This permit, issued on _July 1, 2015 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to tines, imprisonment or civil action; or may cause the permit to be null and void.
Excavation
1) Unless specifically altered herein, the dimensions of the area to be excavated shall not exceed the
area that is expressly and specifically set forth in the attached permit application and workplan
drawing. Any proposal to change the area to be excavated shall require permit modification.
2) The temporary placement or doubling handling of excavated materials within waters or wetlands is
not authorized.
(See attached sheets for Additional Conditions)
This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the issuing
date. An appeal requires resolution prior to work initiation or
continuance as the case may be.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2018
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina Coastal
Management Program.

ADDITIONAL CONDITIONS
3) Excavation shall not exceed -12 feet plus 2 inches of over dredge below the normal low water level. In
no case shall the depth of excavation exceed the depth of the connecting waters.
4) The permittee shall notify the Division of Marine Fisheries, Shellfish Sanitation Recreational Water
Quality Section, prior to the initiation of any dredging activities authorized by this permit so that
temporary swimming advisories, if needed, may be implemented.
5) In order to protect fish and shellfish, no in -water no excavation is permitted between April 1 and
September 30 of any year without prior approval from the Division of Coastal Management.
Spoil Disposal
6) All excavated materials shall be confined above normal water and landward of regularly or irregularly
flooded marsh behind adequate dikes or other retaining structures to prevent spillover of solids into any
marsh or surrounding waters.
7) The spoil area shall be inspected and approved by the Division of Coastal Management prior to the
beginning of any dredge activities.
Sedimentation and Erosion Control
8) In order to protect water quality, runoff from construction shall not visibly increase the amount of
suspended sediments in adjacent waters.
9) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence,
diversion swales or berms, etc.).
General
10) The permittee understands and agrees that, if future operations by the United States requires the
removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the
opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause
unreasonable obstruction to free.navigation of the navigable waters, the permittee shall be required,
upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or
obstructions cause(thereby; without expense to the United States or the state of North Carolina. No
claim shall be made against the United States or the.state of North Carolina on account of any such
removal or alteration.
11) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
12) The permittee and/or his contractor shall meet with a representative of the Division prior to project
initiation.

13) This major modification shall be attached to the original Permit No. 120-13, and copies of both
documents shall be readily available on site when Division personnel inspect the project for compliance.
14) All conditions and stipulations of the active permit remain in force under this major.modification unless
specifically altered herein.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: Future development of the permittee's property including any new storage or processing
facilities may require a modification of this permit. Contact a representative of the Division at
(252) 808-2808 prior to the commencement of any such activity for this determination. The
permittee is further advised that many non -water dependent activities are not authorized within
30 feet of the normal high water level.
NOTE: The U.S. Army Corps of Engineers authorized the proposed project under General Permit No.
SAW- SAW-2013-01747.

Barge Fleeting Areas

Dear Ms. Styron,
The North Carolina State Ports Authority (NCSPA) is requesting a major
modification to permit 120-13 exp 12/31/2016 to allow ongoing maintenance dredging of
the current barge fleeting areas (southern) near Radio Island and the northern barge
fleeting area east of Marsh Island. The areas are needed to harbor a maximum of 15
barges between and during the off-loading events at the Port of Morehead City. The
current permitted southern site is west of Radio Island, approximately 238' from the
shoreline of the former Aviation Fuel Terminals. The northern site is located east of
Marsh Island, approximately 364' from the shoreline.
The NCSPA is requesting that the areas be allowed to be maintained to a depth of
12'+ 2" of over dredge. The proposed placement of the dredged material will be at 1 of
4 already permitted dredge material placement locations. These locations are Brandt
Island, North Radio Island, Marsh Island, and Radio Island. Dredging would be
conducted with a hopper dredge, hydraulic dredge, or bucket to barge method. Dredging
would be conducted in accordance with all environmental conditions currently inplace for
the Morehead City inner harbor.

