Bonner Bridge on NC Highway 12 , as requested in the permittee's application dated 12/2/16 and e-mail dated 1/3/17, including the attached workplan drawings (10): as referenced in Condition No. 1 of this permit. This permit, issued on 2/6/17 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. TIP No. B-2500, Phase I 1) All work authorized by this permit shall be carried out in accordance with the following attached workplan drawings (10), except as modified herein: 6 dated 12/1/16, 1 dated 10/12/16, 1 dated received 1/3/17, & 2 dated received 12/2/16. NOTE: The specific development being permitted does not preclude the remainder of the B-2500 project being built in the Pamlico Sound provided that future development will be constructed in a way that avoids and minimizes impacts to AECs. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other Signed by the authority of the Secretary of DEQ and the qualified persons within twenty(20)days of the issuing date. Department of Transportation Permit No. 106-12 Page 2 of 4 ADDITIONAL CONDITIONS 3 2) Unless specifically altered herein, this Minor Modification authorizes the following activities associated • with the replacement of the Herbert C. Bonner Bridge over Oregon Inlet, all as depicted on the attached workplan drawings: (a) changes to the work trestle alignment from Bent 65 to Bent 39, including installation of 10 temporary docking piles; (b) construction of an upland dewatering basin with • dimensions of 185 x 36 x 3 feet to receive jetting spoils, if necessary for pile installation; and (c) • construction of 8 temporary barge mooring stations with a radius of 450 feet each in Pamlico Sound for securing work barges and vessels. 3) Nothing in this permit authorizes any activity that has not received approval from the National Park Service (NPS) and the U.S. Fish and Wildlife Service (USFWS) for work within the Cape Hatteras National Seashore and the Pea Island National Wildlife Refuge, if such approval is required. The proposed work shall not commence until the permittee has been issued a Special Use Permit from the NPS and/or USFWS, if required, and a copy of the Special Use Permit(s) are received by the N.C. Division of Coastal Management (DCM). 4) In accordance with commitments made by the permittee, barges shall not be moored within 300 feet of Island C. 5) The mooring anchors shall be removed in their entirety immediately after they are no longer needed. 6) In accordance with commitments made by the permittee, the mooring anchors authorized by this Minor Modification shall be located immediately adjacent to the previously authorized mooring anchors. 7) In accordance with commitments made by the permittee, barge and tug activity accessing the authorized mooring anchors shall remain within marked navigational channels or historically deep waters. 8) No sewage, whether treated or untreated, shall be discharged at any time from any vessels using the authorized facilities. Any sewage discharge at the authorized facilities shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 9) The permittee and/or his contractor shall provide for proper storage and handling of all oils, chemicals, etc., necessary to carry out the project. 10) The installation and removal of the temporary docking piles shall be accomplished by pile driving and/or the use of a vibratory hammer. Should the permittee and/or its contractor propose to utilize another type of pile installation for the docking piles, such as jetting, additional authorization from DCM shall be required. • . . . Department of Transportation Permit No. 106-12 Page 3 of 4 ADDITIONAL CONDITIONS Dewatering Basin to Receive Jetting Spoils 11) No additional permanent and/or temporary impacts due to the jetting operation to wetlands, submerged aquatic vegetation, or waters of the State are authorized by this Minor Modification without prior approval from DCM. 12) This project shalt conform to all requirements of the N.C. Sedimentation Pollution Control Act and the N.C. Department of Transportation's (NCDOT's) Memorandum of Agreement with the N.C. Division of Energy, Mineral, and Land Resources. 13) Prior to implementation of the dewatering basin, the permittee shall provide DCM with workplan drawings depicting any design changes or additional infrastructure that is required, including any infrastructure needed to transport jetting material to the dewatering basin. 14) The permittee and/or its contractor shall monitor the performance of the jetting material transport system and the dewatering basin while it is operational. In the event that the jetting material transport system and the dewatering basin do not contain the jetting spoil material as expected, then the jetting operation shall immediately cease operations and the permittee shall initiate discussions with DCM to determine appropriate actions. 15) Material excavated from high ground areas at the project site, and jetting material that is transported to the dewatering basin, may be used in fill areas associated with the project once properly dewatered or shall be removed from the site and taken to a high ground location. 16) In accordance with commitments made by the permittee, the portion of the dewatering basin located outside of the future road fill area shall be removed and re-graded prior to the opening of the new roadway alignment. General NOTE: The authorized activities shall result in an increase of approximately 44 square feet of temporary impacts to wetlands and a decrease of approximately 479 square feet of temporary impacts to surface waters due to the realignment of the work trestle. 