Statement of Compliance and Consistency
This permit is subject to compliance with this application and permit conditions. Any violation of these terms may
subject the permittee to a fine or criminal or civil action; and may cause the permit to become null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for
compliance. The applicant certifies by signing this permit that: 1) prior to undertaking any activities authorized by this
permit, the applicant will confer with appropriate local authorities to confirm that this project is consistent with the
local land use plan and all local ordinances, and 2) a written statement from the adjacent riparian property owner(s)
has been obtained, or proof of delivery of certified mail notification of the adjacent riparian property owner(s).
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available
information and belief, certify that this project is consistent with the North Carolina Coastal Management Program.

BUFFER AUTHORIZATION CERTIFICATE
FOR PIER AND DOCKING FACILITIES ACCESS WAY
A riparian buffer authorization is required for pier and docking facilities access ways through the Tar-Pamlico&
Neuse River Riparian buffer per Division of Water Resources (DWR) regulations 15A NCAC 028.0233 &.0259.The
Division of Coastal Management(DCM),through a Memorandum of Understanding with the Division of Water
Resources (DWR) has reviewed your project proposal and has determined that the project as proposed complies
with the aforementioned regulations.
Those activities covered by your Coastal Area Management Act(CAMA) permit have received Buffer Authorization
provided the project is constructed in a manner that continues to meet all of the conditions listed below. Failure to
comply with this Buffer Authorization may subject the property owner and the party(contractor) performing the
construction and/or[and clearing to a civil penalty by DWR of up to$25,000 per day per violation.
t. Crossing is Perpendicular: Pier and docking facility access way must cross the 50 ft. riparian buffer
perpendicularly(which is defined as between 75 and 105 degrees)unless otherwise approved by DCM.The
alignment shall minimize the removal of woody vegetation to the greatest extent practicable.
2. Pervious Materials:All reasonable measures shall be taken to ensure the access way is made of pervious
materials like open-slatted wood or composite, mulch,or grass to meet the intent of the rules to the
maximum extent practicable. •
3. Access Width:The width of the pier or docking facility access way shall be limited to six(6) feet.
4. Project Drawing:The drawing on the CAMA General Permit is considered the project drawing of your •
property indicating the relative location of the pier or docking facility and any requested access way.This
drawing will be used to aid in compliance and monitoring efforts./

Good morning Shane,
I think I'd have significant issues with the proposal. The bigger issue would be the inner portion, due to depths
less than.2 feet. As you're aware,this has the potential for continued disturbance(increased sedimentation) and
destruction(prop scar) associated with continued use. These concerns are greater in the inner section,but are
also relevant in the outer section. Additionally,the docking of vessels in the proposed slips would result in
continued shading of SAV. As light is one of the most important factors that affects SAV,having vessels
docked continuously presents a.threat of significantly restricted light availability. Because this is.a designated
PNA,protection of the SAV habitat is even more critical in order to protect the species that utilize the SAV
during vulnerable life history stages. Therefore,I'd lean towards objecting to the inner portion as-proposed.
Are they able to position the dock any further south, and possibly rotate the alignment so that the terminal end
points north instead of south?I could be wrong, but looking at it one the map and in the images, it seems like
they could get closer to the property line on the south, especially if they shifted the alignment. Then they could
possibly extend the length of their structure so that both vessels could be docked along the outer side while still
in waters deeper than 2 feet?Just a thought that I had.

All,
I have a project that requires additional coordination in order to potentially issue a CAMA General Permit for a private
docking facility in the Smugglers Cove Subdivision on a tributary to North Creek, a joint waters primary nursery area. I
have included the proposal from Mr.Alesi which includes platform approximately 16'x 10' platform and a 4'x 31'
pier/docking facility extending down the shoreline at an angle approximating-a line parallel to the quarter width.The
creek widens at this location and the maximum quarter width allowance on the left side of the platform is 20" and the
quarter with at the far right of the proposed facility is approximately 29'.The depths on the outer portion of the dock
range from 2.5'to 3'and on the inner portion range from 1'to 2'. I have been to the site twice and there is a significant
SAV presence. No mooring piles or lifts are proposed, only side to wetslip dockage. Per conditions in 07H.1205(h)(2)
coordination is required for permitting a docking facility in SAV.The proposed vessels are a 13'Skiff and a 23' pontoon
boat with a beam of 8' per conversations with Mr. Alesi.
