including the attached workplan drawing dated 11/18/22.
This permit, issued on February 3, 2023 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
De subject to lines, Imprisonment or civil action; or may cause tie permit to be null and vom.
Excavation
1) A turbidity curtain shall be left between the area to be excavated excavated and the existing water
body, the silt screen shall be left in place after completion of excavation until the project area has
returned to ambient conditions.
2) No excavation shall take place outside of the area indicated on the workplan drawings.
3) Excavation shall not exceed -6 feet below the normal water level. In no case shall the depth of
excavation exceed the depth of connecting waters.

This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2024
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

ADDITIONAL CONDITIONS
4) The temporary placement or double handling of excavated or fill materials within waters or vegetated
wetlands is not authorized.
5) All mechanized equipment will be regularly inspected and maintained to prevent contamination of
waters and wetlands from fuels, lubricants, hydraulic fluids, or other toxic materials. In the event of a
spill of petroleum products or any other hazardous waste, the permittee shall immediately report it to the
National Response Center at (800) 424-8802 and provisions of the North Carolina Oil Pollution and
Hazardous Substances Control Act will be followed.
General
6) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
7) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
8) This Minor Modification shall be attached to the original Permit No. 100-16, which was issued to the
permittee on 11/22/26, as well as all subsequent modifications, refinements, and renewals, and copies of
all documents must be readily available on site when Division personnel inspect the project for
compliance.
9) All conditions and stipulations of the active permit remain in force unless specifically altered -herein—
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers assigned the proposed project COE Action Id. No. SAW-
2016-00821.

Minor Modification to Major Permit
1. Brian Rubino of Quible & Associates, P.C. (agent) has requested a Minor Modification
to Major Permit #100-16, which was issued a Major Modification on November 16, 2021
that expires on December 31, 2024. The issued Major Modification authorized minor
dredging watenvard of the existing boat ramps located off 708 Harbor Road in Wanchese,
Dare County, within the adjacent waters of Broad Creek. The authorized excavation area
measured 90' x 100' x -.75', with the excavation amount totaling 187 cubic yards. A 50'x40'
dredge disposal area was authorized landward of the 75' AEC on the adjacent parking lot.
A minor modification to Major Permit #100-16 was issued on October 14, 2022, that
authorized an additional 6" increase in dredge depth within a 50'x90' area to achieve a 6'
depth,
Please note thata name change request was made as part of the minormodification request
on September 13, 2022. This request was to change the permit holders name from N.C.
Seafood Industrial Park Authority to NC Wanchese Marine Industrial Park. It appears that
this request was not made on the issued October 14, 2022 minor modification.

2. Brian Rubino of Ouible & Associates P.C.(agent) has requested a Minor Modification
to Major Permit #100-16 to excavate an additional 20'x50' area along the waterward end
of the authorized dredge area to a 6' depth below normal water level.
3. The Minor Modification request is pursuant to the provisions of reference (a) and the
request meets the requirements contained in 15A NCAC 07H .0208 USE STANDARDS.
4. The required fee of $100, paid by Check#7472, was received by the Elizabeth City
District Office on 1 9 2022.
5. It is recommended that the Minor Modification request be granted, provided all the
Permit Conditions of the major modification issued on November 16. 2022 remain in effect.

The purpose of this CAMA Minor Modification request is to be able to excavate an additional 20 x 50 It area at
the end of the already permitted boat launch area. It has recently been described to us that the 110 It boat that
is being launched will require a train of tailers that will push the stern of the boat down at angle that will require
expansion of the dredged depth to -6 ft for an additional 20 If. This has only recently been brought to our
attention, so I apologize for having to request an additional permit modification. The boat builder along with the
NC Department of Commerce has been carefully planning the launch of this vessel that has been delayed due
to COVID-related issues. While the vessel only draws 5 It of water while afloat, this 50 If x 110 ft launch space
needs 6 ft of water for launching only.

SUBJECT: CAMA Drcdge/Fill Permit Modification for NC Wanchese Marine Industrial
Park #100-16, Dare County, North Carolina.
Biologists with the North Carolina Wildlife Resources Commission (NCWRC) reviewed the permit
application with regard to impacts on fish and wildlife resources. The project site is located at 708 Harbor
Road within Wanchese Harbor in Wanchese, NC. Our comments are provided in accordance with
provisions of the Coastal Area Management Act (G.S. 113A-100 through 113A-128), as amended,
Sections 401 and 404 of the Clean Water Act, as amended, the Endangered Species Act of 1973, as
amended (16 U.S.C. 1531 et seq.), the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16
U.S.C. 661 et seq.), the Magnuson -Stevens Fishery Conservation and Management Act (FCMA), as
amended (16 U.S.C. 1801 et seq.), and the Migratory Bird Treaty Act (16 U.S.C. 703-712 et seq.).
The applicant proposes to excavate an additional 20' by 50' area along the waterward end of the
authorized dredge area to -6' NWL.
The NCWRC is familiar with the project and project area. We (to not have significant concerns, as long as
all previously identified permit conditions, such as the April 1 — September 30 in -water work moratorium,
remain.

Proposed Project: Excavate an additional 201 area along the waterward end of the
authorized dredge area to a 6' depth below normal water level.
