Sawyer Motor Company, Inc., PO Box 639, Manteo, NC 27954 Authorizing development in Dare County at adj. to Scarboro Creek and Roanoke Sound at 112 Gilbert St., in Manteo, as requested in the permittee's application dated 12/4/22 (MP-1, MP-2, & MP-4), including work plan drawings (3) Sheets 1-3 of 3 dated 11/30/22. This permit, issued on April 10, 2023 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation rt tnese terms may be subject to Imes, imprisonment or civil action; or may cause the permit to be null and void. Docking Facility Expansion I) This permit authorizes the demolition of portions of the existing facility and the construction of the docks, piers, boatlift, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) This permit authorizes 2 additional formalized boat slips for a maximum of 5 formalized boat slips at this docking facility. (See attached sheets for Additional Conditions) This permit action may be appealed by the pennittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on April 10, 2028 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. ADDITIONAL CONDITIONS Permit No. 44-23 Page 2 of 4 3) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the mooring. Any sewage discharged at the mooring shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 4) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 5) All portions of the authorized structure shall have a minimum setback distance of 15 feet between any parts of the stricture and the adjacent property owner's area of riparian access. 6) The authorized structure and associated activity shall not cause an unacceptable interference with navigation and shall not exceed the dimensions shown on the attached permit drawings. 7) Any portion of the permitted access pier and docking facilities built over wetlands shall not exceed six feet in width and shall be elevated a minimum of three feet above the wetland substrate as measured from the bottom of the decking. 8) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. Upland Excavation 9) No excavation shall take place outside of the area indicated on the workplan drawings. 10) The temporary placement or double handling of excavated materials within waters or vegetated wetlands is not authorized. 1 1) No excavated or fill material shall be placed at any time in any vegetated wetlands/marsh or surrounding waters. 12) Excavation shall not exceed -5 feet below the normal water level. In no case shall the depth of excavation exceed the depth of connecting waters. 13) No excavation shall take place within 10 feet of any Coastal Wetlands. 14) All mechanized equipment will be regularly inspected and maintained to prevent contamination of waters and wetlands from fuels, lubricants, hydraulic fluids, or other toxic materials. In the recent of a spill of petroleum products or any other hazardous waste, the permittee shall immediately report it to the N.C. Division of Water Resources at (919) 733-5083, Ext. 526 or (800) 662-7956 and provisions of the North Carolina Oil Pollution and Hazardous Substances Control Act will be followed. R. D. Sawyer Motor Company, Inc. ADDITIONAL CONDITIONS Dredge Material Disposal 15) No dredge material shall be placed within 30 feet of the normal water line. Permit No. 44-23 Page 3 of 4 16) All excavated materials shall be confined above normal high water and landward of regularly or irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of solids into any marsh or surrounding waters. The barriers shall be maintained and functional until the site is graded and stabilized. 17) The dredge material disposal area shall be inspected and approved by a representative of the Division of Coastal Management prior to the commencement of any dredging activities. Bulkhead 18) The bulkhead shall be constructed in accordance with the alignment depicted on the attached workplan drawings. 19) No vegetated wetlands or open water shall be excavated or filled, even temporarily. 20) The alignment of the authorized bulkhead shall be staked by the permittee and verified by a representative of the Division of Coastal Management within a maximum of 30 days prior to the start of construction. 21) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal or vinyl sheet piles, or other suitable materials approved by Division personnel. 22) The bulkhead shall be structurally tight so as to prevent seepage of backfill or upland materials through the structure. Sedimentation and Erosion Control 23) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 24) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses or properties. 25) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of any phase of grading on cut or tilled slopes. At a minimum, a silt fence shall be properly installed immediately landward of the bulkhead cap immediately following completion of backfilling activities. General 26) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. R. D. Permit No. 44-23 Page 4 of 4 ADDITIONAL CONDITIONS 27) All construction debris associated with the removal or construction of the permitted development shall be contained within the authorized project area and disposed of in an approved upland location. 28) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General Permit 198000291 (Action ID SAW-2023-00070). NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 4501 and assigned the project DWR Project No. 20221753. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high-water level. The Federal agencies have completed review of the proposal as presented by the application and your field investigation report. We recommend that the following conditions be included in the State authorization: 1. All work authorized by this permit must be performed in strict compliance with the attached plans, which are a part of this permit. Any modification to these plans must be approved by the US Army Corps of Engineers (USACE) prior to implementation. 2. The permittee understands and agrees that, if future operations by the United States require the removal, relocation, or other alteration, of the structure or work herein authorized, or if, in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to the free navigation of the navigable waters, the permittee will be required, upon due notice from the U.S. Army Corps of Engineers, to remove, relocate, or alter the structural work or obstructions caused thereby, without expense to the United States. No claim shall be made against the United States on account of any such removal, relocation, or alteration. The permittee shall notify NOAA/NATIONAL OCEAN SERVICE Chief Source Data Unit N CS261, 1315 E West HWY- RM 7316, Silver Spring, MD 20910- 3282 at least two weeks prior to beginning work and upon completion of work. 3. Except as specified in the plans attached to this permit, no excavation, fill or mechanized land -clearing activities shall take place at any time in the construction or maintenance of this project, in such a manner as to impair normal flows and circulation patterns within waters or wetlands or to reduce the reach of waters or wetlands 4. Except as authorized by this permit or any USACE approved modification to this permit, no excavation, fill or mechanized land -clearing activities shall take place at any time in the construction or maintenance of this project, within waters or wetlands. This permit does not authorize temporary placement or double handling of excavated or fill material within waters or wetlands outside the permitted area. This prohibition applies to all borrow and fill activities connected with this project. 5. Unless otherwise authorized by this permit, all fill material placed in waters or wetlands shall be generated from an upland source and will be clean and free of any pollutants except in trace quantities. Metal products, organic materials (including debris from land clearing activities), or unsightly debris will not be used. 6. The authorized structure and associated activity must not interfere with the public's right to free navigation on all navigable waters of the United States. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work for reason other than safety. 7. The permittee shall advise the Corps in writing at least two weeks prior to beginning the work authorized by this permit and again upon completion of the work authorized by this permit. 8. The permittee shall require its contractors and/or agents to comply with the terms and conditions of this permit in the construction and maintenance of this project, and shall provide each of its contractors and/or agents associated with the construction or maintenance of this project with a copy of this permit. A copy of this permit, including all conditions, shall be available at the project site during construction and maintenance of this project. 9. The permittee shall employ all sedimentation and erosion control measures necessary to prevent an increase in sedimentation or turbidity within waters and wetlands outside the permit area. This shall include, but is not limited to, the immediate installation of silt fencing or similar appropriate devices around all areas subject to soil disturbance or the movement of earthen fill, and the immediate stabilization of all disturbed areas. Additionally, the project must remain in full compliance with all aspects of the Sedimentation Pollution Control Act of 1973 (North Carolina General Statutes Chapter 1 13A Article 4). 10. The activity will be conducted in such a manner as to prevent a significant increase in turbidity outside the area of construction or construction -related discharge. Increases such that the turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trout waters by the North Carolina Division of Environmental Management (NCDEM), 25 NTU's or less in all saltwater classes and in all lakes and reservoirs, and 10 NTU's or less in trout waters, are not considered significant. 11. Violations of these conditions or violations of Section 404 of the Clean Water Act or Section 10 of the Rivers and Harbors Act must be reported in writing to the Wilmington District U.S. Army Corps of Engineers within 24 hours of the permittee's discovery of the violation. 