Authorizing development in Tyrrell County at Albemarle Sound and manmade drainage
canal, SR 129. (Pledger Harbor :d), as requested in the permittee's application dated 10/7/19, including the
attached workplan drawings (1) dated 8/23/19.
This permit, issued on 1/10/20 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action;or may cause the permit to be null and void.
1) The depth of excavation within the manmade drainage canal shall not exceed -1.5 feet below the
normal water level. The depth of excavation within the Albemarle Sound shall not exceed—1.8 feet
below the normal water level. In no case shall excavation exceed the depth of connecting waters.
Overdredging is specifically prohibited.
2) In accordance with commitments made by the permittee, excavation shall be accomplished using a
tracked excavator, and all excavated materials shall be placed directly into a closed body dump truck
and hauled offsite to an upland disposal site in a manner not to impact waters or wetlands.
3) Dump trucks or other vehicles that are used to transport excavated materials shall be water tight
during transport. There shall be no spillover of solids or seepage of effluent into any vegetated
wetlands or surrounding waters.

This permit action may be appealed by the permittee or Signed by the authority of the Secretary of DEQ and the Chair

4) No excavation or filling shall take place at any time outside of the alignment of the areas indicated on
the attached workplan drawings, without permit modification.
5) The temporary placement and/or double handling of any excavated or fill material within waters or
vegetated wetlands is not authorized.
NOTE: DCM issued CAMA General Permit No. 68746 on 12/6/17 for excavation of approximately
1,500 square feet of accumulated sediment at the project site.
6) This project shall conform to all requirements of the N.C. Sedimentation Pollution Control Act and the
N.C. Department of Transportation's (NCDOT's) Memorandum of Agreement with the N.C. Division of
Energy,Mineral and Land Resources.
7) The permittee shall employ all sedimentation and erosion control measures necessary to prevent an
increase in sedimentation or turbidity within waters outside the permit area. This shall include, but is
not limited to, the installation of silt fencing or similar appropriate devices around all areas subject to
soil disturbance or the movement of earthen fill, and the immediate stabilization of all disturbed areas.
8) The activity shall be conducted in such a manner as to prevent a significant increase in turbidity outside
the area of construction or construction-related discharge.
9) Construction staging areas shall be located only in upland areas, and not in any protected riparian
buffers, or waters of the State.
10) All mechanized equipment shall be regularly inspected and maintained to prevent contamination of
waters and wetlands from fuels, lubricants, hydraulic fluids, or other toxic materials. In the event of a
spill of petroleum products or any other hazardous waste, the permittee shall immediately report it to the
N.C. Division of Water Resources, and provisions of the North Carolina Oil Pollution and Hazardous
Substances Control Act shall be followed.
11) Dredging in any manner, including"kicking"with boat propellers, is not authorized outside of areas
specifically depicted on the attached workplan drawings, without permit modification.
12) The placement of riprap shall be limited to the areas as indicated on the attached workplan drawings.
The riprap material shall be clean and free from loose dirt or any pollutant except in trace quantities. It
shall be of a size sufficient to prevent its movement from the approved alignment by wave or current
action. The riprap material shall consist of clean rock or masonry materials such as but not limited to
granite, marl or broken concrete without exposed rebar, or other suitable materials approved by DCM.
13) The placement of backfill is not authorized, without permit modification.

Maintenance Clause
14) The maintenance clause of the active permit is modified as follows: The Division of Coastal
Management (DCM) and the U.S. Army Corps of Engineers (USACE) shall be notified in writing at
least two (2)weeks in advance of any maintenance work authorized by this permit, and again upon
completion of the work. The advance notification shall include:
A. The number of the original permit.
B. A statement that no dimensional changes are proposed.
C. A copy of the previously authorized plans with cross-hatching indicating the area to be maintained,
the area to be used for spoil disposal, and the estimated amount of material to be removed. The
location, design and holding capacity of the spoil disposal site shall be approved by a representative
of the Division prior to the initiation of any maintenance dredging activities.
D. The date of map revisions and the permittee's signature shown anew on the previously authorized
plans.

