Philip and Jamie Lanzi Page 2 9. PROJECT DESCRIPTION: The project site is located at 6600 Carmel Trail in Wilmington, adjacent to Howe Creek in New Hanover County. The project area is an undeveloped 0.52 acre parcel that according to the applicant ranges from 0-20' above normal high water (NHW). The property is bordered to the west and east by residential homes that have existing docking facilities, to the north is Carmel Trail, and to the south is Howe Creek. There is an existing stormwater outfall pipe on the property that runs under Carmel Trail and appears to drain the residential area on the landward side of the road. The stormwater pipe currently outfalls into upland area and has formed a small erosion head cut. Upland vegetation on the property currently consists of various native trees and shrubs such as sweet gum, pine trees, oak, and southern magnolia. According to the applicant there is approximately 108 linear feet of shoreline frontage with a strip of Coastal Wetlands approximately 10' wide consisting primarily of smooth cordgrass (Spartina alterniflora). Landward of the Coastal Wetlands is an area of §404 wetlands verified by the U.S. Army Corps of Engineers (USAGE). State Permit No.121-21 was issued to the George Adams Family Trust on September 8, 2021 for a Single Family Home with 2,568 sq. ft. of §404 wetland fill including pool and decking, a stormwater discharge pipe, and a riprap dissipator pad, State Permit No.121-21 was transferred to Philip Lanzi on June 20, 2022 and is due to expire on December 31, 2024. GP No. 85735 was issued to the new owners (Philip and Jamie Lanzi) on April 18, 2022 for a new private pier and platform. On May 6, 2022, a Stop Work Order was issued to Mr. Lanzi for unauthorized §404 and Coastal wetland impacts and the Army Corps of Engineers (USACE) issued a non-compliance letter (Action ID No. SAW 2021-01018). A multi - agency site visit was conducted on August 11, 2022 with Division of Coastal Management, Division of Water Resources, and USACE representatives present as well as the applicant and the applicant's agent. Potential avoidance and minimization techniques and compliance issues were discussed and implemented to some extent by the applicant, including restoring some impacted Coastal and §404 wetland areas, The requested wetland restoration was verified by both the USACE and DCM and was completed on September 13, 2022. The Wilmington -New Hanover County 2006 Land Use Plan classifies adjacent waters and high ground portion at the property as Residential (R-20S). The waters of Howe Creek in the project area are classified as SA-ORW by the Division of Water Quality. The waters in the project area ARE designated as Primary Secondary Nursery Area) by the N.C. Division of Marine Fisheries and they are CLOSED to the harvest of shellfish. 10. PROPOSED PROJECT: The applicant proposes a Major Modification to extend a stormwater discharge pipe and riprap outfall apron with additional §404 wetland fill and to construct a wooden walkway. According to the applicant an additional 968 ft2 of permanent §404 wetland impacts are anticipated from associated grading for the drainage pipe extension, rip rap outfall and inclusion of a previously permitted open wooden deck. The applicant proposes to extend the existing stormwater pipe approximately 90' south toward Howe Creek into §404 wetlands for site drainage improvements. According to the applicant, the permitted stormwater pipe would be extended with a 90 ft. long by 15" wide extension that would drain to existing §404 wetlands (see Sheet 2 of 3). The stormwater pipe relocation and outfall would result in an additional 619 ft2 of permanent §404 wetland impacts and approximately 2 cubic yards of rock is proposed for the outfall apron. As proposed the new outfall and dissipator pad would be located approximately 120.5 ft. from normal high water (NHW) within §404 wetlands. Additionally, the applicant has included 349 ft2. of permanent §404 wetland impacts that were previously permitted Philip and Jamie Lanz! Page 3 as shading impacts. The application states that this area would be permanently impacted by fill and ground disturbance. In addition, a construction corridor is proposed on the southern and eastern sides of the property that would result in temporary impacts within §404 areas of approximately 2,409 sq. ft. (see Sheet 2 of 3). The application states that the area would be restored to pre -construction grades and seeded with a wetland mix. A jurisdictional determination was submitted with the application that is dated 5/26/21. A stormwater