12. In order to protect the endangered West Indian manatee (Trichechus manatus) the Permittee shall implement the U.S. Fish and Wildlife Service's Manatee Guidelines, and strictly adhere to all requirements therein. US 64), in the Town of Manteo, Dare County. This 3.9-acre parcel is adjacent a man-made canal and Scarboro Creek (from the narrows to Shallowbag Bay). The tract is elevated approximately 3' above normal water level (NWL). Current man-made features include a bulkhead, 2 docks, mooring piles, a concrete boat ramp, gravel drive, marina buildings, and boat maintenance equipment. There is also a small area of riprap that exists at the end of the Town -owned road (Gilbert Street) which continues in front of a small section of wetlands on the northeast corner of the applicant's property. The parcel consists of—64,290 of marsh acreage, and the coastal wetlands (CW) identified on this section of the tract were Black needlerush (Juncus roemerianus) and Saltmeadow cordgrass (Spartina patens). Non - coastal vegetation on the parcel included Phragmites, Atlantic cedar, Loblolly pine trees, Live oak, wax myrtle, American Winterberry, and indigenous grasses. There was no erosion noted along the shoreline. The riparian property owner to the northeast is a Town -owned road adjacent a residential area. The riparian property owner to the southwest is a residential parcel developed with a mobile home, bulkhead, and slips. No history of previous permitting was discovered for the project site; however, per Dare County parcel data, a warehouse structure was built in 1930, retail building(s) and asphalt paving were constructed in the year of 1945, and a Quonset building was constructed in 1995. Scarboro Creek is classified as Coastal Waters and is in the Pasquotank River Basin. The Environmental Management Commission's water classification for this waterbody is SC. The project area is closed to shellfishing and is in a Secondary Nursery Area. The water depths adjacent the existing boat ramp range from -1 to -2 NWL. The water depths adjacent the existing dock next to the marsh range from -2 to -4 NWL, with the middle of the basin averaging from -5 NWL to -8 NWL. The canal width is 40'. Development Proposal The applicants propose to remove the existing docks that are currently sited along the bulkheaded shoreline and adjacent the coastal marsh, as well as 5 mooring piles. New construction consists of the following: • Excavation of 692 sf of uplands on the west side of the man-made canal. o Excavation length varies from 54' to 75' and excavation width varies from 9' to 12'. o Install a 60'x42' disposal area outside of the 30-foot buffer for the dredge spoils that will total ±205 cubic yards. The excavated area is proposed to be stabilized with 110 linear feet (In ft) of new vinyl bulkhead with a width of 1 foot. The new bulkhead will tie into the existing area of the boat ramp to the north and the existing bulkheading to the south. There is no bulkheading proposed waterward of NWL with no backfill necessary. Page 3 • Install a 15'x12'.5" 20,000-lb boatlift in the proposed side -to slip along the newly excavated/bulkhead area. The location of the lift will be outside of the 15-foot riparian setback area. • Construct a replacement pier (staging dock) along the edge of coastal marsh adjacent to the boat ramp. This dock will be used by Manteo Marine and their customers, allowing the retrieval and launching of boats from the boat ramp and 4 temporary staging areas (slips). The total length of the dock will be 147 In ft, starting out as 5' wide along the marsh and transitioning to 8' wide along the upland area next to the ramp. o At the request of the southwest riparian property owner, the proposed staging dock was shifted back to be over the coastal wetland vegetation, providing more access to the canal. Approximately 45'x5' will be adjacent or over CW, elevated a minimum of 3' above the vegetation, and will transition to a 94'x5' dock over the canal with the remaining 8'x8' decking being over high ground. Anticipated Impacts Total impacts to High Ground Habitat = 3,386 sf • 692 sf from proposed upland excavation, • 2,520 sf of temporary impacts resulting from the disposal area, • 110 sf of impact in the construction of bulkhead. • 64 sf of impact will result in the 8x8' upland decking proposed in association with the staging dock. Total impacts to Open Water Habitat = 657.50 sf • 187.5 sf of shading will result in the use of the proposed boatlift, • 470 sf of shading will result in the construction of the walkway/pier. Total impacts to Coastal Wetlands = 225 sf • 225 sf of shading will result in the section of dock constructed over CW. Submitted by: Yvonne Carver Date: 12/09/22 RECEIVED DEC 14 2022 DCM-MHD CITY Manteo Marine CAMA Major Project Narrative The subject property is an approximately 4-acre parcel located in the Town of Manteo that includes frontage on Scarboro Creek and a man-made canal. The property is owned by RD Sawyer Motor Company, Inc. and is leased and operated by Manteo Marine (C/O Hunter Smithwick). Manteo Marine is a boat sales and maintenance/repair company that has operated out of this location for many years. There is a boat ramp at the head of the canal. This canal is a T-head where the adjacent owner to the south and Manteo Marine share opposite sides of the "T. In addition to the Manteo Marine building, the property includes a boat ramp, docks, bulkhead and storage yard, and the northeast end of the property consists of a peninsula that is primarily coastal wetlands. To the north of the Site is Gilbert Street, owned by the Town of Manteo. Water