g NOTE: The authorized project will impact approximately 1,332 square feet of surface waters due to
maintenance excavation.
15) If the permittee discovers any previously unknown historic or archaeological resources while
accomplishing the authorized work, it shall immediately stop work and notify the N.C. Department of
Cultural and Natural Resources, DCM, and the Wilmington District Engineer to initiate the required
coordination procedures.
16) No attempt shall be made by the permittee to prevent the use by the public of all navigable waters at or
adjacent to the authorized work following completion of construction.
17) If it is determined that additional permanent and/or temporary impacts are necessary that are not shown
on the attached workplan drawings or described in the authorized permit application, a permit
modification and/or additional authorization from DCM and/or the USACE shall be required. In
addition, any changes in the approved plan may also require a permit modification and/or additional
authorization from DCM and/or USACE. The permittee shall contact representatives of DCM and
USACE prior to commencement of any such activity for this determination and any permit modification.
18) The permittee and/or its contractor shall contact the DCM Transportation Project Field Representative in
Elizabeth City at(252) 207-3656 to request a pre-construction conference prior to project initiation.
19) Development shall only be conducted on lands owned by the NCDOT and/or its Right-of-Ways and/or
easements.
20) The N.C. Division of Water Resources (DWR) authorized the proposed project(DWR Project No.
20171306 V.2)under General Water Quality Certification No.4175. Any violation of the Certification
approved by DWR shall be considered a violation of this CAMA permit.

NOTE: The U.S. Army Corps of Engineers (USACE) assigned the proposed project COE Action ID No.
SAW-2019-02242.
21) This permit does not eliminate the need to obtain any additional permits, approvals or authorizations that
may be required.
NOTE: An application processing fee of$475 was received by DCM for this project. This fee also
satisfied the Section 401 application processing fee requirements of the Division of Water
Resources.

Subject:Submittal of a Major CAMA/Dredge and Fill permit application package for
maintenance excavation of a man made drainage canal Tyrrell County.
Dear Mr.Daisey,
The North Carolina Department of Transportation (NCDOT) is requesting a Major
CAMA/Dredge and Fill permit for maintenance excavation of a man made drainage canal at it's
confluence with the Albemarle Sound located at the terminus of SR 1225 Pledger Harbor Road
east of Columbia in the Community of Goat Neck, Tyrrell County, North Carolina. This
proposed maintenance activity has been identified as a potential for drainage improvement in the
Goat Neck community. The canal opening and adjacent Albemarle Sound shoreline is exposed to
northly winds that result in seasonal shoaling of the canal opening by wave action. This
maintenance activity has been authorized once in 2017 by CAMA/Dredge and Fill General permit
no. 68746-B issued on 6 December 2017. Rather than continuing to authorize future
maintenance of this project with general permits,the NCDOT is seeking authorization to maintain
this area of the Palmetto Peartree Drainage Canal through the Major CAMA/Dredge and Fill
process.
The maintenance activities would be conducted using a tracked excavator and dump truck
working from uplands at the sound shoreline and along the road shoulder of SR 1225. The area
that typically requires maintenance is f75' long x 20' wide to an average depth of minus 1.8'
below the normal water level (NWL). Maintaining the canal opening to the aforementioned
dimensions typically results in±58 cubic yards of material. Spoil material will be placed directly
into a closed body dump truck and hauled offsite to a local upland stockpile site owned by
NCDOT.

DRAINAGE CANAL MAINTENANCE DREDGING PROJECT
PROJECT SUMMARY:
The applicant proposes maintenance dredging of a manmade drainage canal and
maintenance/repair of existing rip rap revetments at the connection with the Albemarle
Sound at the terminus of SR 1225 (Pledger Harbor Rd.) in the community Goat Neck,
Tyrrell County.
8. NARRATIVE DESCRIPTION:
Project Setting
The proposed project site is located at the connection of an unnamed manmade drainage canal
and the Albemarle Sound at the northern terminus of Pledger Harbor Rd (SR 1225) in the
community of Goat Neck in Tyrrell County. The site is approximately 11 miles to the northeast of
Columbia. Pledger Harbor Rd. is located within Palmetto-Peartree Preserve, which was created in
1999 as a mitigation bank for the endangered red-cockaded woodpecker. The 10,297 acre preserve
site is currently owned by the North Carolina Wildlife Resources Commission and is classified as a
Significant Natural Heritage Area. The project area is an estuarine forest dominated by Nyssa
sylvatica(Black Gum),Acer rubrum(Red Maple)and other vegetation typically found in an eastern
North Carolina pine/hardwood forest.Phragmites australis(Common Reed)and various grasses are
found along the drainage canal and roadway.There are no Coastal Wetlands present. Undeveloped
forest/swamp lands dominate the surrounding area,with residences located approximately 1.15 miles
to the south of the proposed project at the intersection of Pledger Harbor Rd. (SR 1225)and Goat
Neck Rd. (SR 1223).
Pledger Harbor Rd. is a state-maintained road with a travel lane of approximately 12' with
grass shoulders in the project area. Roadside canals are located on the west side the entire length of
the roadway. A floodgate within the canal system to limit wind driven sound water into the upper
reaches of the canal is located approximately 0.50 miles to the south of the proposed project area.
Approximate elevation of the project area is 0—2' above NWL.
There are no stormwater runoff controls on the roadway in the project area. Stormwater sheet
flows directly into the adjacent roadside canal and estuarine swamp forest from the road. There are
no existing utility lines within the Right-of-Way of the road.
The Environmental Management Commission has classified the Albemarle Sound as Class SB
in the proposed project area. The waters are closed to shell fishing by the Shellfish Sanitation
Section of the Division of Marine Fisheries. The unnamed canal is approximately 20' wide and
approximately 0.8' to 1.5' deep in the project area within the canal. The water depths are
approximately 1.8' deep 20' offshore within the Albemarle Sound. The Federal Emergency
Management Agency has designated the project area as a Zone AE flood hazard area. There were no
SAV's observed in the project area during the site visit.
The applicant states the canal opening and adjacent Albemarle Sound shoreline are exposed to
northerly winds that result in seasonal shoaling of the canal opening by wave action. DCM issued
General Permit No. 68746 on December 6, 2017 for the maintenance excavation of approximately
1,500 sq. ft. of accumulated sediment at the project site.

