Department of Transportation, 113 Airport Drive, Suite 100, Edenton, NC 27932 Authorizing development in Dare County at Oregon Inlet, Herbert C. Bonner Bridge on NC Highway 12, as requested in the permittee's application letter dated 9/12/16, including the attached workplan drawings (4) dated 9/8/16. This permit, issued on 9/26/16 , is subject to compliance with the application (where consistent with the permit),all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. 1) Unless specifically altered herein, this Minor Modification authorizes a change in the pile installation methodology for permanent bridge piles for the replacement bridge over Oregon Inlet between bridge bents 47 through 78, as indicated in the attached letter dated 9/12/16, including the attached workplan • drawings. 2) In accordance with commitments made by the permittee, the three 66" diameter x 80' long temporary containment/casing piles shall remain in place at each of the 31 temporary storage locations for no longer than 6 days, without additional authorization. NOTE: The specific development being permitted does not preclude the remainder of the B-2500 project being built in the Pamlico Sound provided that future development will be constructed in a way that avoids and minimizes impacts to AECs. Department of Transportation Permit No. 106-12 Page 2 of 3 f` ADDITIONAL CONDITIONS ' NOTE: The timeframe needed for the authorized temporary impact areas will be until;the Spring of 2018. The permittee estimates that approximately 8 days will be required to install the ; permanent pilings at each of the 31 bridge bents between bents 47 through 78.,; 3) Substrate material associated with the temporary containment/casing piles at the temporary storag' locations shall remain in place after piling removal to help compensate for temporary impacts. Material resulting from the removal of the temporary containment/casing piles shall not enter wetlands or waters • of the State outside of the authorized areas, even temporarily. • I 4) No excavation or filling shall take place at any time in any vegetated wetlands or surrounding waters outside of the alignment of the areas indicated on the authorized workplan drawings, without permit modification. 5) The installation and removal of the temporary containment/casing piles at the temporary storage locations shall be accomplished by pile driving and/or the use of a vibratory hammer. Should the permittee and/or its contractor propose to utilize another type of pile installation or removal at the • temporary storage locations, such as jetting or drilled shaft construction, additional authorization from the N.C. Division of Coastal Management(DCM) shall be required. 6) Material excavated from the project site may be used in fill areas associated with the project once properly dewatered. Otherwise,the material shall be removed from the site and taken to a high ground location. 7) In accordance with commitments made by the permittee, the areas of submerged aquatic vegetation and Coastal Wetlands that are impacted by activities authorized by this Minor Modification shall be included within the temporary impact areas monitored in accordance with Condition No. 32 of the original CAMA Permit No. 106-12 issued on 9/19/12. 8) In accordance with commitments made by the permittee, approximately 8,370 square feet of previously approved temporary impact areas due to shading shall be eliminated from the authorized project, as depicted on the attached workplan drawings. NOTE: The new temporary impacts authorized by this Minor Modification within submerged aquatic vegetation, Coastal Wetlands and unvegetated surface waters at 31 authorized temporary impact areas is approximately 8,370 square feet. 9) The permittee shall contact the DCM Transportation Project Coordinator in Elizabeth City to request a preconstruction conference prior to project initiation. 10) If it is determined that additional permanent and/or temporary impacts are necessary that are not shown on the attached workplan drawings or described in the authorization request, a permit modification and/or additional authorization from DCM may be required. In addition, any changes in the approved plan may also require a permit modification and/or additional authorization from DCM. The permittee shall contact a representative of DCM prior to commencement of any such activity for this determination and any permit modification. N.C. Department of Transportation Permit No. 106-12 Page 3 of 3 ADDITIONAL CONDITIONS 11) Nothing in this Minor Modification authorizes any activity that has not received approval from the National Park Service (NPS) and/or the United States Fish and Wildlife Service (USFWS) for work within the Cape Hatteras National Seashore and/or the Pea Island National Wildlife Refuge. The proposed work shall not commence until the permittee has been issued Special Use Permit(s) from the NPS and/or the USFWS, if required, and a copy of the Special Use Permit(s) are received by DCM. 12) The permittee shall coordinate with the U.S. Army Corps of Engineers (USACE) and the N.C. Division of Water Resources (DWR) regarding the project. The permittee shall obtain any required permits from USACE and DWR and provide a copy to DCM prior to initiating construction activities that are authorized by this Minor Modification. 