This permit, issued on May 1, 2023 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Mixed Townhouse and Sinale-Family Develoument 1) Unless specifically altered herein, this permit authorizes the grading and other land disturbing activities associated with the development of the above referenced property, including the 73 mixed use residential units (59 townhomes and 14 single family lots), associated parking, sidewalks, three beach accesses, boardwalk, pool with bath house, public water connections, retaining wall, and sewer extensions for connections, all as expressly and specifically set forth in the attached permit application and workplan drawings. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on May 1, 2028 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee East Fort Macon Road, LLC ADDITIONAL CONDITIONS Vegetation Line Permit No. 46-23 Page 2 of 3 2) The structures shall meet the appropriate setbacks from the pre -project vegetation line (referenced as "static vegetation line" on attached workplans) as shown on plats dated 12/2/22. 3) Prior to the initiation of construction within the Ocean Hazard AEC, a representative of the Division of Coastal Management shall stake the first line of stable, natural vegetation line, the pre -project vegetation line (static vegetation line) and the small and large structure setbacks. These setback determinations shall replace those done at the time the permit application was processed and approved. Construction shall begin within sixty days of this determination, or the measurement is void and shall be re- established. In the case of a major shoreline change within that period, a new setback determination shall be required before construction begins. 4) All boardwalk decking waterward of the Ocean Hazard 60' setback shall not exceed 500 square feet for each lot and not extend oceanward of the pre -project vegetation line (static vegetation line). 5) The three proposed 6' wide beach accesses.shall not extend beyond the first line of stable, natural vegetation. Stormwater Management NOTE: The permittee is advised that the Division of Energy, Mineral and Land Resources (DEMLR) may require a Stormwater Management permit. The permittee shall receive a Stormwater Management permit from DEMLR prior to the initiation of any construction. Submit this plan to the Division of Energy, Mineral and Land Resources, Land Quality Section, 127 Cardinal Drive Extension, Wilmington, NC 28405. Any violation of the permit approved by DEMLR shall be considered a violation of this CAMA permit. Sedimentation and Erosion Control 6) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 7) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses or properties. NOTE: An Erosion and Sedimentation Control Plan may be required for this project if upland disturbance is greater than I acre. If required, the plan must be filed at least thirty (30) days prior to the beginning of any land disturbing activity. General 8) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. NOTE = This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE= The permittee is advised that if water utilities or new wells are required to service the authorized development, plans and specifications for all new waterlines should be submitted and approved by the Public Water Supply Section prior to the initiation of construction. Furthermore, water supply wells must be approved by the county in which the subject property is located, and local cross -connection requirements maybe required. NOTE_, The N.C. Division of Water Resources authorized the proposed project by way of Individual Water Quality Certification 5689 and assigned the project DWR Project No. 20230147. NOTE_ Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 515-5400 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high-water level. The proposal is for the redevelopment of a 6.426 acre tract at 1621 Salter Path Road in Salter Path, Carteret County. The proposed development is consistent with 15A NCAC 7H.0300. The Morehead City District office recommends the project be authorized as proposed on plats dated received 12/6/2022 contingent upon all applicable general conditions and the following standard conditions: • All proposed development and associated construction must be done in accordance with the permitted work plat drawings(s) dated received by DCM on 12/6/2022. • The structures (5000 sf or less) must set back a minimum of 60 feet from the (pre -project vegetation line (old static Vegetation line) as shown on plats dated received 12/6/2022 per NCDCM Director guidance. • All boardwalk decking waterward of the Ocean Hazard 60' setback shall not exceed 500 square feet for each lot and not extend oceanward of the pre -project vegetation line (static vegetation line). Overview: The project site is located at 621 Salter Path Road (along the Atlantic Ocean) and is bordered by an ocean side mobile home park to the east and