Project Proposal
NCDOT states the purpose of this project is to excavate sand accumulation at the confluence
of the drainage canal and the Albemarle sound to improve gravity flow/drainage from the
community of Goat Neck.The applicant states NCDOT is seeking to authorize maintenance/future
maintenance through a CAMA Major Permit rather than continuing to obtain CAMA General
Permits for each excavation.
NCDOT states the proposed area to be maintained is approximately 75' long by the existing
canal width(approximately 20' wide)to an average depth of 1.8'below normal water level(NWL).
According to the applicant,typical canal maintenance to these dimensions will result in the removal
of approximately 58 cubic yards of sandy material. Existing rip rap revetments on the northwest and
southeast sides of the canal will be repaired/maintained within the current alignment/footprint with
Class II and Class B stone to a height of approximately 3' (1' above NWL).
The applicant states the proposed activities and future maintenance activities would be
conducted using a tracked excavator (with 30' reach) and closed body dump truck working from
uplands at the sound/canal shoreline. Spoil Material would be placed directly into the truck and
hauled offsite to a local upland stockpile site owned by NCDOT.
Anticipated Impacts
As proposed,the maintenance activities associated with the unnamed canal at the terminus of
Pledger Harbor Rd.(SR 1225)would result in 1,332 sq. ft.of drainage canal and open water/shallow
bottom (Albemarle Sound) impacts due to excavation. The project is not expected to impact
navigability or public trust access. A localized increase in turbidity can be expected during any in-
water construction activities related to the proposed project. There are no additional impacts
anticipated due to the maintenance/repair of existing rip rap revetments due to all associated
activities remaining in the same footprint and dimensions.

The following are my comments and recommendations regarding the above-mentioned proposal.
The request is for proposed maintenance dredging of a manmade drainage canal and
maintenance/repair of existing rip rap revetments at the connection with the Albemarle Sound at
the terminus of SR 1225 (Pledger Harbor Rd.) in the community Goat Neck, Tyrrell County.
NCDOT states the proposed area to be maintained is approximately 75' long by the existing canal
width (approximately 20' wide) to an average depth of 1.8' below normal water level (NWL).
According to the applicant, typical canal maintenance to these dimensions will result in the
removal of approximately 58 cubic yards of sandy material. Existing rip rap revetments on the
northwest and southeast sides of the canal will be repaired/maintained within the current
alignment/footprint with Class II and Class B stone to a height of approximately 3' (1' above
NWL). Based upon my review I have no objection to the issuance of this permit, but offer the
following conditions:
. 1 The permittee shall exercise all available precautions in the day-to-day operations of the
V facility to prevent waste from entering the adjacent waters and wetlands.
2 2 No excavation or filling shall take place at any time in any vegetated wetlands or
r surrounding waters, without permit modification.
1),The placement of riprap shall be limited to the areas indicated on the attached workplan
drawings. The riprap material shall be free from loose dirt or any pollutant except in trace
quantities.
/Revetment material shall be of sufficient size to prevent movement from the site by wave
V actions or currents.
4 5 Riprap revetments shall be constructed of granite,marl,concrete without exposed rebar,or
other suitable materials approved by the Division of Coastal Management.