17) This Minor Modification shall not result in additional permanent impacts to wetlands or waters of the State, without permit modification. 18) The permittee shall exercise all available precautions in the day-to-day operation of the facility to prevent waste from entering the adjacent waters and wetlands. Department of Transportation Permit No. 106-12 Page 4 of 4 ADDITIONAL CONDITIONS 19) If it is determined that additional permanent and/or temporary impacts are necessary that are not shown • on the attached workplan drawings or described in the authorized permit application, a permit modification and/or additional authorization from DCM may be required. In addition, any changes in the approved plan may also require a permit modification and/or additional authorization from DCM. • The permittee shall contact a representative of DCM prior to commencement of any such activity for this determination and any permit modification. 20) The permittee and/or its contractor shall contact the DCM Transportation Project Field Representative in Elizabeth City at (252) 264-3901 to request a preconstruction conference prior to project initiation. 21) The permittee shall maintain the authorized work in good condition and in conform ince with the terms and conditions of this permit for the life of the permitted structure. 22) The permittee shall make every attempt to maintain the same navigation that is currently possible in the project area of Pamlico Sound. NOTE: The U.S. Coast Guard issued a letter dated 12/14/16 stating no objections to the modifications. • 23) The permittee shall install and maintain, at its expense, any signal lights, signals, signage, or notifications prescribed by the U.S. Coast Guard, through regulations or otherwise, on the authorized • temporary docking piles and mooring buoys. At a minimum, permanent reflectors shall be attached to the structures in order to make them more visible during hours of darkness or inclement weather. 24) The N.C. Division of Water Resources (DWR) authorized the new alignment of the temporary work trestle and the containment of any potential jetting spoil material in an upland basin on 2/3/17 under an In-Field Minor 401 Water Quality Certification(DWR Project No. 20120629 v.5). Any violation of the Certification approved by DWR shall be considered a violation of this CAMA permit. 25) DWR authorized the 8 additional barge mooring locations in Pamlico Sound under General Water Quality Certification No. 3893 (DWR Project No. 20160186 v.2). Any violation of the Certification approved by DWR shall be considered a violation of this CAMA permit. NOTE: The U.S. Army Corps of Engineers authorized the eight mooring anchors under Nationwide Permit Number 33 (COE Action ID No. SAW-1993-03077), which was issued on 1/10/17. NOTE: This Minor Modification does not eliminate the need to obtain any additional slate, federal or local permits, approvals or authorizations that may be required. 26) This Minor Modification shall be attached to the original of Permit No. 106-12, which was issued on 9/19/12, as well as all subsequent modifications, and copies of all documents shall be readily available on site when a Division representative inspects the project for compliance. 27) All conditions and stipulations of the active permit remain in force under this Minor Modification unless specifically altered herein. There are no proposed changes to the permanent impact areas approved in the original permits. Please note that impacts have been shown to the thousandths of an acre herein,thus due to rounding and summing of the impacts will not perfectly match the hundredths in the original permit application. Trestle Alignment Modifications The Team has modified their plans for how they are using the temporary work trestle as it expands to the south. The trestle realignment begins at bent 65 and ends at bent 39,as shown the provided permit drawings. Originally,the trestle was intended to be used for both construction of the new bridge,as well as demolition of the existing bridge. However,the Team has developed a new demolition method,utilizing the existing structure and engineered framework,to allow for a top down removal technique. This eliminates the need for an adjacent work trestle to operate from during the demolition process.Thus,realigning the work trestle, so it abuts the new bridge alignment will increase crane efficiency,while eliminating some of the overall work trestle area. Where some of the work trestle platform was able to be reduced,additional work trestle will be needed around bent 39. The water depths near bent 40 have continued to decrease,thereby restricting crane barge access,so the work trestle will need to be extended to just beyond bent 39 of the new bridge to allow for access and construction of bent 39. The previously permitted temporary storage platform,consisting of 8 support bents,originally planned near bent 39 has been replaced with the extended trestle as well as ten 36"temporary docking piles. These piles would be used to dock a barge between the trestle and the existing bridge for construction and demolition barge access.The included revised permit drawings show the new alignment for the work trestle and proposed docking piles.For comparison we have also included a separate set of the previous trestle alignment drawings(01/14/2016),along with the proposed new trestle alignment drawings(12/01/2016). Pile Installation Methods Correspondence with the agencies has been on-going since the contractor's move'away from jetting as the primary method of pile