Dear Mr. Walton:
Reference your application for a Department of the Army permit to perform maintenance
and new dredging at the existing Northern and Southern Barge Fleeting areas in navigable waters
of the United States, within the Newport RiverBogue Sound in Morehead City, Carteret County,
North Carolina.
Your proposal has been reviewed and found to be consistent with the provisions and
objectives of the CAMA-Corps Programmatic Permit process (copy attached) for construction
activities that receive authorization from the State, of North Carolina. Therefore, you may
commence construction activity in strict accordance with applicable State authorization, attached
Federal special conditions, and the approved plan. Failure to comply with the State authorization
or conditions of the Federal permit could result in civil and/or administrative penalties.
If any change in your work is required because of unforeseen or altered conditions or for
any other reason, plans revised to show the change must be sent promptly to this office and the
North Carolina Division of Coastal Management prior to performing any such change or
alteration. Such action is necessary as revised plans must be'reviewed and the authorization
modified. Your Department of the Army permit will expire on December 31, 2016.

2698 within twenty (20) days of this decision on your permit. You should also be aware that another
qualified party may submit an objection to the issuance of this permit within twenty (20) days.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work
must be carried out in accordance with your application. Modifications, time extensions, and future
maintenance requires additional approval. Please read your permit carefully prior to starting work and review
all project plans, as approved. If you are having the work done by a contractor, it would be to your benefit to
be sure that he fully understands all permit requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we

8. PROJECT SUMMARY:
The northern and southern sites (Radio Island and Marsh island areas) for this project were
previously permitted through CAMA major permit 120-13 and are set to expire on
December 31, 2016. Due to shallower water depths within this area (average of 10' at
northern area and an average of 13'at the southern area), the applicant is requesting a
major modification to the exsitng major permit to include dredging (ongoing as needed
during permit life) along the previously permitted southern barge fleeting area along Radio
Island and the fleeting area at the northern site east of Marsh Island within the Newport
River. The applicant is proposing to maintain these areas to a depth of 12' plus 2 inches of
"over dredge" at nlw. The southern barge berth area has been excavated over the years and
would be considered maintenance dredging. There are no records indicating the northern
barge berth area was ever excavated, therefore this area would be considered new
dredging.
Narrative Description
The NC State Ports Authority project would be located at two sites: one is located along
Radio Island within the Morehead City Channel/Bogue Sound area of the NC State Ports
Authority property. The other side is adjacent to (east) of the spoil island (Marsh Island),
which is owned by the NCSPA, and is located within the Newport River.
Presently there, are existing barge fleeting areas along the southern site (Radio Island) that
allows a maximum of 9 barges. Six 54 inch steel concrete filled monopiles are also within
this area. There are not any existing manmade structures along the northern Marsh Island
site other than an existing red channel navigation buoy south of the proposed project area
and an earthen berm dredge spoil deposit dike with a spoil discharge pipe on Marsh Island.
The existing southern fleeting area along Radio Island currently has the capability to moor
a maximum of six larger (53' x 260') barges and nine of the smaller (35' x 200') barges
which are equipped with navigation lights for safety when moored in this area. There are
six pilings within this location that are equipped with self-contained solar navigation lights
and mooring bollards. The existing 54 inch steel pipe monopiles filled with cast in place
concrete are located a distance of approximately 140' to 330' landward of the USACOE
channel setback depending on location and 240' to 440' (west) waterward of nhw