6 The temporary placement and double handling of any excavated material within waters or
vegetated wetlands is not authorized.
The placement of any backfill is not authorized, without permit modification.
vi The depth of excavation within the manmade drainage canal shall not exceed— 1.5 feet
below the normal water level. The depth of excavation within the Albemarle Sound shall
not exceed—1.8 feet below the normal water level. In no case shall excavation exceed the
depth of connecting waters. Over dredging is specifically prohibited.
9 The Division of Coastal Management(DCM) shall be notified in writing at least two (2)
2 weeks in advance of any maintenance work authorized by this permit, and such
notification shall include:
A. The number of the original permit.
B. A statement that no dimensional changes are proposed.
C. A copy of the original permit plans indicating the area to be maintained,the
area/location to be used for spoil disposal, and the estimated amount of material to
be removed.
D. The date of plan revision and the permittee's signature shown anew on the
original plan.
1 This project shall conform to all requirements of the N.C. Sedimentation Pollution Control
Act and NCDOT's Memorandum of Agreement with the N.C.Division of Land Resources.
If it is determined that additional permanent and/or temporary impacts are necessary that
are not shown on the attached workplan drawings or described in the authorized permit
application, a permit modification and/or additional authorization from DCM shall be
required. In addition, any changes in the approved plan may also require a permit
modification and/or additional authorization from DCM. The permittee shall contact a
representative of DCM prior to commencement of any such activity for this determination
and any permit modification.

Dear Ms. Brittingham:
Reference the application of the North Carolina Department of Transportation, (NCDOT)
for a Department of the Army permit to conduct maintenance dredging of a manmade drainage
canal and maintenance/repair of existing riprap revetments at the connection with the Albemarle
Sound adjacent to Pledger Harbor Road, (SR 1225), in Goat Neck in Tyrrell County,North
Carolina.
The Federal agencies have completed review of the proposal as presented by the
application and your field investigation report.
We recommend that the following conditions be included in the State authorization:
A.All work authorized by this permit must be performed in strict compliance with the
attached plans,which are a part of this permit. Any modification to these plans must be approved
by the US Army Corps of Engineers(USACE)prior to implementation.
B. The permittee understands and agrees that, if future operations by the United States
require the removal,relocation, or other alteration, of the structure or work herein authorized, or
if, in the opinion of the Secretary of the Army or his authorized representative, said structure or
work shall cause unreasonable obstruction to the free navigation of the navigable waters,the
permittee will be required, upon due notice from the U.S. Army Corps of Engineers,to remove,
relocate,or alter the structural work or obstructions caused thereby,without expense to the
United States. No claim shall be made against the United States on account of any such removal,
relocation, or alteration. The permittee shall notify NOAA/NATIONAL OCEAN SERVICE
Chief Source Data Unit N CS261, 1315 E West HWY-RM 7316, Silver Spring, MD 20910-
3282 at least two weeks prior to beginning work and upon completion of work.
C. Except as specified in the plans attached to this permit, no excavation, fill or
mechanized land-clearing activities shall take place at any time in the construction or
maintenance of this project, in such a manner as to impair normal flows and circulation patterns
within waters or wetlands or to reduce the reach of waters or wetlands.
D. Except as authorized by this permit or any USACE approved modification to this
permit, no excavation, fill or mechanized land-clearing activities shall take place at any time in
the construction or maintenance of this project,within waters or wetlands. This permit does not
authorize temporary placement or double handling of excavated or fill material within waters or
wetlands outside the permitted area. This prohibition applies to all borrow and fill activities
connected with this project.
E. Unless otherwise authorized by this permit, all dredged material removed from this
project shall be disposed of in an upland area and in a manner not to impact waters or wetlands.
F. All mechanized equipment will be regularly inspected and maintained to prevent
contamination of waters and wetlands from fuels, lubricants,hydraulic fluids, or other toxic
materials. In the event of a spill of petroleum products or any other hazardous waste,the
permittee shall immediately report it to the N.C. Division of Water Quality at(919) 733-5083,
Ext. 526 or(800)662-7956 and provisions of the North Carolina Oil Pollution and Hazardous
Substances Control Act will be followed.
G.All excavated materials will be confined landward of the mean high water level
elevation contour and any vegetated wetlands.
H. If the permittee discovers any previously unknown historic or archeological remains
while accomplishing the authorized work, he will immediately notify the Wilmington District
Engineer who will initiate the required coordination procedures.
I. The permittee shall advise the Corps in writing at least two weeks prior to beginning the
work authorized by this permit and again upon completion of the work authorized by this permit.
J. The permittee shall require its contractors and/or agents to comply with the terms and
conditions of this permit in the construction and maintenance of this project, and shall provide
each of its contractors and/or agents associated with the construction or maintenance of this
project with a copy of this permit. A copy of this permit, including all conditions, shall be
available at the project site during construction and maintenance of this project.
K. The permittee shall employ all sedimentation and erosion control measures necessary to
prevent an increase in sedimentation or turbidity within waters and wetlands outside the permit
area. This shall include, but is not limited to,the immediate installation of silt fencing or similar
appropriate devices around all areas subject to soil disturbance or the movement of earthen fill,
and the immediate stabilization of all disturbed areas. Additionally,the project must remain in
full compliance with all aspects of the Sedimentation Pollution Control Act of 1973 (North
Carolina General Statutes Chapter 113A Article 4).
L. The activity will be conducted in such a manner as to prevent a significant increase in
turbidity outside the area of construction or construction-related discharge. Increases such that
the turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trout waters by
the North Carolina Division of Environmental Management(NCDEM),25 NTU's or less in all
saltwater classes and in all lakes and reservoirs, and 10 NTU's or less in trout waters, are not
considered significant.
M. The permittee, upon receipt of a notice of revocation of this permit or upon its
expiration before completion of the work will,without expense to the United States and in such
time and manner as the Secretary of the Army or his authorized representative may direct,restore
the water or wetland to its pre-project condition.
N. Violations of these conditions or violations of Section 404 of the Clean Water Act or
Section 10 of the Rivers and Harbors Act must be reported in writing to the Wilmington District
U.S.Army Corps of Engineers within 24 hours of the permittee's discovery of the violation.