installation in the marsh and SAV areas(bents 47 through 78). The Team was able to develop a reliable alternative to jetting, as the primary pile installation method. The original jetting process consisted of utilizing a 66"steel pile casing and excavating the soil material from inside the casing to an elevation between-40 and-60 feet. The permanent pile was then placed in the casing,jetted down through more dense soils to near the final tip elevation,and driven(with a pile hammer) the remainder of the distance to its required tip elevation. Following the first several pile installations,in the upland areas on the north end,it became apparent that recapturing the required volume of jetting water and processing it through a filter system was inefficient and logistically presented various challenges.This result, led the Team to further investigate,the soil profile,to see if jetting could be minimized further or possible eliminated. Upon further investigation and a test pile drive to tip elevation,the Team realized the'soils would likely allow for pile driving and that jetting may be an unnecessary step. Air The current installation process is to excavate to a depth near-60 feet,and then drive the pile the remainder of the distance to the required tip elevation.The Team does not intend to utilize jetting in the marsh and SAV areas as a primary method for pile installation; however,there is still the potential for encountering dense subsurface soil conditions at some pile locations,where the excavation/driving method, in conjunction with some jetting,would need to be used. Should the need arise;jetting would be used,but minimized,as much as possible. If jetting is required,they will contain the jetting spoils that return to the surface within the 66"casing pile and pump them to a basin located in the upland area,north of the end bent(see attached drawing EC-16/CONST 16). This basin is currently sized at 185 x 36 x 3 feet,and would allow for the settling of sediments and storage of a large volume of water.Basin calculations take into account typical jetting water volumes and timeframes associated with these bridge pile installations. Additional Mooring Anchor Locations The Design/Build Team has determined a need for eight additional barge mooring anchor locations in Pamlico Sound for the purpose of securing barges and vessels.The proposed new mooring points are located immediately adjacent to the existing four anchor locations. Coordination with the US Coast Guard has commenced,and an attached drawing shows all twelve anchor locations in Pamlico Sound. A mooring anchor would be set in the sound bed, with a mooring chain and buoy attached to it that would allow the attached vessel to swivel within a 450-foot radius. The addition of the eight mooring stations will eliminate the need tie off multiple barges to one mooring station. With the current proposal of 12 mooring points,each barge will have its own mooring point,increasing security during adverse weather conditions. The Design-Build Team and NCDOT have been coordinating with the US Coast Guard(USCG) and US Army Corps of Engineers navigation staff regarding the type and location of these temporary mooring locations.All USCG lighting and marking requirements will be met.Barge and tug activity accessing these areas will remain within marked navigational channels or historical deep water. Below is a follow up of the questions you all had regarding the Bonner Mod request. • Provide a drawing that is at a scale that more clearly shows the dewatering basin location, and the dewatering basin ditch location, in relation to the normal water level and any SAVs, Coastal Wetlands, and 404 Wetlands in the vicinity. The nearest wetland area is 160+feet away from the basin location—the finger of wetland to the west, near the marina dump station and parking lot (see the attached sheets). We are generally looking at building up slightly on the outside shoulder(closest to silt fence) and excavating slightly on the road side in order to construct the basin, but the basin is entirely within the future footprint of the NC 12 roadway/shoulder. • Provide a profile drawing of the dewatering basin with appropriate scale. An additional profile is attached to help show dimensions and details. A true scale drawing would be difficult to read given the basin dimensions. • Provide a narrative that describes the amount of material that will be excavated from within the basin and the ditch, and the depth of excavation. Will this material be removed when the project is complete and the area restored to pre-project conditions? We don't anticipate this basin being completely excavated—there would be some cut toward the existing road shoulder and some fill on the outside of the proposed road shoulder within the easement. The basin would be built up above existing ground for the most part. The majority of the basin overlaps with the future roadway alignment,with 86% of it being located within the future road fill area. The portion outside of the road fill is within the NCDOT easement and would be removed and re-graded prior to the opening of the new roadway alignment. The total temporary excavation would be around 200 CY. • What measures will be taken to ensure the material within the basin is not vulnerable to being accidentally discharged during high water events? The basin would be located at nearly the same elevation as existing NC 12 near the existing bridge abutment,which historically has not been in an area regularly inundated by high water storm events. In addition,we are not directing any overland flow into