Permit Number
Issued to Rich Ward, authorizing development in the Estuarine Shoreline (AEC) at 908 Riverside Dr, in Sunset
Beach, Brunswick County as requested in the permittee’s application, dated February 10 2023, initially received
by the Town on February 10, 2023. This permit, issued on March 6, 2023, is subject to compliance with the
application and site drawing (where consistent with the permit), all applicable regulations and special conditions
and notes set forth below. Any violation of these terms may subject the permittee to a fine, imprisonment or civil
action, or may cause the permit to be null and void.
This permit authorizes: New single family home construction.
(1) All proposed development and associated construction must be done in accordance with the permitted site drawing
dated received by the Town on February 10, 2023 Maximum built upon area is limited to 2250 square feet per
Storm Water Permit NO. SW8 040740.
(2) All construction must conform to the N.C. Building Code requirements, the Town of Sunset Beach Unified
Development Ordinance and all other local, State and Federal regulations, applicable local building and zoning
ordinances and NFIP Flood Regulations.
(3) Any change or changes in the plans for development, construction, or land use activities will require a re-evaluation
and modification of this permit.
(4) A copy of this permit shall be posted or available on site. Contact this office at 910-579-6297 for a final inspection at

This permit action may be appealed by the permittee or other qualified persons
within twenty (20) days of the issuing date. This permit must be on the project
site and accessible to the permit officer when the project is inspected for
compliance. Any maintenance work or project modification not covered under
this permit, require further written permit approval. All work must cease when this
permit expires on:
December 31, 2025
In issuing this permit it is agreed that this project is consistent with the local Land
Use Plan and all applicable ordinances. This permit may not be transferred to
another party without the written approval of the Division of Coastal
Management.

(5) The amount of impervious surface shall not exceed 30% of the lot area within 75 feet of Mean or Normal high water
(Estuarine Shoreline). This permit authorizes a total of 836.71 sq. ft. of impervious coverage within the northern 75-
foot Estuarine Shoreline Area of Environment Concern (AEC) and 1461.41 sq. ft. of impervious coverage within the
southern 75-foot Estuarine Shoreline AEC as located from Normal High Water across the front and rear property
lines of the lot.
(6) All unconsolidated material resulting from associated grading and landscaping shall be retained on site by effective
sedimentation and erosion control measures. Disturbed areas shall be vegetated and stabilized (planted and
mulched) within 14 days of construction completion.
(7) Any proposed grading within the 30’ buffer from the Normal High Water level must be contoured to prevent
additional stormwater runoff to the adjacent marsh and/or canal. This area shall be immediately stabilized with
landscaping and must remain completely pervious.
(8) With exception of an elevated wooden walkway/stairs and 200 sq. ft. or less of elevated slatted uncovered wood
decking, no other development is authorized within 30 feet of the normal high water line, or the line previously
established by the existing structure relative to the redevelopment of the existing structure.
(9) Pursuant to 15A NCAC, Subchapter 7J.0406(b), this permit may not be assigned, transferred, sold or otherwise
disposed of to a third-party.
(10) Projects shall not increase stormwater runoff to adjacent estuarine and public trust waters.
(11) Prior to any development, silt fence shall be properly installed between all planned land disturbance and the
adjacent marsh, open water areas, and adjacent properties; the silt fence shall be properly maintained throughout
the construction period. Silt fence shall be installed such that it is properly toed-in to the soil.
