southwest of the Herbert C.Bonner Bridge and south of Old House Channel.Adjacent land consist of National Park Service (NPS) land and Pea Island National Wildlife Refuge land which are in conservation for recreational and wildlife uses. Proposed locations are also in the vicinity of dredge spoil islands created when U.S. Army Corps of Engineers (USACOE) placed dredge spoils associated with dredging of adjacent deep water channels. Bodie Island forms the northern shoulder of the Oregon Inlet and is a part of the Cape Hatteras National Seashore,which is administered by the National Park Service.The southern end of Bodie Island, including the Oregon Inlet campground and the Oregon Inlet Marina and Fishing Center, is used for recreation. The Oregon Inlet Marina and Fishing Center is the only permanent business in the vicinity of the project area,with numerous charter fishing boats available for hire by the public. The active Oregon Inlet US Coast Guard(USCG)Station is also in this area. South of the Bonner Bridge are Hatteras Island and the Pea Island National Wildlife Refuge.The Refuge lies within the boundaries of the Seashore and is administered by the US Fish and Wildlife Service (USFWS). A former USCG Station,which is listed on the National Register of Historic Places, is also located in this area. The Environmental Management Commission has classified the Pamlico Sound as Class SA; HQW in the area of the proposed temporary breasting and mooring sites. The project area is in the Pasquotank River basin. The North Carolina Division of Marine Fisheries (NCDMF) has classified all waters in the proposed area as Coastal Waters,but not a Primary Nursery Area. The waters are designated open to shell fishing by the Shellfish Sanitation Section of NCDMF. The Pamlico Sound is approximately 11.5 miles wide in the project area. The sound is approximately 7' to 40'deep at the various locations chosen for the proposed temporary breasting line and mooring project. Numerous submerged aquatic vegetation(SAV) beds are present in the Pamlico Sound. However, the proposed work is entirely located in waters that are 7' deep or more and therefore not SAV habitat. DCM issued CAMA Major Permit#106-12 to NCDOT on September 19, 2012 for the TIP No. B-2500 project. TIP No. B-2500 extends for approximately 15 miles from the southern end of Bodie Island to the community of Rodanthe. However, the September 19, 2012 permit action was legally challenged by the Defenders of Wildlife and the National Wildlife Refuge Association, represented by the Southern Environmental Law Center, in October 2012. FIELD INVESTIGATION REPORT: NCDOT—MAJOR MODIFICATION—TIP NO.B-2500 PHASE I BONNER BRIDGE REPLACEMENT PROJECT PAGE#3 On April 30,2015,all parties involved in the challenge of the CAMA permit,as well as a challenge in federal court of the 2010 Record of Decision for TIP No.B-2500 and related documents,reached a settlement agreement, which has begun to be implemented. Project Proposal The proposed project is to place three (3)temporary work barge breasting sites and two (2) temporary mooring locations in the Pamlico Sound for use during the replacement of Bridge No. 11 (Bonner Bridge)over Oregon Inlet.These sites will be used to secure barges while not actively engaged in use for construction and demolition activities associated with the bridge replacement 'project. The temporary breasting sites and mooring locations will aid in keeping an efficient work schedule, will provide temporary storage and will reduce risk during adverse weather conditions. The breasting lines consist of 36"hollow steel piles that are evenly spaced and aligned in a row. Breasting piles are to be driven by conventional pile driving techniques and would utilize a crane/hammer/barge system. Piles will be driven to secure depths. The number of breasting piles to be used at specific locations are as follows: • 245' breasting line—eight piles, —35 ft. apart, 12-15 ft. of pile above NWL approximate depth below NWL at location: 30—40 ft. • 500' breasting line—eleven piles, —50 ft. apart, 12-15 ft. of pile above NWL approximate depth below NWL at location: 12 -20 ft. • 800' breasting line—seventeen piles, —50 ft. apart, 12-15 ft. of pile above NWL approximate depth below NWL at location: 12— 18 ft. The two barge mooring locations would include a single 350' radius mooring anchor at one location and a cluster of four 450' radius mooring anchors at the other location. Approximate depths of the Pamlico Sound at these mooring locations are 7' —20' and 10' — 12', respectively. The mooring anchors would be set in the sound bed. A mooring chain and buoy would be attached to each anchor to allow the attached vessel to swivel within the appropriate radius. The Design-Build Team and NCDOT coordinated with the USCG and USACOE navigation staff regarding the type and location of the temporary mooring/breasting structures. All lighting and markings will meet USCG requirements. Barge and tug activity accessing these areas will remain within historical deep water or marked navigation channels.According to the applicant,all of the proposed work would occur in areas that have been the location of previous public works projects. The mooring/breasting sites will be utilized throughout construction of the new bridge and demolition associated with the old Oregon Inlet Bridge. The approximate time period will be from March 2016 through August 2019. Following project completion the breasting piles and mooring anchors will be completely removed. F FIELD INVESTIGATION REPORT: NCDOT—MAJOR MODIFICATION—TIP NO.B-2500 PHASE I BONNER BRIDGE REPLACEMENT PROJECT PAGE#4 Anticipated Impacts There would be disturbance to the water column during installation and removal of the breasting piles and mooring anchors. The proposed breasting lines would have temporary surface water impacts of 261.36 sq.ft.from the proposed hollow steel pipe piles.There would be additional impacts to the Sound bottom due to the mooring anchors at the five mooring locations. There are no proposed permanent impacts. NCDOT has committed to take extra caution during material transport and construction to not disturb shallow bottom habitat and has stated in the Major Modification application that all barge and tug activity ingressing/egressing these areas will remain within marked navigational channels or historical deep water. Additional potential impacts to natural resources include the introduction of human disturbance, such as lights and noise, to areas of Pamlico Sound that are usually unoccupied by people. As with any vessel, there