Class Permit Number 116-13 STATE OF NORTH CAROLIINA Department of Environment and Natural Resources and Coastal Resources Commission 'Permit for X Major Development in an Area of Environmental Concern pursuant to NCGS 113A-118 Excavation and/or filling pursuant to NCGS 113-229 to Warren Phillips, 24 Pelican (Drive, Wrightsville Beach, NC 28480 sizing development in New Hanover County at adi to Lee's Cut at 24 Pelican Drive, , as requested in the permittee's application dated 5/27/13 (MP-1 and MP-4) ,This permit, issued on October 24. 2013 is subject to compliance with the application (where consistent With ;the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be=subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Docking Facility 1) Unless specifically altered herein, this permit authorizes only the removal of the existing docking facility and construction of a reconfigured docking facility with associated boatlifts, cabana and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application and workplan drawings. No other structure, whether floating or stationary, . shall become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over public trust waters without permit modification. (See attached sheets for Additional Conditions) permit action may be appealed by the permittee or zalifled persons within twenty (20) days of the issuing n appeal requires resolution prior to work initiation or ance as the case may be. ,This permit must be accessible on -site to Department personnel when the project is inspected for compliance. `!`Any maintenance work or project modification not covered hereunder requires further Division approval. Signature ofPermittee ::Warren Phillips Permit# 116-13 Page 2 of 4 AIDIDITIONAL CONDITIONS )r~~ Should either adjacent property be sold prior to the initiation of construction, the permittee shall be required to obtain a signed riparian corridor waiver from the new property owner prior to the placement of any structure within the 15 foot riparian corridor. The authorized covered cabana shall not be enclosed. Any material used on the sides shall not obstruct view and must be permeable to air and water. Screen or wire on the sides along with benches and knee walls are.pemutted. Lattice is specifically excluded from being used under this authorization. The roof of the covered cabana shall not be designed for second story use. No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. This permit does not authorize the interference with any existing or proposed Federal project, and the permittee will not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum; permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. This permit authorizes a maximum of six formalized boat slips. Shoreline Stabilization Unless specifically altered herein, this permit authorizes the construction of the replacement bulkhead and riprap, that are expressly and specifically set forth in the permit application and workplan drawings. The authorized replacement bulkhead and riprap, shall adhere to the alignment depicted on the attached '.° workplan drawings. The riprap material shall be free from loose dirt or any pollutant. It must be of a size sufficient to prevent its movement from the approved alignment by wave or current action. The riprap material shall consist of clean rock or masonry materials such as but not limited to granite, marl, or broken concrete. `, The bulkhead shall be constructed prior to any backfilling activities. Warren •Ph hil -Phillips ADDITIONAL CONDITIONS Permit # 116-13 Page 3 of 4 The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the structure. The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal or vinyl sheet piles, or other suitable materials approved by Division personnel. 7) All backfill material shall be obtained from a high ground source and confined behind the permitted bulkhead. All fill material to be placed below normal high water level shall be confined behind the permitted bulkhead. Sedimentation and Erosion Control In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. „Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence, diversion swales or berms, etc.). At a minimum, a silt fence shall be properly installed immediately landward of the bulkhead cap immediately following completion of backfilling activities. General The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee shall be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina. No claim shall be made against the United States or the state of North Carolina on account of any such removal or alteration. No open water areas or vegetated wetlands shall be excavated or filled outside the area indicated on the attached workplan drawing. To locate the property from the Wilmington Regional Office (WiRO) travel east from Eastwood Road approximately 3 miles towards Wrightsville Beach. From the AIWW drawbridge, continue to travel east on West Salisbury Street (US HWY 74) for approximately one mile. Turn left onto Pelican Drive and travel east. The property of interest will be located on the left. The property is approximately 0.2 acres with approximately 