pipe profile and stormwater management calculations dated 7/15/22 were also submitted with this application. No additional impervious area or coastal wetland impacts are proposed with this modification request. According to the previous application a total of 24.1 percent or 5,451 ft2 of impervious surface was proposed within the AEC, which encompasses the entire parcel. The proposed wooden walkway would tie into the existing pier. As proposed a 17 ft. long by 6 ft. long L-head walkway would extend from the western side of the permitted open wooden deck and would connect to a 44 ft. long by 6 ft. wide walkway extending to the pier and Howe Creek from the high ground (see Sheet 2 of 3). The adjacent neighbors to the east, Mr. John Carroll and Sue Bark, located at 6604 Carmel Trail submitted concerns about the drainage pipe extension, wetland fill and the location of the rip rap outfall. Mr. Carroll's and Ms. Bark's emails will be included in the permit package. 11. ANTICIPATED IMPACTS: The proposed project modification would permanently impact an additional 968 ft2 of §404 wetlands including 349 ft2 of area that would be permanently impacted by the previously permitted decking adjacent to the ORW waters of Howe Creek. The existing stormwater pipe outfall would be extended approximately 90' south of the current location into §404 wetlands approximately 120.46 from NHW. Moving the outfall pipe into a low relief wetland area may provide improvements to the erosive head cuts but also result in less natural infiltration/flow area between runoff and Outstanding Resource Waters (ORW) of Howe Creek. DCM MP-1 Section 6.0 Additional Information 3.1 Section 6. a. Project Narrative 3.1.1 Project Location and Existing Conditions The project is located on Howe Creek at 6600 Carmel Trail in Wilmington, New Hanover County. Waters in the project area are classified as SA, ORW and are not open to shellfishing. The project area is located in a Primary Nursery Area. The site is currently developed with a residential home and vegetated with typical native shrubs, trees, and typical section 404 and coastal wetland species. Section 404 wetlands and coastal wetlands were delineated by DRG staff and surveyed. Section 404 wetland lines have been approved by USACE, and the JD is attached. Coastal wetland lines were delineated by DRG staff and approved by DCM staff on 5/24/21 and subsequent site visits. The elevation of the tract ranges from 0 ft to the +20 ft NHW. There is currently an existing outfall that directs runoff from the Providence subdivision to the 404 wetlands onsite. 3.1.2 Proposed Action Extension of the subdivision drainage outfall pipe with the addition of a riprap curtain is proposed as a site drainage improvement. The pipe will connect to the existing subdivision culvert and divert drainage around the residence through a 90' long x 15" diameter pipe to existing wetlands. Approximately 2 CY of rip rap are proposed for the outfall apron. Stormwater management calculations for the outfall pipe extension from a Professional Engineer are included. See appendix A and B for details. Previously, a 5'-wide fringe of the open deck was not counted towards the permanent impacts. Due to the proposed structure likely shading this area it is now included in the permeant proposed wetland impact calculations. It is now assumed that all of the 952 s.f. of previously permitted shading impacts will be permanently impacted either by fill or ground disturbance. Total proposed new permanent impacts resulting from the drainage pipe extension, outfall and associated grading, and inclusion of the permitted open wooden deck are 968 s.f.. Also, to ensure no unauthorized violations occur during construction of the residence, a construction corridor (2,409 s.f.) on the southern and eastern sides of the residence is shown as a temporary impact. Post construction, the temporary impact area will be restored back to pre -construction grades and seeded with a wetland seed mix. Silt fence will remain in place until construction activities are complete and wetland plants have re-established. A wooden walkway will tie into the existing pier and permitted open wooden deck. The wooden walkway will be "L" shaped and 6' wide. The lengths of the walkway will be 43' and 17' or 61' for the total length. Please include this in your consideration of adjacent property owners' input and concerns. The road frontage of 6600 Carmel Trail is 120 feet. The proposed frontage of the house to be built is approximately 82 feet. There is concern about how the drainage in the remaining 