the Coastal Resources Commission for development in an area of environment concern
pursuant fi Section 113A-118 of the General Statutes, "Coastal Area Management"
Issued to Weston and An!'anda Lyall, authorizing development in the Ocean Hazard and Estuarine Shoreline - ORW
(AEC) at 272 New River Inlet Rd, in North Topsail Beach, Onslow County, as requested in the permittee's application,
dated Fel ruary, 7, 2023, nd received on February 9, 2023. This permit, issued on March 3, 2023, is subject to
compliance with the application and site drawing (where consistent with the permit), all applicable regulations and
special conditions and notes set forth below. Any violation of these terms may subject permittee to a fine, imprisonment
or civil act on, or may cause the permit to be null and void.
This permit authorizes: Consl uction of 8 x 10 storage building
(1) At proposed development and associated construction must be done in accordance with the permitted work plat
dr wings(s) dated DGH-MHD CITY 219/2023.
(1) At y change or changes in the plans for development, construction, and/or land use activities will require re-evaluation and
m dification of this p rmit. All construction shall conform to the N.C. Building Code requirements and all other local, State
a d Federal regulations, applicable local ordinances, and FEMA Flood Regulations.
(2) At y change or Changg�s in the plans for development, construction, or land use activities will require a re-evaluation and
4clification of this D rmit.
(3) Aopy of this permit hall be posted or available on site. Contact this office at 252-515-5400 for a final inspection at

This permit a ion may be appealed by the permittee or other qualified persons
within twenty 20) days of the issulnb date. From the date of an appeal, any
work conducted under this permit mu'tst cease unfit the appeal is resolved. This
permit must be on the project site an accessible to the permit officer when the
project is ini pected for compliance. Any maintenance work or project
modification rot covered under the permit, require further written permit
approval.Ailw k must cease when this permit expires on:

(5) The pposed dwelling sall each be less than 5,000 square feet of conditioned space and located a minimum distance
of 90 eet of the First Lie of Stable Natural Vegetation (FLSNV). No fill or excavation of wetlands is allowed.
(6) The p rmittee is required to contact the Division of Coastal Management shortly before beginning construction to arrange
a settack measurement that will be effective for sixty (60) days barring a major shoreline change. Substantial progress
on co struction must begin within sixty (60) days of the determination or the measurement is void and must be redone.
(7) All unconsolidated material resulting from associated grading and landscaping shall be retained on site by effective
sedimentation and eroslocontrol measures. Disturbed areas shall be vegetated and stabilized (planted and mulched)
within 14 days of constru tion completion.
(8) The oceanfront uncoverei deck within the setback area shall not exceed a footprint of 500 square feet.
(9) In no case shall a beacl� access structure or stairs be constructed in or over the starter dune or berm. Posts and
rope may be used on end over the berm not to exceed six feet beyond the seaward toe of the berm or starter
(10) The beach accessway mist not exceed six feet in width and shall provide only pedestrian access to the ocean beach.
(11) The beach accessway m st be constructed so as to make negligible alterations to the frontal dunes, This means that the
acces way must be constructed on raised posts or pilings of five feet or less in depth, so that wherever possible only the
posts or pilings touch the frontal dunes without any alteration to the dunes.
(12)Any s ruclure authorized by this permit shall be relocated or dismantled when it becomes imminently threatened by
Chang s in shoreline configuration. The structure(s) shall be relocated or dismantled within two Years of the time when it
becomes imminent) threatened and In any case upon Its colla se or subsidence. However, if natural shoreline recovery
or beach renourishment takes place within two years of the time the structure becomes imminently threatened, so that
the stricture is no longer limminently threatened, then If need not be relocated or dismantled at that time. This condition
shall not affect the permit (holder's right to seek authorization of temporary protective measures allowed under CRC rules.
(13) All buildings constructed ithin the ocean hazard area shall comply with the NC Building Code and the Local Flood
Damao Prevention Ordinance as required by the National Flood Insurance Program, If any provisions of the building
code or a flood damage p evention ordinance are inconsistent with any of the following AEC standards, the more
restric "ve provision shall Mtrol.
(14) The a ount of impervious surface shall not exceed 25% of the lot area within 575 feet of Normal High Water Level
(Estua ine Shoreline - ORN Area of Environmental Concern), in this case, ENTER NUMBER EQUAL TO 25% square
feet is uthorized,
(15) Unless specifically allowed in 15A NCAC 07H, 0209(d)(10), and shown on the permitted plan drawing, all
develo menticonstruction (shall be located a distance of 30 feet landward of Normal High Water Level. No portion of the
roof o -rhang shall encro (ach into the 30 ft. buffer.
(16) All dew lopment shall provide for a buffer zone along the margin of the Estuarine Water which Is sufficient to confine
visible 3iltation within 25 percent of the buffer zone nearest the land disturbing development.

(17) All un nsolidated material resulting from associated grading and landscaping shall be retained on site by effective
sedim ntation and erosloi control measures. Prior to any land -disturbing activities, a barrier line of filter cloth must be installed
betwe n the land disturbi ig activity and the adjacent marsh or water areas, until such time as the area has been properly
stabilized with a vegetath a cover.
(18) Any p oposed for grading within the 30' buffer from the Normal High Water Level must be contoured to prevent additional
stormwater runoff to the adjacent marsh. This area shall be immediately vegetatively stabilized, and must remain in a
vegetated state.
(19) All graded and filled stops shall be of a sufficient angle to retain a vegetative cover or other erosion control device or structure.
(20) This p rmit does not authiorize development within any wetlands or open water areas.
(21) Prior to any developmentl the permittee is required to contact the DCM Field Representative at 252-240-9497, to mark the
landward edge of the 30 �. buffer.
(22) Pursuant to 15A NCAC, c ubchapter 7J.0406(b), this permit may not be assigned, transferred, sold, or otherwise disposed of to
a third party.
(23) The P rmittee andfor thi i Permittee's Authorized Agent shall be responsible for obtaining any and all necessary
authorizations, approvals, or zoning and building permits from the local govemment having jurisdiction (Town of
North Topsail Beach and/or Onslow County) prior to commencing work,
