This permit, issued on 8/29/19 , is subject to compliance with the application (where consistent
with the permit),all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action;or may cause the permit to be null and void.
1) Unless specifically altered herein, all work authorized by this Minor Modification shall be carried out
in accordance with the following attached workplan drawings (10): 2 dated 8/12/19, 1 dated 8/5/19,
I dated 7/11/19, and 6 dated 7/10/19, except as modified herein.
2) Unless specifically altered herein, this Minor Modification authorizes the following additional
activities associated with demolition of the existing Herbert C. Bonner Bridge over Oregon Inlet:
expansion of the south loading dock by approximately 2,000 square feet, an additional bridge
demolition trestle, and 48 additional breasting piles, all as depicted on the attached workplan
drawings.
NOTE: The specific development being permitted does not preclude the remainder of the B-2500
project being built in the Pamlico Sound provided that future development will be constructed
in a way that avoids and minimizes impacts to AECs.

This permit action may be appealed by the permittee or Signed by the authority of the Secretary of DEQ and the Chair

ADDITIONAL CONDITIONS
NOTE: The proposed project will increase temporary impacts to surface waters by approximately 0.03
acres.
3) Nothing in this permit authorizes any activity that has not received approval from the National Park
Service and/or the U.S. Fish and Wildlife Service, if required, for work within the Cape Hatteras
National Seashore and/or the Pea Island National Wildlife Refuge. The proposed work shall not
commence until the permittee has been issued a Special Use Permit from the NPS and/or the USFWS, if
required, and a copy of the Special Use Permit(s) is received by DCM.
4) The authorized activities shall not result in any additional permanent or temporary impacts to vegetated
wetlands or areas with submerged aquatic vegetation, without permit modification.
5) The installation and removal of the piles shall be accomplished by pile driving and/or the use of a
vibratory hammer. Should the permittee and/or its contractor propose to utilize another type of pile
installation, such as jetting, additional authorization from DCM shall be required. In the event that a
piling breaks during removal and cannot be removed in its entirety, it may be cut off flush with the bed
of the water body, and DCM shall be notified of each occurrence within one working day.
6) No dredging or excavation shall occur within waters of the State, either by conventional methods or by
prop wash"kicking"with boat propellers, without permit modification.
7) No sewage, whether treated or untreated, shall be discharged at any time from any vessels using the
authorized facilities. Any sewage discharge at the authorized facilities shall be considered a violation of
this permit for which the permittee is responsible. This prohibition shall be applied and enforced
throughout the entire existence of the permitted structure.
8) The temporary placement and double handling of any excavated or fill material within waters or
vegetated wetlands is not authorized. This condition also applies to the materials stored on work
platforms and removal of the existing bridge, roadway asphalt, and associated materials.
9) The structures authorized by this Minor Modification shall be removed in their entirety immediately 1
after they are no longer needed, or within 30 days of written notification from DCM, whichever comes
first,and disposed of at an approved high ground location.
10) Any significant depressions in the Sound bottom that are created by temporary hollow steel piles and
that persist following removal of the piles shall be filled with native substrate material to approximate
their pre-project contours and elevations as soon as practicable.
11) If it is determined that additional permanent and/or temporary impacts are necessary that are not shown
on the attached workplan drawings or described in the authorized permit application, a permit
modification and/or additional authorization from DCM may be required. In addition, any changes in
the approved plan may also require a permit modification and/or additional authorization from DCM.
The permittee shall contact a representative of DCM prior to commencement of any such activity for
this determination and any permit modification.

