Hi Mark,
Just coming up for air after Christmas. Thanks for sending the new documents. It looks like the changes are minimal, but
I can tell that the new pier is closer to the old pier damaged in the storm. In a perfect world, no additional dock would be
built. But we understand that Bald Head Limited has the right to build additional slips. If this is the furthest away the
new dock can be placed from our property, then we are willing to sign off on the updated plan. We appreciate your
willingness to work with us and try to mitigate the impact of the new dock on our property.

Attached is my drawing, C2, seal dated today, 12-22-22, with the revised location of the pier/dock for 87 Keelson Row,
with the pier located a bit further south/away from your lot at 5 leeward Ct, per my yesterday evening e-mail.
Google Earth Images never quite line up with surveyed drawings unless you are lucky enough that the satellite was
directly overhead of your parcel. Otherwise, you get some distortion. I have tweaked the 2021 Mean High Water Line
of Bald Head Creek to better match the Google shoreline. I have also drawn in the appx VBHI Marina Park replacement
dock, and drew in yellow a line from the private dock at the end of Windward Ct to the appx new floating dock location
for the Village. The HV 87 dock is within the line of the Windward Ct and the Marina Park Docks. Please note, the
original tent-site/Marina Park Dock was further out. So with the new proposals, you will have a better creek sight line
than pre -Hurricane Isaias.

Bald Head Island Limited, LLC has asked me to seek a CAMA GP.1200 Pier/Dock General Permit for
its property at HV 87 (Harbour Village 87), BrunsCo Parcel # 2601B065, 87 Keelson Row, Bald Head
Island, per its CAMA 151-84 Creek Dock Permit Refinement 9-2-21 for re -allocation of one of its 4
Bald Head Island Limited LLC slips. Pier/Dock to meet requirements of 15A NCAC 07H Section
.1200 — General Permit for Piers and Docking Facilities in Estuarine and Public Trust Waters and
Ocean Hazard area.
As you know, Bald Head Island Limited, LLC retained ownership of four of the six slip positions on
the 2007 "Tent Site Dock" aka Creek Dock #3, CAMA 151-84, when it sold "Marina Park" to the
Village of Bald Head Island. Hurricane Isaias, August 3, 2020, severely damaged the 140' long x8'
floating dock and its appx 235 If, six foot wide wood pier plus 12'xl2' pier end structure. That pier,
pier end and floating dock 16have since been removed.
As had been done previously during the CAMA 151-84 existence, CAMA has allowed Limited to re-
allocate its slip positions of the 60 permitted on Bald Head Creek to other Bald Head Island Limited
LLC or related properties. HV87 was allocated one of the Tent Site/Marina Park slip positions.
HV 87 Rev is a recombination of lot HV87 with a portion of Bald Head Island Limited LLC's
26000005 "Remainder" Parcel out to MHW. There are 244.09 LF of MHW/Riparian Shoreline. In
theory allowing a maximum of 8x244 = 1952 sf of "dock platform" of 2000 sf max with a CAMA
Major or 800 sf max of "dock platform with a GP.1200 Permit. For the GP.1200 permit, there is a max
of 400 sf of dock platform for any one element. I am proposing a 17'x23.5' = 399.5 sf fixed pier end
dock platform at the end of appx 250 if of 6'max width pier. The pier and pier end deck height is
designed to be at the height of the top of the HV87 wood bulkhead cap, appx 7.1 FMSL. Top of pier
will be appx 5' above grade at the bulkhead, 7' at the waterward end of marsh grass, and appx 9' at the
escarpment. 6' wide wood pier is to be similar construction to the pier at the Marina Park temporary
kayak dock. Pier 6' or less in width does not count as dock platform.
The floating dock to be tee shaped, with an 11'4"x 30'-6" (11.334'x30.5'= 345.9 sf) with a 6'-8" x 8'
Tee stem (6.667'x8' = 53.4 sf) = 399.3 sf < 400 sf. (I am hoping to acquir he �mporary
kayak dock and add an extra row of floats to the existing 8'x30' main d;ck). V% g out for a
5'x30' ramp (assumed aluminum, to waterward end of hinge plate). 1

Note that per CMA rules, I could exempt the waterward 6' of floating dock (6'x30.5') = 183 sf from
my "Dock Platforms", giving us 399.5 sf fixed pier plus (399.3-183 = ) 216.3 = 615.8 sf of total dock
platform. At 8 sf per If, 615.8/8 = 771f of riparian shoreline required. We have much more.