Reference the application of the North Carolina Department of Transportation, (NCDOT)
for a Department of the Army permit to conduct maintenance dredging of a manmade drainage
canal and maintenance/repair of existing riprap revetments at the connection with the Albemarle
Sound adjacent to Pledger Harbor Road, (SR 1225), in Goat Neck in Tyrrell County,North
Carolina.
The Federal agencies have completed review of the proposal as presented by the
application and your field investigation report.
We recommend that the following conditions be included in the State authorization:
A.All work authorized by this permit must be performed in strict compliance with the
attached plans,which are a part of this permit. Any modification to these plans must be approved
by the US Army Corps of Engineers (USACE)prior to implementation.
B. The permittee understands and agrees that, if future operations by the United States
require the removal, relocation, or other alteration, of the structure or work herein authorized, or
if, in the opinion of the Secretary of the Army or his authorized representative, said structure or
work shall cause unreasonable obstruction to the free navigation of the navigable waters,the
permittee will be required,upon due notice from the U.S. Army Corps of Engineers, to remove,
relocate, or alter the structural work or obstructions caused thereby,without expense to the
United States. No claim shall be made against the United States on account of any such removal,
relocation, or alteration. The permittee shall notify NOAA/NATIONAL OCEAN SERVICE
Chief Source Data Unit N CS261, 1315 E West HWY-RM 7316, Silver Spring,MD 20910-
3282 at least two weeks prior to beginning work and upon completion of work.
C. Except as specified in the plans attached to this permit,no excavation,fill or
mechanized land-clearing activities shall take place at any time in the construction or
maintenance of this project, in such a manner as to impair normal flows and circulation patterns
within waters or wetlands or to reduce the reach of waters or wetlands.
D.Except as authorized by this permit or any USACE approved modification to this
permit, no excavation, fill or mechanized land-clearing activities shall take place at any time in
the construction or maintenance of this project,within waters or wetlands. This permit does not
authorize temporary placement or double handling of excavated or fill material within waters or
wetlands outside the permitted area. This prohibition applies to all borrow and fill activities
connected with this project.
E. Unless otherwise authorized by this permit, all dredged material removed from this
project shall be disposed of in an upland area and in a manner not to impact waters or wetlands.
F.All mechanized equipment will be regularly inspected and maintained to prevent
contamination of waters and wetlands from fuels, lubricants, hydraulic fluids, or other toxic
materials. In the event of a spill of petroleum products or any other hazardous waste,the
permittee shall immediately report it to the N.C. Division of Water Quality at(919)733-5083,
Ext. 526 or(800) 662-7956 and provisions of the North Carolina Oil Pollution and Hazardous
Substances Control Act will be followed.
G.All excavated materials will be confined landward of the mean high water level
elevation contour and any vegetated wetlands.
H. If the permittee discovers any previously unknown historic or archeological remains
while accomplishing the authorized work,he will immediately notify the Wilmington District
Engineer who will initiate the required coordination procedures.
I. The permittee shall advise the Corps in writing at least two weeks prior to beginning the
work authorized by this permit and again upon completion of the work authorized by this permit.
J. The permittee shall require its contractors and/or agents to comply with the terms and
conditions of this permit in the construction and maintenance of this project, and shall provide
each of its contractors and/or agents associated with the construction or maintenance of this
project with a copy of this permit. A copy of this permit, including all conditions, shall be
available at the project site during construction and maintenance of this project.
K. The permittee shall employ all sedimentation and erosion control measures necessary to
prevent an increase in sedimentation or turbidity within waters and wetlands outside the permit
area. This shall include,but is not limited to,the immediate installation of silt fencing or similar
appropriate devices around all areas subject to soil disturbance or the movement of earthen fill,
and the immediate stabilization of all disturbed areas. Additionally,the project must remain in
full compliance with all aspects of the Sedimentation Pollution Control Act of 1973 (North
Carolina General Statutes Chapter 113A Article 4).
L. The activity will be conducted in such a manner as to prevent a significant increase in
turbidity outside the area of construction or construction-related discharge. Increases such that
the turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trout waters by
the North Carolina Division of Environmental Management(NCDEM), 25 NTU's or less in all
saltwater classes and in all lakes and reservoirs,and 10 NTU's or less in trout waters,are not
considered significant.
M. The permittee, upon receipt of a notice of revocation of this permit or upon its
expiration before completion of the work will,without expense to the United States and in such
time and manner as the Secretary of the Army or his authorized representative may direct,restore
the water or wetland.o its pre-project condition.
N.Violations of these conditions or violations of Section 404 of the Clean Water Act or
Section 10 of the Rivers and Harbors Act must be reported in writing to the Wilmington District
U.S.Army Corps of Engineers within 24 hours of the permittee's discovery of the violation.