(shoreline) and are a height of 20.5' above mean high water and aligned in a north to south
configuration. The barges are moored side -to or shore parallel to the west side of the Radio
Island site and along the east side of the mooring pilings. The barge fleeting area location
is bordered on the west by the existing federal navigation routes. When the barges are
moored, the waterward barges are lashed to the other barges tied to the monopiles. The
water depths currently within the southern site area are an average of -13' nlw. The width
of the Bogue Sound/Morehead City Channel is approximately 1,500'.
The northern fleeting area east of Marsh Island currently has the capacity to moor a
maximum of four of the larger (53' x 260') barges or six of the smaller (35' x 200')
barges. The moored barges are equipped with navigation lights for safety when moored in
this area. The moorings are 54 inch steel monopiles and filled with cast in place concrete.
The piles are a height of 20.5' above mean high water and are equipped with self-
contained solar powered navigation lights and mooring bollards. The existing metal pilings
within the northern site are a distance of 100' to 110' landward (west) of the USACOE
channel setback depending on location and approximately 360' waterward (east) of normal
high water (shore) from Marsh Island. The barges are aligned in a north to south
configuration, moored side -to or shore parallel to the east side of Marsh Island and along
the east side of the mooring pilings. The barge fleeting area location is landward of
existing navigation routes. When the smaller barges (35' x 200') are in place a total of six
can be moored and remain outside of the USACOE channel setback. If the larger barges
(53' x 260') are within this fleeting area then a maximum of four could be moored. The
water depths within the northern site are currently an average of -10' nlw. The width of the
Newport River in this area is approximately 3,100'.
There are fringes of coastal marsh located along the northeast side of Marsh
Island and north of the aviation fuel site for the NCSPA Radio Island southern barge
fleeting area. The distance of the proposed development from coastal wetland areas is
approximately 360' to the shore for the northern site and approximately 182' to 238',
depending on location, for the southern site. No wetland impacts are proposed. No high
ground development is proposed for this project.
The Morehead City Land Use Plan classifies this property as Port Mixed Use, with all
AEC's classified Conservation. This section of the Newport River and Morehead City
Channel/Bogue Sound is not designated as Primary Nursery Area and is closed to the
taking of shellfish. Both water bodies carry a water classification of SC. Riparian corridors
were determined through the original permit # 112-96 for the southern site and shall
pertain to the newest proposal. Marsh Island is owned by the NCSPA and does not have
any immediately adjacent riparian properties; therefore riparian corridors are not an issue.
Substrate in the Newport River and the Morehead City Channel/Bogue Sound area is
mostly sand and silt. No SAV's or shellfish beds were observed within the proposal
project area. The closest open shellfish harvesting area is approximately 3,781 feet to the
east of the Northern site and approximately 3158' north of the southern site and is located
within a cove area along the north side of the Morehead/Beaufort causeway.

barge berth area and the construction of the new northern barge berth area within Newport
River. Due to shallower water depths within these areas, -10' nlw at the northern site and -
13' nlw at the existing southern site, the applicant is proposing maintenance excavation at
the existing southern barge berth area and new excavation at the existing northern barge
berth area.
The northern barge fleeting area east of Marsh Island currently has water depths at an
average of -10' nlw, with connecting water depths at 15'plus. Due to shallow water depths
within this area, the applicant is proposing new excavation within this area. They propose
to maintain a depth of-12'nlw plus 2 inches of `over dredge". The excavation area would
be 150' x 750' and would remove approximately 13,200 cubic yards of material. The final
depth for this area would not exceed -12' plus 2 inches of "over dredge". The connecting
water depths within this area are -15' nlw. No SAV or shellfish beds were observed within
this area.
The southern barge fleeting area along Radio Island currently has average water depths of
-13' nlw and connecting water depths of-20'nlw. Due to safety concerns and shallow
water depths, the applicant is proposing maintenance excavation within this area. The
excavation area would be 900' x 400', with a final excavation depth of -12' plus 2 inches
of "over dredge". A total of approximately 35,184 cubic yards of material would be
removed from this area. No SAV or shellfish beds were observed within this area either.
The spoils would be located at one of the existing preapproved spoil sites owned and
maintained by the NCSPA. The possible spoil disposal locations are North Radio Island,
Brandt Island, Marsh Island and the Radio Island disposal site. The type of dredging
method has not been determined at this time (choosing from hopper dredge, hydraulic
dredge, or bucket to barge) by the NCSPA, however all of the existing spoil disposal
locations should be equipped to handle any of the dredging methods.
11. Anticipated Impacts:
The new excavation at the northern location and the maintenance excavation within the
southern location would disturb a total of 472,500ft2 of shallow bottom habitat and remove
an approximate total of 48,384 cubic yards of silty sand material from the shallow bottom
habitat. These shallow water areas would be deepened to a final depth of -12' nlw plus 2
inches of "over dredge". Due to the tidal amplitude 2.5' to 3' within these areas, there is a
possibility of future request for additional maintenance excavation. The excavation would
cause an increase in temporary turbidity.