On November 26, 2022 I certified mailed DCM Adjacent Riparian Property Owner Statement Forms
with cover/explanation letters to north non -Bald Head Island Limited LLC adjacent riparian neighbor
James & Christina Bohanek, 5 Leeward Court; the State Property Office for their 26000001 parcel; and
south non -Bald Head Island Limited, LLC sort of adjacent Old Baldy Foundation. Mr. Bohanek e-
mailed me on Dec 1, saying he got an attempted certified mail delivery notice from me, and asked me
to e-mail him with the letter/form, as they were never home during the day to sign for the certified
letter. The letters to both the State Property Office and Old Boldy were delivered on November 28. I
have the green card back from Old Baldy. I have not received any response e-mails/cc's yet, so am
hoping/assuming that the 10 day non -response window will be the controlling date. The tracking
numbers are 7021 1970 0000 2831 0906 for Old Baldy, 7021 1970 0000 2831 1064 for the State
Property Office and 7021 1970 0000 2831 1071 for the Bohaneks
Structural details/drawings will be provided to the building inspector once CAMA Approval is
achieved. All Lumber will be PTSYP or better. All fasteners will be hot 'dip galvanized or better.
(Note stainless steel is considered better, although it is not necess�, � V,,4,,ban the equivalent size
galvanized steel fasteners.) O

The Village will be putting in an additional 30' of pier length, then a 20'x35'+/- pier height dock/deck platform (CAMA
calls both floating docks and pier ends "dock platforms"), plus atwo 16'x60' floating docks, one to the north and one to
the south of the fixed pier end. They will have a 10'x20' float dock attached for their Village public safety boat, and the
rest of the space ifs for kayaks and stand up paddleboards. Those will be public docks, with some sort of rental
- agreements with the kayak/stand up paddleboard rentals.
Limited tried to get HV 86 rezoned from PD3 to PD3C and combined into. lot HV87 (that's the one north adjacent of
Marina Park). It got shot down, because the Planning Board liked the HV86 residential designation as a "buffer" to
commercial. Heck, in the 90's there was a duplex on the HV86-HV87 property that had a pizza and other businesses for
years. It got damaged in 1999 Hurricane Floyd, and mold got in so Limited tore it down. Limited chose not to fight the
zoning battle and instead has put the two properties on the market. 87 is more valuable with the boat dock permit in
hand, as CAMA in their slip re -allocation Refinement said the pier/dock re -allocations need to follow current regulations
which limit amount of "dock platform" based on current regulations and as part of the original 60'slip Creek Dock count
based on the 1984 permit. That permit had history dating to the 70's Federal Lawsuit against Carolina Cape Fear Corp'
for adding a floating dock to the old USCG fixed pier at Old Baldy, and planning dredge the creek and add 1000 slips. The
resolution was Carolina Cape Fear, and then its successor Bald Head Island Corp donating Battery Island, Striking Island,
Bluff Island, a strip along the east beach north of Bluff Island almost up to Fort Fischer, and some marsh highlands to the
State, in return foir being able to build the Bald Head Marina at its current location with entrance off.of the Cape Fear
River.
So Limited has no specific plans for the proposed slip. A purchaser might find applying daunting, especially if they had to
bring a different consultant on board to sort out a creek permit..
They figure that I am the only one that understands the Creek Permits so they tasked me with getting the permit.
