Wrightsville Beach , as requested in the permittee’s application dated 12/15/22 (MP-1) and 12/7/22 (MP-4),
including work plan drawings (3) Sheets 1-3 of 3, dated 12/19/22.
This permit, issued on March 24, 2023 , is subject to compliance with the application (where
consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation
of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on-site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
March 24, 2028
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

Signature of Permittee
Docking Facility
1) This permit authorizes the remove of the existing docking facility and construction of the docks, pier,
boatlifts, gazebo and other structures and uses located in or over the water that are expressly and
specifically set forth in the permit application. No other structure, whether floating or stationary, shall
become a permanent part of this docking facility without permit modification. No non-water
dependent uses of structures shall be conducted on, in or over Public Trust waters without permit
modification.
2) This permit authorizes a maximum of 4 formalized boat slips at this docking facility.

ADDITIONAL CONDITIONS
3) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
mooring. Any sewage discharged at the mooring shall be considered a violation of this permit for which
the permittee is responsible. This prohibition shall be applied and enforced throughout the entire
existence of the permitted structure.
4) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
5) The authorized gazebo shall not be enclosed. Any material used on the sides shall not obstruct view and
shall be permeable to air and water. Screen or wire on the sides along with benches are permitted.
Lattice is specifically excluded from being used under this authorization.
6) The roof of the gazebo shall not be designed for second story use.
7) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
8) All portions of the authorized structure shall have a minimum setback distance of 15 feet between any
parts of the structure and the adjacent property owner’s area of riparian access.
9) The authorized structures and associated activity shall not cause an unacceptable interference with
navigation, shall not exceed the established Wrightsville Beach pier-head line, and shall not exceed the
dimensions shown on the attached permit drawings.
Sedimentation and Erosion Control
10) In order to protect water quality, runoff from construction shall not visibly increase the amount of
suspended sediments in adjacent waters.
11) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses or properties.
General
12) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
13) All construction debris associated with the removal or construction of the permitted development shall
be contained within the authorized project area and disposed of in an approved upland location.
14) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.

NOTE: The U.S. Army Corps of Engineers authorized the project by way of Regional General Permit
197800056 (Action ID SAW-2023-00021).
NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water
Quality Certification 4497 and assigned the project DWR Project No. 2023-0005.
NOTE: Future development of the permittee’s property may require a modification of this permit.
Contact a representative of the Division at (910) 796-7215 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non-water
dependent activities are not authorized within 30 feet of the mean high-water level.
NOTE: An application processing fee of $250 was received by DCM for this project.

8. PROJECT SUMMARY: The applicant proposes to remove an existing docking facility and construct a new private
docking facility able to accommodate up to four (4) vessels.

9. PROJECT DESCRIPTION
The project site is located at 52 Pelican Drive, adjacent to Lee's Cut, in the Town of Wrightsville Beach, New Hanover
County. According to the application, the parcel located at 52 Pelican Drive has a maximum elevation of approximately
0'-T above normal high water (NHW) and is approximately 8,643 ft2 (0.20 acres). The lot has an existing single-family
residence and private docking facility with the high ground vegetation consisting primarily of ornamental landscaping
and maintained lawn grasses. The adjacent riparian parcels have existing single-family residences with bulkheads
and docking facilities. The project site has approximately 76' of shoreline frontage, currently stabilized by a bulkhead
that approximates NHW.
The applicant currently maintains a private docking facility with a covered gazebo, measuring approximately 16'
long x 17' wide, located directly waterward of the existing bulkhead. The covered gazebo has a ramp that leads to a
floating dock structure, measuring approximately 6' wide x 60' long. Located on either side of the waterward end of
the floating dock are 2 boat lifts, measuring 12' long x 12' wide (1) and 16' long x 15wide (2). CAMA Major Permit
140-17 was issued in December 2017 to a previous property owner for the reconfiguration of a prior existing three
(3) slip docking facility, the current docking facility is configured differently than what was previously permitted.
CAMA General Permit 86014D was issued on March 28, 2022 for the replacement of the existing 16' x 15' boat lift
(see Sheet 2 of 3).
The applicant was issued CAMA General Permit 87448D by this DCM office on October 19, 2022 for the installation
of a new 66' bulkhead with wingwalls located 2' waterward of the existing timber bulkhead. As of the date of this
report, the construction of the new bulkhead has been started but is not yet completed.
The Town of Wrightsville Beach Land Use Plan classifies the adjacent waters as Conservation, and the adjacent high
ground portion of the project area as Residential. The adjacent waters of Motts Channel in the project area are
classified SIB by the Division of Water Resources and this area is NOT designated as Primary Nursery Area (PNA)
by the N.C. Division of Marine Fisheries. They are CLOSED to the harvest of shellfish.
PROPOSED PROJECT
The applicant proposes to remove an existing docking facility and construct a new private docking facility able to
accommodate up to four (4) vessels.
Once the existing docking facility is removed, the applicant proposes to construct a new private docking facility to
accommodate up to four (4) vessels. A ramp, beginning at the previously permitted bulkhead, would lead to a new
proposed floating dock with 1 slip for a larger vessel, measuring approximately 6' wide x 65' long. At the end of the
proposed floating dock, a new floating swim platform/floating dock, measuring approximately 8' wide x 24' long, would
extend east to create a 1-head". The floating swim platform would include 2 slips to accommodate vessels. A new
covered gazebo, measuring approximately 16' wide x 18.5' long, is proposed to be constructed waterward of the
previously permitted bulkhead. A new jet dock, measuring approximately 10' wide x 12' long, is proposed to be
installed to the north of the proposed new gazebo. A new 14' wide x 30' long boat lift would be installed adjacent to
the proposed floating dock on the east side. (see Sheets 1 and 3 of 3). The proposed docking facility would extend
approximately 82 ft. into Lee's cut, which measures approximately 329 ft. across in this area and would not exceed
the Town of Wrightsville Beach pierhead line.