the basin, thus rain events should not be a concern. The basin will only handle temporary flows from the jetting operation and would de-water over a relatively short duration, thereby minimizing the potential for high water events to compromise its integrity. The detail calls for side slopes and earth material on the sides i to be stabilized with geotextile fabric or matting. Also we did not assume any infiltration when sizing the basin but it is reasonable to assume some infiltration will occur. • Will any effluent/water exit the basin and enter the adjacent waters and wetlands? The water leaving the basin will be subject to the same requirements as any other water leaving the project site. Silt fence will remain between it and the wetland boundary that is downgradient. Also,we will make sure to keep the discharged water as clean as possible by lining the outlet ditch with geotextile and adding rock checks for energy dissipation. • flow will the jetting material be pumped from the 66" casing pile to the basin? Will/are the pipes attached to the work trestle? If this requires additional infrastructure (i.e. additional pipes), then that should also be described in the narrative and depicted on the drawings, as well as any SAVs, Coastal Wetlands, and 404 Wetlands that are in the path of any new pipes. Our intent would be to use fused HDPE pipe which would be stretched across the deck of the trestle. Depending on the timing of when and if this basin usage ever became required, our trestle could be to the point where it wasn't connected to the upland area. In this event we would either run the discharge line along the curb line of the existing bridge or float it across the SAV section. The exact size of the discharge line is not yet determined, but it would likely be a 12"-18" pipe,which would fit along the curb line. The request is to allow a change in the work trestle alignment,construction of a settling basin if alternate pile installation method is utilized, and additional barge mooring stations during the replacement of Bridge No. 11 over Oregon Inlet on NC Hwy 12, TIP No. B- 2500 Phase I, in Dare County. This modification will provide a trestle realignment from Bent 65 to Bent 39 and the previously permitted storage platform near Bent 39 has been replaced with the extended trestle as well as ten (10) 36" temporary docking piles. If jetting is utilized for pile installation, a 185'x36'x3' basin would be constructed in an upland area, north of the end bent located at the northern approach. Jetting spoils would be pumped to the basin and it would allow for the settling of sediments and storage of large volumes of water.The proposed eight(8)mooring points are located immediately adjacent to the existing anchor locations in the Pamlico Sound.The proposed changes will result in an increase in temporary Coastal Wetland impacts(from 0.032 ac. to 0.033 ac.) and a decrease in temporary Surface Water impacts (from 0.066 ac. to 0.055 ac.). They also removed the concrete seal slabs that were positioned on the piles driven for the new Bent 23. These seal slabs were not permanently affixed to the piling and wave action could damage the slabs and piles. As of this email all the crane and support barges have been moved from close proximity of the bridge. The current plan is to move the support barges and three of the crane barges and to the Pamlico Sound Mooring. Approx. 7.8 miles SW of Bonner Bridge.) The 4th crane barge,the largest in the fleet, will be spudded and anchored on the back side of the north end of Pea Island, i.e. adjacent to Davis Slough/Channel on back side of Pea Island). Barges will be staged at the south end and/or Island C mooring piles prior to transit to the Pamlico Sound mooring location. South End land crane will be boomed down. The boom tip will be placed on top of stacks of crane mats. North End land cranes will be positioned on higher ground near the north end of the existing bridge and the booms will be boomed down onto concex boxes and/or crane matts. North End work trestle cranes will be boomed down onto conex boxes and crane mates. Project Wide: • North and South Land Cranes will be used to hoist and stack various materials to be secured or tied down. • PCL hope to complete all crane hoisting operations Wednesday afternoon. • Small equipment will be moved to the warehouse storage near Dare County Airport. • Fuel storage tanks will be moved to the warehouse or staged on the work trestle. • Traffic drums, signs and message boards will be taken down in a staged/staggered manner over the next few days, (i.e. pull ever other drum first cycle, every other drum next cycle & repeat). • The goal is to have all items tied down, moored, secured by COB on Thursday. Pea Island New Inlet The 2 land cranes will be positioned to high ground (relatively speaking)away from the existing metal bridge & breach site. Crane and truck mats will be stacked and secured together and anchored. Jetting water line will be secured as best as possible. Jetting water tanks will be filled with water and left in place. 10 tractor trailers that are loaded with cored slabs that are on the project will be relocated to Plymouth or other Small equipment&supplies will be repositioned to high ground away from the bridge or removed from the project limits, or put on top of the new structure. Fuel storage tanks will be removed from the project limits. The goal is to be complete with all storm preparations Thursday afternoon or Friday morning. 2 Summary. Both projects have been very cooperative in their preparations and discussions with my staff.