ADDITIONAL CONDITIONS
12) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work following completion of construction and demolition
activities.
13) The permittee shall install and maintain at its expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities.
14) The permittee and/or its contractor shall contact the DCM Transportation Project Field Representative in
Elizabeth City to request a preconstruction conference prior to project initiation.
NOTE: This permit does not eliminate the need to obtain any additional permits, approvals or
authorizations that may be required. This includes approval, if required, from the N.C. Division
of Water Resources and/or the U.S. Army Corps of Engineers.
15) Development authorized by this permit shall only be conducted on lands owned by NCDOT and/or its
right-of-ways and/or easements.
16) This Minor Modification shall be attached to the original of Permit No. 106-12, which was issued on
9/19/12, as well as all subsequent modifications, and copies of all documents shall be readily available
on site when a Division representative inspects the project for compliance.
17) All conditions and stipulations of the active permit remain in force under this Minor Modification unless
altered herein.
NOTE: A minor modification application processing fee of$100 was received by DCM for this project.

The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be carried
out in accordance with your application.Modifications,time extensions,and future maintenance requires additional

having the work done by a contractor,it would be to your benefit to be sure that he fully understands all permit
requirements.

In addition to the letter sent on July 10,2019,the North Carolina Department of Transportation
(NCDOT)is providing further information concerning the above referenced permits to authorize
an additional south dock loading span to complete the marine demolition of the existing bridge.
This additional modification information is being submitted after further geotechnical
investigation determined an extra span on the south dock loading trestle is needed for splicing

180 foot steel pipe piles. The Design-Build Team is continuing to look for ways to minimize
impacts through their means and methods of demolition of the old bridge.
Bridge Demolition Additional South Dock Loading Span
The Design-Build Team has determined a need for an additional temporary bridge loading dock
span that would accommodate the splicing of 180-foot steel pipe piles that are used to build the
temporary bridge demolition trestle.The additional south dock loading span will be abutting and
located north of the current south dock layout.The dimensions represent a—2,002 square foot
area(46.25 x 43.3'),and will be 10 feet above the water surface(mean lower low water)at the
same elevation as the current south dock.The additional south dock loading span will be
supported by a total of 8 temporary hollow steel trestle piles(36-inch diameter pipe piles)totaling
approximately 57 square feet. One pile will be located at each of the four corners of the additional
loading span,and 4 additional piles will be placed 2/3 of the length of the additional span west of
the current south dock. Table 1 states the spatial location of the additional south dock loading
span piles.
The included revised permit drawings show the additional bridge demolition trestle and proposed
breasting pile locations(sheets 8,9 and 10)addressed in the July 10,2019 modification request,
and expansion of the south loading dock(sheet 5A)included in this modification request.

Breasting Lines/Temporary Trestle Clarification
There will be 49 bents supported by three piles at each bent,and 48 associated breasting piles
located mid-span along the length of the west side of the trestle.The July 10,2019 modification
letter previously stated 48 bents,and 47 breasting piles. Use of the 48 breasting piles will be
installed and used throughout the bridge demolition process.It was previously stated in the July
10,2019 letter that approximately 10 breasting piles would be used at one time,and would be
moved along the length of the trestle as demolition work progressed.
Summary Tables of Impacts
For comparison,Table 2 is an abbreviated version of the surface water impacts and the changes in
impacts due to adding the bridge demolition temporary trestle,associated breasting piles and,
expansion of the south loading dock.To clarify,Table 2 incorporates the modifications including
in the July 10,and current request as compared to the previously permitted(December 2018)
impacts.

The North Carolina Department of Transportation(NCDOT)requests a modification of the
above referenced permits to authorize additional work trestle and multiple breasting piles
necessary to complete the marine demolition of the existing bridge. This modification is required
due to shoaling that has occurred likely from lack of maintenance dredging. The Design-Build

demolition of the existing bridge.On site conditions have changed and this modification request
represents a change from the amount of trestle originally anticipated during pre-construction
demolition planning.
Bridge Demolition Temporary Trestle and Associated Breasting Piles
The Design-Build Team has determined a need for additional temporary bridge demolition trestle
and associated breasting piles. The additional bridge demolition temporary trestle will be located
east of the new bridge and west of the existing bridge between the old bridge bents#129 and
155. The trestle will include a total of 48 bents supported by three piles at each bent. This trestle
extension would serve as a transfer platform for the old bridge superstructure,substructure and
pile pieces before they are transferred down the length of the platform to barges.The trestle
dimensions represent an—92,688 square foot area(1931' x 48')and will be 14 feet above the
water surface, supported by an estimated 147 temporary hollow steel trestle piles(36"inch
diameter piles)totaling approximately 1,039 square feet. The first three bents(bent#1-3)of the
additional bridge demolition temporary trestle will be built from barge-mounted cranes,and the
remaining 45 bents(bent#4-48)will be built from cranes-on the bridge demolition temporary
trestle. Both construction methods will thereby minimize temporary surface water disturbance.
Table 1 states the location of the bridge demolition temporary trestle corner piles.

