HomeMy WebLinkAboutWRC _External_ Updated Project Plans - Permit No_ 137-21 (Kitty Hawk)I was at the Kill Devil Hills area yesterday and offer the following comments for Kitty Hawk based on what was seen on site and the documents attached on Heathers 6/29/2022 email. This area between stations 145-00+ to 165-00+ has houses that extend into the beach, so any dune construction will be forward the existing dune line. It will be a very noticeable bump and not in-line with the rest of the dunes in the area. It will essentially be a berm to protect the only houses on the waterward side of NC Hwy 12. It would not surprise me if this is modified that they would come back and request the same for stations 166-00+ to 170-00+ (similar situation). I just don’t think it is a “dune” but erosion protection for those homes. Perhaps the verbiage is why they are saying “dune”. Honestly I would prefer just a pile of sand rather than a “dune” with a crest width of 20’ or so. It just doesn’t match the beach profile. Either way, they need to ensure appropriate tie into the existing dune area so as not to create a gap or trough issue on the backside. As far as fence, there is considerable fence present at Kitty Hawk (as seen in the aerials from the same document for the dune modification request). The existing fence is a couple of rows long and bisects the gap between the previous row, minimizing width and potentially entrapping turtles. Fencing should be installed appropriately, minimizing the number of rows. It may not be appropriate to install additional fencing. Attached are photos from yesterday’s visit to Kill Devil Hills that shows the same fence installment concerns. I would state that although there is not consistent dune construction for the Dare 4 Town project, remnant dilapidated fence should be removed. Fencing should not be conducted during nesting season due to continued disturbance, the need to open completed portions of the project area (this may alleviate workload for turtle patrol as well as add considerable area for unaltered nesting and available nest relocation area), and the presence of previous fencing that would move the fence install well into the beach profile. In looking at existing conditions, fence installation may not meet the exception allowance. I can send a separate email regarding the beach inspection and compaction for Kill Devil Hills. Also, I am trying to get clarification on their sand fencing plan. I checked with Ken and he said they are planning on installing more than just at the constructed “dune” areas- it may be as much as along the entire length, but they plan to install in accordance with the exemption criteria (directly waterward of the actual frontal/vegetated dune and not waterward of what they call the “dune”). But he said they have another subcontractor installing the sand fencing and so he needs to check on their schedule and how/when they’ll be installing it (if in turtle season). I went ahead and let Ken know that should they plan to install fencing during nesting season, it would likely impact the ability to “clear” any parts of the project area until all work is finished. Also, if anyone else has any comments regarding their proposal to construct additional dune repairs as shown on the updated plans from CPE I emailed on June 29, please let me know asap. The final plans at time of permitting were modified to just allow for 2 sections of “dune” repair/construction- from Stations 185+50 to 190+80 (at the Kitty Hawk/Kill Devil Hills line) and from Stations 146+00 to 154+00 (south of the Kitty Hawk Bath House access and Perry Street). Due to some recent erosion that has taken place and in anticipation of additional erosion that could occur prior to construction, CPE has requested that the dune repair construction area be extended along the northern section from Station 145+00 up to 165+00. Ken Willson with CPE has confirmed that the proposed extension would not cut below the existing grade and would just tie into the oceanward side of the dune where it meets the template at the time (again, if needed). Also, the proposed design has been relocated landward of the original proposal. Fill footprint has also been finalized and adjusted based on current conditions- while there are a few areas where the footprint has been extended waterward (the dashed green line shows the original toe of fill), the overall area of impact below MHW has been reduced. In accordance with Condition No. 14 of the subject permit, an updated survey showing beach conditions was conducted by TI Coastal between May 25 and May 31, 2022. The updated survey data have been incorporated into the attached drawings and cross sections. Please refer to the attached email last dated January 28, 2022, for additional context on our expectations as to how to satisfy this condition. As previously discussed, and noted on the drawings submitted with our CAMA application, “The Seaward toe of beach fill line as shown, is not fixed and rather is subject to change based on the conditions of the nearshore bathymetry at the time of construction”. For the purpose of comparison, we have included on the attached drawings the position of the seaward toe of beach fill as shown on the original plans dated November 4, 2021 (green dashed line). On average, the proposed seaward toe of fill shown on the attached drawings is located landward of the seaward toe of fill shown on the original permit drawings. There are some areas between baseline stations 162+00 and 153+00 as well as 63+00 and 25+00 that indicate a seaward toe of fill slightly seaward of the seaward toe of fill shown on the permit drawings dated November 4, 2021. Also shown on the updated plans attached is the location of the Mean High Water (MHW) line as observed on May 25 through May 31, 2022. This is in accordance with Condition No. 3 of the permit. We will also provide this data as we did previously in a GIS Shapefile. That will be provided in a follow up email. Please also note that the locations of the three (3) sublines proposed by Weeks Marine for Kitty Hawk are indicated on the attached drawings. Lastly, as we’ve mentioned a couple of times, due to some dune losses that occurred in April 2022, we would like to get permission to repair some of the dunes to their pre-storm conditions. The CAMA permit states in Condition 13 that: In accordance with commitments made by the permittee and to ensure compliance with Condition No. 12, the engineered dune shown on the original plans is hereby eliminated except 2 remaining dune sections, located between Stations 185+50 and 190+80, and Stations 146+00 and 154+00, …”. No changes to the southern dune section is being proposed (Station 185+50 to 190+80), but we would like to extend the northern dune section to cover the area between 165+00 and 145+00. Cross sections of the proposed dune modifications are provided in the attached. The dune modification has been designed to comply with Condition 12 of the CAMA permit in terms of aligning the constructed dune with existing adjacent dune ridges to the greatest extent possible, designing to the same configuration as the adjacent frontal dune, and adherence to the 3H:1V slope requirement along the oceanward face. We are requesting you review these updated plans in terms of the updated berm and toe of fill dimensions and approve assuming you find the plans in compliance with the subject permit. Furthermore, we request you provide authorization to construct the dune along the additional location described herein with the understanding that the dunes will be constructed to adhere with condition 12. Please note construction of the project is anticipated to begin in mid-July.