depths and existing features were surveyed by Quible in June 2022 and plotted on the CAMA Major Plan set. A site visit was conducted with Mrs. Yvonne Carver from NCDCM in June 2022 as well. It is understood that a CAMA Major Permit is required since the proposed work is commercial in nature. The proposed work includes: Proiect 1: Creation of a new boat slip with lift. This would involve excavation of 692 sq.ft of earthen material on the west side of the canal adjacent to the existing boat ramp. This is an upland area that currently includes a dock. The existing dock would be removed and the landward edge of the excavated boat slip area would be stabilized with a bulkhead (110 If). The proposed bulkhead would tie into the boat ramp area. There is a proposed 20,000 Ito lift in this side -to slip location that will enable Manteo Marine to allow customers to test new boats and easily access the water. Project 2: This involves removal of the existing pier that is in poor condition on the east side of the canal adjacent to the ramp. The existing dock (as shown on the CAMA Plan) is 82 If. This is proposed to be replaced by a 147 if pier that would generally follow the edge of the marsh along the canal. This would involve removal of five old pilings that are now on the waterward edge of where the new pier is proposed. This is a staging dock for Manteo Marine customers and would allow retrieval and launching of boats from the ramp and temporary staging areas for boats that are brought into and are leaving the facility. This would not provide permanent fixed slips. In order to attempt to maintain as much boating ingress and egress as possible, Mr. Smithwick has agreed to shift the proposed new dock as far landward as possible, while maintaining enough natural water depth needed for safe navigation. The original design was modified to the current configuration based on comments from the neighboring property owner. It is understood that they objected to the first preferred configuration. They have been re -notified, but no certified green cards have been received to date for the new layout. Once green cards are received, they will be provided to DCM. (c) In the event of any casualty at the Premises during the last one (1) year of the Lease Term, Landlord and Tenant each shall have the option to terminate this Lease on written notice to the other of exercise thereof within sixty (60) days after such occurrence. (d) In the event of reconstruction of the Premises, Tenant shall continue the operation of its business in the Premises during any such period to the extent reasonably practicable from the standpoint of prudent business management, and the obligation of Tenant to pay annual rental and any other sums due under this Lease shall remain in full force and effect during the period of reconstruction. The annual rental and other sums due under this Lease shall be abnted proportionately with the degree to which "Tenant's use of the Premises is impaired, commencing from the date of destruction and continuing during the period of such reconstruction. ASSIGNMENT AND SUBLETTING 18. Tenant shall not assign this Lease or any interest hereunder or sublet the Premises or any part thereof, or permit the use of the Premises by any party other then the Tenant, without Landlord's prior written consent, which consent shall not be unreasonably withheld, conditioned or delayed. Tenant shall pay to Landlord, concurrently with any request for consent to assignment or sublet, a non-refundable fee of S as payment to Landlord for its review and processing of the request. REMEDIES UPON DEFAULT 20. No termination of this Lease prior to the normal ending thereof, by lapse of time or otherwise, shall affect Landlord's right to collect rent for the period prior to termination thereof. (a) Tenant covenants that with respect to any Hazardous Materials (as defined below) it will comply with any and all federal, stale or local laws, ordinances, rules, decrees, orders, regulations or court decisions relating to hazardous snt and, hazardous materials, hazardous waste, toxic substances, environmental conditions on, under or about the Premises of soil and ground water conditions, including, but not limited to, the Comprehensive Onvironmentel Response, Compensation and Liability Act of 1980, the Resource Conservation and Recovery Act, the Hazardous Materials Transportation Act, any other legal requirement concerning hazardous or toxic substances, and any amendments to the foregoing (collectively, all such matters being "Hazardous Materials Requirements"). Tenant shall remove from the Premises, all Hazardous Materials that were placed on the Premises by Tenant or Tenant's employees, agents, invitees or contractors, either after their use by Tenn or upon the expiration or earlier termination of this Lease, incompliance with all Hazardous Materials Requirements. (b) Tenant shall be responsible for obtaining all necessary permits in connection with its use, storage and disposal of Hazardous Materials, end shall develop and maintain, and where necessary file with the appropriate authorities, all reports, receipts, manifest, filings, lists and invoices covering those Hazardous Materials and Tenant shell provide Landlord with copies of all such items