Breasting Lines
Forty seven(47)associated breasting piles are located mid-span along the length of the west side
of the trestle. These 36"temporary breasting piles will range from 80 to 100 linear feet in length.
Approximately 10 breasting piles will be used at one time,and they will be moved along the
length of the trestle as demolition work progresses. These breasting piles are needed to tie barges
off to help maintain their position while loading of the existing bridge demolition pieces,and
prevent damage to the newly constructed bridge.
The included revised permit drawings show the additional bridge demolition trestle and proposed
breasting pile locations on permit sheets 8,9 and 10.

*Permanent surface water and permanent fill in wetland impacts were calculated based on the type of foundation. If the foundation has a pile cap then the cap would be in the water- 1.0'based on the mean high water elevation, so
the cap dimensions were used instead of the individual pile sizes(giving us a larger footprint). If the foundation has 54"circular piles with no pile cap then the pile surface area was used to calculate the impact, plus a small area
immediately around the pile.
**The impacts for the removal of the existing bridge were calculated using the pile window(the extent that the piles project into the water)and not individual pile sizes. The demolition/pile removal in wetlands was considered
"Temporary Fill"because"Temporary Excavation"is not a category. NC DEPARTMENT OF TRANSPORTATION
*** Impacts for the temporary work trestle,work bridge, and work platform were calculated as pile impacts. The piles being proposed are 36"circular piles The work trestle. platforms, and bridge all require two piles per span and
spans will be spaced every 40 feet apart. The boardwalk impacts are calculated as the entire footprint of the 10'wide boardwalk. Impacts for the trestle and breasting lines installed to remove the existing bridge were calculated as

Modification to the 401 Water Quality Certification Pursuant to Section 401 of the Federal Clean Water Act
with ADDITIONAL CONDITIONS
THIS CERTIFICATION is issued in conformity with the requirements of Section 401 Public Laws 92-500 and
95-217 of the United States and subject to the North Carolina Division of Water Resources(NCDWR)Regulations
in 15 NCAC 2H.0500 and 15A NCAC 2B.This certification authorizes the NCDOT to impact an additional 0.03
acres of open waters in Dare County. The project shall be constructed pursuant to the modification dated received
July 10,2019 and additional information received August 20,2019. The authorized impacts are as described below:

The application provides adequate assurance that the discharge of fill material into the waters of the Pasquotank
River Basin in conjunction with the proposed development will not result in a violation of applicable Water Quality
Standards and discharge guidelines. Therefore,the State of North Carolina certifies that this activity will not violate
the applicable portions of Sections 301,302,303,306,307 of PL 92-500 and PL 95-217 if conducted in accordance
with the application and conditions hereinafter set forth.
This approval is only valid for the purpose and design that you submitted in your modified application dated
received July 10,2019 and additional information received August 20,2019. All the authorized activities and
conditions of certification associated with the original Water Quality Certification dated September 7,2012 and
modifications dated November 6,2015,February 25,2016,September 30,2016,February 3,2017,and November
21,2018 still apply except where superseded by this certification. Should your project change,you are required to
notify the NCDWR and submit a new application. If the property is sold,the new owner must be given a copy of
this Certification and approval letter,and is thereby responsible for complying with all the conditions. If any
additional wetland impacts,or stream impacts,for this project(now or in the future)exceed one acre or 150 linear
feet,respectively,additional compensatory mitigation may be required as described in 15A NCAC 2H.0506(h)(6)
and(7). For this approval to remain valid,you are required to comply with all the conditions listed below. In
addition,you should obtain all other federal,state or local permits before proceeding with your project including
(but not limited to)Sediment and Erosion control,Coastal Stormwater,Non-discharge and Water Supply watershed
regulations. This Certification shall expire on the same day as the expiration date of the corresponding Corps of
Engineers Permit.
Condition(s)of Certification:
1. This modification is applicable only to the additional proposed activities at Site 6. All of the authorized
activities and conditions of certification associated with the original Water Quality Certification dated
September 7,2012 and subsequent modifications dated November 6,2015,February 25,2016,September
30,2016,February 3,2017,and November 21,2018 still apply except where superseded by this
certification.

