WHEREAS, Grantor owns a certain parcel or tract of land situated at Taylor's Creek, Rachel Carson Reserve, Beaufort, Carteret County, North Carolina (said lands owned by the Grantor being hereinafter referred to as the "Property"); and WHEREAS, the Grantee is seeking a mooring easement to be installed by the Town of Beaufort. The mooring will serve as a secure place where vessels in violation of the Town's navigable waterways ordinance can be held temporarily while arrangements are made with the owner to reclaim or haul and store, auction, or destroy. The vessel in violation will be locked to the mooring. The town's construction plans will include the installation of a mooring ball and anchor;and NOW, THEREFORE, in consideration of the sum of ONE DOLLAR AND NO/100 ($1.00), and other good and valuable consideration, the receipt of which is hereby acknowledged, the Grantor does hereby grant unto Grantee, its successors and assigns, the right, privilege and easement to construct, operate and maintain a mooring with accessories and appurtenances necessary in connection therewith (hereafter referred to as the "Facilities") necessary to provide a secure place where vessels in violation of the Town's navigable waterways ordinance can be held temporarily while arrangements are made with the owner to reclaim or haul and store, auction, or destroy. The vessel in violation will be locked to the mooring constructed in the waterway over and upon Taylor's Creek, Rachel Carson Reserve, Beaufort, Carteret County, North Carolina, being more particularly described as: A subaqueous easement with an area of 2,827 sq. ft. (60' diameter circle) more or less, lying 100 feet northeasterly from the banks of the Rachel Carson Reserve, and located at coordinates 34.7124 N.,-76.6597 W. For additional reference, see Exhibit A, attached for illustrative purposes. IT IS UNDERSTOOD AND AGREED BETWEEN THE GRANTOR AND GRANTEE: i. This Easement is granted subject to all existing rights of way and easements within the Easement Area. 2. Grantor reserves the right to utilize the area within the Easement Area for all purposes not inconsistent with the easement rights herein conveyed. 3. The Facilities constructed and installed hereunder shall remain the property of Grantee. Grantee shall have the right to inspect, rebuild, remove, repair, improve and relocate within the Easement Area, and make such changes, alterations, substitutions, additions to or extensions of its Facilities as Grantee may from time to time deem advisable. 4. Grantee shall repair any damage and, to the extent practical, restore to its original condition, the Easement Area, or any other land that is disturbed by the construction, installation and maintenance of the Facilities. 5. If the Facilities are not operated within the Easement Area for a continuous period of twelve (12) months, this Easement shall be deemed abandoned. 6. It is further understood and agreed that this conveyance is made subject to the condition that Grantee shall properly obtain all necessary permits required by State and federal law. Failure to obtain such permits in a timely manner shall be deemed an abandonment of this Easement. TO HAVE AND TO HOLD, the aforesaid rights, privileges and easements unto said Grantee, its successors and assigns, for so long as Grantee maintains said gas pipeline and no longer. David Halsey 215 Pollock St. Beaufort, NC 28516 For the sum of $14,415.00 (Fourteen Thousand, Four Hundred Fifteen Dollars and Zero Cents), TD Eure Marine Construction, LLC proposes to supply the labor, equipment, and materials necessary to facilitate the work specified below. It is the intent of TD Eure Marine Construction to collaborate with the owner(s) to provide a turn -key project for any/all items and components described below. Provide and Install (1) Mooring Ball & Anchor to include the following: • 1000 lbs. Pyramid Shaped One -Piece Cast Iron Permanent Mooring/Anchor • 1" x 25' Heavy (Bottom) Chain • ''%" x 25' Light (Top) Chain • 24" Carolina Waterworks Mooring Buoy • All Associated Swivels and Shackles • Mooring will be Rigged and Ready • DOES NOT INCLUDE CAMA PERMIT Exclusions: All items and quantities not specifically included in the proposal are specifically excluded. Unless otherwise noted, contract excludes engineering, plumbing, electrical, sod or landscaping. TD Eure is not responsible for damage to driveway, culverts or damage to any unmarked utilities. Payment Terms: TD Eure reserves the right to invoice up to 50%of the contract once materials arrive on -site. Progress payments may be billed, up to 90% of the contract total. Any unpaid balance will be invoiced upon completion. In addition to the contract total, any fees for local zoning/building permits will be assessed on the final invoice. Completion Date: TD Eure will make every effort to complete project with 180 days of receipt of all permits.
