This correspondence is with reference to the request submitted by you to modify State Permit No. 94-
13, which was originally issued to Mark and Deborah Mitchell on August 7, 2013. State Permit 94-13
authorized a 5 slip docking facility at 115 South Channel Drive adjacent to Banks Channel in the Town of
Wrightsville Beach, New Hanover County. State Permit No. 94-13 expires on December 31, 2016. The action
proposed in your submittal consists of relocating the authorized 14 ft. by 5 ft. (70 sq. ft.) finger pier, which runs
parallel to the shoreline, from the southern side of the floating dock to the northern side of the floating dock.
Upon review of the information provided the Division of Coastal Management has determined that the
proposed action continues to be consistent with existing State rules and regulations and is in keeping with the
original purpose and intent of the permit. I hereby submit this Letter of Refinement authorizing the modification
of State Permit #94-13, as described in your request dated September 29, 2014 and modified drawing received
in this office on September 16, 2014. Please note that this Letter of Refinement does not authorize additional
boat slips. A maximum of 5 boat slips have been authorized at this docking facility, docking additional vessels
will result in enforcement action. By copy of this letter we are also notifying the Town of Wrightsville Beach of
our action. Please note this refinement does not alleviate the need to obtain any other local, state or federal
permits.