A North Carolina Division of Coastal Management (DCM) Fisheries Resource Specialist has reviewed the
subject permit application for proposed actions that impact fish and fish habitats. The applicant
proposes a modification to State Permit #120-13 to include dredging along the permitted southern
barge fleeting area along Radio Island and the fleeting area site to the north of Marsh Island. The
applicant proposes to dredge and maintain both sites at -12' normal low water plus 2". Neither
submerged aquatic vegetation nor shellfish beds are observed in either site.
A moratorium on dredging from April 1—September 30 should be observed in order to protect fish and
shellfish in the area from disturbance cause by the dredging and excess turbidity during seasons deemed
critical to growth and reproduction. This will also result in the dredging being less likely to alter fish
movements and migration in this area just within Beaufort channel inlet.

The following is my assessment and consequent recommendations of the above referenced proposal:
This proposal involves the maintenance excavation of approximately 35,184 cubic yards of material
within the southern barge fleeting area and new excavation of approximately 13,200 cubic yards within
the northern barge fleeting area. Due to shallow water depths and safety concerns, the NCSPA is
requesting to dredge and maintain as needed through the life of the permit, to a final depth of -12' plus
2 inches of "over dredge". The development conforms to the guidelines set forth under 15A NCAC 07H
.0208. The waters of this area of Bogue Sound and Newport River is closed to shellfish harvest and are
not considered a Primary Nursery Area. Assuming that state and federal agencies concur with the
proposal, the District recommends the project be authorized as proposed, contingent upon the
following specific and general conditions:
1. All precautions should be taken to ensure that navigation is not unnecessarily impacted. No
attempt will be made by the permittee to prevent the free and full use by the public of all
navigable waters at or adjacent to the authorized work. Use of the permitted activity must not
interfere with the public's right to free navigation on all navigable waters of the United States.
2. The excavation within both locations shall not exceed a final depth of -12' nlw plus 2 inches of
.over Dredge" and shall remain within the dimension as shown on plats dated received by DCM
3/11/15.
The applicants should notify DCM of the type of dredging method and spoil disposal location
within 30 days prior to work commencing.

The NC Division of Coastal Management hereby acknowledges receipt of your application for State
approval for development at the NCSPA property in Morehead City. The complete package was received
on 3/11/15. The projected deadline for making a decision is 5/25/15. An additional 75-day review period
is provided by law when such time is necessary to complete the review. If you have not been notified of
a final action by the initial deadline stated above, you should consider the review period extended.
Under those circumstances, this letter will serve as your notice of an extended review. However, an
additional letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from 3/11/15, you may request a
meeting with the Director of the Division of Coastal Management and permit staff to discuss the status
of your project. Such a meeting will be held within five working days from the receipt of your written
request and shall include the property owner, developer, and project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed
development. Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the
property of your proposed development. You should post this notice at a conspicuous point along your
property where it can be observed from a public road. Some examples would be: Nailing the notice card
to a telephone pole or tree along the road right-of-way fronting your property, or at a point along the
road right-of-way where a private road would lead one into your property. Failure to post this notice
could result in an incomplete application.
An onsite inspection will be made, and if additional information is required, you will be contacted by the
appropriate State or Federal agency. Please contact me if you have any questions and notify me in
writing if you wish to receive a co of my field report and/or comments from reviewing agencies.

NOTICE OF FILING OF
A PPLICATION FOR CAMA
MAJOR DEVELOPMENT PERMIT
The Department of Environment and Natural Resources hereby gives public notice as required
by NCGS 113A-119(b) that application for a development permit in an Area of Environmental
Concern as designated under the CAMA was received on 3/11/15. According to the application,
the NCSPA applied for a permit for new excavation and maintenance excavation at the existing
northern and southern barge fleeting areas within Bogue Sound and Newport River, Morehead
City, Carteret County.
A copy of the entire application may be examined or copied at the office of Heather M. Styron,
NC Division of Coastal Management, located at 400 Commerce Avenue, Morehead City, NC,
(252) 808 2808 during normal business hours.
Comments mailed to Braxton Davis, Director, Division of Coastal Management, 400 Commerce
Avenue, Morehead City, N.C. 28557, prior to 4/16/15, will be considered in making the permit
decision. Later comments will be accepted and considered up to the time of permit decision.
Project modification may occur based on review and comment by the public and state and
federal agencies. Notice of the permit decision in this matter will be provided upon written
request.