the Ocean Club condos to the west. The property is 279,916.56 square feet (6.426 acres) in its entirety, has a shoreline length of 400' and is an average of 25' above NHW. The site contains native oaktrees, typical lawn grasses and shrubs, existing asphalt drives and a delipidated beach access. The property is also void of coastal wetlands and 404 jurisdictional wetlands. Applicable AECs are the Ocean Erodible AEC and High Hazard Flood Area, as indicated by Zone VE 12 on the FEMA Flood Insurance Rate Map. The waters of the Atlantic Ocean are classified as SB and are open to the taking of shellfish. The substrate in this area is large coarse -grained sand typical of oceans and inlets. This area has strong tidal currents and shifting sands. The long-term annual erosion rate in the vicinity of the property is 2.0 feet per year. The total Ocean Erodible Area for this tract is 180 feet. Because this property is unique it was determined by the Director of DCM that the development setbacks can be measured from the pre -project vegetation line (the Beach Management Plan (old static line exception) is more restrictive and more oceanward than the (pre - project vegetation line). The total land area combined is 279,916.56 square feet (6.426 acres), however only 250,905.6 square feet (5.76 acres) of property would be disturbed. According to the applicant, the proposal to construct the mixed -use development would result in a density of 11.36 units per acre and the total percentage of impervious coverage within the AEC would be 26.30% (low density with pre-88 impervious). The proposed method of sewage disposal would be connection lines to an offsite wastewater system on the northern tract across highway 58. The drinking water supply source would be the West Carteret Water Supply. The applicant is proposing 14 single family lots along the south side (oceanside) of the tract. The single- family structures would meet the minimum 60' setback from the pre -project vegetation line, would be 5000 sf or less (actual dimensions not given and would not include unenclosed porches or decks), three stories over parking and a maximum height of 100' from grade. Each lot would have a 500sf or less shore parallel 10' wide deck area at the pre -project vegetation line that would connect to two common area boardwalk locations for the HOA along the east and west side of this area. All decking would be elevated and unenclosed. They are also proposing three 6' wide beach accessways (west side, middle and east side of tract) that would begin at the pre -project vegetation line and extend oceanward. The beach accesses would terminate at the first line of stable natural vegetation. Infiltrating permeable pavers are proposed for all drives, and parking spaces within the development. All parking would meet a minimum distance of 120' from the pre -project vegetation line and start landward of the single-family lots. The applicant is proposing a total of 59 townhomes with 7 of those (15& 16, 69-73) to start 155' from the pre -project vegetation line along with the pool and bathhouse. The remaining townhomes, private sidewalks, parking, retaining walls and HOA common areas are located outside of the total AEC Area (180') as well as 210'+ landward of the pre -project vegetation Line. Anticipated impacts: Grading, filling and development of the properties would result in the disturbance of approximately 250,905.6 ft2 (5.76 acres) of high ground. The development would result in 26.30% (low density with pre-88 impervious) of impervious coverage within the AEC. Basis for Determination: The project site is located in Carteret County and is subject to the 2007 Town of Indian Beach Core Land Use Plan. The Future Land Use Map (FLUM) designates the site as Multi -Family Residential. Additionally, the site is identified as part of the Salter Path Maritime Forest a Significant Natural Heritage Area. As has been discussed, there is a significant trend within town whereby all mobile home parks and campgrounds are being converted to group housing or multi -unit development. All areas depicted on the Future Land Map as multi family either fall within the B-1 or RR zoning district. Under either of these districts, multi family housing is permitted. The density within these areas is defined under the town's Group Home Ordinance. This ordinance requires all proposed multi -unit developments to submit preliminary site plans that the Town Board must review and approve. The town has established specific regulations targeted at these developments which are outlined in the Group Home Ordinance. Within the multi -family district, an average of 16 units per acre (depending on the number of bedrooms proposed per unit) will be allowed, with a maximum building height of 100 feet. Redevelopment of these areas has already begun and is expected to continue. These densities may be affected by two factors: the presence of Outstanding Resource Waters (ORW) adjacent to the site, or the need for large portions of land needed for package treatment plant drain and repair fields. One significant issue related to these developments is wastewater treatment and stormwater management. The town will rely on oversight from both NCDENR and the Carteret County Health Department to ensure that facilities are adequate to support permitted densities within these developments. When applicable, all construction activities shall be performed and maintained in full compliance with G.S. Chapter 113A Article 4 (Sediment and Pollution Control Act of 1973). Regardless of applicability of the Sediment and Pollution Control Act, all projects shall incorporate appropriate Best Management Practices for the control of sediment and erosion so that no violations of state water quality standards, statutes, or rules occur. Culverts shall be designed and installed in such a manner that the original stream profiles are not altered and allow for aquatic life movement during low flows. The dimension, pattern, and profile of the stream above and below a pipe or culvert shall not be modified by widening the stream channel or by reducing the depth of the stream in connection with the construction activity. The width, height, and gradient of a proposed culvert shall be such as to pass the average historical low flow and spring flow without adversely altering flow velocity. If the width of the culvert is wider than the stream channel, the culvert shall include multiple boxes/pipes, baffles, benches and/or sills to maintain the natural width of the stream channel. If multiple culverts/pipes/barrels are used, low flows shall be accommodated in one culvert/pipe and additional culverts/pipes shall be installed such that they receive only flows above bankfull. Placement of culverts and other structures in streams shall be below the elevation of the streambed by one foot for all culverts with a diameter greater than 48 inches, and 20% of the culvert diameter for culverts having a diameter less than or equal to 48 inches, to allow low flow passage of water and aquatic life. If the culvert outlet is submerged within a pool or scour hole and designed to provide for aquatic passage, then culvert burial into the streambed is not required. For structures less than 72" in diameter/width, and topographic constraints indicate culvert slopes of greater than 2.5% culvert burial is not required, provided that all alternative options for flattening the slope have been investigated and aquatic life movement/connectivity has been provided when possible (e.g. rock ladders, cross -vanes, sills, baffles etc.). Notification, including supporting documentation to include a location map of the culvert, culvert profile drawings, and slope calculations, shall be provided to DWR 30 calendar days prior to the installation of the culvert. When bedrock is present in culvert locations, culvert burial is not required, provided that there is sufficient documentation of the presence of bedrock. Notification, including supporting documentation such as a location map of the culvert, geotechnical reports, photographs, etc. shall be provided to DWR a minimum of 30 calendar days prior to the installation of the culvert. If bedrock is discovered during construction, then DWR shall be notified by phone or email within 24 hours of discovery. Installation of culverts in wetlands shall ensure continuity of water movement and be designed to adequately accommodate high water or flood conditions. When roadways, causeways, or other fill projects are constructed across FEMA-designated floodways or wetlands, openings such as culverts or bridges shall be provided to maintain the natural hydrology of the system as well as prevent constriction of the floodway that may result in destabilization of streams or wetlands. Biologists with the North Carolina Wildlife Resources Commission (NCWRC) reviewed the permit application with regard to impacts on fish and wildlife resources. The project site is located at 1621 Salter Path Road, adjacent the Atlantic Ocean in Salter Path, NC. Our comments are provided in accordance with provisions of the Coastal Area Management Act (G.S. I I3A-100 through 113A-128), as amended, Sections 401 and 404 of the Clean Water Act, as amended, the Endangered Species Act of 1973, as amended (16 U.S.C. 1531 et seq.), the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et seq.), the Magnuson -Stevens Fishery Conservation and Management Act (FCMA), as amended (16 U.S.C. 1801 et seq.), and the Migratory Bird Treaty Act (16 U.S.C. 703-712 et seq.). The applicant proposes to develop a mixed townhouse and single-family development impacting 5.76 acres of the 6.426-acre "Salter Path Family Campground Ocean Side" development. The tract has been vacant since 2012 with previous impervious areas retraining in place. Impervious coverage within the AEC would be 26.30%. Sewage disposal would be across NC Hwy 58 at the "The