2. The temporary piles associated with the proposed work trestle and breasting lines must be removed in
their entirety upon completion of the project. Exceptions to this condition require prior approval from
NCDWR.
3. A copy of this Water Quality Certification shall be maintained on the construction site at all times. In
addition,the Water Quality Certification and all subsequent modifications,if any,shall be maintained with
the Division Engineer and the on-site project manager.
Violations of any condition herein set forth may result in revocation of this Certification and may result in criminal
and/or civil penalties. This Certification shall become null and void unless the above conditions are made
conditions of the Federal 404 and/or Coastal Area Management Act Permit. This Certification shall expire upon the
expiration of the 404 or CAMA permit.
If you wish to contest any statement in the attached Certification you must file a petition for an administrative
hearing. You may obtain the petition form from the office of Administrative hearings. You must file the petition
with the office of Administrative Hearings within sixty(60)days of receipt of this notice. A petition is considered
filed when it is received in the office of Administrative Hearings during normal office hours. The Office of
Administrative Hearings accepts filings Monday through Friday between the hours of 8:00am and 5:00pm,except
for official state holidays. The original and one(1)copy of the petition must be filed with the Office of

Reference the Department of the Army (DA) permit dated August 14, 2013, to Mr. Clay
Willis, of the North Carolina Department of Transportation(NCDOT) for impacts associated
with the replacement of the Herbert Bonner Bridge (Bridge No. 11) on NC 12 Highway over
Oregon Inlet, TIP Project B-2500 (Phase I). The 3.55 mile project includes the construction of a
new bridge and 0.49 acres of fill in jurisdictional wetlands for bridge approaches. The project
area contains the Pamlico Sound, Oregon Inlet, and Motts Creek and adjacent wetlands in the
Pasquotank River Basin(8-Digit Cataloging Unit 03010205).
Also reference your permit modification request letter and attachments received via email
dated July 10, 2019 and August 16,2018,proposing the following:
Bridge Demolition Additional South Dock Loading Span
The Design-Build Team has determined a need for an additional temporary bridge loading
dock span that would accommodate the splicing of 180-foot steel pipe piles that are used to
build the temporary bridge demolition trestle. The additional south dock loading span will be
abutting and located north of the current south dock layout. The dimensions represent a—2,002
square foot area(46.25 x 43.3'), and will be 10 feet above the water surface (mean lower low
water) at the same elevation as the current south dock. The additional south dock loading span
will be supported by a total of 8 temporary hollow steel trestle piles (36-inch diameter pipe
piles)totaling approximately 57 square feet. One pile will be located at each of the four corners
of the additional loading span,and 4 additional piles will be placed 2/3 of the length of the
additional span west of the current south dock. Table 1 states the spatial location of the
additional south dock loading span piles.

The included revised permit drawings show the additional bridge demolition trestle and
proposed breasting pile locations (sheets 8, 9 and 10)addressed in the July 10,2019
modification request, and expansion of the south loading dock(sheet 5A) included in this
modification request.