terminus of the Pledger Harbor Road right-of-way where the manmade canal
connects to the Albemarle Sound, in the Goats Neck community of Tyrrell County.

DATE: November 26, 2019
Consistency Determination: The request is consistent with/not in conflict with the Tyrrell
County/Town of Columbia Land Use Plan certified by the CRC
on March 25, 2010.
Overview: The project site consists of a 20 foot wide by 75 foot long area within the Pledger
Harbor Road right-of-way at its northern terminus along the Albemarle Sound. The right-of-way
is within the 10,297 acre Palmetto-Peartree Preserve, which is owned by the NC Wildlife
Resources Commission and classified as a Significant Natural Heritage Area. Approximate s'
elevation of the project area is 0 to 2 feet above Normal Water Level (NWL). The project area is
in an AE floodzone.
Existing improvements within the right-of-way include a 20 foot wide roadside canal that is
approximately .8 foot to 1.5 feet deep within the project area, two (2) 6 foot wide by 30 foot long
sections of rip rap revetment on the canal banks, and a 12 foot wide state-maintained travel lane
with grass shoulders. The roadside canal is located on west side of the entire 1.15 miles of
roadway that connects with Goat Neck Road to the south. Stormwater sheet flows directly into
the adjacent roadside canal and estuarine swamp forest from the road. The applicant states that
the canal opening and adjacent shoreline are exposed to northerly winds that result in seasonal
shoaling of the canal opening by wave action. DCM issued General Permit No. 68746 in
December 2017 for maintenance excavation of approximately 1,500 sq. ft. of accumulated
sediment at the project site.

Routine maintenance dredging of the 20 foot wide by 75 foot long canal area to an average depth
of 1.8 feet below NWL and the repair and maintenance of two (2)6 foot wide by 30 foot long riprap
revetments to a height of 3 feet are proposed. The existing riprap revetments will be
repaired/maintained with Class II and Class B stone. Maintenance activities will be conducted
using a tracked excavator and closed body dump truck working from the uplands. Spoil will be
placed directly on the truck and hauled to an offsite stockpile site owned by NCDOT. NCDOT is
seeking to authorize maintenance/future maintenance through a CAMA Major Permit rather than •
continuing to obtain CAMA General Permits for each excavation.
The waters of the Albemarle Sound are classified as SB in this area and are closed to shellfishing.
There were no SAV observed in the project area during the site visit. A review of potential historic
resources or archaeological sites was not provided.
Anticipated Impacts resulting from this project are expected to include: the excavation of 1,332
sq. ft. of Public Trust Area/Estuarine Waters Areas of Environmental Concern (AEC).
The project will improve gravity flow/drainage from the community of Goat Neck.
Basis for Determination:
The Tyrrell County/Town of Columbia Land Future Land Use Plan Map identifies the project site
as "Conservation", which includes land and water areas that are environmentally sensitive,
including areas of environmental concern, as indicated on Page 133.