upon request. Tenant shall provide within five (5) days after receipt thereof, copies of nil notices, orders, claims or other correspondence from any federal, state or local government or agency alleging any violation of any Hazardous Materials Requirements by Tenant, or related in any manner to Hazardous Materials. In addition, Tenant shall provide Landlord with copies of all responses to such correspondence at the time of the response. D. Sawyer Motor Co. The applicants are proposing to remove the existing docks and 5 mooring piles from the canal, excavation of uplands on the west side of the canal, install a disposal area outside of the 30-foot buffer for the dredge spoils, stabilize the excavated area with new vinyl bulkheading, install a boatlift in the proposed side -to slip along the newly excavated/bulkhead area, and construct a replacement pier (staging dock) along the edge of coastal marsh adjacent to the boat ramp. The project area is located at the RD Sawyer Motor Company off 112 Gilbert Street (S. US 64), in the Town of Manteo, Dare County, which is adjacent a man-made canal and Scarboro Creek. The development proposed will involve the Estuarine Waters (EW), Public Trust Area (PTA), Coastal Shoreline (CS) and Coastal Wetlands (CW) Areas of Environmental Concern (AECs). I have reviewed the Rules of the Coastal Resources Commission (CRC) as they pertain to this project, and my findings are as follows: 15A NCAC 07H .0206 ESTUARINE WATERS (d) Use Standards. Suitable land/water uses shall be those consistent with the management objectives in this Rule. Highest priority of use shall be allocated to the conservation of estuarine waters and their vital components. Second priority of estuarine waters use shall be given to those types of development activities that require water access and use which cannot function elsewhere such as simple access channels; structures to prevent erosion; navigation channels; boat docks, marinas, piers, wharfs, and mooring pilings. Sawyer Motor Co. 01 /04/23 Page 3 Measurements to determine widths of the water body, canals or basins shall be made from the waterward edge of any coastal wetland vegetation that borders the water body. The one-fourth length limitation does not apply in areas where the U.S. Army Corps of Engineers, or a local government in consultation with the Corps of Engineers, has established an official pier -head line. The one-fourth length limitation shall not apply when the proposed pier is located between longer piers or docking facilities within 200 feet of the applicant's property. However, the proposed pier or docking facility shall not be longer than the pier -head line established by the adjacent piers or docking facilities, nor longer than one-third the width of the water body. (1) Piers and docking facilities shall not interfere with the access to any riparian property and shall have a minimum setback of 15 feet between any part of the pier or docking facility and the adjacent property owner's areas of riparian access. The line of division of areas of riparian access shall be established by drawing a line along the channel or deep water in front of the properties, then drawing a line perpendicular to the line of the channel so that it intersects with the shore at the point the upland property line meets the water's edge. The minimum setback provided in the rule may be waived by the written agreement of the adjacent riparian owner(s) or when two adjoining riparian owners are co applicants. 15A NCAC 07H .0205 COASTAL WETLANDS (CW) (c) Management Objective. It is the objective of the Coastal Resources Commission to conserve and manage coastal wetlands so as to safeguard and perpetuate their biological, social, economic and aesthetic values, and to coordinate and establish a management system capable of conserving and utilizing coastal wetlands as a natural resource necessary to the functioning of the entire estuarine system. (d) Use. Standards. Suitable land uses are those consistent with the management objective in this Rule. First priority of use shall be allocated to the conservation of existing coastal wetlands. Secondary priority of coastal wetland use shall be given to those types of development activities that require water access and cannot function elsewhere. Consistent: The replacement dock will be 147 linear feet, starting out as 5' wide alonglover the marsh and transitioning to 8' wide along the upland area next to the existing boat ramp. Any portion of dock over the CW will be elevated at least 3 feet above the wetland substrate. The proposed boatlift will be outside of the 15-foot riparian setback. (7) Bulkheads (A) Bulkhead alignment, for the purpose of shoreline stabilization, shall approximate the location of normal high water or normal water level; (B) Bulkheads shall be constructed landward of coastal wetlands in order to avoid significant adverse impacts to the resources; (C) Bulkhead backfill material shall be obtained from an upland source approved by the Division of Coastal Management pursuant to this Section, or if the bulkhead is a part of a permitted project involving excavation from a non -upland source, the material so obtained may be contained behind the bulkhead; Recommendations for Manteo Marine, LLC / R.
