Permit Class Permit Number NEW 23-23 STATE OF NORTH CAROLINA Department of Environmental Quality and Coastal Resources Commission for X Major Development in an Area of Environmental Concern pursuant to NCGS 113A-118 Excavation and/or filling pursuant to NCGS 113-229 Issued to Jim and Donna Petrilla, 4 Sunset Ave., Wrightsville Beach, NC 28480 Authorizing development in New Hanover County at adj. to AIWW at 4 Sunset Ave. in Wrightsville Beach , as requested in the permittee’s application dated 5/25/22 (MP-1, MP-4), including work plan drawings (2) Sheets 1-2 of 2, dated 9/30/22. This permit, issued on February 3, 2023 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on February 3, 2028 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee Docking Facility Expansion 1) This permit authorizes only the docks, piers, boatlift, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non-water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) This permit authorizes 2 additional formalized boat slip for a maximum of 6 formalized boat slips at this docking facility. (See attached sheets for Additional Conditions) Jim and Donna Petrilla Permit No. 23-23 Page 2 of 2 ADDITIONAL CONDITIONS 3) All portions of the authorized structure shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner’s area of riparian access. 4) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the mooring. Any sewage discharged at the mooring shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 5) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 6) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 7) The authorized structure and associated activity shall not cause an unacceptable interference with navigation and shall not exceed the dimensions shown on the attached permit drawings. Sedimentation and Erosion Control 8) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 9) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses or properties. General 10) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 11) All construction debris associated with the removal or construction of the permitted development shall be contained within the authorized project area and disposed of in an approved upland location. 12) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the project by way of Regional General Permit 197800056 (Action ID SAW-2022-02582). NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 4501 and assigned the project DWR Project No. 20140117v2. PROJECT SUMMARY: The applicant proposes to install a boat lift for two (2) PWCs at an existing docking facility for a total of six (6) formalized slips. Petriffa, Page 2 9. PROJECT DESCRIPTION: The project site is located at 4 Sunset Ave., adjacent to Banks Channel, between the Atlantic Ocean and Greenville Sound Highground vegetation consists of ornamental landscaping. The lot is approximately 0.17 acres in size and has an average elcvation of approximately 6' above normal high water (NHW). A single-family residence exists on the upland portion ofthe project site. The project site has approximately 50 linear feet of shoreline frontage stabilized by a timber bulkhead. The applicant currently maintains an existing docking facility within Banks Channel which was authorized by State Permit 430-14 on March 25, 2014. The 90' long by 6' wide access pier extends from the bulkhead and terminates at a partially covered "L-head" platform, measuring 24' in length by 16' in width, which is oriented towards the south. An access ramp leads from the "L-head" onto a floating dock, which measures approximately 40' in length by 6' in width, that runs in same alignment as the pier. A boatlift, measuring approximately 13' in length by 14' is located on the landward end of northern side of the floating dock. The existing boat lift is located within the 15' riparian setback oft Sunset Avenue. The existing docking facility currently accommodates up to four (4) vessels. The Town of Wrightsville Beach Land Use Plan classifies adjacent waters and high ground area of project site as Conservation. There are no known archaeological sites located in the project vicinity. The waters of Banks Channel are classified SB by the Division of Water Quality. They are NOT designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries and they are CLOSED to the harvest of shellfish. 10. PROPOSED PROJECT: The applicant proposes to install a boat lift for two (2) PWCs at an existing docking facility for a total of six (6) formalized slips. The applicant proposes to install a 12.5' long by 11' wide boat lift to accommodate up to two (2) PWCs. The proposed lift would be located on the southeastern side of the existing L-head, immediately adjacent to the existing pier (See Page 1 of 2). The application states that the proposed lift would be located 16' from the riparian line (See Page I of 2). According to application materials, the existing water depth in the location of the proposed lift would be 3' 11" at Normal Low Water (NLW). The proposed lift would allow for the docking facility to accommodate up to six (6) vessels. 11. ANTICIPATED IMPACTS: The proposed project would incorporate 137.5 sq. ft. of Estuarine Waters and Public Trust Areas. The proposed structures would not encroach into the adjacent 15' Riparian Corridor Setback Area requirement. Minor increases in turbidity should be expected during construction. The existing docking facility extends approximately 160' into a waterbody, which measures approximately 950' across. This distance conforms to the 1/4 width rule and the locally established pier head line.