40 feet will be impacted. It seems that the surface water accumulating from impervious surfaces in the northeast quadrant of 6600 Carmel Trail's lot will create a path for high volume flow of water directed at the northwest quadrant of 6604 Carmel Trail's property. The surface water elevation drop is 6 feet from the NE to NW point of the 6600 lot. Surface water, the Proposed Drainage Pipe Extension and Riprap Outcropping converge 7 feet from the property line, directly across from 6604's cement crawl space, newly replaced drainage pipes and sump pump. Three air conditioners sit not far from that area. There is concern for storm event impacts to these items. There is concern about erosion at the newly proposed convergence location of pipe extension and riprap. With regards to the Proposed Drainage Pipe Extension at 6600 Carmel Trail I would like to know who will be legally responsible for its maintenance and repair. Will it withstand a 25, 50, or 100-year flood? There is concern about the additional loss or damage to the wetland and remaining trees in the newly Proposed Temporary Wetland Impact area of 2409 square feet. I am thrilled that the use of native plants will be utilized in the remaining wetland areas. I appreciate that efforts that have been made to lessen and control the continued soil run-off since the clearing of this lot. The road frontage for the proposed building of 6600 Carmel Trail is approximately 120' and the proposed frontage of the house to be built is approximately 82' which leaves about 40' for the surface water to run off. There is also a proposed landscape berm that will be going in across what looks to be the front the 6600 Carmel Trail as indicated by the engineer's drawing. My concern is the surface water flow from the Northwest to the Northeast corner of 6600 Carmel Trail draining into where the culvert currently ends (the Northeast corner of Carmel Trail) during major rain events and hurricanes. Currently 10 homes drain into the 6600 Carmel Trail property, mostly on the Northwest where the elevation is approximately 18' at Chesapeake Court. The elevation at the Northeast corner of 6600 Carmel Trail is 16' (6604 Carmel Trail side). As a result of the new building structure (6600 Carmel Trail) and proposed landscape berm, the water will flow down Carmel Trail to one of three openings, either driveway 1, driveway 2 and or where the existing culvert is currently located. This is a location where erosion has occurred. With this said, the surface water will run down the Northeast side of the of 6600 Carmel Trail/6604 Carmel Trail. The new property owners have requested Permitted Permanent Wetlands Impact of 2,377 sq ft with and additional Proposed Permanent Wetlands Impact of 968 sq ft. The loss of the Permitted and Proposed Permanent Wetlands Impact is on the Northeast side of the property. The decrease of the wetlands and forest, and the addition of the building and proposed landscape berm does not allow for surface water to dissipate over the property as it once did but takes it to a single point of runoff. This is an area of concern. The fall from the existing Culvert to the beginning of the riprap outfall is about 5' and the Riprap Outfall comes to within 3' of my property line. At this convergence I have three air conditioners that are within 9' of this transitional area, which is halfway down my house. I have just spent considerable money, time and effort on this corner of my house. At this corner is a crawl space/storage area where I added a sump pump and dehumidifiers to dry this location out and keep away any water intrusion. Where water used to run through and mildew was prevalent, it is now dry. I currently have a permit opened with CAMA to do the exterior work. For the outside I added 4" corrugated drain pipe and replaced a wooden -walled vestibule with concrete block and added a fence. There is concern about erosion at the convergence location due to increased water velocity and amount of surface runoff that is not addressed. Other concerns involve the additional loss of wetland in the new Proposed Permanent Wetlands Im act area of an additional 968 sq feet. With this proposed plan and by virtue of bringing the surface water runoff to a single point, it seems water runoff problems have not been addressed. One possible solution to resolve these issues would be to redirect the new drain pipe an additional 30' and point the new drain pipe toward the southwestern part of 6600 Carmel Trail. There is more open area for the water to dissipate and take advantage of the natural flow of the land.
