Department of Transportation, 113 Airport Drive, Suite 100, Edenton, NC 27932 Authorizing development in Dare County at Oregon Inlet, Herbert C. Bonner Bridge on NC Highway 12, as requested in the permittee's application letter dated 6/22/16, including the attached workplan drawings (2) dated 5/10/16. This permit, issued on July 14, 2016 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. 1) Unless specifically altered herein, this Minor Modification authorizes a revision in the containment system associated with the bridge pile jetting operation to be used at bents 47 through 78 as a means and method for construction during replacement of the Herbert C. Bonner Bridge over Oregon Inlet, as depicted on the attached workplan drawings. 2) All reasonable efforts shall be made to contain jetting spoils and keep them from entering wetlands or areas containing submerged aquatic vegetation. NOTE: The specific development being permitted does not preclude the remainder of the B-2500 project being built in the Pamlico Sound provided that future development will be constructed in a way that avoids and minimizes impacts to AECs. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty(20)days of the issuing date. This permit must be accessible on-site to Department ‘ e O dll personnel when the project is inspected for compliance. Department of Transportation Permit No. 106-12 Page 2 of 3 ADDITIONAL CONDITIONS 3) In accordance with commitments made by the permittee in the permit application, a primary and secondary containment system shall be used to capture as much of the jetting water as possible and allow for re-use of the water within the jetting operation for bridge bents 47 through 78. Excess spoil shall be disposed of according to the NCDOT borrow/waste procedures at an approved off-site location. 4) The permittee and/or its contractor shall monitor the performance of the authorized containment system while it is operational. In the event that the authorized containment system does not contain the jetting spoil material as expected, then the jetting operation shall immediately cease operations and the permittee shall initiate discussions with DCM to determine appropriate actions. 5) No additional permanent and/or temporary impacts due to the jetting operation to wetlands, submerged aquatic vegetation, or waters of the State are authorized by this Minor Modification without prior approval from DCM. NOTE: This Minor Modification will reduce the amount of temporary impacts to wetlands and waters of the State due to removal of the secondary containment boxes from the project design. 6) If it is determined that additional permanent and/or temporary impacts are necessary that are not shown on the attached workplan drawings or described in the authorization request, a permit modification • and/or additional authorization from DCM may be required. In addition, any changes in the approved plan may also require a permit modification and/or additional authorization from DCM. The permittee shall contact a representative of DCM prior to commencement of any such activity for this determination and any permit modification. 7) Nothing in this Minor Modification authorizes any activity that has not received approval from the National Park Service (NPS) and/or the United States Fish and Wildlife Service (USFWS) for work within the Cape Hatteras National Seashore and/or the Pea Island National Wildlife Refuge. The proposed work shall not commence until the permittee has been issued Special Use Permit(s) from the NPS and/or the USFWS, if required, and a copy of the Special Use Permit(s) are received by DCM. 8) The permittee shall contact the DCM Transportation Project Coordinator in Elizabeth City to request a preconstruction conference prior to project initiation. 9) The N.C. Division of Water Resources (DWR) is currently reviewing the proposal to determine if the activities authorized by this Minor Modification will require authorization from North Carolina's Water Quality Certification program. If required, the permittee shall receive a Water Quality Certification from DWR, and a copy shall be provided to DCM, prior to the initiation of any construction activities authorized by this Minor Modification. NOTE: This Minor Modification does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. 10) This Minor Modification shall be attached to the original of Permit No. 106-12, which was issued on 9/19/12, as well as all subsequent modifications, and copies of all documents shall be readily available on site when a Division representative inspects the project for compliance. f N.C. I have put together a request for a minor permit modification to allow for a change in the secondary containment system operation.After reviewing their proposal and looking at their revisions, I think this is going to be a better system and will result in less temporary impact issues around the pile jetting operation. I attached the request letter, schematic drawings and a copy of the permitted footprint of the trestle &jetting containment areas for reference.There will be no change in the permitted impact footprint.All permitted impacts will remain the same. The change is a result of the contractor's review of the previously proposed system and identification of some operational inefficiencies,and logistical problems. The main one being a secondary containment system placed directly around the pile template and primary containment system,will be difficult to efficiently empty excess spoils. The system will likely still require additional settling tanks,resulting in more spoil transfers, increasing the risk of losing material. After reviewing the system, PCL has made revisions that still provide secondary containment,while increasing efficiency and also reducing potential temporary impact effects on the coastal marsh areas. As shown in the provided diagram,the revised system will pump the spoils out of the primary containment system (66"cylinder pile)into a secondary system that is located adjacent to the pile template/primary containment. This location will have two settling tanks staged (1 @20 cubic yd. / 1 @25 cubic yd. boxes), providing easy access for removal of settled spoils. The waste water from the settling tanks will be routed through a filter system, recycling the water for additional Use in the jetting operation. With the revised containment system, frame work for the pile template structure and containment system can be adjusted for elevation on 8 support spud piles. Therefore,the containment system can be adjusted to remain elevated above the marsh substrate and wetland vegetation. Next week will be another template reset to the next bent location. So, no jetting planned for next week.The next opportunity to watch them jet a pile will probably be the week of July 25th My only concern with waiting to the week of July 25th, is permit processing time. If we wait until then,and DWR/DCM say we don't like the way this process looks and we can't issue the permit authorization, then we will likely get into a standoff with the contractor over the process.We can't contractually direct them on how to jet the piles, as long as they are containing the jetting spoils in a primary/secondary containment system.They have stated they will contain the spoils and provided us with a process that illustrates primary and secondary containment. If they fail to contain the jetting spoils, as the permit requires,then we immediately shut them down and it will be upon them to change the jetting process, with any time delays falling directly upon the contractor(they have spent over a month refining this process and have significant time/expense invested with it). NCDOT will very clearly communicate to the inspectors and PCL that, their proposed process must contain the jetting spoils in a secondary containment, as it has been proposed. Any temporary impacted areas, the permit currently allows, 1 is only from placement of the containment bins within that footprint.There will be no loose jetting spoils allowed within the temporary impact areas around the bent.
