Overbeck Marine Construction, acting as agent for Saltmeadow Way, LLC. c/o Heather
Nicholson, has submitted a request to modify CAMA Major Permit No. 104-22, which was
issued on October 3, 2022, and is scheduled to expire on October 3, 2027.
The permittee is requesting approval to modify the existing single docking facility instead of
constructing an additional docking facility as originally permitted due to Figure 8 HOA
covenants. The existing docking facility is located off Banks Channel, near the waters of Middle
Sound, in Wilmington, New Hanover County.
The permittee is requesting authorization to add a new fixed landing on the north side of the
existing pier, measuring approximately 6' wide x 8' long. A ramp that would lead to a new L-
shaped floating dock system, measuring approximately 8' wide x 32' long and approximately 6'
wide x 24' long (see Page 1 of 3). The permittee also requests to remove an existing floating
dock, located at the end of the existing docking facility, and to relocate the 13' x 13' existing
boat lift to the landward -most side of the proposed 6' x 24' floating dock, which is oriented
parallel to the shoreline. The existing pier and 16' wide x 20' long fixed platform would remain
the same. The total slip count for the proposed modification to the existing docking facility
would be a total of 4 slips, the same as what was originally permitted by State Permit No. 104-
22. The proposed changes would result in a decrease in total platform area by approximately 36
ft2, for a total of 768 ft2 of platform area, which appears to be within the 8 ft2 per linear foot of
shoreline rule allowance.
Based on the information provided, regarding the minor modification request (plans and
documents), there does not appear to be any impacts to any wetlands, and the size/footprint of

the development plan would remain consistent with DCM's Rules concerning the Estuarine
Shoreline and Public Trust AECs.
At this time, this office has no objection(s) to this minor modification request. The applicant has
submitted a check (No. 5636) in the amount of $100 to cover the processing fee.
By copy of this memo, DCM is requesting that the respective agencies provide any comments on
the proposed project to Cameron Luck of DCM's Morehead City office within 14 days of receipt of
this memo

On behalf of Saltmeadow Way, LLC % Heather Nicholson, we are applying for a CAMA Minor
Modification for the permitted docking facility at 32 Saltmeadow Road.
Currently on the property there is an existing 6'x70' fixed pier, 16'x20' platform, 8'x20' floating
dock, and 13'xl3' boat lift which are positioned on Banks Channel. Due to the increased boat traffic in the
area it is difficult to load and unload from the existing boat lift. We originally proposed an additional
docking facility on the basin side of the property. However, Figure 8 HOA does not allow two dock
accesses on one property causing us to reconfigure the current facility.
We are proposing to remove the existing floater and boat lift and reconfigure the dock facility
according to the attached drawing. This includes adding an additional 13'x13' boat lift on the new floating
dock which would total 4 slips. Please see the attached drawings for clarification.
All proposed work is consistent with current DCM regulations and is within the riparian corridor and will
be constructed according to all current local and state building codes.
The project proponent hereby certifies that all information contained herein is true, accurate, and
complete to the best of my knowledge and belief.
The project proponent hereby requests that the certifying authority review and take action on this CWA
certification request within the applicable reasonable period of time.