13) This Minor Modification does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. 14) This Minor Modification shall be attached to the original of Permit No. 106-12, which was issued on 9/19/12, as well as all subsequent modifications, and copies of all documents shall be readily available on site when a Division representative inspects the project for compliance. 15) All conditions and stipulations of the active permit remain in force under this Minor Modification unless altered herein. NOTE: A minor modification application processing fee of$100 was received by DCM for this project. The correct estimate of temporary impacts that are being eliminated from certain areas, and added to other areas, is 7,440 square feet; and (2) Condition No. 8 incorrectly states that the temporary impact areas being eliminated were due to shading, however the temporary impact areas being eliminated were due to the removal of jetting containment boxes that would have been placed on the substrate. The North Carolina Department of Transportation(NCDOT)requests a minor modification to the above referenced permit, for a change in location of temporary impact area associated with the work trestle and bridge bent pile installation.The current permit has a 40'w X 60'L(2400 sq.ft.)temporary impact area at Site 5,associated with each bridge bent construction location.The contractor has utilized a portion of that permitted footprint,which is 33'w X 52'L(1,716 sq. ft.). Their process for bridge bent pile installation is requiring the installation of 66"X 80' long hollow steel casing piles at each pile location(3 per bent).This allows the contractor to excavate within the 66"casing pile to depths of around 80 ft.,prior to the placement of the 54"concrete production pile, which is then driven to the design depth. This process reduces the need for a pile jetting operation. In between bridge bent pile installation the 3 —66"x 80' long casing piles require temporary storage(4-6 days),while the pile template is relocated and set in place at the next bent. The contractor has reviewed the site and process for potential temporary storage area,resulting in the safest most efficient option,being a vertical pile placement directly beside the work trestle,at mid-span. This would be within an 8' wide X 30' long area directly abutting the work trestle,as shown in the revised permit drawings. The modified permit drawings,illustrate eliminating an 8'X30'section of the permitted temporary impact and relocating 8'X30' to mid-span,directly adjacent to the work trestle. This will provide temporary storage(4-6 days) for the 3 hollow 66"casing piles. The temporary impact square footage will remain the same,as previously permitted. The casing piles are hollow steel piles that are vibrated into position,and will only be stored in the temporary location for 4-6 days. Once the pile template is in place at the next bent,the casing piles are vibrated out and then positioned within the template and permitted bent location.NCDOT will include the 8'X30' relocated temporary impacts into the post construction 3 year monitoring protocol that is required by condition 32)of Permit No 106-12. All other conditions of the regulatory permits and documents will be followed as previously committed to. The request is to allow temporary placement/storage adjacent to the work trestle of 66"x80' hollow containment/casing piles associated with bridge bent construction during the replacement of Bridge No. 11 over Oregon Inlet on NC Hwy 12, TIP No. B-2500 Phase I, in Dare County. This modification will provide vertical temporary storage (4-6 days) for the three hollow casing piles within an 8'x30' area directly adjacent to the work trestle at mid-span. The hollow steel piles will be vibrated into position to a depth of approximately 40' to 50'. Once the pile template is positioned at the next bent, the hollow steel piles will be vibrated out and then positioned within the template at the permitted bent location. This will be a staged process with only three hollow steel piles being temporarily stored at one time. Response from PCL: I don't foresee issues with material getting stuck in the casings on the north end because we are largely dealing with sand. However, if this is encountered we would plan to vibrate the casings up until they are fully extracted which should shake free any contained material. On a typical pile we stop vibrating prior to the casing being fully extracted just because it isn't need to get the pile all of the way out and there are concerns of how the casing will behave once it is no longer contained by the ground. If substrate is still trapped we would continue to run the vibratory hammer over the casing storage location until all of the material becomes dislodged. The time frame needed for the temporary impact area will be until the Spring of 2018,with the trestle work bridge going out to the inlet and then subsequent removal. I don't anticipate they will need to modify anything.They didn't the last time we modified the trestle configuration and actually changed the impact numbers.This area is not in the USFWS Pea Island jurisdiction. I believe we are still in the NPS boundary from the shoreline, but this area is within the permitted footprint of the bridge alignment and our easement. I am checking on your other two questions,and will get back to you soon.
