The Town requests removal of the 50-foot buffer associated with a magnetometer anomaly, identified as modern marine debris, within the currently permitted 304-acre Jay Bird Shoals Borrow Area. As described in the Town's October 2019 permit application, a magnetometer survey of Jay Bird Shoals and resultant analysis by Tidewater Atlantic Research, Inc. (TAR), resulted in the identification of eleven targets consisting of a tire, several small objects (i.e. traps), and deteriorated buried wire or cable. To avoid dredging and placement of the marine debris during construction, a minimum 50-foot buffer (on either side of the wire or cable) was instituted along the modern marine debris field (see Figures 1 and 2 below). Final preparations have begun for the implementation of the Project by the Town, with construction anticipated for winter 2020/2021. Construction plans and specifications indicate the buffer area as a no -dredge area. However, based on further analysis by TAR of the magnetometer anomaly and confirmation the anomaly is modern marine debris, the Town would like to give the Contractor the option to remove the marine debris using appropriate equipment to drag and remove the debris from the borrow area and dispose of it properly. A letter has been provided by TAR documenting its professional opinion (Attachment A). The removal of the marine debris and subsequently the buffer would provide the Contractor more flexibility in its movement of the dredge within the borrow area and allow for more uniform removal of material. The removal of the buffer will allow the Contractor to selectively remove the marine debris if it determines it necessary prior to construction. Only if the Contractor can locate and document the successful removal of the marine debris will the buffer be removed. The Town plans to host a pre -construction agency meeting prior to beginning construction to review plans, permit conditions and project schedule. In the event this minor modification is granted, the Town will provide an addendum to the Contractor to allow for evaluation and planning of the marine debris removal. That buffer was not identified or recommended for avoidance in our report on the remote -sensing survey. Analysis of the remote -sensing data generated during the survey identified a total of 252 magnetic anomalies. Twenty-one anomalies are associated with the low -intensity long -duration linear feature within the buffer. That feature could be geological and represent a deposit of magnetic material such as magnetite. By the same token, the feature could be associated with deteriorated pipeline, wire rope, or armored cable. The buffer was apparently recommended, possibly by Geodynamics, to identify material generating the signatures as a potential hazard for dredging. While the feature does not represent a submerged cultural resource that is eligible for inclusion on the National Register of Historic Places, I agree that avoidance or removal should be considered. If the anomalies do represent deteriorated pipeline, wire rope, or armored cable it would likely not be something desirable to have broken up and deposited on the beach.