is the potential for oil, fluids, construction debris, etc. to enter adjacent waters. All temporary breasting line and mooring locations are greater than 100' from any shoreline. The work plan drawings submitted with the application depict that all temporary breasting line and mooring locations would appear to satisfy the Project Commitment 25b found within Appendix A of the December 2010 Bonner Bridge Record of Decision, which states the following: "Do not moor any construction barges within 300 feet (91.4 meters)of the following islands: Green Island, Wells Island, Parnell Island, Island MN, Island C, the small unnamed island immediately east of Island C, Island D, and Island G (see Figure 1 in the Biological and Conference Opinions in Appendix E of the FEIS)." The breasting line and mooring anchor structures will potentially impede navigation in Public Trust Waters in the project area. The various sites also have the potential to impede fishing access, particularly when breasting and mooring locations are being utilized with construction vessels. NCDOT will install and maintain any lights/signals and any additional navigation aids prescribed by the U.S. Coast Guard on authorized facilities. The application package includes an e-mail dated January 15,2016 from a representative of the USCG stating that the anchor/mooring areas are all outside the navigation channel and should not create a hazard to vessel traffic. In the application package, NCDOT states (DCM MP-4 form) that yellow buoys will be used, which will be sufficiently sized to match anchor line weight and will clearly mark the mooring sites. Date: February 18, 2016 Consistency Determination: The request is consistent with/not in conflict with the Dare County 2009 Land Use Plan certified by the CRC on February 24, 2011. Overview: The project area consist of three (3) sites in the Pamlico Sound, west and south of the Herbert C. Bonner Bridge (bridge). Site 1 is located approximately 1.5 miles west of the northern terminus of the bridge, directly south of Island C and north of Old House Channel. Site 2 is located approximately 6 miles southwest of the bridge, south of Old House Channel. Site 3 is located directly south of the bridge's southern terminus, adjacent to the trestle/dock near Davis Channel. Water depths at Site 1 are between 7 and 40 feet. Water depths at Site 2 are between 7 and 20 feet. Water depths at Site 3 are between 10 and 12 feet. Replacement of the Herbert C. Bonner Bridge across Oregon Inlet is anticipated to begin in March of 2016. Construction methods have changed since a permit for the replacement was issued in 2012. As a result, the project's Design-Build Team has modified their construction plans to accommodate temporary working barges. Installation of an 800 foot long breasting line at Site 1; four (4) 450 foot radius mooring anchors at Site 2, and; a 245 foot long breasting line, a 500 foot long breasting line, and a 350 foot radius mooring anchor at Site 3 is proposed. Breasting lines will consist of 36 inch hollow steel piles evenly spaced and aligned in a row. The 800 foot breasting line will consist of seventeen (17) piles spaced approximately 50 feet apart, the 245 foot long breasting line will consist of eight (8) piles spaced approximately 35 feet apart, and the 500 foot long breasting line will consist of eleven (11) piles spaced approximately 50 feet apart. The waters of the Pamlico Sound are classified as SA; HQW and are open to shellfishing in the project area. There are no identified historic or archaeological resources at the sites identified within the project area. Due to water depths greater than 7 feet, no Submerged Aquatic Vegetation (SAV) is located at the sites identified within the project area. Anticipated impacts resulting from this project are expected to include: a temporary impact to 261.36 sq. ft. of Public Trust Area/Estuarine Waters Areas of Environmental Concern (AEC). Basis for Determination: The project area is located within the Pamlico Sound. As indicated on Page 217, the "Conservation" designation applies to all CAMA Areas of Environmental Concern (AECs). Upon review of the email from Sector North Carolina(LCDR Burrill) and Coast Guard Station Oregon Inlet(BMCS Hinote), it appears that Sector North Carolina concurs with the proposed barge mooring locations (with the USACE caveat that it is possible that they may need to be moved, if environmental conditions change) and the proposed location of private aids to navigation(PATON) (related to the barge mooring system), with the recommendation that the PATON be charted and lighted. Permanent jurisdictional impacts are not being changed,they remain as originally permitted, only temporary impacts are effected,which is noted in the request letter and impact table. These dimensional changes will improve the contractors ability to effectively and safely access the work zones, which is a primary concern in such a dynamic marine environment. The processing of a major modification to a major permit follows the same process as a new major permit. It looks like there are still a few things we need before accepting this major modification request as complete. We still need the MP forms (MP-1 and MP-4), and authorization to debit the $475.00 processing fee. In addition, we need workplan drawing(s)that show the water depths for all of the in-water work (ex. the 800 foot breasting line, and all of the work near Davis Channel and the old ferry landing.) The request includes a typical drawing of the moorings, but a typical drawing of the breasting lines is still needed. Please let me or Greg know if you have any questions or concerns. Permanent jurisdictional impacts are not being changed,they remain as originally permitted, only temporary impacts are effected,which is noted in the request letter and impact table.These dimensional changes will improve the contractors ability to effectively and safely access the work zones, which is a primary concern in such a dynamic marine environment. With this request are also two proposed barge mooring locations and three breasting locations.These sites have been reviewed by NCDOT, PCL and USCG Oregon Inlet station for navigability and safety concerns. Correspondence with the USCG Oregon Inlet station is included with this request. The minor modification fee is $100.00 and the major modification fee is $475.00. (The two letters that were submitted both state $570.00). Is WBS Element 32635.1.4 the correct number to debit for the minor modification fee of$100.00 and the major modification fee of$475.00?
