This is with reference to your request to modify State Permit No. 31-20, acting on behalf of the Town of
Oak Island. The permit was issued on March 6, 2020 for beach nourishment, a Minor Modification was
issued on August 12, 2020, and a Major Modification application is currently under review. The permit
expires on December 31, 2023.The action proposed in your submittal is to allow the use of an additional
vehicular accessway to the beach and subsequent restoration of the subject area, as described in your
email received on 3/19/21.
In reviewing the information provided and consulting with the appropriate resource agencies, the Division
of Coastal Management has determined that the proposed action is consistent with existing State rules and
regulations. This Letter of Refinement serves as a one-time amendment of Condition No. 12 to allow for
this additional accessway, provided the area is restored at minimum to its pre -project condition, or
to a greater extent, in accordance with the design shown on project plans. All other permit conditions
remain in effect.
Please note this authorization does not authorize any work not expressly described above. If you have
any questions concerning the above or if I can be of any other assistance, please advise.
