Bonner Bridge on NC Highway 12 as requested in the permittee's application dated 2/2/16, including the attached workplan drawings (8): 7 dated 1/14/16, and 1 dated 1/25/16. This permit, issued on February 5,2016 , is subject to compliance with the application (where consistent with the permit),all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. TIP No. B-2500, Phase I 1) Unless specifically altered herein, this Minor Modification authorizes the elimination of the casting yard in North Carolina, an updated layout of the barge loading/unloading dock, and a revised layout of the main work trestle, all as depicted on the attached workplan drawings. NOTE: The breasting lines and the mooring anchor locations depicted on the attached workplan drawings are being reviewed separately as a Major Modification of this Permit No. 106-12, and have not been authorized. NOTE: The specific development being permitted does not preclude the remainder of the B-2500 project being built in the Pamlico Sound provided that future development will be constructed in a way that avoids and minimizes impacts to AECs. (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or Signed by the authority of the Secretary of DEQ and the other qualified persons within twenty (20) days of the issuing Chairman of the Coastal Resources Commission. date. Department of Transportation Permit No. 106-12 Page 2 of 2 ADDITIONAL CONDITIONS NOTE: The elimination of the casting yard will decrease temporary impacts to surface waters by 0.01 acres. The updated layout of the barge loading/unloading dock will increase temporary fill in Coastal Wetlands by 0.001 acres (43.56 square feet), and decrease temporary impacts to surface • waters by 0.005 acres. The revised layout of the main work trestle will increase temporary fill in Coastal Wetlands by 0.012 acres (522.72 square feet), and increase temporary fill in surface waters by 0.026 acres. 2) The permittee and/or his contractor shall provide for proper storage and handling of all oils, chemicals, etc., necessary to carry out the project. 3) The permittee shall exercise all available precautions in the day-to-day operation of the facility to prevent waste from entering the adjacent waters and wetlands. 4) If it is determined that additional permanent and/or temporary impacts are necessary that are not shown on the attached workplan drawings or described in the authorization request, a permit modification and/or additional authorization from the N.C. Division of Coastal Management(DCM) may be required. In addition, any changes in the approved plan may also require a permit modification and/or additional authorization from DCM. The permittee shall contact a representative of DCM prior to commencement of any such activity for this determination and any permit modification. 5) Nothing in this Minor Modification authorizes any activity that has not received approval from the National Park Service (NPS) and/or the United States Fish and Wildlife Service (USFWS) for work within the Cape Hatteras National Seashore and/or the Pea Island National Wildlife Refuge. The proposed work shall not commence until the permittee has been issued Special Use Permit(s) from the NPS and/or the USFWS, if required, and a copy of the Special Use Permit(s) are received by DCM. 6) The permittee shall coordinate with the U.S. Army Corps of Engineers (USACE) and the N.C. Division of Water Resources (DWR) regarding the project. The permittee shall provide any permits issued by USACE and DWR to DCM. NOTE: This Minor Modification does not eliminate the need to obtain any additional state, federal or local peiinits, approvals or authorizations that may be required. 7) This Minor Modification shall be attached to the original of Permit No. 106-12, which was issued on 9/19/12, as well as all subsequent modifications, and copies of all documents shall be readily available on site when a Division representative inspects the project for compliance. 8) All conditions and stipulations of the active permit remain in force under this Minor Modification unless specifically altered herein. Please note that impacts have been shown to the thousandths of an acre herein,thus due to rounding and summing of the impacts will not perfectly match the hundredths in the original permit application. The Design-Build Team refined their means and methods for construction while the Department worked through the legal challenges to the project. Since the permits were originally issued in 2012,the construction market and available equipment have changed. As a result of these refinements and market changes,the Design-Build Team has modified plans, which resulted in minor changes to the temporary impact areas. There are no proposed changes to the permanent impact areas approved in the original permits. Nothing Compares..,.. State of North Carolina I Department of Transportation I Division I 113 Airport Drive I Suite 100 I Edenton,NC 27932 252-482-1850 Construction and operation of a casting yard that was originally planned in Hyde County has been cancelled due to changing market circumstances. Instead, casting will take place off-site at a commercial pre-existing casting facility located in coastal Virginia. Therefore,the 0.01 acre temporary surface water impacts for the casting yard piles are not needed. An updated layout of the barge loading/unloading dock at the south end of the project (Site 3) is proposed that will operate more efficiently and better utilize the existing bathymetry. The original design followed the angle of the existing landward emergency ferry ramp and had two dock fingers attached to the end of the dock. Impacts for this originally-permitted structure were calculated based on 24-inch hollow steel piles supporting the temporary structure deck. The proposed layout has a different footprint over the water with 36-inch temporary hollow steel piles to be used,but the impacts still total less than 0.01 acre(0.005 acre of temporary surface water impact, 0.001 acre of temporary CAMA wetland impact).New plansheets have been provided to show the proposed layout and dimension.Additionally, shaded areas have been shown on the attached aerial drawing to depict the temporary impacts within the CAMA AEC buffer within the former ferry ramp at Site 3. These impacts include 0.052 acre of temporary fill (ABC stone,matting and Eco block)and 0.036 acre of temporary trestle(0.002 acre of pile supporting the trestle)leading to the loading dock. Portions of the main work trestle(part of Site 5,aligned between the existing bridge and new bridge in the northern third of the bridge extent)have been revised to provide a safer and more efficient work area for the contractor and on-site personnel. The revised work trestle layout, shown in the attached plans,will provide limited amounts of additional storage on the deck for maneuvering cranes,accessing the bent work areas,staging piles, and storing materials. This additional storage will reduce the risk of accidents and spills occurring during construction. The work trestle will also be utilized for the jetting water lines,which will access surface waters for intake withdrawal(including the Motts Creek channel near bent 77). The temporary hollow steel trestle piles would increase in size from the originally-permitted 24-inch diameter hollow steel piles to 36-inch diameter hollow steel piles. In total,the increase in number of required hollow steel piles and the increase in the pile diameter results in a slight increase in temporary impacts.Temporary fill in wetlands(CAMA wetlands) is proposed to increase from 0.02 acre to 0.032 acre. Temporary fill in surface waters is proposed to increase from 0.04 acre to 0.066 acre. The impacts related to the modifications contained herein are summarized in each table.
