Department of Transportation(NCDOT) in the attached cover letter dated March 11, 2022, including the attached contractor letter and schedule requesting additional moratorium relief for the subject project. Based upon comments received in response to this request from the N.C. Division of Marine Fisheries, the N.C. Wildlife Resources Commission and the National Marine Fisheries Service, DCM has determined that the NCDOT request for an additional 6 days of relief from the in-water work moratorium that is in the CAMA Permit 70-20 is approved, and does not require additional authorization from DCM beyond this e-mail. Work must be completed as described, and if any aspect of the project should change,NCDOT must contact DCM to determine if additional authorization is necessary. Please note that this e-mail response does not eliminate the need to obtain any additional permits, approvals or authorizations that may be required. This includes approval, if required, from the U.S. Army Corps of Engineers and/or the N.C. Division of Water Resources (DWR). Please let me know if you have any questions or concerns. A drill rig capable of applying 30,000 lbs. of down pressure will be used to twist down the caissons. The Division 3 Resident Engineer's Office has reviewed the request and determined that the proposed timeframe for twisting down the caissons is appropriate given the existing project status.Once the caissons are at the desired tip elevation the contractor will be able to resume the necessary pile construction within the caissons which is not considered in-water work subject to the moratorium. The contractor has indicated that if this moratorium relief request is not granted,they could suffer mobilizations costs of$57,000 from their drilling subcontractor,Keller.Please let me know if this time-sensitive relief request can be granted by the appropriate agencies or if any additional information is required. The work on the bridge replacement has run into some unforeseen difficulties and will need some relief during the fish moratorium that started on February 1, 2022. Civil Works Contracting is requesting a relief from the fish moratorium for roughly 6 calendar days to allow CWC and Keller Drilling time to twist the extended 54" casing shaft down 5 to 7 feet lower to allow the casings to be sealed into the hardpan material. Civil Works Contracting/Keller Drilling are requesting NCDOT allow us to make some adjustments to our plan due to the permanent casings not holding the required sealed in the competent materials. During the pouring of Bent1-C2, the shaft consumed 72 cubic yards which is well beyond neat line volume. The extra concrete that was placed at B1/C1 appeared to be pushing soil.This was evident as reflected in the low blow count required to drive the casing pipe B1/C1 to design tip elevation. CWC/Keller Drilling also is proposing to twist the extended casings utilizing a CZM EK200 drilling rig capable of applying 30,000 pounds of down pressure (or more) on the casing.The permanent top casing with a wall thickness of 1/2" and a diameter of 54" will be required to be twisted 5 to 7 feet beyond the current elevation for sealing the shaft. We propose adding a minimum of 5' at each casing location. Each casing extension will be welded by a welder that is currently certified by NCDOT. We estimate that each casing will require at least 12 hours to weld the extension. Once welded, CWC/Keller will begin twisting the casings until the top of casing is at the top of concrete design elevation, which should take about eight hours for the crew at each location. This moratorium relief request#2 includes the time needed for procuring the additional 54" caissons, roughly 4-5 days; the time to weld the extension to each caisson, roughly 4-6 days; and the ti it will take to twist the extended 54" diameter casings to design 4-5 days. WC estimates roughly 41 calendar days for these impacts to our current completion L date as per the attached schedule. _--- The total number of fish moratorium relief days is estimated to be 6 calendar days or 12 tide cycles to complete the work in the water. This added time will allow for inclement weather conditions and unforeseen equipment failures. The following schedule is provided: • Day 1-5 order and receive the additional 54" caissons, no tide cycles being affected during this construction phase. • Day 6-10 prepping and welding the 54" caissons, no tide cycles being affected during this construction phase. vA n • Day 11-15 twist caissons at each location during the hours of 0700 to 1700 with a low too high to low tide cycle being in affect during this construction This timeline 1 WI stated above will complete the construction for the 54" pipe casing work at bent 1 and 9'‘Z-72. This will complete our waterway disturbance until after the moratorium is cleared on July 1, 2022. Should this moratorium relief request be denied, Keller could demobilize from the site at an additional $57,000 cost, with no guarantees their schedule would allow them to return at the end of the moratorium in June 2022. The contract could easily overrun the expected quantities of concrete, with no control of where it flows to. Civil Works Contracting, NCDOT, and the traveling public for both the r dway and waterway will be impacted for an additional 6 months beyond or contract co pletion date of October 2, 2023, and at an additional cost of $??? Extensions to the caissons would then be welded to the top of the existing caissons. Please let me know if I need to provide any additional information or if you think we would need to submit a moratorium relief request for the proposed twisting of the permanent caissons.
