This permit, issued on August 10.2017 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action;or may cause the permit to be null and void.
1) Unless specifically altered herein,this Minor Modification authorizes the installation of 70 linear feet
of temporary sheet pile, and installation of two temporary piles to provide additional support, at the
ramp to the loadout dock/work trestle, as depicted on the attached workplan drawings.
2) No new vegetated wetlands or waters of the State shall be excavated or filled, without permit
modification.
3) The temporary sheet pile shall be removed once it is no longer necessary, or upon written request from
s the N.C. Division of Coastal Management(DCM).

NOTE: The specific development being permitted does not preclude the remainder of the B-2500
project being built in the Pamlico Sound provided that future development will be constructed
in a way that avoids and minimizes impacts to the AECs.

This permit action may be appealed by the permittee or Signed by the authority of the Secretary of DEQ and the
other qualified persons within twenty (20) days of the issuing Chairman of the Coastal Resources Commission.

ADDITIONAL CONDITIONS
4) Nothing in this Minor Modification authorizes any activity that has not received approval from the
National Park Service (NPS) and/or the United States Fish and Wildlife Service (USFWS) for work within
the Cape Hatteras National Seashore and/or the Pea National Wildlife Refuge. The proposed work shall
not commence until the permittee has been issued Special Use Permit(s) from the NPS and/or the USFWS,
if required, and a copy of the Special Use Permit(s) are received by DCM.
5) The permittee shall coordinate with the U.S. Army Corps of Engineers (USACE) and the N.C. Division of
Water Resources (DWR)regarding the project. The permittee shall provide any permits issued by
USACE and DWR to DCM prior to initiating construction activities.
6) If it is determined that additional permanent and/or temporary impacts are necessary that are not shown on
the attached work plan drawings or described in the authorized permit application, a permit modification
and/or additional authorization from DCM shall be required. In addition, any changes in the approved
plan may also require a permit modification and/or additional authorization from DCM. The permittee
shall contact a representative of DCM prior to commencement of any such activity for this determination
and any permit modification.
7) This Minor Modification does not eliminate the need to obtain any additional permits, approvals or
authorizations that may be required.
8) The permittee and/or his contractor shall contact the DCM Transportation Project Field Representative in
Elizabeth City at(252) 264-3901 to request a preconstruction conference prior to project initiation.
9) This Minor Modification shall be attached to the original of Permit No. 106-12, which was issued on
9/19/12, as well as all subsequent modifications, and copies of all documents shall be readily available on
site when a Division representative inspects the project for compliance.
10) All conditions and stipulations of the active permit remain in force under this Minor Modification unless
altered herein.
NOTE: A minor modification application processing fee of$100 was received by DCM for this project.

Dear Greg,
On behalf of the North Carolina Department of Transportation (NCDOT), we hereby request a minor
modification of the above-referenced CAMA Major Development Permit due to the identification of
temporary stabilization needs at the ramp to the loadout dock/work trestle for the Bonner Bridge
Replacement project. There are no proposed changes to the permanent impact areas approved in
the original permits, and the changes presented herein are contained within the previously-
permitted temporary footprint of the project.
The proposed change is focused on temporary shoreline protection and stabilization where the
land-based ramp joins the water-based loadout trestle. This location is the former emergency ferry
ramp on the southeastern end of the B-2500 project on Hatteras Island. Adjacent to Davis Channel
and Green Island Slough, the shoreline at the former ferry ramp has experienced gradual erosion
since the 1990's (or before). PCL's access to the loadout trestle is built up using concrete block
stacked to form a retaining structure on top of the former ferry ramp, which grades up to the pile-
supported loadout/work trestle.
Over the past year, the shoreline has eroded to the point of only being a few feet from the stacked
concrete block and there is a serious concern for stability of the block and structure and safety of
the workers while on the structure. PCL has determined the best course of action is to set the block
back and install sheet pile at the outer edge of the retaining block,which would add stability and
reduce future erosion, while staying within the permitted temporary ramp and dock footprint. They
are also proposing to add two temporary piles within the ramp footprint, which will provide additional
support to carry loads that are being transferred onto the loadout trestle. The work will not require

any additional fill in wetlands or surface waters, but is a temporary shoreline stabilization effort to
protect the previously-disturbed work area.
The attached drawings depict a plan view of the ramp and dock as well as a bathymetric profile
view of the dock. The plan view drawing (sheet 5A) provides the extent of sheet pile to be installed,
as well as recent survey data showing the approximate shoreline changes.
CAMA Permit: NCDOT requests that the N.C. Division of Coastal Management review this permit
modification request and issue a minor modification for the CAMA Major Development Permit
issued September 19, 2012 and last modified September 26, 2016.

113A-121.1 or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter
150B with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh,NC 27611-6714,
(919)733-2698 within twenty(20)days of this decision on your permit.You should also be aware that
another qualified party may submit an objection to the issuance of this permit within twenty(20)days.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work

The following are my comments and recommendations regarding the above mentioned
modification request. The request for stabilization includes the installation of 70' of temporary
sheet pile and two temporary piles within the existing footprint of the ramp/loadout trestle ramp.
These requests are related to the replacement of Herbert C. Bonner Bridge over Oregon Inlet on
NC Hwy 12 in Dare County. The applicant states that the shoreline in the area has eroded and there
is a concern for stability of the ramp structure and safety of workers while on the ramp structure.
There are no jurisdictional wetlands or surface waters impacts associated with the modification
request. Based upon my review I have no objection to the issuance of this minor modification,but
offer the following conditions:

Agencies,
PCL's ramp to the loadout trestle is experiencing some issues due to the shoreline erosion along that section of the
shoreline.They currently have concrete block stacked to form a retaining structure that ramps up to the pile supported
loadout/work trestle. Over the past year,that shoreline has eroded to the point of only being a few feet from the
stacked concrete block and there is real concern for stability. PCL has decided to set the block back and install some
sheet pile at the outer edge of the retaining block,which would add stability from future erosion.They are also
proposing to add a couple of piles in the ground under the block, which will give added support to carry loads that are
being transferred onto the loadout trestle.The work will not require any additional fill in wetlands or surface waters, but
is a temporary shoreline stabilization effort. For that reason, I know CAMA has requested a minor permit modification,
but I'm not sure the COE or DWR will need to issue anything for this request. I did want to notify you all of it, so you
could determine appropriate action, if any.The current lack of stability is becoming more of concern, so I have asked
John Jamison with HDR engineering to go ahead, prepare a request and submit it on NCDOT behalf. I'm going to be out
next week on vacation, and didn't want it to be lingering any longer. He will have a set of drawings to submit along with
a request letter. Feel free to communicate any questions to him directly. I have copied him on this email, along with
Pablo,so everyone is aware of the request.

Just a quick FYI to confirm Clay's comment below that DCM will review the anticipated request for this work
as a Minor Modification of existing CAMA Permit 106-12, for the B-2500 project.
Also, in order to potentially get a jumpstart on communication before the request comes in, would you please let
me or Greg know when you determine if a 404 or 401 permit action will likely be required based upon Clay's
description below?