10. ANTICIPATED IMPACTS
The proposed new docking facility would result in the incorporation of a maximum of 1,010 ft2 of Estuarine Waters
and Public Trust Area. The proposed structures would not encroach into the 15' riparian corridor setback
requirement, would not exceed the''/<width of the waterbody and would not exceed the Town's Pierhead Line.
Minor increases in turbidity can be expected during excavation and construction.

Mr. and Mrs. Kenneth Jefferies are requesting that a Major Permit be issued for the installation
of a floating dock, covered platform, and boat lift at 52 Pelican Drive, Wrightsville Beach, NC
28480. This structure with a total of four boat slips (3 wet and 1 dry) would be for the
recreational use of the homeowner.
There is currently a home on the property, and we would be replacing the existing floating dock,
covered platform, and 2 boat lifts over the water. There was no SAV sighted and there is no
coastal wetlands on the property.
The pilings for this project would be set using a barge and vibratory hammer to reach the rated
capacity (approximately 8-10' deep). Construction materials would be stored on dry land of
approximately 1200 sqft.

In addition to this completed application form, (MP-1) the following items below, if applicable, must be submitted in order for the application
package to be complete. Items (a) — (9 are always applicable to any major development application. Please consult the application
instruction booklet on how to properly prepare the required items below.

The Division of Coastal Management hereby acknowledges receipt of your application, as acting agent for Kenneth
and Crystal Jefferies, for State approval for development of the subject property located at 52 Pelican Drive, adjacent
to Lee's Cut, in the Town of Wrightsville Beach, New Hanover County. It was received as complete on December 29,
2022 and appears to be adequate for processing at this time. The projected deadline for making a decision is March
5, 2023. An additional 75-day review period is provided by law when such time is necessary to complete the review.
If you have not been notified of a final action by the initial deadline stated above, you should consider the review
period extended. Under those circumstances, this letter will serve as your notice of an extended review. However, an
additional letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from December 29, 2022, you may request a meeting
with the Director of the Division of Coastal Management and permit staff to discuss the status of your project. Such a
meeting will be held within five working days from the receipt of your written request and shall include the property
owner, developer, and project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed development.
Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the property of your proposed
development. You should post this notice at a conspicuous point along your property where it can be observed from
a public road. Some examples would be: Nailing the notice card to a telephone pole or tree along the road right-of-
way fronting your property; or at a point along the road right-of-way where a private road would lead one into your
property. Failure to post this notice could result in an incomplete application.
An onsite inspection will be made, and if additional information is required, you will be contacted by the appropriate
State or Federal agency. Please contact me if you have any questions and notify me in writing if you wish to receive
a copy of my field report and/or comments from reviewing agencies.

