I took a quick look and have a couple of initial things.
1. Have you spoken to the town about this project? I know that they have a local ordinance on pier length in Jean
Guite Creek of 75 ft. What is the proposed total length from the edge of the wetlands? Is this something they
would permit? It is kinda tucked in behind the wetlands, but I would still like to hear some feedback from the
town. I'll send it to them but I dont see a problem

3. What is the overhang of the roofed area? 1'
4. 1 will need a cross -sectional drawing of covered platform. In progress with the engineer. You will have it prior to

I will take a more in depth look at it next week. I have scheduled a site visit for Thursday, November 3`a. Permit fee for a
docking facility is $200.00. 1 will let you know if I have additional questions pending my review. Thanks and have a

As to the length Dare County allows us to measure the 75' from the wetlands present on the lot. I think we are good and
should a change be needed once the field visit happens then so be it.
I have one letter back and the other just went out last week. I'll get you a package once I get the other one back.
Thanks again for the help with the hard ones
FYI we have a variance application into the town with a meeting 12/19 for 36 Ginguite Trail so we don't have to build an
extra 100' of pier just to please a poorly written regulation. When they see we can move it to one side and go out way
way further I think we will get the variance.

ORDER GRANTING VARIANCE

The Board of Adjustment of the Town of Southern Shores (the `Board") held a
Public Hearing on December 19, 2022 to consider a Variance application submitted by
Kerry Skinner (the "Applicant") seeking to vary Town Code Section 36-202(b)(5)c on
the parcel of property located at 36 Ginguite Trl. (the "Property"). The Board, having
heard all of the evidence and arguments presented at the hearing makes the following
FINDINGS OF FACT:
The Applicant owns the Property.
2. A new pier is to be constructed on the Property.
Town Code Section 36-202(b)(5)c states that no such permitted dock or
pier shall extend into adjacent waters more than 75 feet from an estuarine
bulkhead, mean high waterline, or a line connecting the outermost limits
of the coastal wetlands on either side of the proposed structure, whichever
is nearest the channel.
4. The Applicant alleges that an irregular shoreline on the Property restricts
his ability to reach deeper water without extending further than the
allowed 75 ft.
The Applicant claims that the pier could be moved further south to comply
with the 75 ft. requirement but doing so would add significant costs and
require an additional 155 ft. of marshland disturbance.
Based on the above Findings of Fact, and considering the burdens of proof and
persuasion being on the Applicant, the Board makes the following CONCLUSIONS:
1. All parties are properly before the Board, and the Board has the jurisdiction to
consider and render a decision on the requested Variance.
