This is with reference to the CPE's request on behalf of the Town to modify State Permit No.137-21.
The permit was originally issued on October 5, 2021 and the permit expires on December 31, 2024.
The action proposed in your submittal, as submitted by Ken Willson with CPE, is to expand the
length of the northern approved engineered dune repair area from Station 145+00 to 165+00, as
needed and within the alignment/profiles shown in the submittal.
In reviewing the information provided, the Division of Coastal Management has determined that the
proposed action is consistent with existing State rules and regulations provided the work adhere to
the submitted drawings in addition to all existing permit conditions, except as expressly altered
herein. This Letter of Refinement serves as approval of the expanded dune repair as shown on
plan set (18) with Sheets 1, 5, 7-9,12-18 dated June 21, 2022, and Sheets 2-4, 6, and 10-11 dated
6/26/22. This authorization thereby alters Condition No.13 of the permit to include the additional
dune repairs described above.
This Letter of Refinement does not authorize any additional modifications or work not specifically
described above and/or in the permittee's request, nor does it eliminate the need to obtain any
other additional state, federal or local permits, approvals or authorizations that may be required.
Please note that the permittee is also still required to obtain the appropriate easements or similar
legal instruments from any impacted property owners prior to starting work as stated in Condition
No. 4 of the active permit. By copy of this letter we are also notifying the U. S. Army Corps of
Engineers of our action. If you have any questions concerning the above or if I can be of any other
