ADDITIONAL CONDITIONS
3) In accordance with commitments made by the permittee in the permit application, a primary and

8) The permittee shall contact the DCM Transportation Project Coordinator in Elizabeth City to request a
preconstruction conference prior to project initiation.
9) The N.C. Division of Water Resources (DWR) is currently reviewing the proposal to determine if the
activities authorized by this Minor Modification will require authorization from North Carolina's Water
Quality Certification program. If required, the permittee shall receive a Water Quality Certification
from DWR, and a copy shall be provided to DCM, prior to the initiation of any construction activities
authorized by this Minor Modification.
NOTE: This Minor Modification does not eliminate the need to obtain any additional state, federal or

Greg,
Per our phone conversations this week and discussion about the secondary containment system process. I have put
together a request for a minor permit modification to allow for a change in the secondary containment system
operation. After reviewing their proposal and looking at their revisions, I think this is going to be a better system and will
result in less temporary impact issues around the pile jetting operation. I attached the request letter, schematic
drawings and a copy of the permitted footprint of the trestle &jetting containment areas for reference. There will be no
change in the permitted impact footprint. All permitted impacts will remain the same.
Let me know if you have any questions.
Thanks,
Clay Willis

The North Carolina Department of Transportation(NCDOT)requests a minor
modification to the above referenced permits, due to process improvements in the
secondary containment system, associated with the pile jetting operation. The change is a
result of the contractor's review of the previously proposed system and identification of
some operational inefficiencies, and logistical problems. The main one being a secondary
containment system placed directly around the pile template and primary containment
system, will be difficult to efficiently empty excess spoils. The system will likely still
require additional settling tanks, resulting in more spoil transfers, increasing the risk of
losing material.
After reviewing the system, PCL has made revisions that still provide secondary
containment, while increasing efficiency and also reducing potential temporary impact
effects on the coastal marsh areas. As shown in the provided diagram, the revised system
will pump the spoils out of the primary containment system (66"cylinder pile)into a
secondary system that is located adjacent to the pile template/primary containment. This
location will have two settling tanks staged (1 @20 cubic yd. / 1 @25 cubic yd. boxes),
providing easy access for removal of settled spoils. The waste water from the settling
tanks will be routed through a filter system, recycling the water for additional Use in the
jetting operation. With the revised containment system, frame work for the pile template
structure and containment system can be adjusted for elevation on 8 support spud piles.
Therefore, the containment system can be adjusted to remain elevated above the marsh
substrate and wetland vegetation. This is a vast improvement over the previous system,

which was permitted to lay directly on the substrate, thus increasing the concern of
temporary impact effect from the weight of the secondary containment box. The proposed
containment operation is still completely within the originally permitted temporary
impacts area for the pile jetting operation. There will be no changes in jurisdictional
impacts resulting from this process modification. All condition of the CAMA permit and
modifications will be followed.

CAMA Minor Permit Modification(CAMA Major Permit No. 106-12)
TIP B-2500 Phase I- Replacement of Bridge No. 11 on NC 12,Dare County
DATE: July 11,2016
The following are my comments and recommendations regarding the above mentioned
modification request. The request is to revise the jetting operation containment system as a means
and method for construction at bents 47 through 78 during the replacement of Bridge No. 11 over
Oregon Inlet on NC Hwy 12, TIP No. B-2500 Phase I, in Dare County. The change is a result of
the contactor's review of the previously proposed system and identification of operational
inefficiencies and logistical problems. There will be no changes in jurisdictional impacts resulting
from this process modification, according to the applicant. Based upon my review I have no
objection to the issuance of this permit, but offer the following conditions:
1 This Major Modification of Permit 106-12 authorizes the revision in the jetting operation
containment system to be used at bents 47 through 78 as a means and method for
construction during the replacement of Bridge No. 11 over Oregon Inlet, as depicted on
the attached work plan drawings.
2 No jetting spoil material shall be placed at any time in any vegetated wetlands or
surrounding waters without permit modification.
3 No vegetated wetlands or waters of the State shall be excavated or filled, without permit
modification.

4 If it is determined that additional permanent and/or temporary impacts are necessary that
are not shown on the attached work plan drawing(s)or described in the authorized permit
application, a permit modification and/or additional authorization from the N.C. Division
of Coastal Management(DCM) shall be required. In addition, any changes in the
approved plan may also require a permit modification and/or additional authorization
from DCM. The permittee shall contact a representative of DCM prior to
commencement of any such activity for this determination and any permit modification.
5 No permanent and/or temporary impacts from jetting spoils to wetlands or waters of the
State are authorized by this permit without prior approval from DCM.
6 In order to minimize impacts to fish species, the water intakes for the jetting operation
shall use NCDMF recommended jetting intake screens and approach velocities.
7 This permit does not eliminate the need to obtain any additional state, federal, or local
permits, approvals or authorizations that may be required.
8 All conditions and stipulations of the active permit remain in force under this Major

Subject: Pile jetting for this Thursday-delayed
Garcy and Greg,
The contractor just notified me they will not be jetting on Thursday, due to a pile delivery issue. The pile supplier will
now be shipping the piles on Thursday evening, which means they will likely be jetting on Saturday. Next week will be
another template reset to the next bent location. So, no jetting planned for next week. The next opportunity to watch
them jet a pile will probably be the week of July 25th
My only concern with waiting to the week of July 25th, is permit processing time. If we wait until then, and DWR/DCM
say we don't like the way this process looks and we can't issue the permit authorization, then we will likely get into a
standoff with the contractor over the process. We can't contractually direct them on how to jet the piles, as long as they
are containing the jetting spoils in a primary/secondary containment system. They have stated they will contain the
spoils and provided us with a process that illustrates primary and secondary containment. If they fail to contain the
jetting spoils, as the permit requires, then we immediately shut them down and it will be upon them to change the
jetting process, with any time delays falling directly upon the contractor(they have spent over a month refining this
process and have significant time/expense invested with it).
NCDOT will very clearly communicate to the inspectors and PCL that, their proposed process must contain the jetting
spoils in a secondary containment, as it has been proposed. Any temporary impacted areas, the permit currently allows,
1
is only from placement of the containment bins within that footprint. There will be no loose jetting spoils allowed within
the temporary impact areas around the bent.
Let me know how you all want to proceed and we can discuss.
Thanks,
Clay

Cathy—
I received a phone call from Clay stating that PCL might use a different methodology related to the 2nd containment
system. We can discuss today.

Per our conversation, attached are information from the permit application and meeting minutes. Please clarify the
secondary containment for me, so we can make sure we are in compliance with what the agencies understood would be
used for jetting containment.
Thanks
