applicant, Robert D. White., and the contractor, Phillip Harrington, Bear Garden Inc., to obtain a CAMA General Permit to
excavate land in the inlet adjacent to my property, and to temporarily deposit the spoil material on this land that I own until
it is reclaimed onsile or is removed at a later date, and I specifically grant permission for the operation of this endeavor.

Re: Objection to the Issuance of CAMA General Permit #86836-A for the excavation of a man-made canal
located at 144 Edgewater Drive, Shiloh.
Dear Ms. Smart:
This letter is in response to your correspondence dated March 6, 2023 regarding your objection as an adjacent
riparian property owner to a permit request from Ken Elliott on behalf of Robert White & William Gray, for the
excavation of 539 cubic yard from an existing man-made canal. This project is located at 141 Edgewater Drive,
Shiloh in Camden County and adjacent to the Albemarle Sound.
Under the Coastal Area Management Act (CAMA), the Coastal Resources Commission (CRC) has established
Rules for General Permits for this type of development that are found in 15A NCAC 07H.1500.
The Division has reviewed your objections, along with all aspects of this development proposal for consistency with
the aforementioned Rules, which describe the CRC's standards and guidelines for this type of development. Our
review of the proposed development has found it to be consistent with the Rules of the CRC and the State's Coastal

RE: Letter of concern to Ken Elliott's submission of Robert White's request for a CAMA permit at 140
and 141 Edgewater Drive, Shiloh, NC
Dear Mr. Renaldi:
Overall, I do not have an objection to dredging or the concept of dredging the canal in Camden Point. The
fishing industry is what sustains the community residents and is an important aspect of community
survival and vibrancy.
However, based on the February 20, 2023, letter from Mr. Ken Elliott summarizing an enclosed CAMA
permit application for dredging the canal, I have the following comments, concerns, and objections.
The application itself is false. The property owner is William Gray, not Robert White. Mr. Gray should be
the applicant or, minimally, the co -applicant. With the summary letter identifying the use of the spoils
toward fulfillment of Mr. Grays permit of April 2022, Mr. Grays involvement is made even more clear.
Mr. Gray must be listed on the application and accountable for activity involving his property.
The submission map indicates a property line without further designation. There are no measurements,
standing markers, or historical value applied to the indicated line on the application. As documented in a
letter from me to CAMA dated June 21, 2022, the parties have agreed the property line includes a
structural monument by Hassell Land Surveys dated December 22, 1971, and what is now a tree stump
just prior to the adjoined bulkhead along the Albemarle Sound. These designations must be made on the
application.
With further regard to property lines, the application suggests that there is a right of way between Mr.
Gray's properties. We now know, as documented by CAMA in April 2022, there is no community right of
way. Rather, there are three properties owned by Mr. Gray. Regardless of where the spoils will be placed,
the whole and contiguous nature of the properties must be reflected on the application.
As the dredging application is being commingled with Mr. Grays permit of June 2022, spot elevations need
to be made prior to dredging and shown on the site plan. It will not be acceptable to fill sand on Mr.
Grays properties an "average of 9 inches deep" in addition to the spoils of the proposed dredging,
creating a depth greater than previously permitted.

Again, as the application is being commingled with Mr. Gray's permit, prior to sculpting or smoothing the
spoils for landscaping purposes, Mr. Gray needs to "construct swale to maintain efficient stormwater
drainage."
I believe a silt fence is a requirement of CAMA for drying purposes yet no silt fence is designated on Mr.
Gray's property adjacent to mine.
Reasonable oversight must be provided by CAMA with regard to the current dredging application and
existing permit of Mr. Gray.

I am writing to you on behalf of Mr. Robert D. White, owner of Frog Island Seafood, Inc., PO Box 2107, Elizabeth
City, NC 27909, who is applying for an NC Division of Coastal Management CAMA General Permit for a dredging
project to increase the navigable depth of a portion of the inlet between Albemarle Sound and the Camden Point
inner canal. The inlet is located at the eastern end of Edgewater Drive.
Sedimentation, shoreline erosion and wave action have decreased the water depth in the inlet to an average of
1.75 feet along the traditional marked entrance to the inside canal. The dredged area is proposed to be located
approximately 20 feet from the western shoreline of the inlet, will be 30 feet wide and 3.5 feet deep, totaling
12,120 square feet. The dredging operation will be performed by usage of a long -reach excavator from the
western shoreline of the inlet at 140 and 141 Edgewater Drive on property owned by Mr. William D. Gray.
The dredged spoil amount of approximately 785 cubic yards will be stored temporarily at 140 and 141 Edgewater
Drive for drying out until removal offsite. After drying, it will be taken to a selected upland site at 101 Cheryl
Lane in Camden Point where it will be stockpiled for later use. A portion of the spoil will be used by Mr. Gray
for backfill maintenance of his bulkhead at 140 and 141 Edgewater Drive, as already permitted by NC Coastal
Management.
As an adjacent riparian property owner to the proposed spoil drying site, I am required to notify you of the
development to give you the opportunity to comment on the project. Please review the attached riparian owner
notification and drawings. If you have no objections to the project, please indicate as such at the top of the
enclosed owner's statement, sign and date the statement, and then return the statement to my office in the
enclosed self-addressed stamped envelope.
Also, please complete the waiver section on the statement since there may be construction and excavation
equipment at times within 15 feet of your property.
Should you have any objections to this proposal, please send your written comments to CAMA Field

the connecting canal in Camden Point. The spoil removed will be temporarily placed onshore
on the William D. Gray parcels # 1 and #2 at 141 Edgewater Drive in Camden Point. The
dredged spoil will then be transferred to a parcel owned by Robert White at 101 Cheryl Lane in
Camden Point, at the intersection of Sailboat Road and Cheryl Lane. This spoil site will be
fenced with silt fence and is located outside of CAMA jurisdiction. Please see attached maps.
From there the spoil stockpile will be used as needed.