Jefferies proposed to remove an existing docking facility and construct a new private docking

Location description: The site is located in Waters of Lee's Cut at 52 Pelican Drive, Wrightsville
Beach New Hanover County, North Carolina.
Description of project area and activity: The proposal is to remove an existing docking facility
and construct a new private docking facility able to accommodate up to four (4) vessels. A
ramp beginning at the previously permitted bulkhead will lead to a new floating dock with 1
slip for a larger vessel measuring approximately 6 feet wide by 65 feet long. At the end of the
floating dock a new floating swim platform/floating dock measuring approximately 8 feet
wide by 24 feet long will extend east to create an "IL -head". The floating swim platform will
include 2 slips to accommodate vessels. A new covered gazebo, measuring approximately 16
feet wide by 18.5 feet long is proposed to be constructed waterward of the previously
permitted bulkhead A new met dock measuring approximately 10 feet wide by 12 feet long, will
be installed to the north of the proposed new gazebo. A new 14 feet wide by 30 feet long boat
lift will be installed admacent to the proposed long floating dock on the east side. The new
docking facility will result in the cover and shading of a maximum of 1,010 square feet of
Estuarine Waters of the US.
Please note, a Coastal Area Management Act (CAMA) permit authorization must
be obtained from the North Carolina Division of Coastal Management (DCM) prior
to commencing any work on this project.

Any violation of the attached conditions or deviation from your submitted plans may subject
the permittee to a stop work order, a restoration order, a Class I administrative penalty, and/or

This verification will remain valid until the expiration date identified below unless the nationwide
and/or regional general permit authorization is modified, suspended or revoked. If, prior to the
expiration date identified below, the nationwide and/or regional general permit authorization is
reissued and/or modified, this verification will remain valid until the expiration date identified below,
provided it complies with all requirements of the modified nationwide permit. If the nationwide and/or
regional general permit authorization expires or is suspended, revoked, or is modified, such that the
activity would no longer comply with the terms and conditions of the nationwide permit, activities
which have commenced (i.e., are under construction) or are under contract to commence in reliance
upon the nationwide and/or regional general permit, will remain authorized provided the activity is
completed within twelve months of the date of the nationwide and/or regional general permit's
expiration, modification or revocation, unless discretionary authority has been exercised on a case -
by -case basis to modify, suspend or revoke the authorization.
Activities subject to Section 404 (as indicated above) may also require an individual Section 401

This project is consistent with the Wrightsville Beach Land Use Plan Update.
The applicant proposes to remove an existing docking facility and construct a new private
docking facility able to accommodate up to four (4) vessels. The project is located at 52
Pelican Drive, adjacent to Lee's Cut in Wrightsville Beach.
Areas of Environmental Concern (AEC's) impacted by the proposal are EW, and PTA.
Waters at the project site are classified as SB and are not open to the harvesting of
shellfish. The area is not a Primary Nursery Area.
I have reviewed this proposal for consistency with the Wrightsville Beach Land Use Plan
Update and offer the following comments.
The general area of the project is classified as Conservation
In general, the Wrightsville Beach Land Use Plan contains policies, which allows
development in Conservation classified AECs, which is consistent with the State's
minimum use standards. The Wrightsville Beach Land Use Plan contains some policies,
which exceed the State's minimum use standards. However, none of these policies
appear to be applicable to this project.
This project is consistent with the Wrightsville Beach Land Use Plan Update.

The Division of Water Resources (DWR) has received a copy of your CAMA Major application renewal
request received bythis office on December 30, 2022. DWR issues approval in theform of a Water Quality
Certification (WQC) in conjunction with the CAMA Major Permit and General Permit(s) 198000291 or
197800056 issued by the US Army Corps of Engineers (USACE). This Certification allows you to use the
CAMA Major Permit when the Division of Coastal Management issues it.
In accordance with the attached General Certification #4497 (GC 4497), the impacts described in your
application do not require written authorization to utilize GC 4497. However, you are required to follow
the conditions listed in the attached certification. You should get or otherwise comply with any other
federal, state and local requirements before you go ahead with your project including (but not limited to)
erosion and sediment control regulations.
This Certification can be contested as provided in Articles 3 and 4 of General Statute 150B by filing a
written petition for an administrative hearing to the Office of Administrative Hearings (hereby known as
OAH). A petition form may be obtained from the OAH at http://www.ncoah.com/ or by calling the OAH
Clerk's Office at (919) 431-3000 for information.
Within sixty (60) calendar days of receipt of this notice, a petition must be filed with the OAH. A petition
is considered filed when the original and one (1) copy along with any applicable OAH filing fee is received
in the OAH during normal office hours (Monday through Friday between 8:00am and 5:00pm, excluding
official state holidays).
The petition may be faxed to the OAH at (919) 431-3100, provided the original and one copy of the petition
along with any applicable OAH filing fee is received by the OAH within five (5) business days following the
faxed transmission.