62' of shoreline frontage along Lee's Cut, which is currently stabilized by an old timber bulkhead and rip -rap. The elevation of the property averages approximately 6'above normal high water (NHW). The applicant currently maintains a two-story single family residence on the property. Upland vegetation consists of maintained lawn grass and ornamental landscaping. There are currently no Coastal Wetlands on the property. The applicant currently maintains a private docking facility in Lee's Cut. An existing covered platform, measuring approximately 24' in length by 24' in width extends waterward over the existing timber bulkhead in a westerly direction towards Lee's Cut. Extending from the southern side of the platform is a fixed finger pier, measuring approximately 14' in length by 2' in width, which runs parallel to the shoreline. Also extending from the platform is an access ramp which leads onto a floating dock, measuring approximately 20' in length by 8' in width, which runs perpendicular to the shoreline. There are two (2) existing mooring pilings which are located on the waterward side of the floating dock. The existing docking facility currently accommodates up to two (2) vessels and it appears through aerial photography review that the existing facility was built prior to the CAMA regulations. The Wrightsville Beach Land Use Plan classifies adjacent waters as Conservation, and the adjacent high ground portion of the project area as Developed. The waters of Lee's Cut, in Greenville Sound are classified as SB#, by the NC Division of Water Quality. These waters are NOT designated as Primary Nursery Area (PNA), by the NC Division of Marine Fisheries and they are CLOSED to the harvest of shellfish. PROPOSED PROJECT: The applicant proposes to remove an existing docking facility and the construction of a new docking facility and new bulkhead within Lee's Cut. Once the existing facility is removed a new vinyl bulkhead would be constructed approximately 2' waterward of the existing 62 linear foot timber bulkhead. A new covered platform would then be constructed, measuring approximately 25' in length by 20' in width, which would be located within the same footprint as the existing covered platform. An access ramp would then lead onto a new floating dock, measuring approximately 40' in length by 6' in width, which would run perpendicular to the shoreline and channel. A new floating dock, measuring approximately 14' in length by 6' in width would be installed from the waterward end of this floating dock and oriented towards the north creating an "L head" configuration. Two (2) new boatlifts, each measuring approximately 13' in length by 14' in width would be installed on each side of the most landward side of the new floating dock configuration. The application also proposes to replace the existing fixed finger pier, aforementioned to access a new single -pole boatlift, measuring approximately 12' in length by 9' in width, which would be located on the waterward side of the finger pier. The application states that the existing water depth at the location of these proposed structures range from approximately -4' to -T at normal low water (NLW). ANTICIPATED EVIPACTS: AUG 2 U 2013 The proposed new vinyl bulkhead would disturb approximately 1,116 sq. ft. of highground for #Le Wp.9"T*backfill and tie -back anchor system and incorporate approximately 124 sq. ft. of Estuarine Waters and Pubic Trust Area. The proposed docking facility and fixed platform would incorporate approximately 1,324 sq. ft. of Estuarine Waters and Pubic Trust Area, essentially within an area currently usurped by the existing docking structures. The docking facility would extend approximately 75' into a waterbody, which measures approximately 390' across. Staff review of the plans and specifications has determined that the development activities proposed at this time will not pose a threat to surface water quality from stormwater runoff. The Director has determined that projects that are reviewed and approved by the Division as not posing a water quality threat from stormwater runoff should not be subject to the stormwater management permitting requirements of 15A NCAC 21-1.1000, the stormwater rules. Proposed floating docks = (6' x 40' (not calculated due to alignment and dimensions)) + (6' x 14') = 84 sq. ft. Covered Platform = 19' x 20' = 380 sq. ft. (credit applied for access through) Fixed Finger Pier = 2' x 14 = 28 sq. ft. Total = 492 sq. ft. It is the staffs recommendation that the new vinyl bulkhead waterward of an existing dilapidated timber bulkhead are CONSISTENT with the Rules of 15 NCAC 7H.0208 (b) (7) (Dxii) Use Standards for Bulkheads and Shore Stabilization Measures. The construction of the docking facility would provide docking space for the total up to six (6) vessels at this location. It appears that the project is consistent with the use standards set forth in NCAC 07H .0208(bx6), including the 'A width rule, the eight square foot rule and the pier width rule. The proposed structures would be located entirely over open water. If the project is determined to be consistent with NCAC 07H .0208(b) and (6), it is recommended that any permit issued should include the following conditions: 1. This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structures, whether floating or stationary, may become a permanent part of the structure without permit modification. No non -water dependent uses of structures may be conducted on, in, or over public trust waters without permit modification. 2. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 3. The authorized structure and associated activity must not cause an unacceptable interference with navigation and shall not exceed the established pierhead line. 4. The permittee must install and maintain, at his expense, any signal lights and signals prescribed by the U.S. Coast Guard, through regulations or otherwise, on authorized facilities. 5. In order to protect water quality, runoff from the construction must not visibly increase the amount of suspended sediments in adjacent waters. 6. This permit does not authorize the interference with any existing or proposed Federal project, and, the permittee will not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the project without having the permit transferred to a third -party. 8. This permit authorizes a maximum of six (6) boat slips. At no time shall more than six (6) vessels be moored or docked at the facility. The restriction of the number of vessels shall apply to all marine vessel types, including but not limited to motorboats, sailing vessels and personal watercraft. 9. The alignment of the authorized bulkhead must be staked by a representative of the Division of Coastal Management within a maximum of 30 days prior to the start of construction. Failure to initiate construction within 30 days, or erosion of the shoreline by adverse weather conditions will require the alignment to be restaked by DCM within a maximum of 30 days prior to the new expected start of construction. 11. The bulkhead must be constructed prior to any backfilling activities. 12. The bulkhead must be structurally tight so as to prevent seepage of backfill materials through the structure. 13. The bulkhead must be solid and constructed of treated wood, concrete slabs, metal sheet piles or other suitable materials approved by department personnel. No excavation is permitted except for that which may be required for the construction of the bulkhead wall, riprap, deadmen cables, etc. This permit does not authorize any excavation waterward of the approved alignment. 14. The fill material will be clean and free of any pollutants except in trace quantities. Metal products, organic materials, or unsightly debris will not be used. 15. All backfill material will be obtained from a high ground source and confined behind the permitted bulkhead. 16. No backfill material is to be placed within 30 feet of the normal high water line, except that which will be used to backfill the area behind the permitted bulkhead. 17. In order to protect water quality, runoff from the construction must not visibly increase the amount of suspended sediments in adjacent waters. NOTE: Future development of the permittee's property may require a modification of this permit. Skvada, III Secretary The Division of Coastal Management hereby acknowledges receipt of your application, acting as agent for Mr. Warren Phillips, for State approval for proposed development located at 24 Pelican Drive, adjacent to Lee's Cut, in the Town of Wrightsville Beach, New Hanover County. It was received as complete on August 5, 2013 and appears to be adequate for processing at this time. The projected deadline for making a decision is October 20, 2013. An additional 75-day review period is provided by law when such time is necessary to complete the review. If you have not been notified of a final action by the initial deadline stated above, you should consider the review period extended. Under those circumstances, this letter will serve as your notice of an extended review. However, an additional letter will be provided on or about the 75th day. If this agency does not render a permit decision within 70 days from August 5, 2013, you may request a meeting with the Director of the Division of Coastal Management and permit staff to discuss the status of your project. Such a meeting will be held within five working days from the receipt of your written request and shall include the property owner, developer, and project designer/consultant. NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed development. Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the property of your proposed development. You should post this notice at a conspicuous point along your property where it can be observed from a public road. Some examples would be: Nailing the notice card to a telephone pole or tree along the road right-of-way fronting your property; or at a point along the road right-of-way where a private road would lead one into your property. Failure to post this notice could result in an incomplete application. A field report has been prepared and is in the process of being circulated to the various state and federal review agencies for their comments.
