Permit Class Permit Number NEW 24-23 STATE OF NORTH CAROLINA Department of Environmental Quality and Coastal Resources Commission for X Major Development in an Area of Environmental Concern pursuant to NCGS 113A-118 Excavation and/or filling pursuant to NCGS 113-229 Issued to Kenneth and Jeanna McCraw, 811 Oxfordshire Lane, Chapel Hill, NC 27517 Authorizing development in Pender County at adj. to AIWW at 138 Forest Lane (Great Oak Drive Lots 122 & 123) in Hampstead, as requested in the permittee’s application dated 11/7/22 (MP-1, MP-4), including work plan drawings (3) Sheets 1-3 of 3 dated 11/7/22. This permit, issued on February 10, 2023 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on February 10, 2028 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee Docking Facility Expansion 1) This permit authorizes only the boatlift, cleats, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non-water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) This permit authorizes 2 additional formalized slips for a maximum of 4 formalized boat slips at this docking facility. (See attached sheets for Additional Conditions) Kenneth and Jeanna McCraw Permit No. 24-23 Page 2 of 3 ADDITIONAL CONDITIONS 3) No portion of the permitted structure shall be located within 80 feet of the near bottom edge of the federally maintained AIWW channel. 4) No portion of the authorized docking facility, including tie piles, shall extend more than one quarter of the width of the water body. Measurements to determine width of the water body shall be made from the normal high-water line or the waterward edge of any coastal wetland vegetation which borders the water body, whichever is more restrictive. 5) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 6) The authorized structures and associated activities shall not cause an unacceptable interference with navigation and shall not exceed the dimensions shown on the attached permit drawings. 7) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 8) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the mooring. Any sewage discharged at the mooring shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. Sedimentation and Erosion Control 9) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 10) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses or properties. General 11) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 12) All construction debris associated with the removal or construction of the permitted development shall be contained within the authorized project area and disposed of in an approved upland location. 13) The permittee and/or their contractor shall meet with a representative of the Division prior to project initiation. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 497 and assigned the project DWR Project No. 2022-1661. NOTE: Future development of the permittee’s property may require a modification of this permit. Kenneth McCraw Page 2 9. PROJECT DESCRIPTION: The project site is located at 138 Forest Lane, adjacent to the AIWW, in Hampstead, Pender County. To locate the property from the WIRO office, drive north on NC Highway 17, turn right at Headwaters Drive. Follow Headwaters Drive approximately 0.8 miles to Overlook Drive. Turn left on Overlook Drive and follow it to Northline Drive near the end of the road. Turn right on Northline Drive and follow it to the end. Turn right onto Great Oak Drive and the property will be located on the left hand side of the road, along Forest Lane at house number 138. The property consists of a 2.2-acre parcel (combination of both lots 122 and 123) that is situated on land that is approximately 0-25 feet above normal water level (NWL) and is vegetated primarily with lawn grasses and mature Oaks. Currently, the property is under developed and the shoreline (approximately 511 linear feet) is partially stabilized with a vinyl bulkhead (issued under CAMA general permit No. 85470-D). Coastal and 404-type wetlands extend waterward of the bulkhead/retaining wall a distance approximately 150-170 linear feet. Groundsel bush (Baccharis halimifolia) and Bulrush (Scirpus spp.) are among several species that vegetate the area immediately waterward of the highground. Waterward of this transition zone, Smooth Cordgrass (Spartina alterniflora), intermixed with Glasswort (Salicornia spp.) and Sea Lavender (Limonium carolinianum), span along the tidal flat a distance of approximately 130'-140' before reaching the open water area of the AIWW. The width of the waterbody measures approximately 650' from marsh to marsh. Based on 2020 aerial imagery, it appears Submerged Aquatic Vegetation (SAV) is present between the marsh fringe and the proposed docking facility; however, no SAV was observed within the footprint of the docking during DCM's site visit 5/11/2022. An existing private docking facility is located on the property and extends easterly from the common line of lots 122 and 123. The docking facility was permitted under CAMA general permit No. 85987-D, which was issued on 5/11/22. The existing facility consists of a 6' x 325' access pier, 14' x 18' fixed platform, 6' x 44' finger pier, 8' x 24' floating dock and 13' x 13' boadift. The existing facility extends to the established pier -head line, as measured between the two adjacent pier structures bordering the subject property. The waters of the AIWW are classified SA-ORW by the Division of Water Quality. The project area is NOT designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries and is OPEN to the harvest of shellfish. Currently, there is one boatlift at the property and one floating dock that is void of any mooring devices along the southern side. As designed, the proposal would create four slips total (two lifts and two wet slips). According to the site plan drawings, water depths around the proposed docking facility range average approximately -3.0, at normal low water, and the area surrounding the proposed docking facility was also found to be void of SAV. Based on the current layout, the proposed structures do not appear to extend beyond the existing pier -head line. Additionally, all structures would be located within the applicant's riparian corridor (outside of the 15' setback) and within'/4 of the width of the waterbody. The applicant did not require a waiver from neither neighbor for the proposed development. 10. ANTICIPATED IMPACTS The proposed docking facility expansion would result in the incorporation of approximately 169 square feet of Estuarine Waters and Pubic Trust Area. Although no SAV was observed within the docking facility area, there are patchy beds of SAV inland of the facility. The proposed development would be located outside of the adjacent 15' riparian corridor setbacks on both sides and would be constructed outside of the federal channel setback, within 1/4 of the width of the waterbody. Turbidity associated with the piling installation would be kept to a minimum. Waters in the project area are classified as SA/ORW and are open to commercial shellfishing. The project is located at 138 Forest Lane, adjacent to the AIWW in Hampstead, Pender County. Areas of Environmental Concern (AEC's) impacted by the proposal are PT and EW. Waters at the project site are classified as SA-ORW and are open to the harvesting of shellfish. The area is not a Primary Nursery Area. I have reviewed this proposal for consistency with the Pender County Comprehensive Land Use Plan and offer the following comments. The general area of the project is classified Developed, while the AECs impacted by the work are classified as Conservation. In general, Pender County allows development in Conservation classified AECs which is consistent with the State's minimum use standards. The Pender County Land Use Plan contains some policies, which exceed the State's minimum use standards. However, none of these more restrictive policies appear to be applicable to this project. This project is consistent with the Pender County Comprehensive Land Use Plan Update.
