Oak Island Drive Oak Island, North Carolina 28465 dkelly@ci.oak-island.nc.us Dear Mr. Kelly: I am responding to your request dated June 5, 2020 for modifications to the existing Department of the Army (DA) permit issued for the above referenced project on April 30, 2020 The referenced Section 404 and Section 10 permit authorizes impacts to navigable waters of United States to provide shoreline protection along approximately 4 miles of Oak Island, Brunswick County, North Carolina. The permit modification is proposed for the removal of the 50-foot buffer associated with a magnetometer anomaly, identified as modern marine debris. Removal of this 50-foot buffer will allow for the removal of the marine debris and provide the dredging contractor with more flexibility in its movement of the dredge within the authorized borrow area. I have determined that the proposed project modifications described above are minor and are not contrary to the public interest and therefore, the DA permit is hereby modified. It is understood that all conditions of the original permit remain applicable and that the expiration date is unchanged. The permit modification is as follows: The removed marine debris shall be disposed of in high ground, outside of waters of the United States and outside of Navigable Waters of the United States in accordance with state and local requirements. -2- Should you have any questions, please contact Mr. Ronnie Smith, Regulatory Division, at telephone (910) 251-4829.