Pearls Soundside". The 14 single family lots would meet the 60' ocean setback. Ocean front lots would have 500 ft2 or less of elevated decking within the ocean hazard setback. A 10' wide parallel to shore deck will be aligned along 400' of ocean shore, connecting to two common area boardwalk locations for the HOA along the east and west side. Three 6' beach accessways would begin at the pre -project vegetation line and extend oceanward. The beach accesses would terminate at the first line of stable natural vegetation. Infiltrating permeable pavers are proposed to aid in stormwater treatment. Fifty-nine townhomes will be constructed with seven of those sited 155' from the pre -project vegetation line. The Atlantic Ocean at this location is classified SB by the Environmental Management Commission. The ocean shore at the project location is designated by the US Fish and Wildlife Service (USFWS) as critical habitat for Loggerhead sea turtles (Caretta caretta) and proposed critical habitat for Rufa Red Knot (Calidris canutus rufa). However, we are concerned with the presentation of the "static vegetation line", "first line of stable natural vegetation" (FLSNV), and approximate "normal high water line" (NHWL). Within the original application a 2004 aerial with the "Salter Path Family Campground Ocean Side" overlay was included. This indicated the FLSNV was positioned well within bare sand. The NCWRC has discussed with staff from NCDCM and believes the FLSNV is more aligned with the terminus of the existing beach access and the NHWL is more aligned with the FLSNV as presented on the 2004 aerial. Our concerns are two -fold. One is the setback for development may have been set based on poorly represented lines on a plan. The second is the positioning of the 400' long 10' wide deck and landing of the three access stairs appear to be rather far forward along the beach profile based on the static vegetation and FLSNV lines and narratives provided within the application package. The forward extension of structures on beaches designated as critical habitat is especially concerning due to impacts to nesting and overall habitat use. Due to the designation and proposed designation of this area as critical habitat for two federally listed species, the NCWRC requests clarification of the vegetation lines and NHWL. PROJECT SUMMARY: The Pearls Oceanside project is proposed as a mixed townhouse and single-family development on the old "Salter Path Family Campground Ocean Side" in Salter Path, Carteret County. Narrative Description The Pearls Oceanside project is located at 1621 Salter Path Road (along the Atlantic Ocean) and is bordered by an ocean side mobile home park to the east and the Ocean Club condos to the west. The property is 279,916.56 square feet (6.426 acres) in its entirety, has a shoreline length of 400' and is an average of 25' above NHW. The site contains native oak trees, typical lawn grasses and shrubs, existing asphalt drives and a delipidated beach access. The property is also void of coastal wetlands and 404 jurisdictional wetlands. The waters of the Atlantic Ocean are classified as SB and are open to the taking of shellfish. Carteret Counties Land Use Plan classifies this area as municipality (Indian Beach/Salter Path) with all AEC's classified conservation. The substrate in this area is large coarse grained sand typical of oceans and inlets. This area has strong tidal currents and shifting sands. The property is located within the Ocean Erodible AEC and High Hazard Flood Area, as indicated by Zone VE 12 on the FEMA Flood Insurance Rate Map. The long-term annual erosion rate in the vicinity of the property is 2.0 feet per year. The total Ocean Erodible Area for this tract is 180 feet. Because this property is unique it was determined by the Director of DCM that the development setbacks can be measured from the pre -project vegetation line (the Beach Management Plan (old static line exception) is more restrictive and more oceanward than the (pre -project vegetation line)). For this tract, the pre -project vegetation line is where the total Ocean Erodible Area (180') will be measured from. 10. Project Description: The project (The Pearls Oceanside) is located at 1621 Salter Path Road, adjacent to the Atlantic Ocean, in Salter Path, Carteret County. The applicant's proposal is to construct 73 mixed use units (59 townhomes and 14 single-family lots with 5000 sf or less homes), associated parking, sidewalks, three beach accesses, boardwalk, pool with bath house, public water connections, retaining wall and sewer extensions for connections. The total land area combined is 279,916.56 square feet (6.426 acres), however only 250,905.6 square feet (5.76 acres) of property would be disturbed and therefore would be classified as low density per the applicant. According to the applicant, the proposal to construct the mixed -use development would result in a density of 11.36 units per acre and