The North Carolina Natural Heritage Program (NCNHP) appreciates the opportunity to provide
information about natural heritage resources for the project referenced above.
A query of the NCNHP database indicates that there are records for rare species, important natural
communities, natural areas, and/or conservation/managed areas within the proposed project
boundary. These results are presented in the attached 'Documented Occurrences'tables and map.
The attached 'Potential Occurrences'table summarizes rare species and natural communities that
have been documented within a one-mile radius of the property boundary. The proximity of these
records suggests that these natural heritage elements may potentially be present in the project area
if suitable habitat exists. Tables of natural areas and conservation/managed areas within a one-mile
radius of the project area, if any, are also included in this report.
If a Federally-listed species is documented within the project area or indicated within a one-mile
radius of the project area, the NCNHP recommends contacting the US Fish and Wildlife Service
(USFWS) for guidance. Contact information for USFWS offices in North Carolina is found here:

Please note that natural heritage element data are maintained for the purposes of conservation
planning, project review, and scientific research, and are not intended for use as the primary criteria

(NCDOT) for a Coastal Area Management Act Major Development Permit for the proposed
maintenance excavation of a manmade drainage canal at its confluence with the Albemarle
Sound located at the terminus of SR 1225 Pledger Harbor Road east of Columbia in the
Community of Goat Neck in Tyrrell County.
Although processing of the application is nearing completion, additional time is needed for this
office to complete the review and make a decision on your request. Therefore, it is necessary
that the standard review time be extended. An additional 75 days is provided by G.S. 113A-
122(c)which would make March 4,2020,the new deadline for reaching a decision on your
request. However,we expect to take action prior to that time and will do so as soon as possible.

Another follow up question regarding the repair/maintenance of the existing the rip rap revetments:
• The two existing revetments are approximately 30'L by 6'W.After review of the permit application, the submitted
drawings show that all maintenance/repair will be within that footprint/alignment, but what will be the approximate
height of the revetments be once the repair/maintenance is completed?

The refurbishment of the existing riprap will be completed using Class II and Class B. Same size as what is there now. There
should be very little turbidity during the "in-water excavation". The material deposited by wave action creating the shoal is a
course sand. The material to be excavated is like a "washed sand". If push comes to shove NCDOT could use turbidity curtains if
it alleviates some concern but is unnecessary, in my opinion, due to the small scope of the project and material to be
excavated. If there is any turbidity at all it will be short term and localized.

The NC Division of Coastal Management hereby acknowledges receipt of your application for
State approval for development related to the proposed maintenance excavation of a drainage canal
that connects to the Albemarle Sound at the terminus of Pledger Harbor Rd. (SR 1225) in Goat
Neck,Tyrrell County.It was received complete on October 7,2019 and appears to be adequate for
processing at this time. The projected deadline for making a decision is December 21, 2019. An
additional 75-day review period is provided by law when such time is necessary to complete the
review. If you have not been notified of a final action by the initial deadline stated above, you
should consider the review period extended. Under those circumstances, this letter will serve as
your notice of an extended review. However, an additional letter will be provided on or about the
75th day.
If this agency does not render a permit decision within 70 days from October 7, 2019, you may
request a meeting with the Director of the Division of Coastal Management and permit staff to
discuss the status of your project. Such a meeting will be held within five working days from the
receipt of your written request and shall include the property owner, developer, and project
designer/consultant.
NCGS 113A-119(b)requires that Notice of an application be posted at the location of the proposed
development. Enclosed you will find a "Notice of Permit Filing" postcard which must be posted
at the property of your proposed development. You should post this notice at a conspicuous point
along your property where it can be observed from a public road. Some examples would be:

You have our approval, in accordance with the conditions listed below, for the following impacts for the purpose of
reestablishing canal drainage patterns and bank stabilization at the end of SR 1225(Pledger Harbor Rd)in Palmetto
Peartree Preserve in Tyrrell County:

The project shall be constructed in accordance with your application dated received October 16,2017 and additional
information from the Army Corps of Engineers received November 3,2017. After reviewing your application,we
have decided that these impacts are covered by General Water Quality Certification Numbers 4085 and 4087. These
certifications correspond to the Nationwide Permits 3 and 13 respectively issued by the Corps of Engineers. In
addition,you should acquire any other federal,state or local permits before you proceed with your project including
(but not limited to)Sediment and Erosion Control,Non-Discharge and Water Supply Watershed regulations. This
approval will expire with the accompanying 404 permit.
This approval is valid solely for the purpose and design described in your application(unless modified below).
Should your project change,you must notify the NCDWR and submit a new application. If the property is sold,the
new owner must be given a copy of this Certification and approval letter,and is thereby responsible for complying
with all the conditions. If total wetland fills for this project(now or in the future)exceed one acre,or of total
impacts to streams(now or in the future)exceed 150 linear feet,compensatory mitigation may be required as
described in I 5A NCAC 2H .0506(h)(6)and(7). For this approval to remain valid,you must adhere to the
conditions listed in the attached certification and any additional conditions listed below.
Condition(s)of Certification:
I. The issuance of this certification does not exempt the Permittee from complying with any and all statutes,rules,
regulations,or ordinances that may be imposed by other government agencies(i.e. local, state,and federal)
having jurisdiction, including but not limited to applicable buffer rules,stormwater management rules, soil
erosion and sedimentation control requirements,etc

2. The Permittee shall ensure that the final design drawings adhere to the certification and to the drawings
submitted for approval. [15A NCAC 02H.0507(c)and 15A NCAC 02H.0506(b)(2)and(c)(2)]
3. During the construction of the project,no staging of equipment of any kind is permitted in waters of the U.S.,or
protected riparian buffers. [I5A NCAC 02H.0506(b)(2)]
4. All mechanized equipment operated near surface waters must be regularly inspected and maintained to prevent
contamination of stream waters from fuels,lubricants,hydraulic fluids,or other toxic materials. [15A NCAC
02H.0506(b)(3)]
5. Erosion and sediment control practices must be in full compliance with all specifications governing the proper
design,installation and operation and maintenance of such Best Management Practices in order to protect
surface waters standards[15A NCAC 02H.0506(b)(3)and(c)(3)]:
a. The erosion and sediment control measures for the project must be designed, installed, operated, and
maintained in accordance with the most recent version of the North Carolina Sediment and Erosion
Control Planning and Design Manual.
b. The design, installation,operation,and maintenance of the sediment and erosion control measures must
be such that they equal, or exceed,the requirements specified in the most recent version of the North
Carolina Sediment and Erosion Control Manual. The devices shall be maintained on all construction
sites, borrow sites, and waste pile (spoil) projects, including contractor-owned or leased borrow pits
associated with the project.
c. For borrow pit sites,the erosion and sediment control measures must be designed, installed,operated,
and maintained in accordance with the most recent version of the North Carolina Surface Mining
Manual.
d. The reclamation measures and implementation must comply with the reclamation in accordance with the
requirements of the Sedimentation Pollution Control Act.
6. Sediment and erosion control measures shall not be placed in wetlands or waters unless otherwise approved by
this Certification. [15A NCAC 02H.0506(b)(3)and(c)(3)]
7. The appropriate BMP's shall be used to prevent offsite turbidity and contain turbidity within the work area.
[15A NCAC 02H.0506(b)(3)and(c)(3)]
8. All excavated material shall be properly disposed of in approved upland site. [15A NCAC 02B.0200]
9. Erosion control matting in riparian areas shall not contain a nylon mesh grid which can impinge and entrap
small animals. Matting should be secured in place by staples,stakes,or wherever possible live stakes of native
trees. Riparian areas are defined as a distance 25 feet from top of stream bank. [15A NCAC 02B.0224,.0225]
10. The permittee and its authorized agents shall conduct its activities in a manner consistent with State water
quality standards(including any requirements resulting from compliance with §303(d)of the Clean Water Act)
and any other appropriate requirements of State and Federal law. If NCDWR determines that such standards or
laws are not being met(including the failure to sustain a designated or achieved use)or that State or federal law
is being violated,or that further conditions are necessary to assure compliance,NCDWR may reevaluate and
modify this certification. [15A NCAC 02B.0200]
11. The Permittee shall report any violations of this certification to the Division of Water Resources within 24
hours of discovery.[15A NCAC 02B.0506(bx2)]
12. Upon completion of the project(including any impacts at associated borrow or waste site),the NCDOT
Division Engineer shall complete and return the enclosed"Certification of Completion Form"to notify
NCDWR when all work included in the 401 Certification has been completed. [15A NCAC 02H.0502(f)]
13. A copy of this Water Quality Certification shall be maintained on site at the construction site at all times. In
addition,the Water Quality Certification and all subsequent modifications,if any,shall be maintained with the
Division Engineer and the on-site project manager. [15A NCAC 02H.0507(c)and 15A NCAC 02H.0506
(b)(2)and(c)(2)]

hearing. You may obtain the petition form from the office of Administrative hearings. You must file the petition