Breasting Lines/Temporary Trestle Clarification
There will be 49 bents supported by three piles at each bent, and 48 associated breasting
piles located mid-span along the length of the west side of the trestle. The July 10, 2019
modification letter previously stated 48 bents, and 47 breasting piles. Use of the 48 breasting
piles will be installed and used throughout the bridge demolition process. It was previously
stated in the July 10, 2019 letter that approximately 10 breasting piles would be used at one
time, and would be moved along the length of the trestle as demolition work progressed.
Summary Tables of Impacts
For comparison, Table 2 is an abbreviated version of the surface water impacts and the
changes in impacts due to adding the bridge demolition temporary trestle, associated breasting
piles and, expansion of the south loading dock. To clarify, Table 2 incorporates the
modifications including in the July 10, and current request as compared to the previously
permitted (December 2018) impacts.

at the south dock loading platform related to the replacement of Bridge No. 11 over Oregon Inlet
on NC Highway 12 in Dare County.Th applicant states that the proposed modification is necessary
to complete demolition of the existing bridge in a response to shoaling. The additional bridge
demolition temporary trestle will be located east of the new bridge and west of the existing bridge.
The temporary trestle will be approximately 1,931' by 48', supported by 147 hollow steel piles
(36"diameter piles),and will be approximately 14' above Normal Water Level(NWL).The trestle
will consist of forty-nine(49)bents supported by three piles at each bent. The associated breasting
lines will be located mid-span along the length of the west side of the temporary trestle. All
breasting piles (36" in diameter) will be installed and utilized throughout the process of bridge
demolition. The additional south dock loading span will abut the existing loading span on the
northern side of the current configuration. The loading span will be approximately 46' by 43',
supported by eight (8)temporary hollow steel piles (36"in diameter), and will match the existing
platform height at approximately 10' above NWL. Based upon my review I have no objection to
the issuance of this modification for the proposed activities,but offer the following conditions:
1 The permittee shall exercise all available precautions in the day-to-day operations of the
facility to prevent waste from entering the adjacent waters and wetlands.

2 The installation and removal of the piles for the new temporary work trestles and temporary
breasting lines,shall be accomplished by pile driving and/or the use of a vibratory hammer.
Should the permittee and/or its contractor desire to utilize another type of pile installation
additional authorization from the DCM shall be required.
3 All construction access shall be through the use of the existing bridge, authorized
temporary work trestle, existing high ground areas, and barges.
4 Barges used for construction and demolition access shall be removed immediately when
they are no longer needed.
5 Dredging in any manner, including"kicking"with boat propellers, is not authorized
without permit modification.
6 The temporary placement and double handling of any excavated or fill material within
waters or vegetated wetlands is not authorized. This condition also applies to the materials
stored on work platforms and removal of the existing bridge, roadway asphalt, and
associated materials.
7 In order to protect water quality, runoff from construction shall not visibly increase the
amount of suspended sediments in adjacent waters.
8 If it is determined that additional permanent and/or temporary impacts are necessary that
are not shown on the attached workplan drawings or described in the authorized permit
application, a permit modification and/or additional authorization from DCM shall be
required. In addition, any changes in the approved plan may also require a permit
modification and/or additional authorization from DCM. The permittee shall contact a
representative of DCM prior to commencement of any such activity for this determination
and any permit modification.
9 No attempt shall be made by the permittee to prevent the full and free use by the public of
all navigable waters at or adjacent to the authorized work following completion of
construction and demolition activities.
10 The permittee shall install and maintain at his expense any signal lights or signals
prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized
facilities.
11 Pilings in open water from the temporary work trestle and breasting lines shall be removed
in their entirety, except that in the event that a piling breaks during removal and cannot be
removed in its entirety,DCM shall be notified to determine an appropriate course of action.
Existing bridge pilings in SAV areas and wetlands shall be cut off at the mudline.