the total percentage of impervious coverage within the AEC would be 26.30% (low density with pre-88 impervious). The proposed method of sewage disposal would be connection lines to an offsite wastewater system on the northern tract across highway 58. The drinking water supply source would be the West Carteret Water Supply. The single-family structures would meet the minimum 60' setback from the pre -project vegetation line, would be 5000 sf or less (actual dimensions not given and would not include unenclosed porches or decks), three stories over parking and a maximum height of 100' from grade. Each lot would have a 500sf or less shore parallel 10' wide deck area at the pre - project vegetation line that would connect to two common area boardwalk locations for the HOA along the east and west side of this area. All decking would be elevated and unenclosed. They are also proposing three 6' wide beach accessways (west side, middle and east side of tract) that would begin at the pre -project vegetation line and extend oceanward. The beach accesses would terminate at the first line of stable natural vegetation. Infiltrating permeable pavers are proposed for all drives, and parking spaces within the development. All parking would meet a minimum distance of 120' from the pre -project vegetation line and start landward of the single-family lots. The applicant is proposing a total of 59 townhomes with 7 of those (15&16, 69-73) to start 155' from the pre -project vegetation line along with the pool and bathhouse. The remaining townhomes, private sidewalks, parking, retaining walls and HOA common areas are located outside of the total AEC Area (180') as well as 210'+ landward of the pre - project vegetation Line. The property is 6.426 acres and located at 1621 Salter Path Road In Indian Beach. No wetlands were located or surveyed on the site. The existing impervious areas taken from aerials found on both Carteret County GIS, Google Earth and predate NCDEQ Stormwater regulations. Since there is no existing impervious survey and all campers have been previously removed from the site, a conservative area (45,473 square feet) is used for the existing impervious area. The site drains both north toward Bogue Sound, Class SA;ORW and south Into the Atlantic Ocean, Class SB. The design of the project assumes the entire tract drains toward Bogue Sound. Given the proximity to SA waters a maximum impervious of 12%Is allowed to remain a low -density project. We have utilized the density calculation method outlined in 15A NCAC 02H .3003(1)(b). This method allows an additional 28,133 square feet of impervious, however maintaining the low -density permitting option. Infiltrating permeable pavement for the 1-year 24-hour storm event is proposed for all drives and parking spaces within the development. Based on the soils report prepared by Land Management Group, approximately 66' of the drive entrance of does not meet the MDC for infiltrating permeable pavement. This area not receiving credit has been accounted for in the total built upon area for the development. The excessively drained soils have high infiltration rates and limited runoff. The following measures are proposed for the site. If it becomes evident that additional erosion and sedimentation control measures are needed, they shall be installed immediately. It is intended that all grading and excavation activities within a certain area will be protected as soon as that activity is complete. 1. Temporary Gravel Construction Entrance —Stone construction entrance will be used to reduce transport of sediment off site. 2. Sediment Fence —Sediment fence will be utilized as necessary in locations as shown on plans or as deemed necessary by the engineer to ensure that off -site sedimentation is controlled. 3. Seeding — All disturbed areas will be seeded within 7-14 days following construction in accordance with the seeding schedule shown on the plans. 4. Temporary Sediment Traps — Sediment traps will be constructed as shown on plans and serve to trap sediment and prevent from the sediment moving off -site. Erosion Control Specifications 1. All erosion and sediment control measures shall be checked for stability and effective operations following every runoff producing rainfall event or at least once per week. Repairs required shall be completed immediately to the dimension and functions indicated on the plans. 2. Sediment shall be removed from behind the sediment fencing when it becomes 0.5 feet deep at the fence. The fence shall be replaced or repaired as necessary to maintain a barrier. 3. Once construction traffic has ceased and adjacent soils are vegetated, remove the geotextile and soiled aggregate and install the remainder of the PICP pavement structure per the plans. If additional construction traffic uses the installed PICP system, surface must be protected with a woven geotextile and minimum of 2 inches of ASTM No. 8 open -graded aggregate layer.
