Department of Transportation, 113 Airport Drive, Suite 100, Edenton, NC 27932 Authorizing development in Dare County at Oregon Inlet, Herbert C. Bonner Bridge on NC Highway 12, as requested in the permittee's application letter dated 6/6/16, including the attached workplan drawings (5): 3 dated 6/1/16, and 2 dated as received 6/6/16. This permit, issued on 6/17/16 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. 1) Unless specifically altered herein, this Minor Modification authorizes the placement of a 36" hollow steel pile in Motts Creek to create a protected jetting water intake point as a means and method for construction during replacement of the Herbert C. Bonner Bridge over Oregon Inlet, as depicted on the attached workplan drawings. • 2) In accordance with commitments made by the permittee, a—1/2 inch metal "bottle cap" type screen shall be placed over the top of the authorized 36" pile, and a screen shall also be placed on the intake line. • NOTE: The specific development being permitted does not preclude the remainder of the B-2500 project being built in the Pamlico Sound provided that future development will be constructed in a way that avoids and minimizes impacts to AECs. • (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or Signed by the authority of the Secretary of DEQ and the other qualified persons within twenty (20) days of the issuing Chairman of the Coastal Resources Commission. date. Department of Transportation Permit No. 106-12 Page 2 of 2 ADDITIONAL CONDITIONS 3) The permittee shall exercise all available precautions to ensure that the authorized jetting water intake structure and associated equipment does not pose a hazard to navigation. 4) In accordance with commitments made by the permittee, the permittee shall replace the substrate that is removed from within the authorized 36" hollow steel pile during installation with suitable material prior to extracting the pile. NOTE: The permittee shall request approval from the N.C. Division of Coastal Management (DCM) if any additional jetting water intakes are desired. 5) If it is determined that additional permanent and/or temporary impacts are necessary that are not shown on the attached workplan drawings or described in the authorization request, a permit modification and/or additional authorization from DCM may be required. In addition, any changes in the approved plan may also require a permit modification and/or additional authorization from DCM. The permittee shall contact a representative of DCM prior to commencement of any such activity for this determination and any permit modification. 6) Nothing in this Minor Modification authorizes any activity that has not received approval from the National Park Service (NPS) and/or the United States Fish and Wildlife Service (USFWS) for work within the Cape Hatteras National Seashore and/or the Pea Island National Wildlife Refuge. The proposed work shall not commence until the permittee has been issued Special Use Permit(s) from the NPS and/or the USFWS, if required, and a copy of the Special Use Permit(s) are received by DCM. NOTE: This Minor Modification does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The permittee is strongly encouraged to contact the DCM Transportation Project Coordinator in Elizabeth City to request a preconstruction conference prior to project initiation. 7) This Minor Modification shall be attached to the original of Permit No. 106-12, which was issued on 9/19/12, as well as all subsequent modifications, and copies of all documents shall be readily available on site when a Division representative inspects the project for compliance. 8) All conditions and stipulations of the active permit remain in force under this Minor Modification unless specifically altered herein. Material inside the 36 inch pile will be removed by suction line to -3 ft. below the creek bed.That material (" 1 cubic yard)will be carried up through the pump system and discarded in an upland location. This intake point will be maintained throughout the project for a water intake point and will be utilized during pile jetting operations for water supply. Following the pile installation along the section of the bridge, PCL will replace the removed substrate with suitable material and extract the pile. The water intake point in Motts Creek was included in the permitting language and is located within the cross hatched footprint of the temporary work trestle on the permit drawings. I double checked with HDR engineering on the temporary pile impact calculations included in the permit and they informed me that the Impact summary table ***Bent Impacts for temporary trestle pile impact of 0.066 acres SW, allows for the Motts Creek Channel intake. At the time of permitting a particular design for the intake point wasn't available, it has since been designed, so I wanted to make you all aware of their set-up. By having the 36"sump pile, it provides another opportunity to put a —1/2 inch metal "bottle cap" type screen over the top of the 36" pile, as well as a screen on the intake line itself. '-The impacts for the removal of the existing bridge were calculated using the pile window(the extent that the piles project into the water)and not individual pile sizes.The demolition/pile removal in wetlands was considered'Temporary Fill"because"Temporary Excavation"is not a category. NC DEPARTMENT OF TRANSPORTATION Impacts for the temporary work trestle,work bridge,and work platform were calculated as pile impacts.The piles being proposed are 36"circular piles The work trestle,platforms,and bridge all require two piles per span and spans will be spaced every 40 feet apart.The boardwalk impacts are calculated as the entire footprint of the 10'wide boardwalk. After receiving the June 6, 2016 e-mail below, the following additional detail was received from NCDOT in response to a request from DCM for additional information: • "Page 2, second paragraph of the permit modification request from February 2, 2016 includes language about Motts Creek intake point and 36 inch pile impacts. • By having the 36 " sump pile, it provides another opportunity to put a—1/2 inch metal "bottle cap" type screen over the top of the 36"pile, as well as a screen on the intake line itself." FYI, the specific language from the February 2, 2016 NCDOT request, which was authorized by DCM in a Minor Modification on February 5, 2016, is as follows: "The work trestle will also be utilized for the jetting water lines, which will access surface waters for intake withdrawal (including the Motts Creek channel near bent 77.)"