12 The temporary work trestle and breasting lines shall be removed in its entirety within 90
days after it is no longer needed and disposed of at an approved high ground location.
13 This permit authorizes only the structures that are expressly and specifically set forth in
the permit application and shown on the attached workplan drawings. No other
structures,whether floating or stationary,may become a permanent part of this project
without additional authorization from the DCM. No non-water dependent uses of
structures may be conducted on, in, or over public trust waters without permit
modification.
14 Unless specifically altered herein, any mitigative measures or environmental
commitments specifically made by the permittee in the original CAMA permit
application,the NEPA/404 Merger Process, and/or the Record of Decision document
dated December 20,2010 shall be implemented,regardless of whether or not such
commitments are addressed by individual conditions of this permit modification.
15 Nothing in this permit authorizes any activity that has not received approval from the
National Park Service (NPS) and the U.S. Fish and Wildlife Service (USFWS) for work
within the Cape Hatteras National Seashore and Pea Island National Wildlife Refuge.
The proposed work shall not commence until the permittee has been issued Special Use
Permits from the NPS and the USFWS, and a copy of the Special Use Permits are
received by DCM.
16 The permittee and/or his contractor is encouraged to contact the DCM Transportation
Project Field Representative in Elizabeth City at(252) 264-3901 to request a pre-
construction conference prior to project initiation.
NOTE: This project will temporarily impact approximately 108,464 sq. ft. (2.49 acres) of
surface waters.
NOTE: In accordance with the commitments made by the permittee, the permittee shall
coordinate with NCDMF to barge suitable bridge demolition material to four
existing artificial reef sites in the Atlantic Ocean for disposal, as described in the
letter of application. The composition of the disposal material shall conform to all
state and federal requirements.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or
local permits, approvals or authorizations that may be required, including any
necessary for the disposal of suitable material on artificial reefs.

Willis, of the North Carolina Department of Transportation(NCDOT) for impacts associated
with the replacement of the Herbert Bonner Bridge (Bridge No. 11) on NC 12 Highway over
Oregon Inlet, TIP Project B-2500 (Phase I). The 3.55 mile project includes the construction of a
new bridge and 0.49 acres of fill in jurisdictional wetlands for bridge approaches. The project
area contains the Pamlico Sound, Oregon Inlet, and Motts Creek and adjacent wetlands,in the
Pasquotank River Basin(8-Digit Cataloging Unit 03010205).
Also reference your permit modification request letter and attachments received via email
dated July 10, 2019 and August 16,2018,proposing the following:
Bridge Demolition Additional South Dock Loading Span
The Design-Build Team has determined a need for an additional temporary bridge loading
dock span that would accommodate the splicing of 180-foot steel pipe piles that are used to
build the temporary bridge demolition trestle. The additional south dock loading span will be
abutting and located north of the current south dock layout. The dimensions represent a—2,002
square foot area(46.25 x 43.3'), and will be 10 feet above the water surface (mean lower low
water) at the same elevation as the current south dock. The additional south dock loading span
will be supported by a total of 8 temporary hollow steel trestle piles (36-inch diameter pipe
piles)totaling approximately 57 square feet. One pile will be located at each of the four corners
of the additional loading span, and 4 additional piles will be placed 2/3 of the length of the
additional span west of the current south dock. Table 1 states the spatial location of the
additional south dock loading span piles.

The included revised permit drawings show the additional bridge demolition trestle and
proposed breasting pile locations (sheets 8, 9 and 10) addressed in the July 10,2019
modification request, and expansion of the south loading dock(sheet 5A) included in this
modification request.

Breasting Lines/Temporary Trestle Clarification
There will be 49 bents supported by three piles at each bent, and 48 associated breasting
piles located mid-span along the length of the west side of the trestle. The July 10, 2019
modification letter previously stated 48 bents,and 47 breasting piles. Use of the 48 breasting
piles will be installed and used throughout the bridge demolition process. It was previously •
stated in the July 10, 2019 letter that approximately 10 breasting piles would be used at one
time, and would be moved along the length of the trestle as demolition work progressed.
Summary Tables of Impacts
For comparison, Table 2 is an abbreviated version of the surface water impacts and the
changes in impacts due to adding the bridge demolition temporary trestle, associated breasting
piles and, expansion of the south loading dock. To clarify, Table 2 incorporates the
modifications including in the July 10,and current request as compared to the previously
permitted(December 2018)impacts.
