I received this notice in the mail several days ago and this application
instructs me as the adjacent property owner to file any objections with the
DCM. I have indicated on the form that I am not willing to sign the wavier,
and I have outlined in a letter to the Pirate's Cove Homeowners Association
my position. I also returned the form to the contractor on this date.
My understanding is that in a situation like this, the homeowners association
decides on the design and things of that nature and the CAMA will make the
decision as to the location of the dock and platform. My letter to the
homeowners association addresses concerns on both levels, design and
proposed positioning of the dock.
I am hoping that CAMA will require the applicant to locate the dock ten feet
to the north as most other properties as I have outlined in my letter.

Dear Mark:
I am in receipt of an application from Northeastern Marine Construction for
the construction of a dock and platform at property VL 53. A copy of the
application is being provided. Please note that I have not signed the wavier
section of the application. I will return the form to Northeastern.
My understanding is that the ARB will take this application under
consideration and I ask that the ARB consider the following:
1. The application shows a platform 10 ft X 20 ft or 20 X 20 ft. I will
ask that the Board not allow a 20 ft X 20 ft platform. The 10 ft X 20
ft is the standard size of the platform along Roanoke Sound in Village
Landings.
2. The proposed dock will start approximately 15 feet from our property
line. The bulkhead length shows 16.42 feet. I will ask that the
Board consider moving the dock ten (10) additional feet to the north.
This would place the south side starting point of the dock about 25
feet from our property. The majority of the docks along the sound
start roughly 15 feet from the north side of the property line and not
the south side. Most lots in Village Landings are 50 feet in width
along the sound and almost every dock, except for VL 58 start 15 feet
from the north side line. By moving the dock ten additional feet, the
dock would still be closer to our property line than others along the
sound. Others along the sound are about 35 feet in from the property
south side property line.
3. The application also shows a "T" shape platform and there are only
two of those in Village Landings, one of which I believe was on one
of the original model homes, VL 62. Most of the platforms extend
out into the sound and then turn right. By moving the dock ten feet
to the north, this would also allow the dock to turn right (southerly)
matching almost every other dock.
4. In the event CAMA would have an issue with the dock being moved
ten feet to the north, then I would request that the Board consider the
platform turn to the left (northerly) for the 20 feet. Again, this was
done on VL 58 so that the platform did not get too close to VL 59
platform.

I wanted to let you know that I appreciate the fact that the State allows adjacent
property owners the opportunity to offer some imput when an application is submitted to
your department. That did mean a lot to both my wife and I and being from NJ where
adjacent property owners have zero imput at all, we were surprised and pleased on how

Due to circumstances involving delays at site visits and road construction, I did not get back to the
office until after 5:30. After reading your comments below, I felt that a drawing showing the approved
final location would be the best way to address your concerns. When I was onsite 53 Ballast Point, I
measured the bulkhead along the shoreline, and determined that the original design would have
actually placed part of the platform in the 15-foot riparian corridor. This could not have been
approved without a signed waiver from you. I measured the shoreline straight across from the
property line, and the side of the platform on the right side was sited at that 20-foot mark, removing it
from the 15-foot corridor and an extra 5 feet further north, and the pier approximately 5-7' further
north.
I believe that this new proposed placement of the dock and platform should alleviate any further
concerns. We respectfully request that you acknowledge this and respond with an official retraction
of your objection. If you need to discuss further, please let me know. I am going to be out in the field
again today, but can give you a call if necessary. Your cooperation in this matter is greatly
appreciated.
