HomeMy WebLinkAbout23-10 - WATSON CERTIFIED MAIL: 7021 0950 0002 2684 8552 RETURN RECEIPT REQUESTED SENT VIA EMAIL TO: reid.watson@icloud.com March 29, 2023 Wilbur & Diana Watson 514 Fairway Dr. W Sunset Beach, NC 28468 RE:NOTICE OF REGULATORY REQUIREMENTSCASE #23-10 Dear Mr.& Mrs. Watson: This letter confirms that on 3/16/2023, I was notified via email concerning the property owned by Wilbur & Diana Watson, located at 1522 Riverside Dr. adjacent to a man-made feeder canal located in Sunset Beach, Brunswick County, North Carolina. The purpose of the email was to investigate unauthorized development of an in-ground pool within the Estuarine Shoreline Area of Environmental Concern. No person or entity may undertake development in a designated Area of Environmental Concern without first obtaining a permit in accordance with the Coastal Area Management Act (CAMA); North Carolina General Statutes (N.C.G.S.) §113A-100 et seq. Information provided to me, including an As-Built survey, dated 3/17/2023, shows that Wilbur & Diana Watson undertook, or are legally responsible for, development including the construction of an approximately 27’ x 12’ in-ground pool, approximately 32’ from Normal High Water, on the aforementioned property, and that CAMA Minor Permit # 21-26 did not authorize this development activity. This activity is taking place in the Estuarine Shoreline AEC as designated by the NC Coastal Resources Commission and that is contiguous with the Atlantic Intracoastal Waterway. This letter also confirms email correspondence between Brendan Brock (DCM Field Rep) and Robert Norton and Rachel Smith confirming delivery of the As-Built survey on 3/20/2023 and email correspondence between Danielle Champion and Brendan Brock concerning delivery of the As- Built survey and asking if any additional information would be requested by DCM on 3/21/23. Continuation of work after receipt of this Notice may constitute a violation of the Act and Wilbur and Diana Watson may be subject to civil and/or criminal penalties as provided by N.C.G.S. §113A-126. Each day that the development described in this Notice is continued or repeated may constitute a separate violation that is subject to an additional assessment of $10,000. An injunction or criminal penalty may also be sought to enforce any violation in accordance with N.C.G.S. §113A-126. In this case, there will be no assessment levied against Wilbur and Diana Watson. Wilbur & Diana Watson 3/29/2023 Page 2 of 2 If Wilbur & Diana Watson continues to violate the CAMA, you should consider yourself forewarned and expect a civil penalty to be levied against Wilbur & Diana Watson consistent with the North Carolina Administrative Code, Title 15A, Subchapter 7J, Section .0409, as adopted by the Coastal Resources Commission. The relevant statutes and regulations are available from this office, and I am willing to assist Wilbur & Diana Watson in complying with the requirements of these laws.
